MINUTES OF THE PUBLIC HEARING OF MONDAY, APRIL 15, 2019 AT 200 HIGHLANDS BOULEVARD DRIVE REGARDING A PROPOSED ZONING TEXT AMENDMENT TO THE CODE OF ORDINANCES REGARDING THE PLANNING AND ZONING COMMISSION Mayor Mike Clement called the Public Hearing of the Board of Aldermen to order at 7:00 p.m. Roll call showed those present were Alderman Huether, Alderman Hamill, Alderman Ottenad, Alderman Baumann, Alderman Toben, and Mayor Clement. Alderman Nolte was absent. A quorum was present. The following notice of the public hearing was then read: “The City of Manchester Board of Aldermen shall hold a public hearing on Monday, April 15, 2019 at 7:00 p.m. at the Manchester Police Facility, 200 Highlands Boulevard Drive, to consider the following: Case # 19-TXT-001 City Staff proposes a Zoning Text Amendment to sections of Article I of Chapter 400 of the Code of Ordinances of the City of Manchester regarding Administration. The proposed changes will affect Section 400.020 pertaining to Composition and Section 400.060 pertaining to Quorum.” Mayor Clement advised that first the proponents would speak, then the opponents, and comments from the public, followed by questions from the members of the Board of Aldermen or the City staff. City Administrator Larry Perney, speaking on behalf of the Director of Planning and Zoning, explained that the Director of Planning and Zoning has stated that this Ordinance puts us in line with State Statute on the composition and quorum of the Planning and Zoning Commission allowing the liaison and the Mayor to be voting members of the Planning and Zoning Commission. There were no opponents and no comments from the public. Alderman Ottenad stated that previously the Mayor recommended, and the members of the Board of Aldermen voted, to appoint the member to the Planning and Public Hearing –Zoning Text Amendment regarding Administration Page 1 Zoning Commission. She said what she is reading now is that the Board of Aldermen will decide amongst themselves who will be the liaison, and that is if they decide to have a liaison. City Attorney Erin Seele stated that is correct. She said that is in line with RSMo 89.320 that reads that one of the members will be a liaison to the Board of Aldermen, if the Board chooses, so this language is mirroring that authority from the State Statute. Alderman Ottenad said that she realizes that this goes with the state statute, but what bothers her is that the Mayor recommends and they vote on people to lesser boards and commissions, but this is different. City Attorney Erin Seele stated that this is a unique statute that gives the Mayor the authority to put the Mayor on the Commission, if the Mayor chooses, or the Board gets to choose someone if they want to. Mayor Clement suggested that the Mayor could recommend someone to the Board, he asked if that is correct. City Attorney Erin Seele said the Mayor could recommend, but the Board could go on without the Mayor, but she feels that the Board would want to know what the Mayor thinks about it. CALL TO ORDER Mayor Mike Clement called the Regular Board of Aldermen meeting to order at 7:04 p.m. 2. ROLL CALL AND STATEMENT OF QUORUM Roll call showed those present were Alderman Huether, Alderman Hamill, Alderman Ottenad, Alderman Baumann, Alderman Toben, and Mayor Clement. Alderman Nolte was absent. A quorum was present. 3. APPROVAL OF THE MINUTES a. Minutes of the Regular Board of Aldermen meeting of Monday, April 1, 2019 Alderman Hamill made the motion to approve the Minutes of the April 1, 2019 Regular Board of Aldermen meeting. The motion was seconded by Alderman Ottenad and carried 5 - 0, without any objections from the members of the Board of Aldermen. 4. ESTABLISHMENT OF ORDER OF ITEMS ON THE AGENDA Alderman Hamill made the motion to approve the order of items on the agenda, as submitted. The motion was seconded by Alderman Ottenad and carried 5 - 0, with no objections from the members of the Board of Aldermen. 5. CONSIDERATION OF PETITIONS AND COMMENTS FROM THE PUBLIC a. Discussion regarding Republic Services Ms. Kyle McCool, 1655 Weatherwood Drive, stated she wanted to comment on the extraordinary services of Robert, her trash man. She said this year he purchased cookies from the girl scouts as they were just walking down the street selling their cookies. She said he stopped them and asked to buy some cookies. She said they always appreciate his kindness and generosity. Regular Board of Aldermen meeting 04/15/2019 Page 1  Ms. Susan Bruno, 858 Weatherwood Drive, stated that Robert is always warm, engaging, and wonderful. She stated they chatted at the end of the driveway, and one day he asked about her husband, she had to explain that she lost her husband. She said he was so upset, he gave her a hug. She said he is a wonderful human being. The next day, her trash cans were up against her garage because she has a big oak tree, and with the acorns, it is a struggle for her to bring the trash cans up to the front door. She stated that for 3 ½ years now Robert has been bringing her trash cans to her garage. She thanked Robert for all he has done. Ms. Kim Demerit, 728 Rockridge, appeared with her son, Sam. Ms. Demerit said she doesn’t get to see Robert, but Sam is at home with grandparents when Robert comes by. It makes Sam’s day to see Robert. They appreciate everything Robert does and how kind he is to her son. For Halloween last year, her son dressed up like Robert. Ms. Lisa Galati, 785 Whispering Meadows Drive, stated that she was outside mowing grass, and she looked down and saw a little bird that fell out of the tree, and it was still alive. She works at a hospital but she freaked out and she ran over to a neighbor’s house to ask for help, and Robert came and helped. He ensured that he would take care of the bird. She wanted to thank him for sharing his smile and kindness, she said it is infectious. Ms. Janet Williams, 1030 Arbor Pointe, advised she was speaking on behalf of all the people in her subdivision, and said she wanted to thank Robert. Every time he is in their subdivision, the homeowners always talk about how wonderful Robert is. Her two little grandsons were at her house when Robert was picking up their trash, and they had to go out and see the trash man. He said Robert was so sweet, and he gave them big hugs and shook their hands. They were in heaven. He is so good to everyone. She expressed her thanks to Robert. Mayor Clement addressed Robert Chestnut saying this wasn’t about Republic Services. He said: “It was about you and the job you do.” He said in a community we don’t normally see this kind of response and reaction. He praised what Robert gives back to the community. Mayor Clement said he is a part of this community and this is his family out here too. Mayor Clement stated that when the City started looking at our contracts with Republic Services, they talked about pricing, and how long it would be possible to extend it, including recycling, and then the question came: “Are we going to be able to have Robert?” He said that is a true story. Mayor Clement presented Robert with a proclamation while his family was able to participate. Mayor Clement stated that Robert is to be recognized for the period of May 5 – May 11; usually it is not for an entire week. Republic Services Operations Manager Allen Elliott stated that they wanted to thank the residents of Manchester for allowing them to be at this special meeting; it is a privilege. Also in attendance from Republic Services were Tom Real, Controller, Albert Lee, Route Supervisor, and Joell Aguirre, Manager, Municipal Sales. He said it is hard to find good people and good employees. He said Robert has been outstanding for them; he is one of the best they have. He also spoke about the trucks with the Republic stars, which is five Regular Board of Aldermen meeting 04/15/2019 Page 2 R’s intertwined, and the five R’s stand for relentless, respectful, resourceful, reliable and responsible, and he said Robert exemplifies all of those five R’s. b. Approval of “picnic license” for the American Legion’s outdoor event on May 18, 2019 from 11:00 a.m. – 3:00 p.m. City Clerk Ruth Baker explained that the Walter Le Pere American Legion Post 208 is celebrating their 100th birthday on May 18 at their premises on Old Sulphur Spring Road. She stated that they have a full liquor license for inside the Legion Hall building; however, the May 18 event is going to be outside on the grounds, and they would like a temporary permit to sell and serve liquor outside on that day. Alderman Toben made the motion to approve the “Picnic License” for the American Legion outdoor event on May 18, 2019. The motion was seconded by Alderman Ottenad and carried 5 - 0, without any objections from the members of the Board of Aldermen. c. Proclamation acknowledging Local Government Week Mayor Clement presented to City Administrator Larry Perney a Proclamation acknowledging Local Government Week. d. Comments from the Public Ms. Nancy Venezia, 1721 Blakefield Terrace, a resident for 24 years, invited everyone to participate in the 68th annual National Day of Prayer on May 2 from noon until 1:00 p.m. in this courtroom. She said the call to prayer has continued throughout history which she briefly reviewed. 6. REPORTS FROM THE MAYOR a. Mayoral Report Mayor Clement stated that on April 9, five City of Manchester representatives made a presentation to the POW/MIA Board at Jefferson Barracks. He said they were at Jefferson Barracks to seek recognition as a POW/MIA City. The Board was enthusiastic in their support of their application and it was approved unanimously. On May 20, Manchester will receive the Purple Heart City and the POW/MIA City recognitions. He thinks this will be the first time a City will receive both recognitions at the same time. On April 13, Arbor Day was celebrated, there was a tree giveaway and they planted a beautiful black gum tree. He said they talked about and appreciated the value of the trees in our community. The tree that was planted was a “community filling in the hole” event. He said everyone there took their turn in filling in the dirt. On May 8, there will be a Community Safety Summit in the Parks Building. It will include topics on suicide, opioid use and detection and family gun safety. In addition to the presenters there will be 8 to 10 agencies present to answer questions. Doors open at 6:30 Regular Board of Aldermen meeting 04/15/2019 Page 3 p.m. He said Lieutenant Smith and Chief Will are putting a lot of effort into this and it will be a great evening with lots of information. On May 9, the Manchester Business Association will have their lunch and networking meeting. Mayor Clement thanked Alderman Toben for the work he has put into this first luncheon. On May 11, Manchester’s Craft Beer Festival will be held in Schroeder Park. Mayor Clement stated because of the past turnout and response, Manchester will be hosting another session of “Better Together/Freeholders” informational events. The date is May 16 at 6:00 pm and 7:15 p.m. He stated that local residents have collected over 1,300 signatures advocating for the formation of the Freeholders Board. Mayor Clement stated that on May 27, Manchester will hold a Memorial Day Ceremony. It will be a fairly large ceremony. There will be World War II Veterans, the Manchester Community Band and a Bald Eagle attending the event. On April 12, the Egg Hunt took place in Schroeder Park. Mayor Clement said there were about 300 residents who came out for that. It was a packed house. Mayor Clement thanked staff for everything they do to make these events possible. 7. REPORTS FROM THE CITY ADMINISTRATOR a. List of Paid Bills (Warrant dates of March 31 – April 13, 2019) There were no questions. 8. REPORTS FROM COMMITTEES a. Planning and Zoning Commission Alderman Hamill stated that there was one case, a sign application for Fontbonne College. He said it was approved by the Commission, contingent upon a variance being approved by the Board of Adjustment. b. Homecoming Committee Alderman Ottenad stated there was a meeting on April 10, and there were several new members for the committee. 9. ACTION ON OLD BILLS a. There were none. 10. INTRODUCTION OF NEW BILLS a. BILL APPROVING AN AMENDMENT TO THE CODE OF ORDINANCES PERTAINING TO THE PLANNING AND ZONING COMMISSION Regular Board of Aldermen meeting 04/15/2019 Page 4  Alderman Hamill introduced Bill # 19-2371, entitled: “AN ORDINANCE APPROVING TEXT AMENDMENTS TO THE ZONING CODE OF THE CITY OF MANCHESTER PERTAINING TO COMPOSITION AND QUORUM OF THE PLANNING AND ZONING COMMISSION”, by title only. No further action at this time. 11. MISCELLANEOUS a. Comments from the Public There were none. 12. ADJOURNMENT At 7:42 p.m., there being no further business, Alderman Hamill made the motion to adjourn.
