MINUTES OF THE REGULAR BOARD OF ALDERMEN MEETING OF MONDAY, APRIL 1 , 2019 AT 200 HIGHLANDS BOULEVARD DRIVE 1. CALL TO ORDER Mayor Mike Clement called the Regular Board of Aldermen meeting to order at 7:00 p.m. 2. ROLL CALL AND STATEMENT OF QUORUM Roll call showed those present were Alderman Huether, Alderman Nolte, Alderman Hamill, Alderman Ottenad, Alderman Baumann, Alderman Toben and Mayor Clement. A quorum was present. 3. APPROVAL OF THE MINUTES a. Minutes of the March 18, 2019 Regular Board of Aldermen meeting Alderman Hamill made the motion to approve the Minutes of the March 18, 2019 Regular Board of Aldermen meeting. The motion was seconded by Alderman Baumann and carried unanimously, without objections from the members of the Board of Aldermen. 4. ESTABLISHMENT OF ORDER OF ITEMS ON THE AGENDA Alderman Nolte and Alderman Ottenad simultaneously made the motion to approve the order of items on the agenda, as submitted. The motion was seconded by Alderman Hamill and carried 6 – 0, with no objections from the members of the Board of Aldermen. 5. CONSIDERATION OF PETITIONS AND COMMENTS FROM THE PUBLIC a. Comments from the Public There were none. Regular Board of Aldermen 04/01/2019 Page 1 6. REPORTS FROM THE MAYOR a. Introduction of Tree Board Mayor Clement introduced the members of the Tree Board: Ms. Nancy Miller, Mr. Mike Stemmler, and Ms. Jane Sharp. He said they are a volunteer board and he wanted to thank them for agreeing to be of service. b. Proclamation recognizing Arbor Day, 2019 Mayor Clement presented a Proclamation to the MDC Foresters, Danny Moncheski and Becky Blue, recognizing Arbor Day 2019. c. Tree City USA award presentation – Danny Moncheski and Becky Blue, MDC Foresters Mr. Danny Moncheski said he wanted to thank everyone for allowing them to come. It is exciting to see the first proclamation of the season. Mr. Moncheski explained what “Tree City” is and what it means to the region. Tree City USA it is a recognition program. The criteria to become a “Tree City” is there needs to be a Tree Ordinance that will provide for the protection of trees and what type of things you want to plant in the community, to designate a tree board, there needs to be an Arbor Day Ceremony and Proclamation, and the City will need to spend at least $2 per capita on the maintenance and care of trees and green space. d. Mayoral Report Mayor Clement acknowledged that the City just finished six informational sessions on the Better Together Unification Plan and the Municipal League Freeholders Petition, and there were probably close to 600 residents who came and listened. He said that half of the sessions were so full that it was necessary to send some people away. There will be two more informational sessions on May 16 at 6:00 p.m. and 7:15 p.m. at the Police Station. On April 9, there will be several city officials going to Jefferson Barracks to give a presentation to the POW/MIA Board. He stated that Manchester is seeking to be recognized as a POW/MIA City. He said this is one of a broad series of efforts that the City is taking to recognize our veteran community. Mayor Clement stated the next Small Business gathering is Thursday, April 11 at the Parks Building, beginning at 7:30 a.m. and it will be finishing up around 9:00 a.m. Mayor Clement advised that April 13 will be the Arbor Day event at the Park. The tree giveaway starts at 8:00 a.m. and there will be a Memorial tree planting at 9:00 a.m. Mayor Clement stated that Manchester will be holding a Community Safety Summit on Wednesday, May 8 at the Parks Building, with presentations on suicide, opioid use and Regular Board of Aldermen 04/01/2019 Page 2 abuse and detection, and family gun safety. There will be very well-recognized speakers. The doors open at 6:30 p.m., and this will be the first of its kind here in Manchester. Mayor Clement stated the Manchester Business Association will have its first luncheon/networking meeting on Thursday, May 9 at 11:45 a.m. at the Parks Building. He wanted to remind everyone of the May 27 Memorial Day ceremony. There will be a large group of planners who have been working on this. This will be another big event in Manchester. The Manchester Community band will be there along with the Honor Guard. 7. REPORTS FROM THE CITY ADMINISTRATOR a. List of Paid Bills (Warrant dates of March 17 – March 30, 2019) There were no questions. 8. REPORTS FROM COMMITTEES a. Planning and Zoning Commission Alderman Hamill stated there were two things on the agenda at the last meeting, one was a residential plat approval at a lot at the Bend of Sulphur Springs, and it passed unanimously. He stated the other was a text amendment related to a definition that has been tabled for more information. b. Homecoming Committee Alderman Ottenad stated the first meeting of the year will be April 10 at the Parks office. 9. ACTION ON OLD BILLS a. There were none. 10. INTRODUCTION OF NEW BILLS a. BILL APPROVING BOUNDARY ADJUSTMENT OF 792 CANARY Alderman Toben introduced Bill # 19-2369, entitled: “AN ORDINANCE APPROVING THE BOUNDARY ADJUSTMENT PLAT FOR 792 CANARY DRIVE AND 792A CANARY DRIVE, TWO TRACTS OF LAND BEING PART OF LOT 29 OF HAUHART HOME PLACE SUBDIVISION IN THE CITY OF MANCHESTER, MISSOURI, SUBJECT TO CERTAIN CONDITIONS”, by title only. Alderman Toben stated that emergency legislation had been requested, so he made the motion for approval of emergency legislation. The motion was seconded by Alderman Ottenad, and carried unanimously, without objection. Alderman Toben read for the second time Bill # 19-2369, entitled: “AN ORDINANCE APPROVING THE BOUNDARY ADJUSTMENT PLAT FOR 792 CANARY DRIVE AND 792A Regular Board of Aldermen 04/01/2019 Page 3 CANARY DRIVE, TWO TRACTS OF LAND BEING PART OF LOT 29 OF HAUHART HOME PLACE SUBDIVISION IN THE CITY OF MANCHESTER, MISSOURI, SUBJECT TO CERTAIN CONDITIONS”, by title only. Alderman Toben made the motion that Bill # 19-2369 become Ordinance # 19-2253. The motion was seconded by Alderman Ottenad. A poll of the Board showed: Alderman Huether – aye Alderman Nolte – aye Alderman Hamill – aye Alderman Toben – aye Alderman Baumann – aye Alderman Ottenad – aye Mayor Clement announced the vote passed 6 – 0, with no objections from the Board. b. BILL AMENDING THE TRAFFIC CODE RELATING TO APPROACH OF EMERGENCY VEHICLES Alderman Baumann introduced Bill # 19-2370, entitled: “AN ORDINANCE AMENDING A PORTION OF THE CITY’S TRAFFIC CODE, CHAPTERS 300 AND 310 OF THE MUNICIPAL CODE, RELATING TO THE ENFORCEMENT AND OBEDIENCE TO TRAFFIC REGULATIONS”, by title only. Alderman Baumann stated that emergency legislation had been requested, so he made the motion for approval of emergency legislation. The motion was seconded by Alderman Toben and carried unanimously, without objection. Alderman Toben read for the second time Bill # 19-2370, entitled: “AN ORDINANCE AMENDING A PORTION OF THE CITY’S TRAFFIC CODE, CHAPTERS 300 AND 310 OF THE MUNICIPAL CODE, RELATING TO THE ENFORCEMENT AND OBEDIENCE TO TRAFFIC REGULATIONS”, by title only. Alderman Baumann made the motion that Bill # 19-2370 become Ordinance # 19- 2254. The motion was seconded by Alderman Ottenad. A poll of the Board showed: Alderman Nolte – aye Alderman Hamill – aye Alderman Toben – aye Alderman Baumann – aye Alderman Ottenad – aye Alderman Huether – aye Mayor Clement announced the vote passed 6 – 0, with no objections from the Board. RESOLUTION APPROVING CONTRACT DESIGN SERVICES FOR CLOVERLEAF STORMWATER IMPROVEMENTS Alderman Hamill read proposed Resolution # 19-0673, entitled: “A RESOLUTION AUTHORIZING THE CITY ADMINISTRATOR OF THE CITY OF MANCHESTER TO ENTER INTO A CONTRACT WITH HORNER & SHIFRIN, INC. IN AN AMOUNT NOT TO EXCEED TWENTY-NINE THOUSAND NINE HUNDRED NINETY DOLLARS ($29,990.00) TO PROVIDE THE CITY WITH SURVEYING AND ENGINEERING DESIGN SERVICES FOR THE CLOVERLEAF LANE STORM SEWER IMPROVEMENTS PROJECT IN THE CITY OF MANCHESTER”, by title only. Alderman Hamill made the motion for approval of Resolution # 19-0673. The motion was seconded by Alderman Ottenad and carried 6 – 0, with no objections from the Board. d. RESOLUTION ENDORSING ST. LOUIS COUNTY’S GRANT PROGRAM FOR THE CITY’S RECYCLING EFFORTS Alderman Huether read proposed Resolution # 19-0674, entitled: “A RESOLUTION OF THE CITY OF MANCHESTER BOARD OF ALDERMEN ENDORSING SAINT LOUIS COUNTY’S GRANT PROGRAM FOR THE CITY’S RECYCLING EFFORTS”, by title only. Alderman Huether stated that Director of Public Works Ruck and she recently attended a meeting put on by St. Louis County Department of Public Health, and there were several grant opportunities that were presented. There is one opportunity that Manchester is checking into, and one that they plan to move forward on. The one they plan to apply for relates to the electronics recycling program events. They plan to submit both to cover the current budgeted costs for the recycling events and also cover funds that would cover the cost recycling CRT’s and televisions for Manchester residents. Alderman Huether stated these grant programs are funded by the fees that are charged when trash is taken to landfill. The goal is to reduce trash going to landfills. Alderman Huether stated the second one they are currently investigating relates to composters. It would help offset the cost of composters for Manchester residents to reduce the amount of compostable food waste that goes into the landfill. Alderman Huether stated they are both due in April, and the City would get notification in May. Alderman Huether made the motion for approval of Resolution # 19-0674. The motion was seconded by Alderman Ottenad and carried 6 – 0, with no objections from the Board. e. RESOLUTION INCREASING SPEED LIMIT ON 141 Alderman Nolte read proposed Resolution # 19-0675, entitled: “A RESOLUTION AUTHORIZING THE MISSOURI DEPARTMENT OF TRANSPORTATION (MoDOT) TO INCREASE THE SPEED LIMIT ON MISSOURI ROUTE 141 IN THE CITY LIMITS OF MANCHESTER”, by title only. Alderman Ottenad read a prepared statement: Regular Board of Aldermen 04/01/2019 Page 5  “I realize that this current Board, as well as some residents and the Missouri Department of Transportation (MoDOT), desire to raise the speed limit on Highway 141 to 50 miles per hour, just as other municipalities have, so that we have a uniform speed limit and less confusion will exist. For those who don’t enter or leave 141 at Connector Road, they may not see the accidents waiting to happen, or narrowly avoided, with dump trucks, semis or SUVs picking up speed going down the hill from Carman heading north to Connector Road. Vehicles regularly choose not to stop at red lights at Connector Road because they are going too fast, cannot slam on the breaks fast enough, or just run the light rather than even attempting to stop because of their speed. This puts anyone trying to enter 141 from Connector Road in peril, because even if they have the green light on Connector, they cannot go without taking the extra time to ensure no one is coming down the hill fast or that people will just run the light. I personally, use this intersection all the time and would have been T-boned, and perhaps killed, at least three different times had I not waited longer after the light turned green to see that a truck was barreling down the hill, had no intention of stopping and ran the red light at a high rate of speed, even though I had the green to enter the intersection for a number of seconds. Additionally, this is not unique to the residents coming from the subdivision on the east side of 141 like me. While the Connector Road intersection may be one of the worst for this problem because of the hill, I have heard from residents along both sides of 141, who have issues like I describe. Although I have always stated that I did not want to vote to raise the speed limit on 141 because of these profound safety concerns, I am going to support this measure this evening because I have been assured that the police will have more of a presence on 141 if the limit is increased. I understand the reality that many are traveling faster than 50 miles per hour already on 141, so if we can increase the police presence to hopefully avoid some of these situations I have described, the modest speed increase will be worth it. Alderman Nolte made the motion for approval of Resolution # 19-0675. The motion was seconded by Alderman Ottenad and carried 5 – 1, with one objection from the Board. f. RESOLUTION AUTHORIZING CONTRACT FOR REPLACEMENT OF THE FABRIC COVER ON THE PUBLIC WORKS STORAGE BUILDING Alderman Ottenad read proposed Resolution # 19-0676, entitled: “A RESOLUTION AUTHORIZING THE CITY ADMINISTRATOR OF THE CITY OF MANCHESTER TO ENTER INTO A CONTRACT WITH GREENFIELD CONTRACTORS, L.L.C. IN THE AMOUNT OF TWENTY-TWO THOUSAND ONE HUNDRED THIRTY DOLLARS AND EIGHTY-FIVE CENTS ($22,130.85) FOR THE FURNISHING OF ALL TOOLS, LABOR, EQUIPMENT AND MATERIALS FOR THE PERFORMANCE OF ALL WORK NECESSARY FOR REPLACEMENT OF THE FABRIC COVER ON THE PUBLIC WORKS STORAGE BUILDING”, by title only. Director Ruck stated that the storage building was built in 2002, the fabric cover has developed tears and the bindings on it are tearing. He said he was told that the fabric door on the front has patches on it using gorilla glue. Regular Board of Aldermen 04/01/2019 Page 6  Alderman Ottenad asked if this was within the budget. Director Ruck answered that there is $25,000 budgeted. Alderman Ottenad made the motion for approval of Resolution # 19-0676. The motion was seconded by Alderman Hamill and carried 6 – 0, with no objections from the Board. 11. MISCELLANEOUS a. Comments from the Public Mr. Robert Lopez, 1302 Mautenne, said he is definitely against increase of the speed limit on 141. Peter Bitzer, 310 Croydon Lane, stated that he was surprised to hear of a consideration of a change in the speed limit on 141. He said he is not a traffic manager, but the number of stoplights in the Manchester area are many more than in other areas where there are less stoplights. He said that when driving through Manchester where the speed limit is 45 miles per hour, and when going 50-55 miles per hour, he still gets passed up. A little further north, around Ladue and Olive, a person can drive 60 miles per hour and people are still passing by. He thinks there should be a consistency, from the south to the north, or leave our speed limit lower. He said he remembers when there were two lanes on 141, and it is better now with more lanes, but people are just driving way too fast these days. Alderman Huether stated that raising the speed limit to 50 miles per hour is consistent with the neighboring communities. Mayor Clement added that the Missouri Department of Transportation (MoDOT) has indicated for years that 141 was built for a speed limit of 50 miles per hour. He said the City did not make this decision lightly. Mayor Clement stated that he and Chief had talked about the speed limit, and the Chief also feels this would be acceptable. Mayor Clement stated that the City of Manchester has been accused as being a speed trap, and that is why there hasn’t been much police presence there. He said he now particularly expects the police presence at the intersection Alderman Ottenad referred to. 12. ADJOURNMENT At 7:32 p.m., there being no further business, Alderman Hamill made the motion to adjourn.
