MINUTES OF THE SPECIAL BOARD OF ALDERMEN MEETING OF WEDNESDAY, AUGUST 7, 2019 AT MANCHES TER CITY HALL 14318 MANCHE STER ROAD MANCHE STER, MO 63011 1. CALL TO ORDER Mayor Mike Clement called the Special Board of Aldermen meeting to order at 6:00 p.m. 2. ROLL CALL AND STATEMENT OF QUORUM Roll call showed those present were Alderman Huether, Alderman Nolte, Alderman Hamill, Alderman Ottenad, Alderman Baumann, Alderman Toben and Mayor Clement. A quorum was present. 3. DECISION RELATING TO THE SPECIAL USE PERMIT AND BUSINESS LICENSE FOR GUANG CHEN AND CHEN SHENG MASSAGE, LOCATED AT 20 STONEGATE CENTER, MANCHESTER, MO 63088 Mayor Clement called for discussion, and there being none, he asked for a motion to vote on either the proposal from the attorney for Chen Sheng Massage and Spa or from the attorney for the City of Manchester. Alderman Nolte made the motion that based on the findings set forth herein and the entire record, the Board of Aldermen hereby finds and determines that the Chen Sheng Massage & Spa, and its owners, have failed to comply with and violated Chapters 405 and 605 of the Municipal Code of the City of Manchester, Ordinance 17-2173, other ordinances regulating businesses, and Statutes of the State of Missouri in material ways. Therefore, pursuant to Sections 405.550(F) and 605.190(C) of the Municipal Code and the terms of Ordinance 17-2173, the Board does hereby revoke the special use permit issued by the Board pursuant to Ordinance 17-2173 as well as affirms the City Administrator’s revocation Special Board of Aldermen 08/07/2019 Page 1 of the 2019 business license previously issued to the Chen Sheng Massage & Spa and Mr. Guang Chen, both effective immediately. The motion was seconded by Alderman Hamill. A poll of the Board showed: Alderman Ottenad - aye Alderman Huether - aye Alderman Nolte - aye Alderman Hamill - aye Alderman Toben - aye Alderman Baumann - aye Mayor Clement announced the motion passed 6 – 0, with no objections from any members of the Board of Aldermen. 4. ADJOURNMENT At 6:03 p.m., there being no further business, Alderman Hamill made the motion to adjourn. The motion was seconded by Alderman Toben and carried unanimously, with no objections from the members of the Board of Aldermen. The meeting adjourned at 6:03 p.m. Respectfully submitted, Ruth E.
