MINUTES OF THE REGULAR BOARD OF ALDERMEN MEETING OF MONDAY, OCTOBER 7 , 2019 AT 200 HIGHLANDS BOULEVARD DRIVE 1. CALL TO ORDER Mayor Mike Clement called the Regular Board of Aldermen meeting to order at 7:00 p.m. 2. ROLL CALL AND STATEMENT OF QUORUM Roll call showed those present were Alderman Huether, Alderman Hamill, Alderman Ottenad, Alderman Baumann, and Mayor Clement. Alderman Nolte and Alderman Toben were absent. A quorum was present. 3. APPROVAL OF THE MINUTES a. Minutes of the Public Hearing of Monday, September 16, 2019 pertaining to clarifying zoning regulations Alderman Hamill made the motion to approve the Minutes of the Public Hearing of Monday, September 16, 2019 pertaining to clarifying zoning regulations. The motion was seconded by Alderman Ottenad and carried 4 - 0, with no objections from any members of the Board of Aldermen. b. Minutes of the Regular Board of Aldermen meeting of Monday, September 16, 2019 Alderman Hamill made the motion to approve the Minutes of the Regular Board of Aldermen meeting of Monday, September 16, 2019. The motion was seconded by Alderman Ottenad and carried 4 – 0, with no objections from any members of the Board of Aldermen. 4. ESTABLISHMENT OF ORDER OF ITEMS ON THE AGENDA Mayor Clement stated that the Old Bill on the Agenda has become a Substitute Bill which will be introduced by Alderman Huether. Regular Board of Aldermen 10/07/2019 Page 1  Alderman Ottenad made the motion to approve the Order of Items on the Agenda as amended. The motion was seconded by Alderman Hamill and carried 4 – 0, with no objections from any members of the Board of Aldermen. 5. CONSIDERATION OF PETITIONS AND COMMENTS FROM THE PUBLIC a. Comments from the Public There were no comments from the public. Alderman Huether stated she had been asked to share some interesting things about the Recycling Event held at Schroeder Park. She said there was funding through the St. Louis County Department of Public Health for residents of the City of Manchester, as well as St. Louis County residents, whereby two CRT’s or TV’s could be recycled at no charge to the resident. She said there were 477 participants and 15 tons of material collected. She said for a comparison, in July, there were 12 tons of materials collected. Alderman Huether stated that during the same morning, the Clean Stream event took place in the Parks. She said there were 165 volunteers. There were scouts, individuals, and families that participated. She stated there were three one-ton dump trucks full of material collected. 6. REPORTS FROM THE MAYOR a. Mayoral Report Mayor Clement stated that since the last Board of Aldermen meeting, the City’s first recognition of POW-MIA Day was held with a ceremony at the Veterans Memorial. Mayor Clement expressed thanks to Alderman Huether, City Administrator Larry Perney and City Clerk Ruth Baker who were instrumental in making that happen. He said the event included the “Missing Man Table” which was moved later that day to Schroeder Park. He announced that Tucker’s Place Restaurant also hosted a “Missing Man Table” that day. Mayor Clement called attention to a recent issue of the West Newsmagazine, and stated that for the first time there is a two-page spread in the publication that is totally dedicated to the activities for senior adults living in West County. He said this spread includes all activities offered by Manchester, Ballwin, Ellisville, Wildwood and Chesterfield. He announced that the Parks Department is hearing a lot of good affirmations from senior adults who are pleased that they can see what is being offered in the area. He informed that Manchester’s own programs are almost filled to capacity, and the City is continuing to provide more programming for the senior adults. He said there is recognition throughout the West County area that older adults need to be engaged, healthy and happy and this is helping them to achieve that. Mayor Clement stated that this evening, October 7, there is a Women’s Self Defense Class which is offered by the Police Department currently taking place. He called attention to the October 10 Stargazing event at Fussner Park in collaboration with the St. Louis Astronomical Society. He advised that on October 11, there will be a new art exhibit reception, and on October 18, the Halloween Festival will take place which is a very big Regular Board of Aldermen 10/07/2019 Page 2 event in Manchester. He said there are many good things happening in Manchester, it is a very active community. 7. REPORTS FROM THE CITY ADMINISTRATOR a. List of Paid Bills (Warrant dates of September 15 – October 5, 2019) City Administrator Perney referred to the list of paid bills. There were no questions. 8. REPORTS FROM COMMITTEES a. Planning and Zoning Commission Alderman Hamill stated that since the last Board of Aldermen meeting, the Planning and Zoning Commission did meet. He said there were three main things: one was a sign approval for a tenant’s sign on the western edge of City, which was approved unanimously. He mentioned that there was a boundary adjustment request to consolidate seven or eight lots into one lot and that was approved unanimously. He said there was also a proposed text amendment to add in the Planned Business District a tire store, and that was unanimously rejected. b. Homecoming Committee Alderman Ottenad stated that there had not been a meeting since Homecoming, but there will be a meeting on October 9 at 6:30 p.m. at the Parks Building. This will be a wrap up for Homecoming for this year. 9. ACTION ON OLD BILLS a. BILL # 19-2387 – AN ORDINANCE CLARIFYING ZONING REGULATIONS PERTAINING TO MEDICAL MARIJUANA This item was moved to the Introduction of New Bills Section, because it is now a Substitute Bill, and it will be read for the first time. 10. INTRODUCTION OF NEW BILLS a. SUBSTITUTE BILL # 19-2387 – AN ORDINANCE CLARIFYING ZONING REGULATIONS PERTAINING TO MEDICAL MARIJUANA Alderman Huether stated that there seemed to be some consensus at the last meeting that the hours of the operation of a dispensary which is for the medical uses of marijuana, that those hours be similar to the pharmacies in Manchester. She said those hours were changed in the Bill, so primarily it lessens the evening hours on the weekend to make them more similar with the pharmacies in Manchester. Alderman Huether introduced Substitute Bill # 19-2387 entitled: “AN ORDINANCE APPROVING TEXT AMENDMENTS TO THE ZONING CODE OF THE CITY OF MANCHESTER PERTAINING TO MEDICAL MARIJUANA USES AS REQUIRED BY ARTICLE XIV OF THE MISSOURI CONSTITUTION”, by title only. Regular Board of Aldermen 10/07/2019 Page 3  There being no questions, no further action at this time. 11. MISCELLANEOUS a. Comments from the Public There were no comments from the public. 12. EXECUTIVE SESSION: a. Closed Session: Pursuant to Section 610.021 (1) of the Revised Statutes of the State of Missouri pertaining to legal actions, causes of action or litigation involving a public governmental body and any confidential or privileged communication between a public governmental body or its representatives and its attorneys. Alderman Hamill made the motion to go into Closed Session: Pursuant to Section 610.021 (1) of the Revised Statutes of the State of Missouri pertaining to legal actions, causes of action or litigation involving a public governmental body and any confidential or privileged communication between a public governmental body or its representatives and its attorneys. The motion was seconded by Alderman Ottenad. A poll of the Board showed: Alderman Ottenad - aye Alderman Huether - aye Alderman Nolte - absent Alderman Hamill - aye Alderman Toben - absent Alderman Baumann - aye Mayor Clement stated that the motion passed 4 – 0, with no objections from any members of the Board of Aldermen. 13. ADJOURNMENT At 7:13 p.m., Mayor Clement stated that the open portion of the meeting had ended, and the elected officials would be going into a closed session. At 7:51 p.m., after the Executive Session, there being no further business, Alderman Hamill made the motion to adjourn.
