MINUTES OF THE REGULAR BOARD OF ALDERMEN MEETING OF MONDAY, DECEMBER 2 , 2019 AT 200 HIGHLANDS BOULEVARD DRIVE 1. CALL TO ORDER Chairman of the Board Marilyn Ottenad called the Regular Board of Aldermen meeting to order at 7:00 p.m. 2. ROLL CALL AND STATEMENT OF QUORUM Roll call showed those present were Alderman Huether, Alderman Nolte, Alderman Hamill, Alderman Ottenad, Alderman Baumann, and Alderman Toben. Mayor Clement was absent. A quorum was present. 3. APPROVAL OF THE MINUTES a. Minutes of the Monday, November 18, 2019 Regular Board of Aldermen meeting Alderman Hamill made the motion to approve the Minutes of the Regular Board of Aldermen meeting of Monday, November 18, 2019. The motion was seconded by Alderman Toben and carried unanimously, with no objections from any members of the Board of Aldermen. 4. ESTABLISHMENT OF ORDER OF ITEMS ON THE AGENDA Alderman Toben made the motion to approve the Order of Items on the Agenda as submitted. The motion was seconded by Alderman Hamill and carried unanimously, with no objections from any members of the Board of Aldermen. 5. CONSIDERATION OF PETITIONS AND COMMENTS FROM THE PUBLIC a. Comments from Morningside Condominium trustees Mr. Larry Doyle, residing at 803 Hanna Court, one of the Board members of Morningside Condominiums, stated that the subdivision is asking the City of Manchester to Regular Board of Aldermen 12/02/2019 Page 1 take over their roadway and make it a public street. Thanks to Prop S, they were able to replace the street and bring the street up to Code. The owners agreed to pay for a cost of the new street to bring it up to code so the City would take it over. There are only 10 units in the complex. b. Comments from the Public There were none. 6. REPORTS FROM THE MAYOR a. Recommendation to reappoint Mike Stemmler as a member of the Tree Board (January 15 expiration) Alderman Hamill made the motion to reappoint Mike Stemmler as a member of the tree Board for another term. The motion was seconded by Alderman Toben and carried unanimously, with no objections from any members of the Board of Aldermen. b. Presentation of Proclamation honoring the 100th anniversary of the Walter Le Pere American Legion Post 208 Alderman Ottenad gave a Proclamation to members of the Walter Le Pere American Legion Post 208 in honor of their 100th Anniversary. c. Mayoral Report There was none. 7. REPORTS FROM THE CITY ADMINISTRATOR a. Cookies with a Cop City Administrator Larry Perney wanted to remind everyone to come to “Cookies with a Cop” on December 7 from 11:00 a.m. to 1:00 p.m. at the Justice Center. Kids and families can join for cookies and help decorate the Christmas tree and make ornaments for the tree. b. Holiday lights decorating City Administrator Perney spoke about the holiday light decorating contest and judging. He said this is an opportunity to show your spirit December 1 through December 17, and to make your plans to deck out your homes or businesses. The contest is open to anybody that is in Manchester. You can nominate yourself or a neighbor. Please nominate through an email or by calling the parks department. c. Breakfast with Santa City Administrator Perney stated that the annual “Breakfast with Santa” will be held on December 7 from 8:30 a.m. to 10:30 a.m. Come eat breakfast and visit with Santa. This year it will be at the Parks Department. Tickets need to be purchased in advance. Regular Board of Aldermen 12/02/2019 Page 2  d. Buddy the Manchester Elf Buddy, the Manchester Elf” will be making a big return December 9 through 14. City staff will place Buddy throughout the City. They will be taking pictures and sending clues as to where he is. He extended an invitation to please take pictures with him and submit them for a chance to win a prize. e. Senior Citizen Holiday Luncheon The Senior Citizen Holiday Luncheon is December 12 at the First Evangelical Free Church on Carman Road. It is for Manchester Residents aged 65 and older. Reservations are required. Please contact the Parks department if interested. f. “Yes, Virginia, there is a Santa Claus” There is a holiday staged reading “Yes, Virginia, there is a Santa Claus” on December 13 at 7:00 p.m. at the Lyceum, upstairs at City Hall. g. Letter to Bob thanking for emergency sewer problem taken care of City Administrator Perney read a letter thanking Director Bob Ruck, Mike Clement, Karla Miller, Michelle Melugin and Tope Plumbing for helping him with an emergency sewer problem. He stated they were his angels in helping in his time of need. h. Email to Bob thanking the City for fixing the sidewalk and mudjacking in front of their house City Administrator Perney read an email that Director Ruck received thanking the City for fixing the sidewalk and the mudjacking in front of their house. i. Manchester Business Association Happy Hour Alderman Ben Toben wanted to remind all the Manchester Businesses that there will be a Manchester Business Association Happy Hour on December 11 at 4:00 p m at Tucker’s Place West restaurant. j. Alderman Huether – Electronic Recycling Event Alderman Megan Huether wanted to report that the last Electronic Recycling Event that was held in November had more than 480 cars. They recovered 345 CRT items that are now being properly recycled. Overall there were 17 tons of electronics recycling collected that day. This signifies the end of our Grant Money from St. Louis County. k. List of Paid Bills (Warrant dates of November 17 – November 30, 2019) There were no questions. 8. REPORTS FROM COMMITTEES Regular Board of Aldermen 12/02/2019 Page 3  a. Planning and Zoning Commission No report was given. 9. ACTION ON OLD BILLS a. AN ORDINANCE APPROVING THE FISCAL YEAR BUDGET FOR 2020 Alderman Ottenad read for the second time Bill # 19-2394, entitled: “AN ORDINANCE ADOPTING AND APPROVING THE BUDGET FOR THE CITY OF MANCHESTER FOR THE YEAR JANUARY 1, 2020 THROUGH DECEMBER 31, 2020, AND APPROPRIATING SUCH SUMS AS SET FORTH HEREIN FOR ALL DEPARTMENTS AND ACCOUNTS THEREIN SPECIFIED”, by title only. Alderman Ottenad made the motion that Bill # 19-2394 become Ordinance # 19-2278. The motion was seconded by Alderman Hamill. A poll of the Board showed: Alderman Nolte – aye Alderman Hamill – aye Alderman Toben – aye Alderman Baumann – aye Alderman Ottenad – aye Alderman Huether – aye Alderman Ottenad announced that the motion passed 6 – 0, with no objections from any members of the Board of Aldermen. 10. INTRODUCTION OF NEW BILLS a. SUBSTITUTE BILL # 19-2393 – AN ORDINANCE AMENDING CHAPTER 605 OF THE CODE OF ORDINANCES REGARDING BUSINESS LICENSES AND REGULATIONS Alderman Huether spoke about the bill, stating there was a change in the definition of an existing business to one that has been in operation on April 30 of the preceding year. That is to help everything mesh better with new renewal year of May 1. Alderman Huether introduced Substitute Bill # 19-2393, entitled: “AN ORDINANCE AMENDING CERTAIN PROVISIONS OF THE CODE OF ORDINANCES RELATING TO CHAPTER 605 BUSINESS LICENSES AND REGULATIONS”, by title only. Alderman Huether stated that emergency legislation had been requested, so she made the motion for approval of emergency legislation. The motion was seconded by Alderman Hamill and carried unanimously, without objection. A poll of the Board showed: Alderman Hamill – aye Alderman Toben – aye Alderman Baumann – aye Alderman Ottenad – aye Alderman Huether – aye Alderman Nolte – aye Alderman Ottenad announced that the motion passed 6 – 0, with no objections from the members of the Board of Aldermen. b. BILL TO AMEND THE 2019 BUDGET Alderman Toben introduced Bill # 19-2395, entitled: “AN ORDINANCE AMENDING ORDINANCE NO. 18-2241 THAT ADOPTED AND APPROVED THE BUDGET FOR THE CITY OF MANCHESTER FOR THE YEAR JANUARY 1, 2019 THROUGH DECEMBER 31, 2019, BY INCREASING REVENUES BY $24,451,000 AND EXPENSES BY $31,722,310”, by title only. Director of Finance Don Yucuis stated that annually we have to look at actual expenses compared to budget, and to comply with State of Missouri statutes, we can’t spend more than what the budget is. This adjustment is in regard to a couple areas that we didn’t budget for, for instance, we didn’t plan on the TIF bond issue refunding and the expenses related to that. Manchester had a couple insurance settlements, one in Parks and one in finance. He said they also did not budget for the Asset Forfeiture fund; they did get some money in and did spend a little. In the Sewer Lateral fund, they believe expenditures will be more than the original budget, the Prop S Fund 2018 program from last year wasn’t finished at the end of the year, so they carried it forward. There were a couple hundred thousand dollars more on the 2019 program that they didn’t budget for. This is being done because the City needs to comply with Missouri State law. No further action required at this time. c. BILL ACCEPTING HANNA COURT INTO THE CITY’S ROADWAY SYSTEM Alderman Baumann introduced Bill # 19-2396, entitled: “AN ORDINANCE ACCEPTING THE CONVEYANCE OF CERTAIN RIGHT-OF-WAY AND ACCEPTING HANNA COURT FOR MAINTENANCE AS A PUBLIC STREET OF THE CITY OF MANCHESTER”, by title only. Director Ruck stated the City started working on this with documentation, and he had hoped that this would have been presented to the Board sooner than this. Alderman Baumann stated that emergency legislation had been requested, so he made the motion for approval of emergency legislation. The motion was seconded by Alderman Hamill and carried unanimously, without objection. Alderman Baumann made the motion that Bill # 19-2396 become Ordinance # 19- 2280. The motion was seconded by Alderman Toben. A poll of the Board showed: Alderman Toben – aye Alderman Baumann – aye Alderman Ottenad – aye Alderman Huether – aye Alderman Nolte – aye Alderman Hamill – aye Alderman Ottenad announced that the motion passed 6 – 0, with no objections from the members of the Board of Aldermen. d. RESOLUTION AUTHORIZING PURCHASE OF A MEDIUM DUTY TRUCK FOR THE PARKS AND RECREATION DEPARTMENT Alderman Nolte read Proposed Resolution # 19-0714, entitled: “A RESOLUTION ACCEPTING THE BID OF MCLARTY CMFO, LLC, DOING BUSINESS AS JOE MACHENS FORD LINCOLN, IN THE AMOUNT OF SIXTY-SIX THOUSAND FOUR HUNDRED THIRTY- ONE DOLLARS ($66,431.00) FOR THE PURCHASE OF ONE (1) 2020 FORD F450 MODEL TRUCK WITH DUMP BODY AND ASSOCIATED EQUIPMENT FOR USE BY THE PARKS, RECREATION, AND ARTS DEPARTMENT AND AUTHORIZING THE CITY ADMINISTRATOR OF THE CITY OF MANCHESTER TO ISSUE A PURCHASE ORDER THEREFORE”, by title only. Alderman Nolte made the motion for approval of Resolution # 19-0714. The motion was seconded by Alderman Hamill and carried unanimously, without objection. 11. MISCELLANEOUS a. Comments from the Public There were none. 12. ADJOURNMENT At 7:25 p.m., there being no further business, Alderman Nolte made the motion to adjourn.
