MINUTES OF THE REGULAR BOARD OF ALDERMEN MEETING OF MONDAY, JUNE 21, 2021 BY VIDEO CONFERENCING ON ZOOM AT 200 HIGHLANDS BOULEVARD DRIVE CALL TO ORDER Mayor Mike Clement called the Regular Board of Aldermen Meeting to order at 7:00 p.m. ROLL CALL AND STATEMENT OF QUORUM Roll call showed those present were Alderman Nolte, Alderman Ottenad, Alderman Huether, Alderman Baumann, Alderman Toben, and Mayor Clement. A quorum was present. Alderman Hudson was absent. APPROVAL OF THE MINUTES June 07, 2021 Board of Aldermen Public Hearing Alderman Ottenad made the motion to approve the minutes of the Monday, June 7, 2021 Board of Aldermen Public Hearing. The motion was seconded by Alderman Huether and carried unanimously, with no objections from any members of the Board of Aldermen. June 7, 2021 Board of Aldermen Regular Meeting Alderman Ottenad made the motion to approve the minutes of the Monday, June 7, 2021 Regular Board of Aldermen Meeting. The motion was seconded by Alderman Huether and carried unanimously, with no objections from any members of the Board of Aldermen. ESTABLISHMENT OF ORDER OF ITEMS ON THE AGENDA Mayor Clement stated in the absence of Alderman Hudson, Alderman Baumann will read the second reading of Bill 21-2437. Alderman Ottenad made the motion to approve the Order of Items on the Agenda, as amended. The motion was seconded by Alderman Nolte and carried unanimously, with no objections from any members of the Board of Aldermen. CONSIDERATION OF PETITIONS Tucker’s Place West Restaurant Presentation Chief of Police Scott Will presented Tuckers Place West Restaurant with a check for their help with the Clean Up for Special Olympics. They raised a total of $7,651 dollars for Special Olympics. Regular Board of Aldermen Meeting 06/21/2021 Page 1 2020 Annual Comprehensive Financial Report Ms. Mollie Malone, Partner with Stopp & VanHoy, presented the Board with the 2020 overview by PowerPoint. There were no major changes this year. There was a net increase in General Obligation Bonds by approximately $6.3 million due to issuance of bonds for Prop S Project. The sales tax revenue decreased by approximately $844 thousand. The City received approximately $1.2 million in CARES Act Grant Awards to assist the City with COVID-19 relief efforts. Ms. Malone stated the audit adjustments would be a recording of delinquent property tax receivables as confirmed by the St. Louis County Collector’s office. Other closing adjustments, as needed, for accounts payable, fixed assets, long-term debt, and other accounts for convert records to the different basis of accounting used for government reporting. She said there would be adjustments to correct errors in balances reported on the schedule of expenditures of Federal Awards (new audit requirement for 2020 due to the CARES Act Award). Comments from the Public Ms. Diane Iezzi, 437 Royal Village Drive, addressed the Board regarding bees in residential districts. Ms. Iezzi made several suggestions for amendments to the Code of Ordinances. Mayor Clement thanked Ms. Iezzi for her comments and said the Board would take her suggestions under consideration. REPORTS FROM THE MAYOR Mayoral Reports Mayor Clement updated the Board about the food drive that ends on July 4th and reminded them about the upcoming Fourth of July events at Schroeder Park. REPORTS FROM THE CITY ADMINISTRATOR 14401 Manchester Road (Sunup Express) Report Director of Planning, Zoning and Economic Development Melanie Rippetoe reported she spoke with the owners, and they have received their permit from MoDOT. She said they plan to remove the street over the weekend and the street will be formed and ready for inspection by June 28. Alderman Baumann asked what will be left to complete after the street is finished. Director Rippetoe answered a little bit of pavement like curbs by the trash dumpster and then finish what will be attached to the part of the street they are working on. She said they have a bit of sewer work to do. Alderman Ottenad asked if the old driveway next to the doctor’s office off Manchester Road is coming off. Director Rippetoe answered there will be three entrances, Manchester, Andersohn, and Henry. Report from Chief Scott Will Chief of Police Scott Will stated that a new House Bill has been passed. It is House Bill 85, Regular Board of Aldermen Meeting 06/21/2021 Page 2 also known as the second amendment preservation act and signed by the Governor. He said that the Bill essentially says that if local or state law enforcement assist federal government in enforcing federal firearm laws, the City must be held accountable for monetary damages of $50,000 per occurrence. There is a lawsuit that was filed to address that issue by the City of St. Louis and County. Report from City Clerk Klocke City Clerk Justin Klocke stated he is excited to share that the City has received a grant for electronic records initiative by the Missouri Secretary of States local records office. The City received $23,500 towards this initiative. Mayor Clement thanked City Clerk Klocke for his hard work on this. Report from City Administrator Perney City Administrator Larry Perney stated that as many people are aware he has turned in his resignation to the City, and his last day will be July 16. Mayor Clement stated we will miss City Administrator Perney and we wish him the best and success in his new job. List of Paid Bills (Warrant dates of 06-07-2021 to 06-21-2021) There were no questions. REPORTS FROM COMMITTEES Planning and Zoning Commission Alderman Nolte stated Planning and Zoning did meet and discussed and approved three site plans for new houses. They also discussed a Special Use Permit for a school at St. Joseph’s Church that was recommended to go to the Board of Aldermen. Veterans Commission Alderman Huether stated the work on the Flags of Valor continues but they have closed registration for volunteers. Currently they are looking at places that they can set up to prepare the dog tags and photos. She said the Veterans Commission has ordered plaques to recognize our Manchester Veterans that have been killed in theater at the Memorial on the physical memorial. Alderman Huether stated the Commission has decided not to meet in July due to spending so much time together in the next few months. Homecoming Committee Alderman Ottenad stated they met June 25 for a potluck picnic. They have decided to advertise on the billboard this year and the West County Magazine. She said that currently they are low on food and game booths. Alderman Ottenad stated this year they will be having bingo from 12 to 1 on Sunday. They will be having a petting zoo but it will be a new company. She said the next meeting is July 14 at 6:30 p.m. at Paul Schroeder Park. Audit and Finance Committee Alderman Baumann stated they just went over the audit before this Board of Aldermen Regular Board of Aldermen Meeting 06/21/2021 Page 3 meeting and the next meeting will be July 19. Alderman Toben wanted to give kudos to Director of Finance Don Yucuis and his staff for having a flawless audit. Tree Advisory Board Interim Director Tyler Jaycox stated they did not meet but their next meeting will be July 12. ACTION ON OLD BILLS BILL NO 21-2436 – VACATION OF CHERRY ALLEY REMNANT Alderman Nolte read for the second time Bill #21-2436, entitled: “AN ORDINANCE VACATING A REMNANT OF CHERRY ALLEY IN THE CITY OF MANCHESTER, MISSOURI”, by title only. Alderman Nolte made the motion that Bill #21-2436, become Ordinance #21-2321. The motion was seconded by Alderman Huether. A poll of the Board showed: Alderman Ottenad – aye Alderman Huether – aye Alderman Hudson – absent Alderman Nolte – aye Alderman Toben – aye Alderman Baumann – aye Mayor Clement announced that the motion passed 5 – 0, with no objections from any members of the Board of Aldermen, and one absent. BILL NO 21-2437 – 500 WOODS MILL ROAD REZONING AND PRELIMINARY SITE PLAN AUTHORIZATION Alderman Baumann read for the second time Bill #21-2437, entitled: “AN ORDINANCE PROVIDING FOR THE REZONING OF A PARCEL CONSISTING OF 22.28 ACRES SUBMITTED BY MCBRIDE BERRA LAND COMPANY, LLC, OWNER UNDER CONTRACT, TO PRD PLANNED RESIDENTIAL DEVELOPMENT DISTRICT AND APPROVING A PRELIMINARY SITE DEVELOPMENT PLAN PER APPLICATIONS 21-REZ-001 AND 21-SP- 004”, by title only. Alderman Baumann made the motion that Bill #21-2437, become Ordinance #21-2322. The motion was seconded by Alderman Ottenad. ACTION ON NEW LEGISLATION RESOLUTION NO 21-0820 – 2021 STREET PAINT STRIPING Alderman Toben read Proposed Resolution 21-0820, entitled: “A RESOLUTION AUTHORIZING THE CITY ADMINISTRATOR OF THE CITY OF MANCHESTER TO ENTER INTO AN AGREEMENT WITH AMERICA’S PARKING REMARKING, INC. IN AN AMOUNT NOT TO EXCEED TWENTY-FIVE THOUSAND ONE HUNDRED SIXTY-FOUR DOLLARS ($25,164.00) FOR STREET PAINT STRIPING SERVICES FOR 2021 WITH CITY OPTION TO RENEW FOR THREE ADDITIONAL ONE-YEAR PERIODS”, by title only. Alderman Toben made the motion for approval of Resolution #21-0820. The motion was seconded by Alderman Ottenad and carried unanimously, without any objections from any members of the Board of Aldermen. RESOLUTION NO 21-0821 – CARMAN ROAD PEDESTRIAN AND SIDEWALK IMPROVEMENT PROPOSAL Alderman Huether read Proposed Resolution NO 21-0821, entitled: “A RESOLUTION FROM THE CITY OF MANCHESTER STAFF, BOARD OF ALDERMEN, AND MAYOR EXPRESSING SUPPORT FOR THE CARMAN ROAD PEDESTRIAN AND SIDEWALK IMPROVEMENT PROPOSAL”, by title only. Alderman Huether made the motion for approval of Resolution #21-0821. The motion was seconded by Alderman Ottenad and carried unanimously, without any objections from any members of the Board of Aldermen. MISCELLANEOUS Comments from the Public There were none. EXECUTIVE SESSION Pursuant to Section 610.021 (3) of the Revised Statutes of the State of Missouri Alderman Nolte made the motion to go into Closed Session: Pursuant to Section 610.021 (3) of the Revised Statutes of the State of Missouri. The motion was seconded by Alderman Toben.
