MINUTES OF THE PUBLIC HEARING OF MONDAY, NOVEMBER 6, 2023 TEXT AMENDMENT TO SECTION 405 RELATING TO SPECIAL USE PERMIT PROCEDURES CALL TO ORDER Mayor Mike Clement called the Public Hearing of the Board of Aldermen to order at 7:00 p.m. ROLL CALL AND STATEMENT OF QUORUM Roll call showed those present were Alderman Nolte, Alderman Dodge, Alderman Ottenad, Alderman Huether, Alderman Toben, Alderman Baumann, and Mayor Clement. A quorum was present. PUBLIC HEARING The following notice of the public hearing was then read: “The City of Manchester Board of Aldermen shall hold a public hearing on Monday, November 6, 2023 at 7:00 p.m. at the Manchester Justice Center, 200 Highlands Boulevard Dr, to consider the following: Case Number 23-TXT-003: Text Amendment to Section 405.550 (G) of the Zoning Code Relating to Special Use Permit procedures.” Speaking as a proponent, Planning, Zoning and Economic Development Director Riganti explained that the text amendment being presented will change aspects of the special use permit procedure to address issues with the process the Board and Staff had previously voiced. Director Riganti explained that the current regulations state that a business license must be obtained within a year of the special use permit’s issuance. She continued that applicants have had difficulty meeting that timeframe due to market fluctuations and labor shortages. She continued that extensions may be granted under the current process, with Board of Alderman approval. Extensions may be granted for 90 days only. The applicant may seek additional extensions by coming before the Board f every ninety days until the applicant obtains a business license. This is a cumbersome process for the Board, staff and the applicant. The proposed changes would lengthen the timeframe of these extensions to 180 day increments. It will also change the validity criteria of the special use permit from obtaining a business license within a year to requiring that a building permit or commercial occupancy be obtained within a year. Director Riganti reported that the Planning & Zoning Commission voted in favor of approval of the text amendment at their meeting. A quorum was present. APPROVAL OF THE MINUTES October 16, 2023 Regular Board of Aldermen Meeting Alderman Ottenad made the motion to approve the minutes of the Monday, October 16, 2023, Regular Board of Aldermen Meeting. The motion was seconded by Alderman Toben and carried unanimously, with no objections from any members of the Board of Aldermen. October 24, 2023 Board of Aldermen Work Session Alderman Ottenad made the motion to approve the minutes of the Tuesday, October 24, 2023, Board of Aldermen Work Session. The motion was seconded by Alderman Baumann and carried unanimously, with no objections from any members of the Board of Aldermen. October 26, 2023 Board of Aldermen Work Session Alderman Ottenad made the motion to approve the minutes of the Thursday, October 26, 2023, Board of Aldermen Work Session. The motion was seconded by Alderman Baumann and carried unanimously, with no objections from any members of the Board of Aldermen. ESTABLISHMENT OF ORDER OF ITEMS ON THE AGENDA Alderman Ottenad made the motion to approve the Order of Items on the Agenda, as presented. REPORTS FROM THE MAYOR Reappointment of Audit and Finance Committee Members (2-year term) Alderman Ottenad made the motion for the reappointment of Peter Bitzer and Ben Toben as members of the Audit and Finance Committee. The motion was seconded by Alderman Regular Board of Aldermen Meeting 11/06/2023 Page 1 Huether and carried unanimously, without objection. Mayoral Proclamations- Veterans Day Mayor Clement thanked the members of the audience who were in attendance. He read a proclamation that honored, remembered, and thanked all those who have served and emphasized the importance of Veterans Day in paying tribute and respect to the sacrifices and service of veterans. Mayoral Proclamations- Vietnam War 50th Anniversary Mayor Clement read a proclamation acknowledging the 50th Anniversary of the end of the Vietnam War. He emphasized the significance of this anniversary and thanked the Veterans for their service during a time of strife and turmoil. Mayoral Reports Mayor Clement reminded everyone that the election would be tomorrow, November 7th, and to get out and vote. Mayor Clement informed the Board and audience of upcoming City events including Conversations with the Mayor on November 8th and the various events in honor of Veterans Day on November 10th. He thanked everyone involved in hosting the last two open houses aimed at educating residents of Manchester and the unincorporated area on annexation. REPORTS FROM THE CITY ADMINISTRATOR Check Presentation to Sergeant Meredith Absolon Chief Will brought up Sgt Absolon and commended her on her strength and perseverance in her battle with cancer. He commended the Manchester community for coming together after hearing of her diagnosis and finding ways to support her in her journey to recovery. Chief Will brought up members from organizations and businesses that held fundraisers for Sgt Absolon including Lafayette Industries, American Legion Post #208, Tucker’s Place Restaurant, Perwinkle Daycare, and Manchester United Methodist Men’s Group. Each organization expressed their appreciation for Sgt Absolon and expressed the overwhelming support that they received from the community in each of their individual fundraisers. Chief Will also recognized Executive Assistant Kat White for the sale of t-shirts and hoodies to benefit Sgt Absolon. Sgt Absolon thanked the residents of Manchester, the Police Officers, Fire Fighters, and Manchester community for their support throughout this experience. Sgt Absolon thanked Executive Assistant Kat White for her time and effort in helping with all the fundraisers and helping her through everything. She continued that the encouragement of the community has been overwhelming and will pay it forward in her support for cancer prevention. Chief Will expressed how special it has been to see the community come together in the way they have for Sgt Absolon. Oath of Office – Police Officer Jeremy Malof Chief Will introduced Manchester’s newest Police Officer Jeremy Malof. He continued that Officer Malof graduated from the Eastern Missouri Law Enforcement Academy in 2018 and has bachelor’s degrees in criminal justice and psychology from UMSL. He joined the City Regular Board of Aldermen Meeting 11/06/2023 Page 2 after working as a patrolman and field training officer for the City of Overland. Officer Malof, joined by his family, had his badge pinned by his wife, symbolizing his addition to the Manchester Police Force. Recognition of Director Errol Tate City Administrator Klocke acknowledged Director of Public Works, Errol Tate. He was recently named the chair of the Diversity, Equity, and Inclusion Committee for the Missouri chapter of the American Public Works Association. List of Paid Bills (Warrant dates of 10-16-2023 to 11-05-2023) There were no questions. Reports from the Committees Planning and Zoning Commission Alderman Nolte reported that the Planning and Zoning Commission gave a positive recommendation for a special use permit and a text amendment. Veterans Commission Alderman Huether reported that Veterans Day would be recognized in the City the upcoming Friday, November 10th. She continued that there would be a Veterans breakfast at American Legion Post #208 from 7-10am, Flags of Valor would fly all day at the Veterans Memorial off of Henry, and there would be a ceremony celebrating Hometown Heroes at 6pm in the Justice Center’s Board Room. Audit and Finance Committee Alderman Toben stated that the Audit and Finance Committee went through the budget meetings, and everything looked good. Tree Advisory Board Alderman Dodge stated that there was no report for the Tree Advisory Board. Homecoming Committee Alderman Ottenad reported that Homecoming Committee had the 2023 wrap up meeting. She continued that in revenue they took in $60,362, $10,000 more than 2022. Expenses totaled at $62,527, $8,000 more from 2022. She continued that all raffle tickets were sold, including the additional 1,000 that were added this year. It was concluded that there needed to be more food booths at future Homecoming celebrations. Alderman Ottenad continued that the holiday thank you dinner for the Homecoming Committee members would be on December 3rd and that the first meeting for 2024 would be April 17th. She thanked everyone who made Homecoming 2023 such a success. Annexation Update Alderman Dodge reminded everyone that the special election would be tomorrow, November 7th and that the polls open at 6am. ACTION ON OLD BILLS BILL NO. 23-2515 Street Dedication Accepting Baxter Commons Drive Regular Board of Aldermen Meeting 11/06/2023 Page 3 Alderman Baumann read for the second time Bill No. 23-2515 entitled: “AN ORDINANCE ACCEPTING THE DEDICATION AND CONVEYANCE OF CERTAIN RIGHT-OF-WAY AND EASEMENTS AND ACCEPTING BAXTER COMMONS DRIVE FOR MAINTENANCE AS A PUBLIC STREET OF THE CITY OF MANCHESTER,” by title only. Alderman Baumann made the motion that Bill No. 23-2515, become Ordinance No. 23-2399. The motion was seconded by Alderman Ottenad. A poll of the Board showed: Alderman Toben – aye Alderman Nolte – aye Alderman Ottenad – aye Alderman Dodge – aye Alderman Baumann – aye Alderman Huether – aye Mayor Clement announced that the motion passed 6 to 0, with no objections from any members of the Board of Aldermen. Mayor Clement commended the trustees for their diligence in working with the City to make this happen over the last twelve months. INTRODUCTION OF NEW LEGISLATION Resolution No. 23-0951 La Bonne Parkway Reconstruction Project Phase Management Alderman Huether read Proposed Resolution No. 23-0951, entitled: “A RESOLUTION AUTHORIZING THE CITY ADMINISTRATOR OF THE CITY OF MANCHESTER TO ENTER INTO A CONTRACT WITH HORNER & SHIFRIN, INC. IN AN AMOUNT NOT TO EXCEED ONE HUNDRED TWENTY-SEVEN THOUSAND ONE HUNDRED THIRTY-SEVEN DOLLARS AND FIFTY-FOUR CENTS ($127,137.54) TO PROVIDE THE CITY WITH PROFESSIONAL ENGINEERING SERVICES FOR THE LA BONNE PARKWAY RECONSTRUCTION PROJECT IN THE CITY OF MANCHESTER,” by title only. Alderman Huether made the motion for approval of Resolution No. 23-0951. Resolution No. 23-0952 La Bonne Parkway Reconstruction Alderman Ottenad read Proposed Resolution No. 23-0952, entitled: “A RESOLUTION AUTHORIZING THE CITY ADMINISTRATOR OF THE CITY OF MANCHESTER TO ENTER INTO A CONTRACT WITH E. MEIER CONTRACTING, INC. IN AN AMOUNT NOT TO EXCEED TWO MILLION NINE HUNDRED NINETY-FIVE THOUSAND SEVEN HUNDRED SEVENTY-ONE DOLLARS AND SEVENTEEN CENTS ($2,995,771.17) FOR THE LA BONNE PARKWAY RECONSTRUCTION PROJECT,” by title only. No further action at this time. MISCELLANEOUS Comments from the Public Alderman Nolte noted that there was a retaining wall behind the old Shop ‘n Save that was falling. He continued that the retaining wall was not within City Limits, but the area it was Regular Board of Aldermen Meeting 11/06/2023 Page 5 falling on is an area in Manchester where kids play. Alderman Nolte explained he brought this issue to staff the previous week and they diligently fixed the problem, putting up barricades and collaborating with Twin Oaks to resolve the issue. He thanked the staff for doing a great job and protecting the public. ADJOURNMENT There being no further business, Alderman Nolte made the motion to adjourn.
