MINUTES OF THE REGULAR BOARD OF ALDERMEN MEETING OF MONDAY, AUGUST 5, 2024 AT 200 HIGHLANDS BOULEVARD DRIVE CALL TO ORDER Mayor Clement called the Regular Board of Aldermen Meeting to order at 7:00 p.m. ROLL CALL AND STATEMENT OF QUORUM Roll call showed those present were Alderman Streeter, Alderman Dodge, Alderman Huether, Alderman Ottenad, Alderman Toben, Alderman Baumann and Mayor Clement. A quorum was present. APPROVAL OF THE MINUTES July 19, 2024 Public Hearing regarding 14246 Manchester Road Alderman Toben made the motion to approve the minutes of the Monday, July 19, 2024, Public Hearing regarding 14246 Manchester Road. The motion was seconded by Alderman Huether and carried unanimously, with no objections from any members of the Board of Aldermen. July 19, 2024 Regular Board of Aldermen Meeting Alderman Toben made the motion to approve the minutes of the Monday, July 19, 2024, Regular Board of Aldermen Meeting. The motion was seconded by Alderman Huether and carried unanimously, with no objections from any members of the Board of Aldermen. ESTABLISHMENT OF ORDER OF ITEMS ON THE AGENDA Alderman Ottenad made the motion to approve the Order of Items on the Agenda, as presented. The motion was seconded by Alderman Streeter and carried unanimously, with no objections from any members of the Board of Aldermen. CONSIDERATION OF PETITIONS Comments from the Public Melissa Walaitis, resident of 1288 Cottagemill Drive, stated that she is opposed to the chickens in Manchester. She has a neighbor that has emotional support chickens, and she believes it poses health risks and violates the City’s code of Ordinances. Melissa Copeland, resident of 610 Wren Ave, wanted to thank the board for passing the traffic study at the last Board of Aldermen meeting. She questioned if the board had looked at the traffic study that Parkway performed. She highlighted parts of the study that she disagreed with. Rita Fitzjarrell, resident of 680 Canary Estates Drive, wanted to let the Board know that they are not hearing much from the Parkway. She has requested information, and they are not responding to her request for information. Regular Board of Aldermen Meeting 08/05/2024 Page 1 REPORTS FROM THE MAYOR Mayoral Proclamation – Damon Snow’s 100th Birthday Mayor Clement read a proclamation to Damon Snow, in celebration of his 100th birthday. Mayoral Reports Mayor Clement stated that the City held another successful recycling event; there were 464 cars that recycled 33,000 pounds. They received 290 pieces of food and over $900 dollars that will be donated to Circle of Concern. Mayor Clement notified the Board and members of the public of upcoming events including Rockin’ Chair Concert on August 9th along with a Car Show on the same night, there will be a Community Band Concert on August 11th ; and Manchester Homecoming is September 6 – 8th . Mayor Clement wanted to lift up National Night Out. It is being held on August 6th. He is aware of 3 events. He wanted to let everyone know if there are more events out there to let him know so the police can try to come out and see everyone. Mayor Clement wanted to congratulate City Attorney Paul Rost on his recently awarded Lou Czech Award. This is a significant recognition that he received. REPORTS FROM THE CITY ADMINISTRATOR List of Paid Bills (Warrant dates of 07-15-2024 to 08-04-2024) There were no questions. REPORTS FROM THE COMMITTEES Planning and Zoning Commission Alderman Baumann stated that the site plan approval has been continued until August 12th Planning and Zoning meeting. Veterans Commission Alderman Huether stated the Veterans Commission will be meeting August 13th at 5:00 pm. Audit and Finance Committee Alderman Toben stated that budget season will be starting, and we hope to adopt the 2025 budget on December 2nd, 2024. Tree Advisory Board Alderman Dodge stated there was no report. Homecoming Committee Alderman Ottenad stated they met on July 31st and there will be 4,000 raffle tickets this year. They are increasing the tickets from 3,000 tickets last year. She wanted to let everyone know that on Sunday of Homecoming rides will be half price. She did say that Louie from the Blues will be back again this year. Alderman Ottenad stated that currently the Homecoming has 10 food booths, 9 informational booths, and 4 retail booths. Alderman Ottenad stated that new this year they will try recycling cans at the Homecoming. Alderman Ottenad stated that the next meeting will be August 21st at 6:30 pm. OLD LEGISLATION BILL NO. 24-2540 Special Use Permit for 14246 Manchester Road Alderman Dodge read for the second time Bill No. 24-2540 entitled: “AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO HONG ZHENG OF PAN-ASIA MARKET TO ALLOW AN ACCESSORY USE AT 14246 MANCHESTER ROAD IN THE C-1 COMMERCIAL ZONING DISTRICT AS PROVIDED FOR IN SECTION 405.240(C)(14) OF THE MUNICIPAL CODE OF THE CITY OF MANCHESTER,” by title only. Alderman Dodge made the motion that Bill No. 24-2540, become Ordinance No. 24-2423. The motion was seconded by Alderman Ottenad. A poll of the Board showed: Alderman Streeter – aye Alderman Dodge – aye Alderman Ottenad – aye Alderman Huether – aye Alderman Baumann – aye Alderman Toben– aye Mayor Clement announced that the motion passed 6 to 0, with no objections from any members of the Board of Aldermen. BILL NO. 24-2542 Conflict of Interest Alderman Streeter read for the second time Bill No. 24-2542 entitled: “AN ORDINANCE RE- ESTABLISHING THE PROVISIONS OF SECTIONS 120.010 THROUGH 120.070 OF THE CODE OF ORDINANCES OF THE CITY OF MANCHESTER, MISSOURI WHICH ESTABLISHES THE CITY’S PROCEDURE FOR THE DISCLOSURE OF POTENTIAL CONFLICTS OF INTEREST AND SUBSTANTIAL INTEREST FOR CERTAIN MUNICIPAL OFFICIALS OF THE CITY OF MANCHESTER, MISSOURI,” by title only. City Administrator Justin Klocke stated that this Bill is just a reaffirmation of the City of Manchester’s Conflict of Interest discloser policy. He stated that every other year biannually, the City has to pass this Ordinance to reaffirm to everyone and the state that we have a policy to disclose conflicts of interest. Alderman Streeter made the motion that Bill No. 24-2542, become Ordinance No. 24-2424. The motion was seconded by Alderman Ottenad. NEW LEGISLATION Bill No. 24-2543 Conveyance of Easement (Manchester Road/Gaywood Drive) Alderman Ottenad read Proposed Bill No. 24-2543 entitled: “AN ORDINANCE AUTHORIZING THE GRANT TO THE MISSOURI HIGHWAYS AND TRANSPORTATION COMMISSION OF PERMANENT AND TEMPORARY EASEMENTS FOR SIDEWALK UPGRADES ALONG MANCHESTER ROAD AT GAYWOOD DRIVE AND AUTHORIZING THE CITY ADMINISTRATOR TO EXECUTE THE EASEMENTS DOCUMENT ON BEHALF OF THE CITY,” by title only. Alderman Ottenad inquired if this is for sidewalks upgrades and if the sidewalks will become ADA compliant. Assistant Director Dave Pracht stated MoDOT has plans to build curb ramps on Manchester Road from Highway 141 overpass heading east to City Limits. He stated that MoDot is hoping to work on their portion next year and then Manchester will work on their portion after that. No further action at this time. MISCELLANEOUS Comments from the Public CLOSED SESSION Alderman Huether read “Notice is hereby given that pursuant to Chapter 610, Section 610.021 of the Revised Statutes of Missouri (the Missouri Open Meetings and Records Law) and subject to a motion duly made and adopted by roll call vote, the Board of Aldermen will hold a closed meeting for the purpose of dealing with matters relating to the following: Legal actions, causes of action or litigation involving a public governmental body and any confidential or privileged communications between a public governmental body or its representatives and its attorneys (Sec. 610.021(1) RSMo). Hiring, firing disciplining, or promoting of particular employees by a public governmental body when personal information about the employee is discussed or recorded, including individually identifiable personnel records, performance ratings or records pertaining to employees or applicants for employment (Sec. 610.021(3)&(13) RSMo)”. Alderman Huether made the motion to go into closed session. The motion was seconded by Alderman Ottenad.
