MINUTES OF THE REGULAR BOARD OF ALDERMEN MEETING OF MONDAY , JULY 15, 2024 AT 200 HIGHLANDS BOULEVARD DRIVE CALL TO ORDER Mayor Clement called the Regular Board of Aldermen Meeting to order at 7:06 p.m. ROLL CALL AND STATEMENT OF QUORUM Roll call showed those present were Alderman Streeter, Alderman Dodge, Alderman Huether, Alderman Toben, Alderman Baumann, and Mayor Clement. Alderman Ottenad was absent. A quorum was present. APPROVAL OF THE MINUTES June 17, 2024 Regular Board of Aldermen Meeting Alderman Dodge made the motion to approve the minutes of the Monday, June 17, 2024, Regular Board of Aldermen Meeting. The motion was seconded by Alderman Baumann and carried unanimously, with no objections from any members of the Board of Aldermen. ESTABLISHMENT OF ORDER OF ITEMS ON THE AGENDA Mayor Clement requested that Agenda Item 7-a be removed from the agenda. Alderman Toben made the motion to approve the Order of Items on the Agenda, as amended. The motion was seconded by Alderman Baumann and carried unanimously, with no objections from any members of the Board of Aldermen. CONSIDERATION OF PETITIONS Comments from the Public Saaber Khodr, resident of 1659 Huntington Hill Dr, requested a follow up on his previous concerns about surveillance and energy weapons. He brought up concerns about corruption, harassment, and issues with police and federal agents and that he believed his rights to speak for freedom were being taken away and a cause for his being targeted by these agencies. Melissa Copeland, resident of 610 Wren Ave, brought up the intense traffic she witnesses surrounding the schools on the street. She expressed adding more traffic is not the answer to the issues they are facing. She wanted to make sure that the traffic study would be conducted on a typical day and asked that the Aldermen vote yes for the traffic study. Bonsai Kurtz, resident of 13523 Featherstone Dr, expressed concern about the City’s limit to the number of massage businesses allowed in Manchester. She explained she had signed a year-long lease prior to learning this information and asked that the Board consider allowing more massage businesses, potentially with probationary periods or surprise inspections. REPORTS FROM THE MAYOR Regular Board of Aldermen Meeting 07/15/2024 Page 1 Mayoral Proclamation – Loris Clifford’s 100th Birthday Mayor Clement read a proclamation to longtime resident and staple in the community, Loris Clifford, in celebration of her 100th birthday. Reappointment of Anne Altepeter to the Board of Adjustment Alderman Toben made the motion to approve the reappointment of Anne Altepeter as a member of the Board of Adjustment. The motion was seconded by Alderman Baumann and carried unanimously, without objection. Mayoral Reports Mayor Clement recognized and thanked the Parks staff for producing another wonderful 4th of July celebration. He also recognized Parks and Arts Specialist Pate for the Community Band Concert on July 14th. Mayor Clement notified the Board and members of the public of upcoming events including the swim finals at the pool on July 18th, Shakespeare in the Park on August 2nd, Rockin’ Chair Concert on August 9th and a Car Show on August 9th. REPORTS FROM THE CITY ADMINISTRATOR Board Room Audio Presentation IT Specialist Dave Fox stated the City went out for bids for the Audio for the Board room. The City received a total of six bids. This bid was different because it was more specialized/customized as to what we want. The bids range from anywhere from $43,000 to $160,000. Three of the bids were under $60,000. IT Specialist Fox stated that we budgeted $40,000, so this project will be over budget. Currently he is reviewing the lower three bids. He is hoping to present it to the Board in two weeks. IT Specialist Fox stated there has not been any upgrades since the building was built which is about 15 years old. Wren Avenue Area Traffic Impact Study Director of Public Works, Errol Tate stated that there were two proposals for the traffic impact study. He stated that the impact study was in the area around Southwest Middle and includes the roads that feed into Wren Avenue as well. After reviewing the two proposals, they determined that Terra engineering was more inclusive and focused more on the side streets that feed to Wren Avenue rather than Sulphur Springs. Director Tate stated that Terra will also be reviewing the original study by CBB for Parkway. He stated that Terra will also include two regular days and one rain day, if they can fit that into the schedule. Alderman Dodge stated it is important to capture the traffic study on a Tuesday. He hopes that we have full cooperation of Parkway and the traffic study is on a normal typical day. Alderman Baumann stated that he wants to make sure the traffic study has two sunny days and a rainy day. City Administrator Justin Klocke stated that Director Tate will be the liaison with the traffic study firm. Community Development Coordinator Position Request Regular Board of Aldermen Meeting 07/15/2024 Page 2 Director of Planning, Zoning and Economic Development Andrea Riganti stated that the position for third Code Enforcement Officer was previously approved by the Board. She proposes that we not hire another code enforcement officer and to hire a Community Development Coordinator (CDC). This role involves working with community members, organizations, and government agencies to enhance the community's well-being. Key duties include facilitating engagement, managing projects, assisting with planning and zoning, and aligning development activities with community goals. The Coordinator reports to the Director of Planning, Zoning, and Economic Development. Alderman Toben made the motion to accept the proposal outlined for the position of Community Development Coordinator. The motion was seconded by Alderman Baumann. List of Paid Bills (Warrant dates of 06-17-2024 to 07-14-2024) There were no questions. REPORTS FROM THE COMMITTEES Planning and Zoning Commission Alderman Baumann stated that the last meeting they had the outdoor storage at Pan Asia and also a new home build. Veterans Commission Alderman Huether wanted to extend a thank you to all the staff and Veterans Commission that greeted and hosted the 4th of July celebration. She stated the next meeting will be in August. Audit and Finance Committee Alderman Toben stated that the Audit and Finance Committee did not meet. Tree Advisory Board Alderman Dodge stated that they met for their quarterly meeting in July, they spoke about legislation that will be coming to the Board soon regarding redefining the City Ordinance regarding plants, grass and weeds. It will be focusing more on nuisances. Alderman Dodge stated the next meeting will be in October. Homecoming Committee Mayor Clement stated that Homecoming is right around the corner. In the next Manchester Message, the Homecoming will be featured in it. OLD LEGISLATION BILL NO. 24-2539 Appointment of Special Prosecutor Jennifer Deschamp Alderman Huether read for the second time Bill No. 24-2539 entitled: “AN ORDINANCE APPOINTING JENNIFER L. DESCHAMP AS SPECIAL PROSECUTING ATTORNEY FOR THE CITY OF MANCHESTER AND ESTABLISHING A RATE OF COMPENSATION FOR THE POSITION,” by title only. Alderman Huether made the motion that Bill No. 24-2539, become Ordinance No. 24-2421. The motion was seconded by Alderman Baumann. NEW LEGISLATION Bill No. 24-2540 Special Use Permit for 14246 Manchester Road Alderman Dodge read Proposed Bill No. 24-2540 entitled: “AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO HONG ZHENG OF PAN-ASIA MARKET TO ALLOW AN ACCESSORY USE AT 14246 MANCHESTER ROAD IN THE C-1 COMMERCIAL ZONING DISTRICT AS PROVIDED FOR IN SECTION 405.240(C)(14) OF THE MUNICIPAL CODE OF THE CITY OF MANCHESTER,” by title only. No further action at this time. Bill No. 24-2541 South Manchester Transportation Development District Dissolution Agreement Alderman Toben read Proposed Bill No. 24-2541 entitled: “AN ORDINANCE AUTHORIZING CITY OF MANCHESTER, MISSOURI TO ENTER INTO A TRANSPORTATION DEVELOPMENT DISTRICT DISSOLUTION AGREEMENT WITH THE SOUTH MANCHESTER TRANSPORTATION DEVELOPMENT DISTRICT; AND AUTHORIZING CERTAIN ACTIONS IN CONNECTION THEREWITH,” by title only. Alderman Toben stated Emergency Legislation had been requested. Alderman Toben made the motion for approval of emergency legislation. The motion was seconded by Alderman Dodge. The motion passed 5 to 0, with no objections from any members of the Board of Aldermen. Resolution No. 24-0979 2024-2025 Road Salt Purchase Alderman Huether read Proposed Resolution No. 24-0979, entitled: “A RESOLUTION AUTHORIZING THE CITY ADMINISTRATOR OF THE CITY OF MANCHESTER TO EXPEND THE SUM OF NINETY-TWO THOUSAND FOUR HUNDRED FIFTY-FIVE DOLLARS ($92,455.00) FOR THE PURCHASE AND DELIVERY OF ROAD SALT FOR THE 2024-2025 FALL AND WINTER SEASON FOR USE BY THE CITY OF MANCHESTER,” by title only. Alderman Huether made the motion for approval of Resolution No. 24-0979. The motion was seconded by Alderman Baumann and carried unanimously, with no objections from any members of the Board of Aldermen. Resolution No. 24-0980 Accepting Contract with Terra Engineering for Wren Ave Area Traffic Study Alderman Baumann read Proposed Resolution No. 24-0980, entitled: “A RESOLUTION OF THE CITY OF MANCHESTER AUTHORIZING THE CITY ADMINISTRATOR TO ENTER INTO A CONTRACT WITH TERRA ENGINEERING LTD. IN AN AMOUNT NOT TO EXCEED THIRTY-ONE THOUSAND SEVEN HUNDRED DOLLARS AND ZERO CENTS ($31,700.00) TO PROVIDE THE CITY WITH A WREN AVENUE NEIGHBORHOOD AREA TRAFFIC OPERATIONS STUDY,” by title only. Alderman Baumann made the motion for approval of Resolution No. 24-0980. The motion was seconded by Alderman Toben and carried unanimously, with no objections from any members of the Board of Aldermen. MISCELLANEOUS Oath of Special Prosecutor Jennifer Deschamp Deputy City Clerk Cinnamon Mullins gave Special Prosecutor Jennifer Deschamp the Oath of Office. Regular Board of Aldermen Meeting 07/15/2024 Page 5 Comments from the Public Chris Winters, 510 Cardinal Lane, he is requesting the traffic study include the intersection of Cardinal and Canary. He wondered how he would go about finding out lawsuits that are current against the City of Manchester. They directed him to Missouri Casenet. CLOSED SESSION Alderman Dodge read “Notice is hereby given that pursuant to Chapter 610, Section 610.021 of the Revised Statutes of Missouri (the Missouri Open Meetings and Records Law) and subject to a motion duly made and adopted by roll call vote, the Board of Aldermen will hold a closed meeting for the purpose of dealing with matters relating to the following: Legal actions, causes of action or litigation involving a public governmental body and any confidential or privileged communications between a public governmental body or its representatives and its attorneys (Sec. 610.021(1) RSMo). Hiring, firing disciplining, or promoting of particular employees by a public governmental body when personal information about the employee is discussed or recorded, including individually identifiable personnel records, performance ratings or records pertaining to employees or applicants for employment (Sec. 610.021(3)&(13) RSMo)”. Alderman Dodge made the motion to go into closed session. The motion was seconded by Alderman Toben.
