CALL MEETING TO ORDER At 4:00 PM, Mayor Burton called the meeting to order. B. PLEDGE TO THE FLAG Legal Advisor Mike Estrada led the Pledge of Allegiance. C. ROLL CALL Councilmember Howorth arrived at 4:05 PM. Present: 5 - Burton, D'Errico, Lesser, Howorth and Powell D. CERTIFICATION OF MEETING NOTICE AND AGENDA POSTING City Clerk Liza Tamura confirmed that the meeting was properly posted. E. PUBLIC COMMENTS (2 MINUTES PER PERSON FOR ONE ITEM, A MAXIMUM OF 5 MINUTES IF A SPEAKER WANTS TO COMMENT ON MORE THAN ONE ITEM) Seeing none, Mayor Burton continued the Public Comments until later during the Downtown Specific Plan Meeting at 6:00 PM. ANNOUNCEMENT IN OPEN SESSION OF ITEMS TO BE DISCUSSED IN CLOSED SESSION At 4:03 PM, City Attorney Quinn Barrow announced the following Closed Session. A. CONFERENCE WITH LEGAL COUNSEL (EXISTING LITIGATION) (Government Code Section 54956.9 (d)(1)) Schilling v. Manhattan Beach, Los Angeles Superior Court Case No. BC 540125 A former employee has sued the City, alleging wrongful termination. B. CONFERENCE WITH PROPERTY NEGOTIATORS (Government Code Section 54956.8) Property: APN: 4138-018-902; 1400 Park View Avenue, Manhattan Beach City Negotiator: City Manager Negotiating Parties: HMC/Interstate Manhattan Beach, L.P. (current lessee) Cerberus Real Estate Capital Management, LLC / Westmont Hospitality Group (proposed lessees) Under Negotiation: Price and terms of lease and easement C. CONFERENCE WITH PROPERTY NEGOTIATORS (Government Code Section 54956.8) Property: 1401 11th Street City Negotiator: City Manager Negotiating Party: Derrick Levy (Property Owner) Under Negotiation: Price and terms of payment 2. RECESS INTO CLOSED SESSION At 4:04 PM, Mayor Burton announced that City Council would recess into Closed Session. RECONVENE INTO OPEN SESSION At 5:18 PM, the City Council reconvened into Open Session with all Councilmembers present. 4. CLOSED SESSION ANNOUNCEMENT IN OPEN SESSION City Attorney Quinn Barrow announced that City Council went into closed session and direction was given regarding all three items but no reportable action was taken. G. DOWNTOWN SPECIFIC PLAN - 6:00 PM At 6:00 PM Mayor Burton reconvened the meeting with all Councilmembers present except Mayor Pro Tem D'Errico. Draft Downtown Specific Plan Update and Direction for Preparation of 16-0143 Final Draft Downtown Specific Plan (Continued from the April 12, 2016, Joint City Council/Planning Commission Meeting) (Community Development Director Lundstedt). DISCUSS AND PROVIDE DIRECTION Mayor Burton continued the Public Comments. The following members provided Public Comments: Susan Bloomfield is in support plan of height in buildings, would like consistency and maintain small town charm and character. Lynne Gross read into record letter sent to the Beach Reporter editor. Bill Victor is opposed to the increase in the height on buildings, spoke on the Traffic Engineer, trash in Downtown area, and opposed to amenities being removed for a dog hospital Burton Fuller is opposed to the plan targeting new people but in support if its based on the residents wants and needs and mentioned that the City Council has letter from previous comments. Kathy Clarke is in support of the letter that Martha Andreani sent. Robert Bush in support of preserving the small beach town character and not economic development, spoke on City Hall remodeling, is opposed to more parking, opposed to the proposed building heights, and additional public safety. Jim, part of the Downtown residents group is opposed to the height limits being raised. Tony Shakawi is opposed to the height of buildings raised and spoke on a new location for Farmers Market, parking for public and employees, and in support for more parking availability for residents. Community Development Director Marisa Lundstedt provided brief presentation. Community Development Director Lundstedt, Planning Manager Laurie Jester, and City Attorney Quinn Barrow responded to City Council questions. Community Development Director Lundstedt requested further clarification on some of the items that were previously discussed at the April 12, 2016 Joint City Council/Planning Commission Meeting. Setbacks and Stepbacks (Page 19) - Planning Commission to do a study and come back and report to City Council on what the usage is for the business. Beachhead Site (Page 47) - Support of study of Beachhead for circulation and agreed on no terraced seating. At 7:25 PM City Council recessed and reconvened at 7:33 PM. Mayor Burton requested an emergency meeting regarding trash around the City. City of Manhattan Beach Page 4 City Council Adjourned Regular Meeting Minutes - Final April 18, 2016 Meeting Councilmember Howorth agreed that trash is a problem but is not related to the Downtown Specific Plan. Councilmember Powell commented that the City received a lot of public comments and public participation throughout the process. Workshops were well promoted and highly publicized and would like to see more of it. H. OTHER COUNCIL BUSINESS, COMMITTEE AND TRAVEL REPORTS, FUTURE DISCUSSION ITEMS None. I.
