APPROVAL OF AGENDA AND WAIVER OF FULL READING OF ORDINANCES Mayor Powell asked that the Comprehensive Annual Financial Report be moved to the third item in General Business A motion was made by Councilmember Howorth, seconded by Mayor Pro Tem Burton, to approve the agenda and move Item No. 12 the Comprehensive Annual Financial Report from "Receive and File" to the last item in "General Business". Presentation of the “I ♥ MB Award” to the Manhattan Beach Police 15-0047 Department Victims Assistance Team. PRESENT Mayor Powell, on behalf of the City Council, presented the “I ♥ MB Award” to the Manhattan Beach Victims Assistance Team who were introduced by Police Chief Eve Irvine: Phyllis Barberic, Maureen Broadhurst, Nancy Carlson, Mary Golob, Jackie Luca, Rosemary Ray, Adrienne Rollo, Cynthia Strand, Annette Tessier, Gayle Wilhite, and Jeannette Wright. 2. Presentation of the “I ♥ MB Award” to Danny Zuker. 15-0048 City of Manhattan Beach Page 1 City Council Meeting Minutes - Final January 20, 2015 PRESENT Mayor Powell, on behalf of the City Council, presented the “I ♥ MB Award” to Danny Zuker Executive Producer of Modern Family. G. CITY MANAGER REPORT City Manager Mark Danaj introduced Public Works Director Tony Olmos who presented an update on the Sepulveda Water Main Project. Mayor Pro Tem Burton asked if there has been some discussion about Artesia being renamed Redondo Beach Boulevard. Public Works Director Olmos said he contacted Redondo Beach Staff and no action is being taken at this time. H. CITY ATTORNEY REPORT City Attorney Quinn Barrow reported that there was no reportable action taken during Closed Session. Mayor Pro Tem Burton requested that the City Attorney provide an update on the Manhattan Village Mall Lawsuit at a future meeting. I. CITY COUNCIL ANNOUNCEMENTS AND REPORTS Councilmember Howorth announced attendance at Senator Ben Allen's swearing in ceremony and thanked Staff for all of their efforts with the Urban Land Institute (ULI) Process last week. Mayor Pro Tem Burton complimented Staff for their efforts with the ULI Process and commented on the synergy working as a team, asked what the next steps will be for ULI, and announced that Palos Verdes lost in the Rugby game. Mayor Powell thanked Staff for the ULI Event and thanked the public for participating. City Manager Danaj stated that the video from Friday's ULI Presentation is on the website and that Staff will be issuing an informational memo to the public. Mayor Powell announced the "State of the City" address to be held at the Knights of Columbus Hall at 8:00 AM on Thursday, January 29, 2015. Mayor Powell stated that Thursday, January 29, 2015, at 5:30 PM the winners of the "Why I ♥ MB” Contest will be announced. Councilmember D'Errico asserted that the ULI Process would not have been a success, had it not been for City Manager Danaj recommending it. Councilmember D'Errico relayed that the Downtown Sidewalk Sale will be taking place this Friday, Saturday and Sunday. J. COMMUNITY ANNOUNCEMENTS REGARDING UPCOMING EVENTS Phil Reimert announced that the Manhattan Beach Residents Association will be sponsoring the City Council Candidates Forum taking place on Thursday, February 12, 2015, in the City Council Chambers from 7:00 p.m. to 8:00 p.m., moderated by Sandra Seville-Jones. City of Manhattan Beach Page 2 City Council Meeting Minutes - Final January 20, 2015 Patrick McBride, resident, shared an announcement on behalf of the City's Older Adults Program regarding this year's upcoming Dine and Discover events at the Joslyn Community Center, the fourth Thursday of each month, from 11:30 a.m. to 1:00 p.m. Jackie May, resident, voiced her concerns regarding the new dog waste bags that have been placed throughout the City. K. PUBLIC COMMENT ON NON-AGENDA ITEMS Farnaz Flechner, Executive Director of the Manhattan Beach Education Foundation, brought up the possibility of creating a plaza adjacent to the new library which would recognize donors to the Education Foundation and to the endowment. Ro Shrieder, longtime resident and veteran teacher, is very supportive of the Manhattan Beach Education Foundation and everything they have done, and supports the plaza. Dr. Ed Caprielian, resident, expressed his appreciation of the Urban Land Institute Study and its recommendations, and provided City Council with additional recommendations that would help the City move in the right direction. L. CONSENT CALENDAR A motion was made by Mayor Pro Tem Burton, seconded by Councilmember Howorth ,to approve the Consent Calendar, Item Nos. 3-8. Amendment No. 1 to the Professional Engineering Services CON 15-0004 Agreement with Wallace & Associates for Additional Construction Inspection Services for the Sepulveda Boulevard and 2nd Street Water Main Replacement Project in the Amount of $23,020 (Public Works Director Olmos). Information Systems Master Plan Update (Finance Director Moe) 14-0496 RECEIVE REPORT Attachments: Information Systems Master Plan - April 2013 Information Systems Assessment - March 2013 Project Review and Status Mayor Powell introduced Finance Director Bruce Moe who summarized and provided history for the IS Master Plan. Finance Director Moe then introduced Information Systems Manager Leilani Emnace who presented a PowerPoint Presentation on the IS Master Plan. Finance Director Moe and Information Systems Manager Emnace responded to City Council questions. Mayor Powell opened the floor to public comment. Patrick McBride, resident, relayed that he is impressed by the system and how everything is tightly controlled, thinks that wireless is the way to go, and that he is frustrated with the problems with the Wi-Fi in Oasis. Phil Reimert, resident, stated that he is concerned about City employees that have software on their mobile units and if these units get hacked is there a firewall to protect the City. Seeing no further requests to speak, Mayor Powell closed the floor to public comment. Status Report on Smoke-Free Public Places Ordinance (Public Works 15-0040 Director Olmos). Public Works Director Tony Olmos and Environmental Programs Manager Coffee responded to City Council questions. Mayor Powell opened the floor to public comment. Lisa Santora, Beach Cities Health District, wanted to commend the City for being at the forefront for creating a healthy community and also requested that the City explore tobacco retail licensing. John Schmidtt, resident and cancer survivor, commended the City Council for the Smoke-Free Ordinance and encouraged the City to adopt a multi-unit ordinance. Bill Victor suggested labeling ashtrays in Spanish as well as English, that the no-smoking law should be posted along with construction regulations and asked if any tickets had been given relating to the No-Smoking Ordinance. Esther Schiller, Director of Smoke-Free Air for Everyone, distributed and read a letter to City Council regarding no smoking in multi-unit housing. Kelly Stroman, Executive Director for Downtown Business Association, encourages more signs for travelers to show Manhattan Beach is Smoke-Free.. Sara Hunter, Manhattan Village Multi-Unit resident, stated that she has problems with smoke from a neighbor and would like to see the issue addressed. Primo Castro, Director of Governmental Relations at American Cancer Society Action Network, also encouraged Smoke-Free in multi-unit housing because of the exposure to other neighbors in surrounding units. Diane Wallace, President of Manhattan Village Home Owners Association, thanked the City Council for taking on this important issue and reported on numerous complaints from the Manhattan Village Complex. Seeing no further requests to speak, Mayor Powell closed the floor to public comment. Discussion continued among City Councilmembers and questions were responded to by Environmental Programs Manager Coffee. A motion was made by Mayor Pro Tem Burton, seconded by Mayor Powell, with the stated goal of making Manhattan Beach the healthiest City for residents and to raise a family: 1) Direct the City Manager and City Attorney to prepare an amendment to the ordinance banning smoking in multi-unit and senior housing, returning with several definitions of multi-unit housing. 2) Prepare a tobacco sales licensing ordinance. 3) Direct Staff to post more "Breathe Free Manhattan Beach" signs throughout the City and Universal Signage banning smoking in the downtown area.The motion carried by the following vote: Aye: 5- Powell, Burton, D'Errico, Lesser and Howorth City of Manhattan Beach Page 6 City Council Meeting Minutes - Final January 20, 2015 City Attorney Barrow clarified that with respect to sales, there would be regulation options and that the City Council direction to draft an amendment prohibiting smoking in all parts of multi-unit development including individual units. 12. Mayor Powell introduced Finance Director Bruce Moe who acknowledged his staff for all of their hard work and then presented a PowerPoint Presentation on the Comprehensive Annual Financial Report (CAFR) which is the audited financial results for the Fiscal Year ending June 30, 2014. Finance Director Moe introduced Audit Partner, Richard Kikuchi from Lance, Soll and Lunghard (CPAs) who spoke about the audit performed on the City's Finances. Audit Partner Kikuchi responded to City Council questions. Mayor Powell opened the floor to public comment. Bill Victor stated that it might be helpful to compare the budget to the previous year, also had questions about the "Contract and Professional" item and inquired about whether "Litigation" is in the CAFR. Seeing no further requests to speak, Mayor Powell closed the floor to public comment. OTHER COUNCIL BUSINESS, COMMITTEE AND TRAVEL REPORTS, FUTURE DISCUSSION ITEMS Mayor Pro Tem Burton asked for clarification on the Manhattan Beach Education Foundation and if it needs to be agendized to see if City Council supports an endowment plaza. Mayor Powell said that Staff needs to query the County to see if this would be allowed. City Manager Danaj stated that Staff could come back with an estimate of the work load and an analysis. Mayor Pro Tem Burton then requested that this matter be agendized as soon as possible. Councilmember Lesser stated that he and Mayor Powell are on the Library Subcommittee and there are a lot of issues. It may take staff some time to confirm what these issues are with the County. He is in favor of bringing it back, but wants to make sure that Staff has time to research and possibly get input from the Library Commission. Mayor Pro Tem Burton wanted to direct the issue to Staff because of the urgency. Councilmember Lesser asked how much time does staff need? City Manager Danaj responded that by next meeting he can bring back the work load assessment. Mayor Pro Tem Burton commented that the February 3, 2015 ULI discussion had been removed from the agenda forecast, to keep the momentum going, he suggested that a presentation or summary could be given at the next City Council Meeting. Assistant City Manager Nader reported that an informational memo is being developed to be released to the community and that could be brought to Council. Mayor Powell asked if Staff wanted to wait until the final recommendations are published. City Manager Danaj responded that he thought what was being asked for was a summary of Fridays ULI presentation. Councilmember Lesser wanted to clarify what is coming next for the benefit of the community. Assistant City Manager Nader replied that there will be a study session sometime in March. Councilmember D’Errico suggested that it be a 10 minute presentation under City Manager Report at the next City Council Meeting. Councilmember Howorth suggested it include a timeline. Mayor Powell requested the status of the LAX letter and a timeline. City Manager Danaj said it is still in progress and may be ready by the end of this week . Mayor Powell spoke of the nuisance ordinance and using it to clean up the corner of Sepulveda and Manhattan Beach Blvd. (Rite Aid). Councilmember Lesser requested a status update from Rite Aid. City Manager Danaj responded that he and the Community Development Director will get a status update from the property owners. R.
