PROCEEDINGS OF THE MANISTEE CITY COUNCIL – SEPTEMBER 21, 2021 A regular meeting of the Manistee City Council was called to order by her honor, Mayor Lynda Beaton on Tuesday, September 21, 2021, at 7:00 p.m. in the City Hall Council Chambers, 70 Maple Street, followed by the Pledge of Allegiance. PRESENT: Lynda Beaton, Jermaine Sullivan, Michael Szymanski, James Grabowski, and Erin Martin Pontiac ABSENT: David Bachman and Cindy Lundberg ALSO PRESENT: City Manager – Bill Gambill, City Attorney – George Saylor, City Clerk – Heather Pefley, DPW Director – Jeff Mikula, Planning and Zoning Administrator – Zachary Sompels, Police Chief – Josh Glass, and City Engineer – Shawn Middleton CITIZEN COMMENTS ON AGENDA RELATED ITEMS None CONSENT AGENDA • Minutes September 7, 2021 Regular Meeting September 14, 2021 Work Session • Financial Reports Payroll August 2021 Invoices August 2021 • Notification Regarding Next Work Session – October 12, 2021, 7:00 p.m. at City Hall in Council Chambers. A discussion will be conducted on rental and building inspections with SAFEbuilt; and such business as may come before Council. • Consideration of Manistee High School Homecoming Parade. A request has been received to hold the Manistee High School Homecoming Parade on Friday, October 1, 2021, beginning at 4:30 p.m. The parade would assemble in the former Eagles parking lot and parade down River Street to the City Marina fountain area. MOTION by Martin Pontiac, second by Grabowski to approve the Consent Agenda as presented. With a roll call vote this motion passed unanimously. AYES: Beaton, Sullivan, Szymanski, Grabowski, and Martin Pontiac NAYS: None CONSIDERATION OF APPROVING A CONTRACT AWARD FOR THE MARINA DOCK REPLACEMENT – PHASE 2. A Michigan Department of Natural Resources Waterways Grant has been received and proceeds from the Capital Improvement Bond have been allocated to replace five docks at the City Municipal Marina. Great Lakes Dock and Materials, LLC $425,775.00 Fisher Contracting Company $467,525.00 The low bid is within the budgeted amounts for the total project. The City Attorney has reviewed and approved the contract documents. MOTION by Szymanski, second by Grabowski to approve a contract with Great Lakes Dock and Materials, LLC in the amount of $425,775.00 and authorize the Mayor and City Clerk to execute the documents. With a roll call vote this motion passed unanimously. AYES: Beaton, Sullivan, Szymanski, Grabowski, and Martin Pontiac NAYS: None CONSIDERATION OF A COMMERCIAL RIVERFRONT LEASE AGREEMENT WITH LITTLE RIVER HOLDINGS, LLC. The City of Manistee has property along the Manistee River Channel that they lease to adjacent property owners for personal boat slips and marinas. The property owned by Little River Holdings, LLC, 480 Water Street, is included in this section. The current recorded lease was executed with the previous owners of the property in the amount of $1.00 per year based upon the easement granted to the City over adjoining property. The lease agreement was entered into on December 5, 2017, with an ending date of December 31, 2022. Attached is a new Commercial Riverfront Lease Agreement between the City of Manistee and Little River Holdings, LLC for 480 Water Street, in the amount of $1.00, with an ending date of December 31, 2022, as prepared by the City Attorney. MOTION by Szymanski, second by Grabowski to approve the Commercial Riverfront Lease Agreement with Little River Holdings, LLC and authorize the Mayor and City Clerk to execute the agreement. With a roll call vote this motion passed unanimously. AYES: Beaton, Sullivan, Szymanski, Grabowski, and Martin Pontiac NAYS: None CONSIDERATION OF PARCEL SPLIT AT 159 QUINCY STREET. A request has been received from Mr. Barwise, owner of 159 Quincy Street (51-51-146-713-04), to split his parcel with a garage on it. It is his intent to sell the land and garage to his neighbor, Mr. Runyan, at 149 Quincy Street. Mr. Runyan has already submitted a parcel combination form in preparation of this land division. The parcels meet Zoning requirements, and the City Assessor has confirmed that the split is legal and allowable. The City of Manistee Planning Commission must give their recommendation to City Council for the parcel split request to continue. Mr. John Helge reported on the activities of the Tree Commission and responded to any questions the Council had regarding their activities. CITIZEN COMMENT None OFFICIALS AND STAFF Gambill provided an update on several items including lake levels reported by the Army Corp of Engineers, Parks and Recreation Master Plan, and MMS/MHS traffic safety. COUNCILMEMBERS Sullivan asked about school crossing guards and commented on a recent article in the Manistee News Advocate regarding a local business. Martin Pontiac offered appreciation for the demolition of blighted homes completed recently. Grabowski stated he was happy with the turnout for the recent Manistee County Regional Summit and inquired about miscellaneous street conditions. Szymanski asked for an update on the Riverwalk construction project. Beaton expressed gratitude to those in attendance of the meeting and expressed she was very happy with the recent Hops and Props event.
