PROCEEDINGS OF THE MANISTEE CITY COUNCIL – OCTOBER 5, 2021 A regular meeting of the Manistee City Council was called to order by her honor, Mayor Lynda Beaton on Tuesday, October 5, 2021, at 7:00 p.m. in the City Hall Council Chambers, 70 Maple Street, followed by the Pledge of Allegiance. PRESENT: Lynda Beaton, Cindy Lundberg, Jermaine Sullivan, Michael Szymanski, James Grabowski, and Erin Martin Pontiac ABSENT: David Bachman ALSO PRESENT: City Manager – Bill Gambill, City Attorney – George Saylor, City Clerk – Heather Pefley, DPW Director – Jeff Mikula, Police Chief – Josh Glass, Fire Chief – Mark Cameron, and City Engineer – Shawn Middleton CITIZEN COMMENTS ON AGENDA RELATED ITEMS None CONSENT AGENDA • Minutes September 21, 2021 Regular Meeting • Financial Reports Cash Balances August 2021 Revenue & Expenses August 2021 • Notification Regarding Next Work Session – October 12, 2021, 7:00 p.m. at City Hall in Council Chambers. A discussion will be conducted on rental and building inspections with SAFEbuilt; and such business as may come before Council. • Consideration of scheduling a public hearing for the Countywide Parks and Recreation Master Plan on Tuesday, November 16, 2021, at 7:00 p.m. Networks Northwest has been working with local governments in Manistee County to update the five-year recreational master plans. This cohesive planning effort helps to ensure that the County continues to be a quality place for people to live, visit, work and play. The State of Michigan DNR requires that municipalities have a current 5-year recreation plan to be eligible for various funding opportunities. A thirty-day public review, which will conclude at the end of October, followed by a public hearing to gather community input, are requirements of the process to approve a new 5-year parks and recreation master plan. • Consideration of the 32nd Annual Victorian Sleighbell Parade and Old Christmas Weekend. The Manistee Downtown Development Authority requests authorization to conduct the 32nd Annual Victorian Sleighbell Parade and Old Christmas Weekend from Thursday, December 2 through Sunday, December 5, 2021; with activities focused in the downtown | Page 1 PROCEEDINGS OF THE MANISTEE CITY COUNCIL – OCTOBER 5, 2021 area. The event will include closing several streets in the City to accommodate the parade and other activities. Please see the attached list for requested assistance and timetables. MOTION by Grabowski, second by Szymanski to approve the Consent Agenda as presented. With a roll call vote this motion passed unanimously. AYES: Beaton, Lundberg, Sullivan, Szymanski, Grabowski, and Martin Pontiac NAYS: None CONSIDERATION OF APPROVING THE PURCHASE OF A CRANE TRUCK. The sewage department operates a crane truck which is utilized for lifting pumps, valves and other heavy equipment. The current truck #130 is a 2000 GMC K3500 and is scheduled for replacement. A quote was solicited from Gorno Ford through their MiDeals contract #071B7700181 for a cab and chassis, service body and crane. The cab and chassis and service body will be paid from the Motor Pool Fund and the crane will be paid for out of the sewer operating budget. MOTION by Szymanski, second by Grabowski to approve the purchase of a 2022 Ford F450, CM- CB 9-foot service body and EC-3200 Stellar crane in the amount of $82,543.00 from Gorno Ford. With a roll call vote this motion passed unanimously. AYES: Beaton, Lundberg, Sullivan, Szymanski, Grabowski, and Martin Pontiac NAYS: None CONSIDERATION OF APPROVING A GRANT APPLICATION OF THE MANISTEE FAMILY DISC GOLF COURSE. The Parks Commission and Department of Public Works have been working to develop a family disc golf course at First Street Beach/Douglas Park. The City has been approved by the Manistee Community Foundation to submit a grant request to the Minger Fund. The total project has been budgeted at $60,115, with $34,565 of in-kind services, $3,050 cash match, and $22,500 in grant proceeds. The in-kind services will be provided by the DPW and volunteers to construct the park and install the equipment. The cash match would be provided from the Parks Department Operating Funds. MOTION by Grabowski, second by Martin Pontiac to approve a grant application to the Minger Fund in the amount of $22,500 and agree to a minimum of $3,050 in cash match. AYES: Beaton, Lundberg, Sullivan, Szymanski, Grabowski, and Martin Pontiac | Page 2 PROCEEDINGS OF THE MANISTEE CITY COUNCIL – OCTOBER 5, 2021 NAYS: None CONSIDERATION OF UPDATING RECORDS WITH THE UNITED STATES ARMY DONATIONS PROGRAM OFFICE FOR THE CIVIL WAR CANNON ON DISPLAY IN VETERANS MEMORIAL PARK. The United States Army Donations Program Office is requiring updated information to be completed, signed, notarized, and retuned in order to retain the Civil War cannon on display in Veterans Memorial Park. MOTION by Szymanski, second by Grabowski to authorize the Mayor and City Clerk to execute the required documents. With a roll call vote this motion passed unanimously. AYES: Beaton, Lundberg, Sullivan, Szymanski, Grabowski, and Martin Pontiac NAYS: None CONSIDERATION OF APPROVAL OF MUTUAL AID AGREEMENT WITH CLARE COUNTY. The Manistee City Police Department, in partnership with the Sleighbell committee, requests assistance from the Clare County Mounted Division. Clare County will assist with police presence and crowd control on Saturday, December 4, 2021, during and after the Manistee Victorian Sleighbell parade. The City Attorney has reviewed and approved the agreement. MOTION by Szymanski, second by Grabowski to approve the Clare County Mutual Aid Agreement. With a roll call vote this motion passed unanimously. AYES: Beaton, Lundberg, Sullivan, Szymanski, Grabowski, and Martin Pontiac NAYS: None CONSIDERATION OF APPLICATIONS TO BOARDS AND COMMISSIONS. The City Clerk has taken action to advertise vacancies on the Compensation Commission, Downtown Development Authority, Harbor Commission, Historic District Commission, Parks Commission, PEG Commission, Planning Commission, and Tree Commission. Mayoral and Manager appointments require a motion, second and Council voted support. The following applications have been received: *Incumbent DOWNTOWN DEVELOPMENT AUTHORITY. One vacancy for an Interest Member, unexpired term ending 06/30/24. City Manager appointment. | Page 3 PROCEEDINGS OF THE MANISTEE CITY COUNCIL – OCTOBER 5, 2021 Deanna Marsh – 378 River Street City Manager Bill Gambill appointed Deanna Marsh, 378 River Street to the Downtown Development Authority as an interest member for the unexpired term ending 6/30/24. MOTION by Martin Pontiac, second by Sullivan to support the City Manager’s appointment of Deanna Marsh, 378 River Street to the Downtown Development Authority as an interest member for the unexpired term ending 6/30/24. With a roll call vote this motion passed unanimously. AYES: Beaton, Lundberg, Sullivan, Szymanski, Grabowski, and Martin Pontiac NAYS: None HARBOR COMMISSION. Three vacancies, three terms ending 10/31/2024 (two terms starting 10/31/2021); Two members can be nonresidents but must own real estate, a business, or profession having a licensed business location in the City. Council appointment. *Tom Swedenborg – 562 First Street *Tracey Lindeman – 308 River Street Grabowski nominated Tom Swedenborg , 562 First Street to the Harbor Commission for the term ending 10/31/2024. With a roll call vote this nomination passed unanimously. AYES: Beaton, Lundberg, Sullivan, Szymanski, Grabowski, and Martin Pontiac NAYS: None Szymanski nominated Tracey Lindeman, 308 River Street to the Harbor Commission for the term ending 10/31/2024. With a roll call vote this nomination passed unanimously. AYES: Beaton, Lundberg, Sullivan, Szymanski, Grabowski, and Martin Pontiac NAYS: None PLANNING COMMISSION. One vacancy, term ending 10/31/24 (term begins 10/31/21); applicants must be City residents. MOTION by Szymanski, second by Grabowski to support the Mayor’s appointment of Shelly Memberto, 347 Second Street to the Planning Commission for the term ending 10/31/24. With a roll call vote this motion passed unanimously. AYES: Beaton, Lundberg, Sullivan, Szymanski, Grabowski, and Martin Pontiac NAYS: None REPORT FROM THE CITY OF MANISTEE PARKS COMMISSION. Mr. Tim O’Connor reported on the activities of Parks Commission and responded to any questions the Council had regarding their activities. CITIZEN COMMENT Liz Laskey, 537 4th Street - commented on the billing/due date for water utility bills and the penalty assessed for late payments. OFFICIALS AND STAFF Gambill updated Council on a recent meeting with MAPS Superintendent Ron Stoneman and purchase offers received for the Monroe Street lot. Mikula gave an update on the RD Phase 1A project and gave notice that work will resume on US31 with center lane closures. COUNCILMEMBERS Sullivan asked if there was an update on the ARP funds and wondered how the City advertises Boards & Commission vacancies. Szymanski commended the Parks Commission for their presentation and commented on the suggested automated reservation system. Beaton asked the City Manager to follow up on the inquiry on the water billing process. CONSIDERATION OF A CLOSED SESSION, UNION CONTRACT NEGOTIATIONS. City Manager William Gambill has requested a Closed Session this evening as permitted by the Michigan Open Meetings Act, Section 8 (c) to discuss contract negotiations with the Police Officers Association of Michigan. | Page 5 PROCEEDINGS OF THE MANISTEE CITY COUNCIL – OCTOBER 5, 2021 MOTION by Grabowski, second by Martin Pontiac action to proceed to Closed Session under Section 8 (c) of the Michigan Open Meetings Act.
