PROCEEDINGS OF THE MANISTEE CITY COUNCIL – OCTOBER 19, 2021 A regular meeting of the Manistee City Council was called to order by her honor, Mayor Lynda Beaton on Tuesday, October 19, 2021, at 7:00 p.m. in the City Hall Council Chambers, 70 Maple Street, followed by the Pledge of Allegiance. PRESENT: David Bachman, Lynda Beaton, Cindy Lundberg, Jermaine Sullivan, Michael Szymanski, James Grabowski, and Erin Martin Pontiac ABSENT: None ALSO PRESENT: City Manager – Bill Gambill, City Attorney – George Saylor, City Clerk – Heather Pefley, DPW Director – Jeff Mikula, Finance Director – Ed Bradford, Planning & Zoning Administrator – Zachary Sompels, Police Chief – Josh Glass, and City Engineer – Shawn Middleton CITIZEN COMMENTS ON AGENDA RELATED ITEMS None CONSENT AGENDA • Minutes October 5, 2021 Regular Meeting & Closed Session October 12, 2021 Work Session • Financial Reports Payroll September 2021 Invoice September 2021 • Notification Regarding Next Work Session – October 26, 2021, 7:00 p.m. at City Hall in Council Chambers. A discussion will be conducted on the Commercial Rehabilitation Act – Hampton Inn, City parks reservation system; and such business as may come before Council. MOTION by Szymanski, second by Grabowski to approve the Consent Agenda as presented. With a roll call vote this motion passed unanimously. AYES: Bachman, Beaton, Lundberg, Sullivan, Szymanski, Grabowski, and Martin Pontiac NAYS: None CONSIDERATION OF ENTERING INTO A PROFESSIONAL SERVICES AGREEMENT WITH FISHBECK TO PROVIDE THIRD PARTY ADMINISTRATION AND OVERSIGHT OF THE EGLE GRANT AND LOAN RECEIVED BY THE CITY FOR THE GATEWAY SITE. The City received a $700,000 grant and $800,000 loan for demolition and remediation of the Gateway project site. The grant/loan program anticipates and requires third party administration and oversight. The City does not have this expertise and needs to engage an environmental consulting firm to provide these services. MOTION by Bachman, second by Szymanski to enter into a professional service agreement with Fishbeck | Page 1  PROCEEDINGS OF THE MANISTEE CITY COUNCIL – OCTOBER 19, 2021 to provide third party administration and oversight of the EGLE grant and loan received by the City for the Gateway site, and further authorize the Mayor to sign the agreement. With a roll call vote this motion passed unanimously. AYES: Bachman, Beaton, Lundberg, Sullivan, Szymanski, Grabowski, and Martin Pontiac NAYS: None CONSIDERATION OF THE SALE OF CITY-OWNED PARCEL, LOT #2 MONROE STREET. The City has received two offers for Lot #2 Monroe Street, which has been listed for sale since March 2018. • Re/Max Bayshore offer: $90,000 – mortgage, to close by 11/15/21 • Coldwell Banker Professionals ALM offer: $86,000 – cash, to close by 10/29/21 MOTION by Szymanski, second by Sullivan to accept the offer of $90,000 and authorize the Mayor and Clerk to sign the Purchase Agreement and all closing related documents. Mayor Beaton notified Council that the second offer of $86,000 had been rescinded. With a roll call vote this motion passed unanimously. AYES: Bachman, Beaton, Lundberg, Sullivan, Szymanski, Grabowski, and Martin Pontiac NAYS: None CONSIDERATION OF A PARCEL SPLIT AT 480 RIVER STREET. The City of Manistee would like to split their parcel at 480 River Street (51-51-349-702-06) so they can sell a portion to Ted Fricano’s business. The parcels meet Zoning requirements, and the City Assessor has confirmed that the split is legal and allowable. The City of Manistee Planning Commission gave their recommendation to City Council for the parcel split request to continue. MOTION by Sullivan, second by Bachman to approve the parcel split at 480 River Street. With a roll call vote this motion passed unanimously. AYES: Bachman, Beaton, Lundberg, Sullivan, Szymanski, Grabowski, and Martin Pontiac NAYS: None CONSIDERATION OF PROPOSED ZONING ORDINANCE AMENDMENT Z21-18. The Planning Commission has approved for recommendation a text amendment to define "Lot Coverage" as "that portion of a lot that is covered with buildings, structures, patios, and anything paved, excluding driveways, expressed as a ratio of the horizontal area measured from the exterior surface of the exterior walls of the ground floor of all principal and accessory buildings on a lot to the total area.” As an ordinance two separate readings are required. If this ordinance is introduced at this time, Council could adopt it at the next regular meeting. | Page 2  PROCEEDINGS OF THE MANISTEE CITY COUNCIL – OCTOBER 19, 2021 MOTION by Szymanski, second by Martin Pontiac to introduce Zoning Ordinance Amendment Z21-18. AYES: Bachman, Beaton, Lundberg, Sullivan, Szymanski, Grabowski, and Martin Pontiac NAYS: None A REPORT FROM RAMSDELL REGINAL CENTER FOR THE ARTS. Mr. Xavier Verna reported on the activities of the Ramsdell Reginal Center for the Arts and responded to any questions the Council had regarding their activities. CITIZEN COMMENT None OFFICIALS AND STAFF Gambill gave an update on transitioning to a new building inspector with SAFEBuilt and a request from Manistee County for a letter of support to extend the Joslin Cove Brownfield. COUNCILMEMBERS Bachman offered his respect to American combat Marine, Duane E. Dewey who recently passed away. Martin Pontiac would like to see the City establish a memorial for Jessica Scharp. Grabowski asked for an update on sidewalk repairs. Szymanski inquired on the timeframe for the US-31 lane closures. Beaton mentioned Halloween activities are beginning and encouraged all to get out to see the decorations residents have displayed.
