PROCEEDINGS OF THE MANISTEE CITY COUNCIL – NOVEMBER 3, 2021 A regular meeting of the Manistee City Council was called to order by her honor, Mayor Lynda Beaton on Wednesday, November 3, 2021, at 7:00 p.m. in the City Hall Council Chambers, 70 Maple Street, followed by the Pledge of Allegiance. PRESENT: David Bachman, Lynda Beaton, Cindy Lundberg, Jermaine Sullivan, Michael Szymanski, James Grabowski, and Erin Martin Pontiac ABSENT: None ALSO PRESENT: City Manager – Bill Gambill, City Attorney – George Saylor, City Clerk – Heather Pefley, DPW Director – Jeff Mikula, Finance Director – Ed Bradford, Planning & Zoning Administrator – Zachary Sompels, Police Chief – Josh Glass, Fire Chief – Mark Cameron, and City Engineer – Shawn Middleton CITIZEN COMMENTS ON AGENDA RELATED ITEMS None CONSENT AGENDA • Minutes October 19, 2021 Regular Meeting October 26, 2021 Work Session • Financial Reports Cash Balances September 2021 Revenue & Expenses September 2021 Quarterly Financial Update Quarterly Investment Update • Consideration of Proposed Zoning Ordinance Amendment Z21-18 • Notification Regarding Next Work Session – November 23, 2021, 7:00 p.m. at City Hall in Council Chambers. A discussion will be conducted on the sign ordinance and SAFEbuilt; and such business as may come before Council. • Consideration of scheduling a public hearing for establishing a Commercial Rehabilitation District, Tuesday, November 16, 2021, at 7:00 p.m. MOTION by Grabowski, second by Szymanski to approve the Consent Agenda as presented. With a roll call vote this motion passed unanimously. | Page 1 PROCEEDINGS OF THE MANISTEE CITY COUNCIL – NOVEMBER 3, 2021 AYES: Bachman, Beaton, Lundberg, Sullivan, Szymanski, Grabowski, and Martin Pontiac NAYS: None CONSIDERATION OF COLLECTIVE BARGAINING AGREEMENT WITH THE POLICE OFFICERS ASSOCIATION OF MICHIGAN. A tentative agreement for a new three-year Police Officers Association of Michigan contract was reached. The Manistee Police Officers, represented by the Police Officers Association of Michigan, ratified the tentative agreement. MOTION by Bachman, second by Sullivan to approve a three-year collective bargaining agreement with the Police Officers Association of Michigan; and authorize the Mayor and City Manager to execute the agreement and make the wage and step increases retroactive to July 1, 2021. With a roll call vote this motion passed unanimously. AYES: Bachman, Beaton, Lundberg, Sullivan, Szymanski, Grabowski, and Martin Pontiac NAYS: None CONSIDERATION OF ENTERING INTO A CLINICAL AGREEMENT WITH MUNSON MEDICAL CENTER - REGIONAL EMS EDUCATION. The Manistee Fire Department would collaborate with Munson Medical Center- Regional EMS Education to provide a clinical site for students to obtain required assessment time on an ambulance. This agreement would allow students in the Paramedic Program to assess points under the supervision of a City Fire Paramedic to meet program required benchmarks in order to obtain State and National Licensing. MOTION by Szymanski, second by Grabowski to authorize the City of Manistee Fire Department entering into a clinical agreement with Munson Medical Center - Regional EMS Education. With a roll call vote this motion passed unanimously. AYES: Bachman, Beaton, Lundberg, Sullivan, Szymanski, Grabowski, and Martin Pontiac NAYS: None CONSIDERATION OF A TEMPORARY ACTIVITY PERMIT FOR THE NORTH CHANNEL BREWERY. North Channel Brewery is requesting a temporary activity permit to allow for additional outdoor seating capacity on City sidewalks. Temporary activity permits must be approved via City Council. This permit would allow for them to continue operations and provide safe, distanced, outdoor dining experience. The North Channel Brewery is requesting the temporary activity permit from Nov. 1, 2021-April 30, 2022, at which point they would be allowed to operate under GP-47 | Page 2 PROCEEDINGS OF THE MANISTEE CITY COUNCIL – NOVEMBER 3, 2021 Commercial Uses Within the City Right-of-Way permit. Temporary activity permits are allowable via the zoning ordinance Section 522 and Section 507. MOTION by Grabowski, second by Sullivan to approve the temporary activity permit for the North Channel Brewery with the recommended stipulations from the DDA and City Planning Department. With a roll call vote this motion passed unanimously. AYES: Bachman, Beaton, Lundberg, Sullivan, Szymanski, Grabowski, and Martin Pontiac NAYS: None A REPORT FROM PLANNING AND ZONING DEPARTMENT AND THE PLANNING COMMISSION. Mr. Zachary Sompels and Mr. Mark Wittlieff reported on the activities of the Planning and Zoning Department and the Planning Commission and responded to any questions the Council had regarding their activities. PRESENTATION OF A RESOLUTION OF THANKS AND APPRECIATION IN HONOR OF DUANE EDGAR DEWEY. Mayor-Pro Tem Mick Szymanski presented a resolution of thanks and appreciation in honor of Duane Edgar Dewey. CITIZEN COMMENT None OFFICIALS AND STAFF Gambill provided an update to Council on progress with Fricano’s, traffic study report, and lead and copper testing results. Pefley stated the election was certified by the County Board of Commissioners. Mikula gave an update and timeline for the Washington Street closure. Glass reported Halloween was a safe event and gave an update on housing demolition. COUNCILMEMBERS Martin Pontiac thanked Mikula for providing her a tour of the sewer expansion project; stated it was good to see kids out trick or treating. | Page 3 PROCEEDINGS OF THE MANISTEE CITY COUNCIL – NOVEMBER 3, 2021 Grabowski thanked everyone for voting in Tuesday’s election. Beaton offered appreciation to everyone for another successful election, congratulated the re- elected councilmembers, and thanked staff for their efforts.
