PROCEEDINGS OF THE MANISTEE CITY COUNCIL – NOVEMBER 16, 2021 A regular meeting of the Manistee City Council was called to order by her honor, Mayor Lynda Beaton on Tuesday, November 16, 2021, at 7:00 p.m. in the City Hall Council Chambers, 70 Maple Street, followed by the Pledge of Allegiance. PRESENT: David Bachman, Lynda Beaton, Cindy Lundberg, Jermaine Sullivan, Michael Szymanski, James Grabowski, and Erin Martin Pontiac ABSENT: None ALSO PRESENT: City Manager – Bill Gambill, City Attorney – George Saylor, City Clerk – Heather Pefley, Planning & Zoning Director – Mike Szokola, Planner – Zachary Sompels, Police Chief – Josh Glass, and City Engineer – Shawn Middleton AMEND AGENDA MOTION by Sullivan, second by Lundberg to amend the agenda to add item VIII. New Business a.) Economic Development Council Update. With a roll call vote this motion passed unanimously. AYES: Bachman, Beaton, Lundberg, Sullivan, Szymanski, Grabowski, and Martin Pontiac NAYS: None PUBLIC HEARING FOR THE COUNTYWIDE PARKS AND RECREATION MASTER PLAN. Networks Northwest has been working with local governments in Manistee County to update the five-year recreational master plans. This cohesive planning effort helps to ensure that the County continues to be a quality place for people to live, visit, work and play. The State of Michigan DNR requires that municipalities have a current 5-year recreation plan to be eligible for various funding opportunities. A thirty-day public review, which concluded at the end of October, followed by this public hearing to gather community input, are requirements of the process to approve a new 5-year parks and recreation master plan. Tom O’Connor, 330 Fourth Avenue – Parks Commission Chair / would like to see additional language added to the community description of the master plan to include that the Little River Band of Ottawa Indians were the original inhabitants of these great lands. Public hearing ended 7:05 p.m. PUBLIC HEARING FOR ESTABLISHING A COMMERCIAL REHABILITATION DISTRICT. Section 207.843 of the Michigan Commercial Rehabilitation Act (Act 210 of 2005) states that a public hearing must be held prior to adopting a resolution establishing a commercial rehabilitation district. The proposed district would be a 3-acre site to include the Lakeshore Motel | Page 1  PROCEEDINGS OF THE MANISTEE CITY COUNCIL – NOVEMBER 16, 2021 property as well as retention area to the south. Thomas Dame, Manistee / spoke against the proposed commercial rehabilitation district. A discussion will be conducted on the sign ordinance and SAFEbuilt; and such business as may come before Council. MOTION by Szymanski, second by Grabowski to approve the Consent Agenda as presented. With a roll call vote this motion passed unanimously. AYES: Bachman, Beaton, Lundberg, Sullivan, Szymanski, Grabowski, and Martin Pontiac NAYS: None ECONOMIC DEVELOPMENT COUNCIL UPDATE Dennis P. McCarthy - Blarney Castle Oil & Propane, Jeff Dontz - Manistee County Commissioner District 5, and Stacie Bytwork - Manistee Area Chamber of Commerce CEO spoke on behalf of the Economic Development Council. Mr. McCarthy acknowledged the partnership between the City and various entities within the County. He thanked the City Council for their support and for everything they have done to aid economic development in the City and County. Mr. McCarthy explained the unique partnership model in Manistee between government, local business, and private enterprise. Mr. Dontz spoke on the successful cooperation between the City and various entities within the County. | Page 2  PROCEEDINGS OF THE MANISTEE CITY COUNCIL – NOVEMBER 16, 2021 Ms. Bytwork stressed the importance of the City’s partnerships within the community and the significance of the decisions being made by Council. She stated the State of Michigan is watching the decisions being made by our local government to determine the future direction of our community. CONSIDERATION OF A RESOLUTION TO APPROVE THE 2022-2026 MANISTEE COUNTY-WIDE PARK AND RECREATION MASTER PLAN. Networks Northwest has been working with local governments in Manistee County to update our five-year recreational master plans; the sections that are specific to City of Manistee include pages A-42 through A-46 of Appendix A and F-26 through F-29 of Appendix F. The State of Michigan DNR requires that municipalities have a current 5-year recreation plan to be eligible for various funding opportunities. MOTION by Martin Pontiac, second by Bachman to adopt the City of Manistee Park and Recreation Master Plan Resolution. MOTION by Szymanski, second by Sullivan to AMEND the original motion to add “The ancestors of the Little River Band of Ottawa Indians were the original inhabitants of these great lands” to the Community Description of the Master Plan. With a roll call vote this motion to AMEND the previous motion passed unanimously. AYES: Bachman, Beaton, Lundberg, Sullivan, Szymanski, Grabowski, and Martin Pontiac NAYS: None Roll call vote was then taken on the original amended motion. Motion passed unanimously. AYES: Bachman, Beaton, Lundberg, Sullivan, Szymanski, Grabowski, and Martin Pontiac NAYS: None CONSIDERATION OF A RESOLUTION ESTABLISHING A COMMERCIAL REHABILITATION DISTRICT. Pursuant to PA 210 of 2005, the City of Manistee has the authority to establish “Commercial Rehabilitation Districts” within the City of Manistee at request of a commercial business enterprise. Hotel Ventures Manistee, LLC has filed a written request with the clerk of the City of Manistee requesting the establishment of the Commercial Rehabilitation District for an area in the vicinity of 101 Lakeshore Drive located in the City of Manistee. MOTION by Grabowski, second by Szymanski to adopt the resolution establishing a Commercial Rehabilitation District. With a roll call vote this motion passed unanimously. | Page 3  PROCEEDINGS OF THE MANISTEE CITY COUNCIL – NOVEMBER 16, 2021 AYES: Bachman, Beaton, Lundberg, Sullivan, Szymanski, Grabowski, and Martin Pontiac NAYS: None CONSIDERATION OF AUTHORIZATION OF THE PURCHASE OF (14) SELF CONTAINED BREATHING APPARATUS FOR THE MANISTEE FIRE DEPARTMENT. The City of Manistee Fire Department pursued a FEMA grant for the purchase of (14) Self Contained Breathing Apparatus to replace the current outdated air packs to the current standard. The department was successful in its application and was awarded the FEMA grant in the amount of $93,330.00. Phoenix Safety Outfitters provided the low bid for the updated (14) Self Contained Breathing Apparatus. City Manager Bill Gambill asked that Council postpone this item. MOTION by Sullivan, second by Martin Pontiac to postpone this item to a future meeting. With a roll call vote this motion passed unanimously. AYES: Bachman, Beaton, Lundberg, Sullivan, Szymanski, Grabowski, and Martin Pontiac NAYS: None CONSIDERATION OF ORDINANCE 21-19 TO AMEND CHAPTER 863, FOOD VENDORS, OF THE CITY OF MANISTEE, MICHIGAN CODIFIED ORDINANCES. The Downtown Development Authority requested an amendment to the Chapter 863 Food Vendor Ordinance to allow for short term food truck opportunities in the downtown district. As an ordinance two separate readings are required. If this ordinance is introduced at this time, it could be adopted at the next regular meeting. MOTION by Grabowski, second by Szymanski to introduce Ordinance 21-19 amending Chapter 863 Food Vendors. With a roll call vote this motion passed unanimously. AYES: Bachman, Beaton, Lundberg, Sullivan, Szymanski, Grabowski, and Martin Pontiac NAYS: None A REPORT FROM THE PEG COMMISSION AND ECONOMIC DEVELOPMENT. Mr. Barry Lind reported on the activities of PEG Commission and responded to any questions the Council had regarding their activities. | Page 4  PROCEEDINGS OF THE MANISTEE CITY COUNCIL – NOVEMBER 16, 2021 Mr. Marc Miller gave the quarterly Economic Development report and responded to any questions the Council had regarding activities. CITIZEN COMMENT None OFFICIALS AND STAFF Gambill stated water filters are available for qualified residents and listed requirements; also said water testing kits are available at cost to residents and asked that results be shared with the water department. Middleton gave an update on the Riverbank and Jackson/VanBuren projects that are nearing completion. Sompels provided follow up from a previous work session discussion on the Planning Commission review of the ordinance referencing boats and RVs. Szokola updated Council on the RRC program and stated the City was recertified last year and the certification is through 2025. COUNCILMEMBERS Lundberg asked for additional information on the lead and copper testing that was performed in the city. Grabowski questioned the cost the City pays for streetlights and stated there are several lights out in the City. He asked Chief Glass to have officers make a list of lights they notice are out in the city. Szymanski inquired on last call for leaf pick up and asked that notice be given to residents. Beaton asked if the public restrooms are all being locked at night; thanked everyone for coming to the meeting.
