PROCEEDINGS OF THE MANISTEE CITY COUNCIL – FEBRUARY 15, 2022 A regular meeting of the Manistee City Council was called to order by her honor, Mayor Lynda Beaton on Tuesday, February 15, 2022, at 7:00 p.m. in the City Hall Council Chambers, 70 Maple Street, followed by the Pledge of Allegiance. PRESENT: David Bachman, Cindy Lundberg, Lynda Beaton, Jermaine Sullivan, Michael Szymanski, James Grabowski, and Erin Martin Pontiac ABSENT: None ALSO PRESENT: City Manager – Bill Gambill, City Attorney – George Saylor, Deputy Clerk – Lora Laurain, Finance Director – Edward Bradford, Planning & Zoning Administrator – Zachary Sompels, Police Chief – Josh Glass, Fire Chief – Mark Cameron, and City Engineer – Shawn Middleton CITIZEN COMMENTS ON AGENDA RELATED ITEMS None. CONSENT AGENDA • Minutes February 1, 2022 Regular Meeting February 8, 2022 Study Session • Financial Reports Payroll January 2022 Invoices January 2022 • Notification Regarding Next Study Session – March 8, 2022, at 7:00 p.m. A Council study session has been scheduled for Tuesday, March 8, 2022, at 7:00 p.m. A discussion will be conducted on the economic development intake process; and such business as may come before Council. • Consideration of holding the Run The Pier 5k Run/Walk On Saturday, August 13, 2022, From 7:30 P.M. - 11:00 P.M. The Run the Pier 5k run/walk will be held on Saturday, August 13, 2022, along City streets from Veterans Memorial Park, west to 5th Avenue Pier, around the Lighthouse and then return to Veterans Memorial Park. Street closures of approximately one hour to include 5th Avenue at Washington Street, west to Monroe, north on Monroe and the westbound lane of Lakeshore Drive. After the race, an event tent with beer and non-alcoholic beverages, food and live music in the Memorial Park parking lot would be held. This event would be held from 7:30 p.m. - 11:00 p.m. • Consideration of Tight Lines for Troops charity veteran’s event to be held on Friday, May 20, 2022 – Saturday, May 21, 2022 Tight Lines for Troops charity veteran’s event is scheduled for Friday, May 20, 2022, and Saturday, May 21, 2022. The event will take place at the public boat launch on First Street, utilizing the ball diamond parking lots on Cherry Street, as well as the City parking lot at the Armory. This event will begin on Friday, May 20, 2022, at 4:00 p.m. and all areas will be cleared by Saturday, May 21, 2022 at 8:00 p.m. MOTION by Grabowski, second by Szymanski to approve the Consent Agenda as presented. | Page 1  PROCEEDINGS OF THE MANISTEE CITY COUNCIL – FEBRUARY 15, 2022 With a roll call vote this motion passed unanimously. AYES: Bachman, Lundberg, Beaton, Sullivan, Szymanski, Grabowski, and Martin Pontiac NAYS: None CONSIDERATION OF ENTERING INTO A FOUR-YEAR INSTALLMENT PURCHASE CONTRACT WITH WEST SHORE BANK, TRUCK & TRAILER SPECIALTIES OF BOYNE FALLS, INC, AND D&K TRUCK COMPANY TO FINANCE THE PREVIOUSLY APPROVED PURCHASE OF A PLOW TRUCK AND RELATED EQUIPMENT On September 7, 2021, Council approved the purchase of a plow truck and related equipment in the amount of $215,531. When approved, it was anticipated that financing arrangements would have to be made at a later date due to the long lead time. The truck chassis is now done and has been delivered to the equipment vendor for assembly. The City solicited financing bids for the chassis and equipment and needs to close on the financing to pay the vendors. MOTION by Bachman, second by Grabowski to adopt a resolution to enter into a four-year installment purchase contract with West Shore Bank, Truck & Trailer Specialties of Boyne Falls, Inc, and D&K Truck Company in the amount of $169,000 to finance the purchase of a plow truck and related equipment; and further authorize the Chief Financial Officer to execute any needed documents. With a roll call vote this motion passed unanimously. AYES: Bachman, Lundberg, Beaton, Sullivan, Szymanski, Grabowski, and Martin Pontiac NAYS: None CONSIDERATION OF ORDINANCE 22-01 TO AMEND THE CITY OF MANISTEE CODIFIED ORDINANCES TO ADD CHAPTER 275 NEIGHBORHOOD RESTORATION AND BEAUTIFICATION COMMISSION As an ordinance two separate readings are required. If this ordinance is introduced at this time it could be adopted at the next regular meeting. MOTION by Szymanski, second by Martin Pontiac to introduce Ordinance 22-01 amending the City of Manistee Codified Ordinances to add Chapter 275 Neighborhood Restoration and Beautification Commission. MOTION by Beaton, second by Bachman to amend proposed Ordinance 22-01 to change the qualification for Neighborhood Restoration and Beautification Commission membership from resident to property owner. With a roll call vote this motion to amend the motion passed. 5-2. AYES: Bachman, Lundberg, Beaton, Sullivan, and Martin Pontiac NAYS: Szymanski and Grabowski With a roll call vote the amended motion passed unanimously. Language has been approved by the Planning Commission. As an ordinance two separate readings are required. If this ordinance is introduced at this time it could be adopted at the next regular meeting. MOTION by Szymanski, second by Grabowski to introduce Zoning Ordinance Z22-01 with proposed text amendments addressing viewshed. With a roll call vote this motion passed, 6-1. AYES: Lundberg, Beaton, Sullivan, Szymanski, Grabowski, and Martin Pontiac NAYS: Bachman CONSIDERATION OF TEXT AMENDMENTS TO THE ZONING ORDINANCE ADDING LANGUAGE ADDRESSING STORM WATER AND LOT COVERAGE For the approval of language addressing lot coverage waivers for storm water management in Article 5 General Provisions in the City of Manistee Zoning Ordinance. Language has been approved by the Planning Commission. As an ordinance two separate readings are required. If this ordinance is introduced at this time it could be adopted at the next regular meeting. MOTION by Bachman second by Martin Pontiac to introduce Zoning Ordinance Z22-02 with proposed text amendments addressing storm water and lot coverage. With a roll call vote this motion passed unanimously. AYES: Bachman, Lundberg, Beaton, Sullivan, Szymanski, Grabowski, and Martin Pontiac NAYS: None CONSIDERATION OF COLLECTIVE BARGAINING AGREEMENT WITH THE COMMAND OFFICERS ASSOCIATION OF MICHIGAN MOTION by Grabowski, second by Szymanski to approve a three-year collective bargaining agreement with the Command Officers Association of Michigan; and authorize the Mayor and City Manager to execute the agreement. With a roll call vote this motion passed unanimously. AYES: Bachman, Lundberg, Beaton, Sullivan, Szymanski, Grabowski, and Martin Pontiac NAYS: None | Page 3  PROCEEDINGS OF THE MANISTEE CITY COUNCIL – FEBRUARY 15, 2022 CONSIDERATION OF APPLICATIONS TO BOARDS AND COMMISSIONS The City Clerk has taken action to advertise vacancies on the Compensation Commission, Harbor Commission, Historic District Commission, Parks Commission, PEG Commission, and Tree Commission. Mayoral and Manager appointments require a motion, second and Council voted support. Nominations for Council appointments do not require a second. After all nominations are made, Council votes on the nominees until one nominee receives majority support. Historic District Commission. One vacancy, term ending 02/28/24. Applicants must be City residents; one member is desired who meets professional qualification standards for archaeologist, architect, architectural historian, historian, or historic architect; Council appointment. Kathryn Kenny – 429 ½ River Street MOTION by Grabowski to appoint Kathryn Kenny, 429 ½ River Street, to the Historic District Commission, term ending 02/28/24. With a roll call vote this motion passed unanimously. AYES: Bachman, Lundberg, Beaton, Sullivan, Szymanski, Grabowski, and Martin Pontiac NAYS: None Parks Commission. Two vacancies, one (1) term ending 06/30/22, one (1) term ending in 06/30/23. Applicants may be nonresidents but must own real estate or a business/profession having a licensed business location in the City or have a child attending school within the City; Mayoral appointment. Karen Peltola – 264 First Avenue Mayor Beaton appointed Karen Peltola, 264 First Avenue, to the Parks Commission, term ending 06/30/23. MOTION by Martin Pontiac, second by Szymanski to support the Mayor’s appointment of Karen Peltola, 264 First Avenue, to the Parks Commission, term ending 06/30/23. With a roll call vote this motion passed unanimously. AYES: Bachman, Lundberg, Beaton, Sullivan, Szymanski, Grabowski, and Martin Pontiac NAYS: None A REPORT FROM THE REPUBLIC SERVICES Mr. Matt Biolette reported on the activities of Republic Services and responded to questions the Council had regarding their activities. With a roll call vote this motion passed unanimously. AYES: Bachman, Lundberg, Beaton, Sullivan, Szymanski, Grabowski, and Martin Pontiac NAYS: None CITIZEN COMMENT None. OFFICIALS AND STAFF City Manager Gambill provided updates on the ice rink, 9th Street Boat Launch, Fricano property, OPRA properties on 8th Street and Sibben Street, and property for sale on 6th Avenue. City Engineer Middleton recommended keeping Maple Street bridge closed to pedestrian traffic at this time. COUNCILMEMBERS Councilmembers offered congratulations to Kathie Boyle and thanked her for her dedication and service to the City of Manistee. Martin Pontiac commented on seasonal potholes on US 31. Lundberg thanked Sompels and Gambill for their work with the owner of the Milwaukee House. Szymanski commended Republic Services for the great service provided by their drivers.
