PROCEEDINGS OF THE MANISTEE CITY COUNCIL – SEPTEMBER 20, 2022 A regular meeting of the Manistee City Council was called to order by her honor, Mayor Lynda Beaton on Tuesday, September 20, 2022, at 7:00 p.m. in the City Hall Council Chambers, 70 Maple Street, followed by the Pledge of Allegiance. PRESENT: David Bachman, Lynda Beaton, Cindy Lundberg, Jermaine Sullivan, Michael Szymanski, James Grabowski, and Erin Martin Pontiac ABSENT: None ALSO PRESENT: City Manager – Bill Gambill, City Attorney – George Saylor, City Clerk – Heather Pefley, DPW Director – Jeff Mikula, Planning & Zoning Administrator – Katie Mehl, Police Chief – Josh Glass, Fire Chief – Mark Cameron, and City Engineer – Shawn Middleton CITIZEN COMMENTS ON AGENDA RELATED ITEMS None received. CONSENT AGENDA • Minutes September 6, 2022 Regular Meeting September 13, 2022 Study Session • Financial Reports Payroll August 2022 Invoices August 2022 • Consideration of text amendment to the Zoning Ordinance. • Notification Regarding Next Study Session – October 11, 2022, at 7:00 p.m. A discussion will be conducted on the Housing Commission; and such business as may come before Council. • Consideration of Manistee Catholic Central Homecoming Parade. MOTION by Grabowski, second by Martin Pontiac, to approve the Consent Agenda as presented. With a roll call vote this motion passed unanimously. AYES: Bachman, Beaton, Lundberg, Sullivan, Szymanski, Grabowski, and Martin Pontiac NAYS: None CONSIDERATION OF A MUTUAL AID AGREEMENT WITH CLARE COUNTY. The Manistee City Police Department, in partnership with the Sleighbell Committee, has requested assistance from the Clare County Mounted Division. Clare County will assist with police presence and crowd control on Saturday, December 3, 2022, during and after the Manistee Victorian Sleighbell Parade. The City Attorney has reviewed and approved the agreement. | Page 1 PROCEEDINGS OF THE MANISTEE CITY COUNCIL – SEPTEMBER 20, 2022 MOTION by Bachman, second by Grabowski to approve the Clare County Mutual Aid Agreement. With a roll call vote this motion passed unanimously. AYES: Bachman, Beaton, Lundberg, Sullivan, Szymanski, Grabowski, and Martin Pontiac NAYS: None CONSIDERATION OF A RESOLUTION ESTABLISHING AUTHORIZED SIGNATORIES FOR MERS CONTRACTS AND SERVICE CREDIT PURCHASE APPROVALS. MERS revised its Plan Document several years ago and now requires a resolution naming the positions at the City that are authorized to execute certain documents, such as Service Credit Purchases. The resolution names the City Manager or Chief Financial Officer as officials authorized to sign these documents. MOTION by Szymanski, second by Grabowski to authorize a Resolution Establishing Authorized Signatories for MERS Contracts and Service Credit Purchase Approvals. With a roll call vote this motion passed unanimously. AYES: Bachman, Beaton, Lundberg, Sullivan, Szymanski, Grabowski, and Martin Pontiac NAYS: None CONSIDERATION OF THE SALE OF CITY-OWNED PROPERTY, RENAISSANCE LOT 1. The City received an offer to purchase the parcel described as Renaissance Lot 1. This lot is part of the Renaissance Park located in Manistee Township. These lots are currently subject to Restrictive Covenants. Offer: $22,500 Use and employment detail: Self Storage. Phase one would include mini warehouse units and would employ 1-2 people for management/maintenance. Phase two would include a large warehouse with office and storage pods, employing 2-4 people. MOTION by Martin Pontiac, second by Grabowski to accept the offer with the inclusion of the proposed additional terms and conditions and authorize the Mayor and Clerk to execute all necessary closing documents. Discussed the Restrictive Covenants, number of lots remaining for sale, recommendation of City Manager, and site plan to be submitted for approval. With a roll call vote this motion passed unanimously. AYES: Bachman, Beaton, Lundberg, Sullivan, Szymanski, Grabowski, and Martin Pontiac NAYS: None CONSIDERATION OF APPLICATIONS TO BOARDS AND COMMISSIONS. The City Clerk has taken action to advertise vacancies on the Brownfield Redevelopment Authority, Compensation Commission, Harbor Commission, PEG Commission, and Tree Commission. | Page 2 PROCEEDINGS OF THE MANISTEE CITY COUNCIL – SEPTEMBER 20, 2022 Mayoral and Manager appointments require a motion, second and Council voted support. Nominations for Council appointments do not require a second. After all nominations are made, Council votes on the nominees until one nominee receives majority support. The following applications have been received: *Incumbent PEG COMMISSION – Two vacancies, terms ending 12/31/23; applicants must be Manistee County Residents. Purpose: Oversees operation of Manistee Public Access. Council appointment. Andrea DeJong – 370 Seventh Street Sullivan nominated Andrea DeJong, 370 Seventh Street, to the PEG Commission for a term ending 12/31/23. With a roll call vote this nomination passed unanimously. AYES: Bachman, Beaton, Lundberg, Sullivan, Szymanski, Grabowski, and Martin Pontiac NAYS: None A REPORT FROM PLANNING AND ZONING, AND THE PLANNING COMMISSION. Mr. Mark Wittlieff and Ms. Katie Mehl reported on the activities of the Planning Commission and Planning and Zoning Department and responded to any questions the Council had regarding their activities. CITIZEN COMMENT None received. OFFICIALS AND STAFF Gambill updated Council on the Quincy/Cleveland neighborhood meeting that took place on September 19th with 15 residents in attendance and expressed his appreciation to Spicer and the DPW Director for their work on the event. He also stated the cost proposal for the PFAS investigation at the landfill was received today and once reviewed, will be brought before Council for action at a future meeting. Mikula stated Memorial Drive was open to traffic today. COUNCILMEMBERS Grabowski asked if any additional thought had been given to the purchase of a camera for the sewers and requested a meeting to further discuss wages. Lundberg commented on the recent Hops & Props event. Szymanski thanked the Planning Commission for their work over the last year, asked if there was an update on when the paving would be completed in Maxwelltown, and commented on the nice work completed on Memorial Drive. | Page 3 PROCEEDINGS OF THE MANISTEE CITY COUNCIL – SEPTEMBER 20, 2022 Sullivan offered appreciation for the cement that was poured at the Rec Center in Sands Park. Beaton commented on the successful Hops & Props event. CONSIDERATION OF A CLOSED SESSION, MANAGER ANNUAL EVALUATION. City Manager William Gambill has requested a Closed Session this evening as permitted by the Open Meetings Act, Section 8 (a) for discussion on the City Manager’s Annual Evaluation. MOTION by Grabowski, second by Sullivan to proceed to Closed Session under Section 8 (a) of the Michigan Open Meetings Act. Time: 7:43 p.m. With a roll call vote this nomination passed unanimously.
