PROCEEDINGS OF THE MANISTEE CITY COUNCIL – JULY 18, 2023 A regular meeting of the Manistee City Council was called to order by her honor, Mayor Jermaine Sullivan on Tuesday, July 18, 2023, at 7:00 p.m. in the City Hall Council Chambers, 70 Maple Street, followed by the Pledge of Allegiance. AYES: Bachman, Beaton, Sullivan, Pratt, Grabowski, and Martin Pontiac NAYS: None INTRODUCTION OF NEW EMPLOYEE, LAURA MACKENZIE Laura Mackenzie was introduced to Council as the newest employee of the Administrative Services Department. Laura will serve as the Accountant/ Accounts Payable Clerk. CONSIDERATION OF AUTHORIZING AN AGREEMENT WITH ASSOCIATED GOVERNMENT SERVICES INC. (AGS), FOR TRADES INSPECTION SERVICES SAFEbuilt will cease to provide inspection services for the City on August 23, 2023. The City is currently in the process of accepting applications for a City Building Official; this position will be responsible for building and rental inspections. The City is also required to provide trades inspections under the current City Ordinance. City staff has explored several options for this service and has found AGS to be the best option. MOTION by Bachman, second by Grabowski to authorize the agreement with Associated Government Services Inc. for trades inspection services allowing the City Manager to execute the documents. AYES: Bachman, Beaton, Sullivan, Pratt, Grabowski, and Martin Pontiac NAYS: None CONSIDERATION OF AN ADDENDUM TO PURCHASE AGREEMENT RELATIVE TO CITY OF MANISTEE BROWNFIELD REDEVELOPMENT AUTHORITY DEVELOPMENT AND REIMBURSEMENT AGREEMENT North Channel Investors, LLC is entitled to brownfield tax increment financing reimbursement under the terms of a development agreement. They intended to create condominium units in the North Chanel Building. This addendum clarifies that North Channel Investors, LLC will continue to receive these payments after they sell condominiums in the building. MOTION by Beaton, second by Bachman to approve the Addendum to Purchase Agreement Relative to City of Manistee Brownfield Redevelopment Authority Development and Reimbursement Agreement. With a roll call vote this motion passed unanimously. AYES: Bachman, Beaton, Sullivan, Pratt, Grabowski, and Martin Pontiac NAYS: None CONSIDERATION OF ZONING ORDINANCE Z23-03 Zoning Ordinance Z23-03 would amend the Zoning Ordinance to remove the requirement of parking for | Page 2  PROCEEDINGS OF THE MANISTEE CITY COUNCIL – JULY 18, 2023 residential use condominiums in the C-3 District, under Article 5, Section 514.H. of the City of Manistee Zoning Ordinance. The Planning Commission voted to recommend approval of this amendment at their July 6, 2023, regular meeting. As an ordinance two separate readings are required. If this ordinance is introduced at this time, it could be adopted at the next regular meeting. MOTION by Beaton, second by Bachman to introduce Zoning Ordinance Z23-03. With a roll call vote this motion passed unanimously. AYES: Bachman, Beaton, Sullivan, Pratt, Grabowski, and Martin Pontiac NAYS: None CONSIDERATION OF A TEMPORARY ACTIVITY PERMIT FOR GARAGE SALES AT 291 FIRST STREET The property addressed as 291 First Street is seeking a temporary activity permit to utilize the property for garage sales, more than the three (3) day allowance in any ninety (90) day period per section 522 of the City of Manistee Zoning Ordinance. MOTION by Bachman, second by Beaton to approve the request for a temporary activity permit for garage sales at 291 First Street. MOTION by Bachman, second by Beaton to AMEND the original Motion to place restrictions on the temporary activity permit to allow sales one weekend per month through September 2023 and the items for sale need to be removed other than the days of sales. With a roll call vote this motion to AMEND the original motion passed unanimously. Mr. Rick Mohr reported on the activities of the Clean Water Recovery Facility and responded to questions the Council had regarding their activities. UPDATE ON MANISTEE COUNTY LAND BANK HOUSE DEMOLITIONS Manistee County Treasurer Rachel Nelson provided an update on house demolitions in the City of | Page 3  PROCEEDINGS OF THE MANISTEE CITY COUNCIL – JULY 18, 2023 Manistee and provided a timeline on projects. CITIZEN COMMENT Comments provided by: - Sean Taylor, 240 10th Street OFFICIALS AND STAFF Gambill and Mikula provided comments and updates. COUNCILMEMBERS Pratt, Grabowski, and Martin Pontiac offered concerns and comments. Mayor Sullivan read a statement on the Housing Commission Forensic Audit. CONSIDERATION OF A CLOSED SESSION, ATTORNEY-CLIENT PRIVILEGED COMMUNICATION. Request to convene a closed session pursuant to the Open Meetings Act, PA 267 of 1976, pursuant to MCL 15.268(1)(h) to discuss attorney-client privileged communication dated July 17, 2023, regarding the City of Manistee Housing Commission. MOTION by Beaton, second by Pratt to proceed to closed session. TIME 8:25 p.m. With a roll call vote this motion passed unanimously.
