PROCEEDINGS OF THE MANISTEE CITY COUNCIL – DECEMBER 5, 2023
A regular meeting of the Manistee City Council was called to order by her honor, Mayor Jermaine Sullivan
on Tuesday, December 5, 2023, at 7:00 p.m. in the City Hall Council Chambers, 70 Maple Street, followed
by the Pledge of Allegiance.
PRESENT: David Bachman, Wesley Smith, Cindy Lundberg, Jermaine Sullivan, Seth Pratt, and
James Grabowski
ABSENT: Erin Martin Pontiac

INTRODUCTION OF NEW EMPLOYEE, JERRY BLEAU, BUILDING OFFICIAL.
Mr. Jerry Bleau introduced himself as the new building official for the City of Manistee. He is looking
forward to serving the community.
CONSIDERATION OF APPROVING A CONTRACT FOR REPLACEMENT OF THE CLEAN WATER RECOVERY
FACILITY, SECONDARY DIGESTER COVER.
The Secondary Digester Cover experienced a structural failure while removing the annual sludge. Spicer
Group recommended complete removal and replacement. The project was designed and bid. One bid was
received from R. K. Davis, Inc. in the amount of $267,809.00. Insurance proceeds will fund the entire
project.

MOTION by Grabowski, second by Bachman to approve a contract with R. K. Davis, Inc. in the amount of
$267,809.00; and authorize the Mayor and City Clerk to execute the documents.
With a roll call vote this motion passed unanimously.

CONSIDERATION OF THE PURCHASE OF AN ATTACK DIGITAL FIRE TRAINING SYSTEM.
The Manistee Fire Department received funds from the 2023 Local Revenue Sharing Board (LRSB) Cycle II
to purchase an Attack Digital Fire Training System. The system is being purchased through a cooperative
purchasing program in the amount of $31,312.80. LRSB grant money will fund the entire project.
MOTION by Bachman, second by Lundberg to approve the purchase of an Attack Digital Fire Training
System in the amount of $31,312.80.
With a roll call vote this motion passed unanimously.

CONSIDERATION OF AUTHORIZING PERMANENT RIVERWALK EASEMENTS WITH WEST SHORE
COMMUNITY COLLEGE AND THE DOWNTOWN DEVELOPMENT AUTHORITY FOR THE EDA RIVERWALK
GRANT PROJECT.
The Spicer Group and City Attorney identified several locations that require a permanent easement to
utilize federal funds to implement the City’s EDA Riverwalk grant scope of work. The easements are
located at 400 River Street and 324 River Street. These easements are required for the City to be
reimbursed for work performed on these properties. Final approval is contingent on Grantor and City
Attorney approval.
MOTION by Lundberg, second by Bachman to authorize permanent Riverwalk Easements with West Shore
Community College and the Downtown Development Authority for the EDA Riverwalk Grant Project; and
authorize the Mayor and City Clerk to execute the documents.
With a roll call vote this motion passed unanimously.

CONSIDERATION OF AN UPDATE TO THE COUNCIL GUIDELINES, CP-10.
During the annual organizational meeting on November 14, 2023, the City Council Guidelines (CP-10) were
reviewed. No changes were made at that time; Council took action to approve as is at that meeting. After
the meeting members of Council asked to update some aspects of CP-10 including amending section 6.
Study Sessions, changing the language, no longer requiring regular monthly study sessions. Changing
section 6. of CP-10 would also then make it necessary to amend the 2024 Council Calendar removing most

scheduled study sessions (budget study sessions remain scheduled).
MOTION by Lundberg, second by Bachman to amend section 6. Study Sessions of CP-10 and remove
scheduled study sessions from the 2024 Council Calendar.
MOTION by Sullivan, second by Bachman to AMEND the original motion to add changing section 28., X.
from Concerns and Comments to Updates and Comments.
With a roll call vote this motion to amend passed, 5-1 vote.

Mayor Sullivan made the following Council Committee appointments:

MOTION by Lundberg, second by Smtih to support the Mayor’s appointments.
With a roll call vote this motion passed unanimously.

Council Personnel Committee appointments will be made at the next regular meeting.
CITY COUNCIL CORE VALUES EXERCISE
Chief Tom Hernden developed a team building exercise for Council and asked them each to identify and
define the City’s top five core values. This exercise will be used to find common ground, identify obstacles,

and accomplish goals. Council will bring their lists back for discussion at future meetings.
A REPORT FROM THE CITY CLERK’S OFFICE.
Ms. Heather Pefley reported on the activities of the City Clerk’s office and responded to any questions the
Council had regarding their activities.
TOURISM’S ECONOMIC IMPACT
Ms. Sammie Lukaskiewicz, Executive Director, Manistee County Tourism Authority gave a presentation on
the mission of the MCTA and the impact of tourism in Manistee County.
OPEN MEETINGS ACT REVIEW
Mr. Tim Figura, Mika Meyers PLC, provided a basic overview of the Michigan Open Meetings Act (OMA)
as a refresher to Council and staff.
