Ordinance 24-01 would amend Chapter 430 by adding to 2-hour parking exemptions to include approved parklets and construction parking. Also, it removes imprisonment language. • Consideration of Ordinance 24-02 to amend Chapter 850 Business Registration, of the City of Manistee, Michigan Codified Ordinances. Ordinance 24-02 would amend Chapter 850 to only require business registrations for businesses that have a permanent physical location in the City. • Consideration of Ordinance 24-03 to amend Chapter 606 Animals, of the City of Manistee, Michigan Codified Ordinances. | Page 1  PROCEEDINGS OF THE MANISTEE CITY COUNCIL – FEBRUARY 6, 2024 Ordinance 24-03 would amend Chapter 606 Animals, changing the word “mammals’ to the more inclusive term “animals.” Also addressing issues with bird feeders in the Downtown District. • Consideration of proclaiming February 11-17, 2024, as National Future Business Leaders of America Week in the City of Manistee. The local advisor for the Middle and High School Future Business Leaders of America (FBLA) has requested that the City of Manistee proclaim February 11-17, 2024, as National FBLA Week. • Consideration of the 2024 Smoke on the Water date correction. The 2024 Smoke on the Water event was approved at the last regular meeting held January 16, 2024. The date for the event was incorrect on the agenda; the correct date is Saturday, July 20, 2024. • Consideration of the Frost Bite Festival. The Frost Bite Festival will be held on Saturday, February 17, 2024, from 12:00 – 5:00 p.m., on River Street in downtown Manistee. Events will include wintery crafts for children of all ages, free books for kids at the library book bike, a scavenger hunt, and a chili cookoff. • Consideration of Trinity Lutheran School 5k Color Run. Trinity Lutheran School is requesting to hold a 5K Color Run on Saturday, May 25, 2024, beginning at 8:30 a.m. The race will start and end at Trinity Lutheran Church/School at 420 Oak Street and is a fundraiser for the school. MOTION by Bachman, second by Lundberg to approve the Consent Agenda as presented. With a roll call vote this motion passed unanimously. AYES: Bachman, Smith, Lundberg, Sullivan, Pratt, Grabowski, and Martin Pontiac NAYS: None CONSIDERATION OF ENTERING INTO A FIVE-YEAR AGREEMENT WITH HURST MECHANICAL, INC. TO SERVE AS PROVIDER OF RECORD FOR MECHANICAL\HVAC SERVICES. The City’s contract with its HVAC Contractor of Record, Custom Sheet Metal & Heating, Inc. has expired. The City issued a request for proposals for HVAC\Mechanical provider of record. Two responses were received. The City is recommending that Hurst Mechanical be awarded the contract. MOTION by Lundberg, second Martin Pontiac by to enter into a five-year agreement with Hurst Mechanical, Inc. to serve as provider of record for mechanical\HVAC services and authorize the Mayor and City Clerk to execute the agreement. The City of Manistee is required by State law to ensure that actual expenditures do not exceed budgeted amounts. Over the course of the current fiscal-year, unanticipated and unbudgeted events and\or Council approved expenditures have occurred. The proposed budget amendment addresses expenditures associated with these events to ensure compliance with State statutes regarding appropriations. MOTION by Grabowski, second by Bachman to adopt budget amendment 2024-1 for fiscal year ending June 30, 2024. With a roll call vote this motion passed unanimously. AYES: Bachman, Smith, Lundberg, Sullivan, Pratt, Grabowski, and Martin Pontiac NAYS: None CONSIDERATION OF APPLICATIONS TO BOARDS AND COMMISSIONS The City Clerk has taken action to advertise vacancies on the Board of Review, Compensation Commission, Historic District Commission, PEG Commission, Tree Commission, and the Zoning Board of Appeals. Mayoral and Manager appointments require a motion, second and Council voted support. Nominations for Council appointments do not require a second. After all nominations are made, Council votes on the nominees until one nominee receives the majority support. The following applications have been received: *Incumbent HISTORIC DISTRICT COMMISSION – Three vacancies, terms ending 02/28/2027. Purpose: historic preservation. Council appointment. *Thad Taylor – 581 Eighth Street *Kathryn Kenny – 140 Ford Street Pratt nominated Kathryn Kenny, 140 Ford Street, to the Historic District Term ending 2/28/2027. With a roll call vote this nomination passed unanimously. Purpose: hears appeals to zoning, building issues. Mayor appointment. Paul DuFresne – 490 Fourth Street Mayor Sullivan appointed Paul DuFresne, 490 Fourth Street to the Zoning Board of Appeals term ending 5/31/26. MOTION by Pratt, second by Bachman to support the mayor’s appointment of Paul DuFresne to the Zoning Board of Appeals term ending 5/31/26. With a roll call vote this motion passed unanimously. AYES: Bachman, Smith, Lundberg, Sullivan, Pratt, Grabowski, and Martin Pontiac NAYS: None A REPORT FROM THE NEIGHBORHOOD RESTORATION AND BEAUTIFICATION COMMISSION (NRBC). Mr. Lucas Richardson reported on the activities of the NRBC and responded to any questions the Council had regarding their activities. CITIZEN COMMENT No comments received. OFFICIALS AND STAFF Gambill provided updates on the police department accreditation and Housing Readiness Incentive Grant award. COUNCILMEMBERS Pratt, Martin Pontiac, Bachman, Lundberg, and Sullivan made inquiries and provided comments.
