PROCEEDINGS OF THE MANISTEE CITY COUNCIL – AUGUST 7, 2024
A regular meeting of the Manistee City Council was called to order by her honor, Mayor Jermaine Sullivan
on Wednesday, August 7, 2024, at 7:00 p.m. in the City Hall Council Chambers, 70 Maple Street, followed
by the Pledge of Allegiance.
PRESENT: David Bachman, Wesley Smith, Cindy Lundberg, Jermaine Sullivan, and Seth Pratt
ABSENT: James Grabowski and Erin Martin Pontiac

Mayor Sullivan announced that Manistee Boat Fest 2024 has been cancelled and therefore will be
removed from the agenda.
PUBLIC HEARING ON THE ADOPTION OF A BROWNFIELD PLAN FOR PROPERTY AT 141 WASHINGTON
STREET IN THE CITY OF MANISTEE
The purpose of the public hearing is to afford an opportunity for all citizens and interested parties to
provide comments on the adoption of the proposed Brownfield Plan for 141 Washington, LLC
redevelopment project.
Public was invited to speak on the proposed Brownfield Plan for the 141 Washington, LLC redevelopment
project.

• Consideration of Ordinance 24-08, repeal of Chapter 1028 River Street Traffic Flow, Parking and
Amenities, of the City of Manistee Codified Ordinances.

Many of the recommendations from the Manistee River Street Corridor – Enhancements and
Future Planning document, the City’s MDOT Shared Streets and Spaces grant application, and
the existing parklets are inconsistent with Chapter 1028 of the City of Manistee Codified
Ordinances. Attitudes have changed with time from emphasizing vehicular traffic to the
current more pedestrian friendly downtown. As a result, the Downtown Development
Authority is recommending the repeal of Chapter 1028. As an ordinance two separate
readings are required. This ordinance was introduced at the July 2, 2024, meeting and could
be adopted at this time.
• Consideration of 2024 Bike Night.
Taco Bout It Mexican Fusion and CVMA Lost Boys would like to host Bike Night on August 16,
2024. This is a fundraiser for veterans with planned activities including live music, a dunk tank,
bike displays, an indoor raffle, and several merchant tents. Nearby businesses have been
informed and approved of the event. They are in collaboration with Ausitn Vela from La
Catrina and CVMA Chapter 10 to ensure responsible beverage service and to help ensure a
safe and enjoyable occasion. They would like to close River Street from Division to Greenbush.
• Consideration of T.J.’s Block Party and Concert.
T.J.’s would like to hold a concert and block party in conjunction with the 2024 Manistee Boat
Fest on Saturday, September 14, 2024. The request includes closing River Street from Poplar
to Maple for 3 hours, from 7-10 p.m. T.J.’s will sponsor the event and provide a small stage.
The event is free and open to the public.
• Consideration of the Manistee Fall Festival and Banner Permit.
The 2024 Manistee Fall Festival will be held on River Street from Poplar to Maple and will
include music, games, and food, in addition to merchant trick or treating on Saturday, October
26, 2024. The festival will run from 12-4 p.m., with merchant trick or treating from 12-2 p.m.
only. The parking lot for Manistee Inn & Marina will be the location for the music, games, food
and other entertainment. They are requesting a banner permit at the River Street archway
from October 21-26, 2024.
MOTION by Smith, second by Pratt to approve the Consent Agenda as presented.

THE CONSIDERATION OF A BROWNFIELD PLAN FOR THE 141 WASHINGTON, LLC REDEVELOPMENT
PROJECT
Earlier this evening a public hearing was held on the proposed Brownfield Plan for the 141 Washington,
LLC redevelopment project. The City of Manistee Brownfield Redevelopment Authority has approved the
Brownfield Plan. Public Act 381 of 1996 requires the municipality where the project is located to also
approve the Plan.
MOTION by Lundberg, second by Smtih to adopt a resolution approving the Brownfield Plan the 141
Washington, LLC redevelopment project.

CONSIDERATION OF A DEVELOPMENT AND REIMBURSEMENT AGREEMENT FOR 141 WASHINGTON, LLC
REDEVELOPMENT AGREEMENT
Earlier this evening a public hearing was held on the proposed Brownfield Plan for the 141 Washington,
LLC development project. Council also considered approving the Brownfield Plan. As part of the approval
process for the project, a Development and Reimbursement Agreement between the City, Developer and
Brownfield Redevelopment Authority needs to be approved.
MOTION by Pratt, second by Lundberg to enter into a Development and Reimbursement Agreement with
141 Washington, LLC and the City of Manistee Brownfield Redevelopment Authority, and further
authorize the Mayor to execute the agreement.
With a roll call vote this motion passed unanimously.

CONSIDERATION OF THE COLLECTIVE BARGAINING AGREEMENT WITH THE POAM UNION
MOTION by Bachman, second by Smith to approve a three-year collective bargaining agreement with the
Police Officer’s Association of Michigan; and authorize the Mayor and City Clerk to execute the
documents.
With a roll call vote this motion passed unanimously.

CONSIDERATION OF THE COLLECTIVE BARGAINING AGREEMENT WITH THE COAM UNION
MOTION by Pratt, second by Lundberg to approve a three-year collective bargaining agreement with the
Command Officer’s Association of Michigan; and authorize the Mayor and City Clerk to execute the
documents.

CONSIDERATION OF ADOPTING A MERS DEFERRED RETIREMENT OPTION PLAN FOR THE POAM AND
COAM
The Police Officer’s Association of Michigan (POAM), Command Officer’s Association of Michigan (COAM),

and the City have agreed through contract negotiations to adopt a Deferred Retirement Option Plan for
the two POAM divisions and the two COAM divisions. Three adoption agreements must be passed to
implement this plan.
MOTION by Bachman, second by Pratt to approve adoption agreements implementing MERS Deferred
Retirement Option Plans for MERS POAM divisions 2 and 21; MERS COAM divisions 20 and 22.

CONSIDERATION OF ADOPTING THE 2023 NATURAL HAZARD MITIGATION PLAN FOR MANISTEE
COUNTY
The 2023 Natural Hazard Mitigation Plan for Manistee County was approved by FEMA now needs to be
adopted by the municipalities that participated in the process of creating the plan. The plan was passed
by the Manistee County Board of Commissioners on May 21, 2024.
MOTION by Lundberg, second by Smith to adopt the 2023 Natural Hazard Mitigation Plan for Manistee
County.

CONSIDERATION OF A CONTRACT WITH HOUSING NORTH FOR CAPACITY BUILDING TO ASSIST WITH
ADMINISTRATION AND IMPLEMENTATION OF THE MSHDA COMMUNITY DEVELOPMENT BLOCK GRANT
(CDBG) CHILL HOME IMPROVEMENT GRANT
The City of Manistee has a three-year agreement with Housing North for a Housing Ready Coordinator
(Tracy Davis) to help implement initiatives identified in the 2019 City of Manistee Housing Action Plan.
The City of Manistee and Housing North collaborated and applied for the MSHDA CDBG CHILL Home
Improvement Grant. It was awarded on October 13, 2023, in the amount of $500,000. Despite the current
agreement with Housing North, the State of Michigan as part of the CHILL grant, is requiring an additional
contract between the City and Housing North to allow for Tracy Davis to assist the City with administering
and implementing the grant. No additional funds will be paid to Housing North for their assistance beyond
the original contract for this work.
MOTION by Pratt, second by Lundberg to approve a contract with Housing North for administration and
implementation of the MSHDA CDBG CHILL Home Improvement Grant; and authorize the Mayor and City
Clerk to execute the documents.

CONSIDERATION OF DESIGNATING A VOTING DELEGATE FOR THE MICHIGAN MUNICIPAL LEAGUE
ANNUAL MEETING
The Annual Convention for the Michigan Municipal League (MML) will be held September 11-13, 2024.
Pursuant to the provisions of the League Bylaws, we are requested to designate by action of governing
body, one official who will be in attendance at the convention as the official representative to cast the
vote of the City of Manistee at the annual meeting, and if possible, to designate one other official to serve
as the alternate. Mayor Sullivan, Councilmember Smith, and Councilmember Lundberg will be attending
the convention.
MOTION by Smith, second by Pratt to appoint Mayor Sullivan as the voting delegate and Councilmember
Lundberg as the alternate voting delegate for the MML Annual Convention.
With a roll call vote this motion passed unanimously.

CONSIDERATION OF APPLICATIONS TO BOARDS AND COMMISSIONS
The City Clerk has taken action to advertise vacancies on the Board of Review, Brownfield Redevelopment
Authority, Compensation Commission, PEG Commission, and Tree Commission.
Mayoral and Manager appointments require a motion, second and Council voted support.
Nominations for Council appointments do not require a second. After all nominations are made, Council
votes on the nominees until one nominee receives the majority support.

BROWNFIELD REDEVELOPMENT AUTHORITY – one vacancy, term ending 06/30/27. Purpose: Promote
revitalization of environmentally distressed and functionally obsolete areas; Mayoral appointment.

Mayor Sullivan appointed Nicholas D. Licina, 374 Eighth Street, to the Brownfield Redevelopment
Authority term ending 06/30/27.
MOTION by Lundberg, second by Pratt to support the mayor’s appointment of Nicholas D. Licina to the
Brownfield Redevelopment Authority term ending 06/30/27.
With a roll call vote this motion passed unanimously.

Mayoral appointment.

Mayor Sullivan did not make an appointment to the Tree Commission. This appointment will be added to
the next agenda.
SPECIAL PRESENTATION
Mayor Sullivan presented a Resolution of Acknowledgement and Appreciation to the City of
Manistee Police Department recognizing Chief Josh Glass, and the important contributions of
accreditation managers, Officer Chirstopher Franckowiak, Sergeant Douglas VanSickle, and
Detective Sergeant Kirsten Goodspeed for their efforts in accomplishing their accreditation goal.
A REPORT FROM THE UTILITIES DEPARTMENT AND MANISTEE BLACKER AIRPORT
Bruce Banks and James Riley reported on the activities of City of Manistee Utilities Department and
responded to any questions the Council had regarding their activities.
Barry Lind reported on the activities of Manistee Blacker Airport and responded to any questions the
Council had regarding their activities.
