PROCEEDINGS OF THE MANISTEE CITY COUNCIL – OCTOBER 1, 2024 A regular meeting of the Manistee City Council was called to order by her honor, Mayor Jermaine Sullivan on Tuesday, October 1, 2024, at 7:00 p.m. in the City Hall Council Chambers, 70 Maple Street, followed by the Pledge of Allegiance. PRESENT: David Bachman, Wesley Smith, Cindy Lundberg, Jermaine Sullivan, Seth Pratt, James Grabowski, and Erin Martin Pontiac (arrived at7:03p.m.) ABSENT: None ALSO PRESENT: City Manager – Bill Gambill, City Clerk – Heather Pefley, DPW Director – Jeff Mikula, Community Development Director – Theresa Waldo, Police Chief – Josh Glass, Fire Chief – Tom Hernden, and City Engineer – Shawn Middleton PUBLIC HEARING ON THE ADOPTION OF A BROWNFIELD PLAN FOR PROPERTY AT 91 ARTHUR STREET IN THE CITY OF MANISTEE The purpose of the public hearing is to afford an opportunity for all citizens and interested parties to provide comments on the adoption of the proposed Brownfield Plan for 91 Arthur Street redevelopment project. The public was invited to speak on the proposed Brownfield Plan for the 91 Arthur Street redevelopment project. With a roll call vote this motion passed, 6-1. AYES: Bachman, Smith, Lundberg, Sullivan, Grabowski, and Martin Pontiac NAYS: Pratt PRESENTATION OF DONATION TO GREAT LAKES BURN CAMP FROM THE CITY OF MANISTEE FIRE DEPARTMENT’S ROOT BEER FLOAT FUNDRAISER Chief Hernden provided the mission of the Great Lakes Burn Camp and extended his appreciation to the Manistee Fire Fighters for their efforts with the Root Beer Float Fundraiser. A donation check was presented to the Great Lakes Burn Camp in the amount of $2277.50 for the funds raised with this event. Hernden also expressed his gratitude to all who sponsored and supported this event. ANNUAL REDEVELOPMENT READY COMMUNITY BOARD AND COMMISSION DISCUSSION TO IDENTIFY AND PRIORITIZE REDEVELOPMENT SITES - Theresa Waldo, Community Development Director and Andrew Stafford, Economic Development Director Members were present from the following Boards & Commissions: Brownfield Redevelopment Authority, Downtown Development Authority, Historic District Commission, Planning Commission, and Zoning Board of Appeals. Mr. Stafford presented an overview of RRC and Manistee’s history as a Certified Redevelopment Ready Community; how we achieved the certification, what we need to complete to maintain it, and the benefits of being RRC Certified. Stafford presented the following list of top six (6) RRC priority sites: • 160 Memorial Drive • 87 Division Street • 348 River Street • 451-453 River Street • 113-115 Cypress Street • 11 Cypress Street THE CONSIDERATION OF A BROWNFIELD PLAN FOR THE 91 ARTHUR STREET REDEVELOPMENT BY DEVELOPER 91/99 ARTHUR DEVELOPMENT COMPANY, LLC Earlier this evening a public hearing was held on the proposed Brownfield Plan for the 91 Arthur Street redevelopment project. The City of Manistee Brownfield Redevelopment Authority has approved the Brownfield Plan. Public Act 381 of 1996 requires the municipality where the project is located to also approve the Plan. MOTION by Grabowski, second by Smith to adopt a resolution approving the Brownfield Plan for the 91 Arthur Street redevelopment by 91/99 Arthur Development Company, LLC, contingent upon entering into a development and reimbursement agreement with the Brownfield Authority and Developer at a future date. | Page 2 PROCEEDINGS OF THE MANISTEE CITY COUNCIL – OCTOBER 1, 2024 With a roll call vote this motion passed unanimously. AYES: Bachman, Smith, Lundberg, Sullivan, Pratt, Grabowski, and Martin Pontiac NAYS: None CONSIDERATION OF AUTHORIZING THE CITY MANAGER TO EXECUTE THE NECESSARY STEPS TO UTILIZE RANGERBID ONLINE AUCTION SERVICES FOR THE SALE OF SURPLUS CITY VEHICLES AND EQUIPMENT The City has utilized the services of an onsite auctioneer to dispose of surplus vehicles, equipment and materials for many years. The current trend in municipalities is to dispose of property through online auctions. The online process improves access to interested buyers, including local buyers, and allows the City to dispose of items in a timely manner. MOTION by Pratt, second by Grabowski to authorize the City Manager to execute the necessary steps to utilize Rangerbid online auction services for the sale of surplus City vehicles and equipment; contingent on City Attorney approval. With a roll call vote this motion passed unanimously. AYES: Bachman, Smith, Lundberg, Sullivan, Pratt, Grabowski, and Martin Pontiac NAYS: None CONSIDERATION OF AN EXTENSION TO THE MANISTEE FALL FESTIVAL, SATURDAY, OCTOBER 26, 2024, 12-4 P.M. Third Coast Boutique is asking for River Street to be closed from Division Street to Greenbush Street in connection with the Fall Festival, which is scheduled for October 26, 2024, 12-4 p.m.; Downtown merchants are hosting downtown trick-or-treating and activities for children. Business owners in the Division Street/Greenbush section of River Street would like to add activities within the street, including a bounce house, apple bobbing, face painting, and corn hole. This additional request was not coordinated with the organizers of the Fall Festival, which was approved by Council at the August 7, 2024, Council Meeting. The DDA does not endorse this new request as the street closure plan does not support their mission to promote economic development and create an inviting and collaborative atmosphere in the downtown. MOTION by Lundberg, second by Sullivan to deny the extension to the Manistee Fall Festival including the additional River Street closure request. With a roll call vote this failed, 2-5. AYES: Lundberg and Sullivan NAYS: Bachman, Smith, Pratt, Grabowski, and Martin Pontiac Council returned to this item following Boards and Commission appointments and took the following action. | Page 3 PROCEEDINGS OF THE MANISTEE CITY COUNCIL – OCTOBER 1, 2024 MOTION by Bachman, second by Pratt to close River Street from Maple Street to Division Street on October 26, 2024, from 12-4 p.m. With a roll call vote this motion passed, 4-3. AYES: Bachman, Smith, Pratt, and Grabowski NAYS: Lundberg, Sullivan, and Martin Pontiac CONSIDERATION OF APPLICATIONS TO BOARDS AND COMMISSIONS The City Clerk has taken action to advertise vacancies on the Board of Review, Compensation Commission, Harbor Commission, Planning Commission, and PEG Commission. Mayor and Manager appointments require a motion, second and Council voted support. Nominations for Council appointments do not require a second. After all nominations are made, Council votes on the nominees until one nominee receives the majority support. The following applications have been received: *Incumbent COMPENSATION COMMISSION – two vacancies, one (1) term ending 09/30/28 and one (1) term ending 09/30/29. Purpose: Establish compensation for City Council members; Mayor appointment. *Shelly Memberto – 347 Second Street Mayor Sullivan appointed Shelly Memberto, 347 Second Street, to the Compensation Commission term ending 9/30/29. MOTION by Grabowski, second Pratt to support the mayor’s appointment of Shelly Memberto, 347 Second Street to the Compensation Commission term ending 9/30/29. With a roll call vote this motion passed unanimously. AYES: Bachman, Smith, Lundberg, Sullivan, Pratt, Grabowski, and Martin Pontiac NAYS: None HARBOR COMMISSION – two vacancies, terms ending 10/31/27. Purpose: Advisory on Marina and harbor development issues; Council appointment. *Thomas M. Swedenborg – 562 First Street Pratt nominated Thomas M. Swedenborg, 562 First Street, to the Habor Commission term ending 10/31/27. With a roll call vote this nomination passed unanimously. Purpose: Reviews Master Plan, zoning, site plans, and development issues; Mayor appointment. *Shelly Memberto – 347 Second Street Mayor Sullivan appointed Shelly Memberto, 347 Second Street, to the Planning Commission term ending 10/31/27. MOTION by Pratt, second by Martin Pontiac to support the mayor’s appointment of Shelly Memberto, 347 Second Street to the Planning Commission term ending 10/31/27. With a roll call vote this motion passed unanimously. AYES: Bachman, Smith, Lundberg, Sullivan, Pratt, Grabowski, and Martin Pontiac NAYS: None A REPORT FROM THE PARKS COMMISSION Ms. Karin Maue reported on the activities of the Parks Commission and responded to any questions the Council had regarding their activities. SHORT-TERM RENTAL DISCUSSION #2 Theresa Waldo, Community Development Director and Tracy Davis, Housing Ready Program Coordinator led the discussion on short term rentals. Since the first discussion, the City has finalized the agreement with Granicus and the information from the first report was reviewed. Discussion included Ordinance Committee recommendations, general feedback from the first discussion, new and updated FAQs, pre- existing units in operation prior to ordinance / cut off date, cap on STRs, and next steps. Council would like to have time to review the final ordinance draft prior to it being presented for adoption. CARDBOARD RECYCLING DISCUSSION #2 Jeff Mikula, Public Works Director provided an update on the plan to have a PCA recycling trailer located within the DPW yard for City residents to dispose of fiber waste. He stated a management plan has been submitted to PCA. In addition, a quote was received today from Republic Services for curbside recycling and will be reviewed. Lastly, Mikula provided an update on the recycling barn at MCC and the plan to assist with getting that cleaned up.
