Discussion and Action Items - New Business City of Manitowoc Page 2 Public Safety Committee Meeting Minutes April 8, 2019 19-0377 Discussion regarding the definition of "holiday" for parking regulations. Attachments: Memo Assistant City Attorney Liz Majerus informed the committee this came up because a parking ticket was contested that was issued on Presidents Day, and the question was whether that was a holiday exempting parking regulations. In researching this issue it was realized we have never addressed what constitutes a holiday for municipal purposes. Statutes have a couple different definitions depending on the purpose so we are recommending the City adopt a definition of holiday. Assistant Chief Rob Barbier informed the committee the downtown 2-Hours parking signs say "2-Hour Parking 9-5 Except Sunday and Holidays". The point of the 2-Hour parking downtown is to ensure our downtown businesses have parking. The Public Safety Committee would like to see a suggested ordinance brought back to the committee defining holiday. City of Manitowoc Page 3 Public Safety Committee Meeting Minutes April 8, 2019 19-0261 Ordinance to Create 10.570, Parking on Front Lawns Prohibited. Attachments: Ord to Prohibit parking vehicles on front lawns Assistant City Attorney Liz Majerus informed the committee we currently regulate this violation through the zoning code chapter 15.430. This code is enforced, but the process is very tedious. The way the process currently works is a citizen or police officer in the field notices a vehicle parked on the lawn, they refer it to the building inspection department, who then goes out and conducts their own inspection. If building inspection sees a violation, they then conduct a reinspection and sends a letter or tries to knock on the door to make sure the citizen is aware of the violation. Then building inspection conducts a reinspection after a period of time. If the vehicle is still there a ticket will be issued. The building inspection department generates the ticket and paperwork, refers it to the police department, and then the police department is responsible for serving the ticket on the offender. The first offense violation is $ 376.00 including court costs. The proposed ordinance streamlines that process and brings it down to an issuance of a parking citation. So the entire process would be replaced with an officer simply seeing a vehicle parked on the front lawn in the field and issuing it a parking citation. That parking citation acts as a warning to inform the resident this isn't allowed under municipal code. If the problem persists after three offenses, it will then be referred to building inspection and processed under the zoning code violation. Ultimately, it is a big cost savings for the offenders and it will help educate citizens this isn't something the City permits. Citizen Patricia Marquardt and Jerrold Paider were present during the meeting and expressed their concerns about passing this ordinance. Alderperson Brey made a motion to adopt the ordinance as written, with the amendments to include motor vehicle instead of just vehicle, and also to include an exemption for street sweeping and Mayor declared snow emergencies. Moved by Brey, seconded by McMeans, that this Ordinance be adopted as amended and referred to Council. The motion carried by the following vote: Aye: 3- McMeans, Lotz and Brey Nay: 1- Howe Excused: 1- Czekala City of Manitowoc Page 4 Public Safety Committee Meeting Minutes April 8, 2019 19-0378 An Ordinance to amend Section 14.270 of the Manitowoc Municipal Code regulating Smoking and Tobacco Products. Attachments: Ord to Amend 14.270 to prohibit tobacco use near playgrounds (2) Assistant City Attorney Liz Majerus informed the committee the primary goal is to minimized the impact of tobacco use on children. This ordinance says you cannot use tobacco products while you are on a playground. Moved by McMeans, seconded by Lotz, that this Ordinance be approved and referred to council. Attachments: Ord to Amend 10.830(33) Revocation of Bicycle Licenses.docx Assistant City Attorney Liz Majerus informed the committee recently with the update of the bicycle regulations a change was missed. This amendment to the revocation of license section acknowledges we transitioned from tags to sticker licenses. Attachments: Ord to Amend 6.170 Fire Suppression Systems Assistant City Attorney Liz Majerus advises the committee this was brought to her attention by the Fire Department. The penalty language in this ordinance was inconsistent with other penalty provision within chapter 6 fire code so this change brings us into conformance with the other areas of chapter 6. Attachments: Ord to Amend 14.280 Use of Cigarettes Tobacco Products and Nicotine Products Prohibited Assistant City Attorney Liz Majerus informed the committee she recently met with the Tobacco Coalition and learned about smoking devices she wasn't aware existed, which are electronic smoking devices that may or may not contain nicotine. Children are bringing these devices into school and law enforcement doesn't have a field test to determine if they contain nicotine. This ordinance states you can't bring these items to school and if your are a minor you can't possess these items. Moved by McMeans, seconded by Brey, that this Ordinance be approved and referred to council. Attachments: Ord to Amend 14.190 Littering Assistant City Attorney Liz Majerus advised this was brought to her attention by Alderperson Kummer who was concerned about the current littering ordinance not being strong enough. This ordinance improves our existing regulation by adopting the state statute that regulates littering. If that statute changes at all our ordinance automatically changes. This also raises the forfeiture to conform to a disorderly conduct violation amount. Moved by Brey, seconded by Lotz, that this Ordinance be approved and referred to council. Attachments: Ord to Decrease Bond for OAR_OWS Citations Assistant City Attorney Liz Majerus explained to the committee when Judge Olson took over the bench his predecessor had established a practice of imposing the standard traffic bond amount for operating after suspension and operating after revocation citations. In addition he imposed a six month license suspension for these violations. Judge Olson thought that was inappropriate to keeping with our goal of keeping people licensed. So instead we were going to eliminate that six month suspension and increase the forfeiture amount. Initially we saw our numbers of OWS and OAR tickets go down dramatically, but when the recession hit the numbers went back up and they have plateaued. Seeing that the increased forfeiture is not having the impact that we want it to have any more we are proposing to bring our forfeiture for these violations back into conformity with the state bond schedule. Alderperson Eric Sitkiewitz advised a citizen requested a 4-way stop at the intersection of South 23rd Street and Grand Avenue during last months listening session. After reviewing accident data for this intersection Chief Reimer did not support the request. Mayor Nickels suggested having police traffic control during large events would help vehicles travel through the area. Moved by Brey, seconded by McMeans, that this Report be placed on file. Fire Chief Todd Blaser informed the committee after 30 years of employment with the City of Manitowoc and over 20 of those years with the fire and rescue department, Administrative Assistant Judy Fuerbringer has announced her retirement effective August 2, 2019. Chief Blaser is looking for the approval to backfill this position, but also to allow for an overlap of employment to allow job knowledge transfer. Moved by Brey, seconded by Lotz, that this Request be approved and referred to the Personnel Committee. The motion carried by the following vote: Aye: 4- Howe, McMeans, Lotz and Brey Excused: 1- Czekala City of Manitowoc Page 8 Public Safety Committee Meeting Minutes April 8, 2019 19-0390 Request to temporarily hire 52 firefighters (instead of 51 as authorized per resolution) to accommodate training of new candidates prior to upcoming retirement. Fire Chief Todd Blaser informed the committee the fire and rescue department currently has an open position due to a resignation back in March of this year and there is a pending retirement planned for the end of May. Currently the fire and rescue department is going through the recruitment process to establish an eligibility list. Chief Blaser is looking for the approval of a temporary position that would term after the May retirement.
