MANTORVILLE CITY COUNCIL MEETING MINUTES MONDAY, JANUARY 9, 2016 6:30 PM New Council Members Henry Blair and Ryan Christensen were sworn in prior to the start of the meeting. 1. Call to Order – Vice Mayor Blair called the meeting to order at 6:35 pm. Mayor Chuck Bradford was sworn in at 6:45 pm. He then resumed the meeting. Members Present: Chuck Bradford (6:45), Henry Blair, Don Hofstad and Ryan Christensen. Others Present: Matt Stradtmann – DCSO, Gretta Becay, Dan Trapp, Scott Larsen and Cami Reber. 2. Pledge of Allegiance - Done 3. Additions/Deletions to Agenda - None 4. Consent Agenda – Motion made by Member Hofstad, second by Member Christensen to approve the consent as follows: a) City Council Meeting Minute’s December 12, 2016 b) Warrant List December 13, 2016, December 29, 2016 & January 9, 2017 c) Dodge County Commissioners Meeting Agenda January 10, 2017 d) Dodge County Zoning Ordinance Amendment(s) Notice e) December 2016 Sheriffs Call Report for Mantorville f) Annual SEMLM Meeting Notice Motion passed unanimously. 5. Public Concerns - None 6. Public Hearing - None 7. Old Business/New Business a) 2017 Annual Meeting Schedule/Calendar Council reviewed the 2017 annual meeting calendar as presented. No changes were made. b) Resolution 2017-01 Approving City Designations for 2017 Motion made by Member Blair, second by Member Christensen to approve Resolution 2017- 01, A RESOLUTION APPROVING CITY DESIGNATIONS FOR 2017. Motion passed unanimously. c) Resolution 2017- 02 Master Fee Schedule  2017 Rates for Legal Services Motion made by Member Blair, second by Member Hofstad to approve Resolution 2017-02, A RESOLUTION ADOPTING THE MASTER FEE SCHEDULE FOR 2017. Motion passed unanimously. d) 2017 Council Committee Appointments Council reviewed the 2017 Council Committee Appointments as presented. No changes were made. e) 2017 Garbage Haulers Motion made by Member Blair, second by Member Hofstad to approve the 2017 garbage haulers list as presented. Motion passed unanimously. f) 2017 Rental License Renewals Motion made by Member Hofstad, second by Member Christensen to approve the rental license renewals for 2017 as presented. Motion passed unanimously. g) Torkelson Response Letter Outside Storage Complaint The City has had correspondence with the Torkelson’ in response to a complaint received at a previous Council meeting. Mr. Trapp asked to speak on the letter that the Torkelson’ submitted. He asked if anyone still had the pictures that he submitted previously. It bothers him terribly that they can make the statement that he was trespassing. They are taking and dragging him down and saying he is doing something illegal and it bothers him a lot. He read a written statement to the Council. He again asked that Council Members come and take a look out his house windows and answer if this view is in good standing with the City of Mantorville CUP that they voted for on this neighborhood. Who is going to police and enforce the CUP? When is the construction timeline done? He asked Council members to drive out and take a look at the pallets; they promised everything would be stored inside, both private and business materials. No one’s property will be more impacted by the landscape business than his. He is very concerned about this. Member Blair commented that with a reasonableness and without other reason to believe it’s not, it’s not unheard of to take them at their word that that’s what it’s for (personal use for their property per the letter submitted). We can’t hear that explanation for different materials over and over, that would be an issue. At this point that is a reasonable response to the pictures that were brought last time. Mayor Bradford noted that if this is an accurate statement, the silt socks would go away in the late spring and if not, then it’s a different issue. Member Hofstad responded that they should be given time to get on this; germination and ground dry out. After spring if it’s not gone, they need to get it out of there. At this point we can’t take any action, follow up and make sure they are doing what they say in their response letter. Mayor Bradford noted in summary that the City has noted the concern, articulated it to the Torkelson’, received a response from them in which they are indicating it is part of construction, we would expect it to be completed in the next construction cycle, early rather than later, and if it hasn’t we will follow up at that point. We do not expect this to constantly be an excuse for things that show up. Mr. Trapp asked that the statement about him trespassing be stricken. The Mayor noted that we cannot edit letters submitted to us; they are accepted in their entirety. We can note on anything we feel is in error. Mr. Trapp asked that the Council take the time and look at the picture, you can see the berm in that picture, he is standing on his property, and that’s a very important thing to him. He doesn’t feel this will ever be a good marriage but he cannot have people saying that he is doing things that are illegal. The Mayor responded that his comments are duly noted and we will keep an eye on this and take any action if we do not see progress. h) Fire Department Member Resignation Motion made by Member Hofstad, second by Member Christensen to approve the resignation of Emily Lushinsky from the Mantorville Fire Department. Motion passed unanimously. i) 2017 Assessment Agreement with Dodge County Assessor’s Office Motion made by Member Blair, second by Member Christensen, to approve the 2017 Assessment Agreement with the Dodge County Assessor’s Office. Motion passed unanimously. 8. TBD a) Public Works Report – Scott reported that they are dealing with the icy roads and gave an update on the 3 blowers at the WW plant - one went bad over the weekend that he and Joe tore apart and he is checking on parts. b) City Clerk Report – Cami reported on the following items:  Dodge Soil and Water Conservation is holding an Urban Birding Community Ed Program on Thursday, February 23 at 7:00 pm in the City Hall Council Chambers.  Request to change the payroll paid date from biweekly Tuesday to biweekly Wednesday. This will give us an extra day to process things if ever needed.  The Auditor is coming this week for preaudit work.  City Prosecutor coming in February to give Council an update on 2016 activity.  CEDA is working on the Dodge County Comprehensive Plan and is gathering input from all cities in Dodge County. A public listening session for Mantorville has been scheduled for Thursday, March 2nd at 6:00 pm here in the Council Chambers.  She is reviewing Part 2 of the Wellhead Protection Plan draft. This will be coming to Council in the near future.  Working on cleaning up downstairs and the record retention files.  Let Cami know if interested in the SEMLM meeting. Dodge County Sheriff’s Deputy, Matt Stradtmann, requested by the Sheriff’s Department that all businesses and apartments, especially those downtown, have addresses and numbers put on the buildings. They are having difficulties trying to track down where some of the apartments are due to no numbers on the buildings. He gave other updates and requested that if anyone has barking dog complaints, that they contact the sheriff’s department so it can be addressed. c) Consultant Report – none d) Committee Report  Chamber – Member Hofstad updated the Council on the annual Chamber meeting last week and they are getting ready for their upcoming year. They changed their meeting dates to Wednesday mornings at 8 am, at the Welcome Center.  EDA – Mayor Bradford and Member Blair updated the Council on discussion on branding and the plan to putting it out there, Committee assignments were given and discussion on the Welcome Center.  Fire – Member Hofstad gave an update that the Fire Department is applying for a grant for the purchase of a commercial washer and dryer for the turn out gear and they are planning for their annual meeting.  Relief – Cami gave the Relief update; approval of 2 new Fire Department Members, sale of stock plus the current money market to pay out Doug Wunderlich’s retirement which needs to be done by July 2017 and they authorized the transfer of funds to pay the Relief Officers, $1,614.75. e) Council Member Report  Member Christensen – is looking forward to serving  Member Hofstad – looking forward to the upcoming year and his 3rd term.  Member Blair – none f) Mayor Report – Mayor Bradford welcomed Ryan to the Council. 9. Executive Session - None 10. Adjourn – Motion made by Member Hofstad, second by Member Blair to adjourn the meeting at 7:33 pm. Motion passed unanimously.
