Maple Grove City Council Closed Session Meeting Minutes January 6, 2020 Call to Order Pursuant to call and notice thereof, a Closed Council Session of the Maple Grove City Council was held at 6: 15 p. m. on Monday, January 6, 2020, at the Maple Grove Government Center/Public Safety Facility, Hennepin County, Minnesota. Present were Mayor Steffenson and Councilmembers Jaeger, Leith, Hanson and Barnett. Also attending was City Administrator Heidi Nelson, Public Works Director/City Engineer Ken Ashfeld, Assistant City Engineer/Public Works Director Jupe Hale, and City Attorneys George Hoff and Scott Landsman. Mayor Steffenson called the meeting to order at 6: 21 p.m. Radintz Mayor Steffenson read the following statement: Property Deferred George Hoff has requested a meeting with the City Council for an attorney- client privileged discussion. The discussion will relate to the Assessments City' s assertion that payment for certain assessments are due against property located in the City and owned by the Radintz family and related entities. The City has demanded payment of the amounts due, and the Radintz family, through its counsel, has refused to make payment. In light of that refusal, the City must weigh its legal options in response, including potential litigation. In order to assess those options, the City needs to seek and receive candid legal advice regarding litigation strategies that it may employ, and it must do so without the risk of disclosing the potential strengths and weaknesses of the City' s position to the opposing parties in this matter. The need for absolute confidentiality in seeking legal advice on that limited subject outweighs the public' s general right to observe Council discussion of City business as set forth in the Open Meeting Law. Minn. Stat. § 13D. 05, subd. 3( b) authorizes this discussion to be held in closed session. Motion by Councilmember Jaeger to go into closed session, seconded by Councilmember Leith. Council adjourns to closed session pursuant to Minn. Stat. 13D. 05, subd. 3( b). Motion by Councilmember Hanson, seconded by Councilmember Leith to open the Council Workshop. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Adjournment Motion by Councilmember Jaeger, seconded by Councilmember Leith, to adjourn to the City Council meeting of January 6, 2020. Upon can of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. The meeting was adjourned at 6: 55 p.m. by Mayor Steffenson.
