Maple Grove City Council Meeting Meeting Minutes February 18, 2020 Call to Order Pursuant to call and notice thereof, a Regular Meeting of the Maple Grove City Council was held at 7: 30 p. m. on February 18, 2020 at the Maple Grove Government Center/ Public Safety Facility, Hennepin County, Minnesota. Members present were Mayor Mark Steffenson and Councilmembers Judy Hanson, Karen Jaeger, Phil Leith, and Kristy Barnett. Absent was none. Present also were Heidi Nelson, City Administrator; Joe Hogeboom, Community and Economic Development Director; Brett Angell, Economic Development Manager; Ken Ashfeld, Public Works Director/ City Engineer; Assistant City Engineer Jupe Hale; and Justin Templin, City Attorney. Mayor Steffenson called the meeting to order at 7: 30 p.m. and led the City in the Pledge of Allegiance. Consideration None. of Items Pulled from the Agenda Special Business Open Forum There were no open forum issues brought before the Council at this meeting. Represent- Representative Kristin Bahner introduced herself to the Council ative Bahner and provided the City with an update from the legislature. She Presentation explained she was working to find effective ways to get the job done on time and on budget. She reported she has been focusing Maple Grove City Council Minutes February 18, 2020 Page S on bringing people together in order to get bills across the finish line. She stated it has been a tremendous honor for her to serve as a local representative. She commented she was the author of two local bonding projects, the first for the completion of TH610 and the second for the expansion of the North Metro Range. She thanked the City Council for their support and leadership on these matters. She then discussed the Hometown Heroes Bill and described the support that would be offered to EMS personnel. She commented on how she was working to create fair co- pays for chronic conditions. She stated another one of her key focuses was taxes and she described how she was working to create tax breaks for working families and seniors. She explained she was proud of the strides being made in the regions education system. She provided the Council with a handout with the bills she would be sponsoring in 2020. She thanked the City Council for their time and encouraged the Councilmembers to contact her at any time with comments or questions. Councilmember Jaeger thanked Representative Balmer for supporting early childhood education. She questioned where Representative Bahner stood on the legalization of marijuana. Representative Bahner reported the State was in the early exploratory phase and stated she has not made up her mind on this topic. She noted she was on a working committee regarding this matter and explained there was a great deal Minnesota can learn from other states. She reported that if this issue moves forward, public safety will be of the utmost priority. Councilmember Jaeger thanked Representative Balmer for all of her efforts on behalf of the City of Maple Grove. Mayor Steffenson thanked Representative Balmer for all of her work on the two bonding bills that will positively impact Maple Grove and the northwest suburbs. 7: 30 p. m. Assistant City Engineer Hale requested the Council approve the 2020 Street Rehabilitation Program. He described the city' s Public street maintenance program and it was noted the city maintains Hearing He stated the anticipated life over 280 miles of roadway. 2020 Street expectancy of bituminous pavement was 20 years. It was noted the city performs maintenance throughout the life of a street in Rehabilitation order to preserve the serviceability of the street and to extend Program the structural life of the pavement. He discussed how streets Maple Grove City Council Minutes February 18, 2020 Page 6 deteriorate over time and explained how streets/ neighborhoods Resolution No. were selected for improvement. He reviewed the neighborhoods 20- 034 that were included in the 2020 project noting three projects were recommended for approval. Project 20- 02 included Chapel Wood, Weaver Estates, Wicklow Meadows, and the Weaver Lake Boat Launch. Project 20- 03 included Weaver Lake Highlands, Hiller, Hiller Autumn Woods, and Hiller White Oaks on the Park. Project 20- 04 included Timber Crest Forest, Scott Middlemist and the Townhomes of Rosemary Woods. He discussed the improvements that would be completed. He described the costs for the project and how the project would be funded. It was noted benefiting properties would be assessed for the street repairs. He noted the city had received a number of letters of objection from residents living in the Chapel Wood neighborhood. Staff commented further on the proposed improvements and recommended approval of the project. Councilmember Leith reported some cities in the metro area assess 100% of the cost for the street improvements, while Maple Grove assessed 50%. He explained engineering staff was pretty good at estimating expenses. He reported if costs come in less than anticipated, fees will be reduced for residents. If the costs come in higher, the city will absorb this expense. He encouraged residents to communicate with staff if they have a wedding or high school graduation party planned for this summer. Motion by Councilmember Hanson, seconded by Councilmember Barnett, to open the public hearing. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Mayor Steffenson opened the public hearing at 8: 00 p.m. and asked if anyone would like to address this issue. Mayor Steffenson reported the City Council received 28 letters of objection for this project. He recommended the Council make a motion to accept receipt of these letters. Motion by Mayor Steffenson, seconded by Councilmember Hanson, to accept receipt of 28 letters of objection to the 2020 Street Rehabilitation Project. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Maple Grove City Council Minutes February 18, 2020 Page 7 Susan Sax, 9186 Comstock Lane North, discussed the private roads within her association. She explained she had one- half of one block that she drove on and she was being fully assessed for this one- half block. She believed being charged $ 3, 480 was an unfair price for using one-half of a block. She requested the Council reconsider their assessment policy. She was of the opinion her townhome value would not increase by $ 3, 480 when the street was improved. Jay Davis, 9204 Archer Lane, commented his road was on the younger side of 20 years. He reported he has lived in a townhouse association since it was new.He questioned why fully loaded semis were allowed access to the nursing home. He stated these tractor/ trailer units were destroying the streets. He recommended the new roads be posted for a certain weight limit. He asked when full payments would be due for the roadway improvements. Assistant City Engineer Hale explained residents would be receiving a letter from the city with further details on the payment options. He stated staff can research the truck traffic using these roadways and could consider posting a slower speed limit or have the roadway improved to allow the weight of truck traffic. Councilmember Hanson asked if interest would be avoided if a resident were to prepay the assessment amount. Assistant City Engineer Hale reported this was the case. Councilmember Hanson questioned if the city had a program in place to assist seniors with the assessment amount. Assistant City Engineer Hale explained the city has a senior deferment program if residents wanted to apply. Ed Hilferty, 6335 Upland Lane, inquired when work on his neighborhood would be completed.Assistant City Engineer Hale indicated all of the projects would be started at the same time and noted each neighborhood would take four to five weeks to complete. He explained additional information would be forwarded to the residents once a contractor was selected for the project. He commented further on the process that would be followed for the bidding project. Cynthia McSherry, 6676 Timber Crest Drive, stated the road in front of her home was 10 years old. She noted she was effected by the upgrades on Bass Lake Road and she believed the Maple Grove City Council Minutes February 18, 2020 Page 8 proposed assessment wasn' t quite fair. Public Works Director/ City Engineer Ashfeld explained when Bass Lake Road was constructed the adjacent streets were sloped back some distance for alignment purposes. He reported the one or two properties that were impacted by this realignment were not assessed for the improvements because this was strictly an interim improvement. He indicated the city views the costs assessed to residents to be for the use of the overall street network and not just for one roadway in order to keep things fair. Paul Garofano, 9164 Comstock Lane North, stated he lived directly off 92° d and Comstock. He believed his assessment was too high and noted he had appealed the assessment. Bob Hankins, 8159 Lawndale Lane North, explained he has lived in his home for the past 18 years. He indicated he has concerns with the level of speed along Lawndale Lane and stated he has brought these concerns to the Police Department. He commented the next generation of kids are now raising their kids and he requested the city work to address the speed of traffic in his neighborhood. Steve Waderich, 9165 Comstock Lane North - Unit # 112, discussed the assessment tiers with the Council. He stated he lived in a townhome unit. He expressed concern with how his fellow townhome dwellers that were seniors would be able to afford the street assessment. He believed the proposed fee for the townhome units was too high and unfair. Hannah Gust, 6754 Cottonwood Lane North, questioned if she would be inheriting the assessment if she were to move into one of these neighborhoods. Assistant City Engineer Hale explained each house would have an assessment levied to it and the assessment would have to be disclosed at the time of sale. The new owner could inherit this assessment or the fee could be negotiated with the seller. Mayor Steffenson stated in most cases, the mortgage lenders like to see the assessments paid off at the time of the sale. Sheree Curry, 7031 Empire Lane, asked how much work would be done on the sewers. She explained she lived on a cul- de- sac and there was a lake at the end of her driveway. She indicated she would like this drainage issue addressed through the street Maple Grove City Council Minutes February 18, 2020 Page 9 improvement project. Assistant City Engineer Hale encouraged Ms. Curry to speak with the engineering department further regarding this concern. Angela Kalthoff, 9120 Comstock Lane, stated she was a first time homeowner. She questioned what the estimated home value increase would be after the street improvement project was completed. Public Works Director/City Engineer Ashfeld reported the city does not make it a practice to complete appraisal work before and after projects. He discussed the importance of having well-maintained infrastructure and how this helped property owners maintain their property values. Ms. Kalthoff stated she believed her assessment was unfair given the level of traffic she generated to and from her townhome unit compared to the traffic that was generated by the nursing home. Assistant City Engineer Hale discussed how the city set assessment rates based on the density of a property. Zachary Kowalski, 8123 Kimberly Lane North, thanked the Council for their time. He believed it would be more equitable to have all roadway expenses rolled into the city' s property taxes instead of assessing homeowners. He questioned if the Council had considered this as an option. Public Works Director/City Engineer Ashfeld reported the street rehabilitation program covered all of the streets within the city. He explained each street in the city would be reconstructed many times throughout its life. He commented on the expense to reconstruct and maintain all of the city' s streets and how the full expense of these projects would impact the general tax levy. He reported the City Council made a decision back in 1993 to fund 50% of street improvements and 100% of all city water and sewer lines. He indicated this was a happy medium that was reached by the city and has been followed for the past 25 years. Craig Carlson, 17884 82nd Place North, stated his street was in poor condition and needed replacement. He reported he and his wife were new to the city and he was surprised to learn his street would only be replaced every 25 years. He questioned if the city did any sealcoating or mill and overlay projects. Assistant City Engineer Hale commented sealcoats have been done in the past and were done on a five to seven year cycle. He indicated the city was moving away from this treatment because of quality issues with seal coating products. Maple Grove City Council Minutes February 18, 2020 Page 10 Mr. Carlson stated the last city he lived in did regular sealcoats along with mill and overlays. He believed that the city was not providing its services in a cost effective manner. He encouraged the city to take a look at other maintenance measures that could be used to enhance the life of a street given the high cost of replacement. Mayor Steffenson reported the city and many neighboring communities have had a problem with sealcoating. He discussed the problems the state has had with the formula for sealcoating materials and noted the top layer of his street has peeled off. Public Works Director/ City Engineer Ashfeld reported that MNDOT has been studying this issue and there has not been an identification as to what has been causing this concern. He explained something changed in the makeup of the sealcoating materials in the past 10 years and this was causing problems for cities. He stated mill and overlays were not always the cheapest methods for rehabilitation but did help extend the life of a roadway. Mr. Carlson thanked staff and the Mayor for their comments. He encouraged the city to reevaluate its street maintenance methods in order to extend the life of its streets beyond 25 years. Councilmember Jaeger stated the city' s poor soils and high water level also contributed to deteriorating streets. Public Works Director/ City Engineer Ashfeld reported this was the case. Heidi O' Brien, 16618 90th Avenue North, explained she lived in a townhome cul- de- sac. She indicated her townhouse faced 90th Avenue and the back fronted 90th Place. She questioned if she would be getting hit with two assessments. Assistant City Engineer Hale reported each resident would only be receiving one assessment. Ms. O' Brien stated her entire neighborhood was signed no parking on the streets and she wanted to make sure residents were not ticketed during the street reconstruction project. Assistant City Engineer Hale stated this would be the case. Sherry Kubsch, 8799 Queensland Lane North, asked if drainage concerns should be brought to city staff. She indicated there Maple Grove City Council Minutes February 18, 2020 Page 11 were many people in her neighborhood that had sump pumps that drained directly to the street. Assistant City Engineer Hale explained a sump drain line could be run along this street to address this concern. Mark Wisniewski, 6268 Upland Lane North, requested further information on how long each phase of the street rehabilitation project would take. Assistant City Engineer Hale stated each project would take roughly four to five weeks to complete. Bill Hudson, 9165 Comstock Lane North —Unit 108, stated he lived in a retirement community and the average age was about 70. He explained the residents park underground and questioned how the handicap individuals would be impacted. Assistant City Engineer Hale reported the city would be working with the association during the street reconstruction to ensure access was allowed. Dave Nowariak, 8121 Narcissus Lane North, asked if the city allowed residents to work with the contractor to have entire driveways to be replaced. Assistant City Engineer Hale reported residents could contact the contractor to hire them privately to complete this work.He recommended the driveway work be completed after the city was done with its work. Bob Laddusaw, 9079 Archer Lane, stated new driveways would be completed within his entire association this summer. He asked if the city could complete the work in his neighborhood sooner rather than later so the driveway work could be completed prior to fall. Assistant City Engineer Hale encouraged Mr. Laddusaw to contact city staff regarding this matter. Sue Arnett, 8789 Shadyview Lane North, commented on the steep slope of her driveway apron. She questioned if the city would address this slope when the street was reconstructed. Assistant City Engineer Hale described the adjustments that could be made to the driveway apron. Ms. Arnett inquired who was responsible for Highway 101 stating this road was in terrible disrepair. Mayor Steffenson reported this was a Hennepin County Road. He indicated the city has made the county aware of the poor condition of this roadway and the lack of investment the county was making in its roadways. He encouraged Ms. Arnett to contact the County Maple Grove City Council Minutes February 18, 2020 Page 12 Commissioners. Ed Hilferty, 6335 Upland Lane, asked if staffs presentation would be available online. Assistant City Engineer Hale reported the information was available in the Council agenda online. Gary Skroch, 17603 81" Place North, questioned how long the curing period was for the curb and driveway aprons. He explained his wife was partially handicapped and he would need access to his home throughout the street reconstruction project. Assistant City Engineer Hale stated this would be a seven day period. He encouraged Mr. Skroch to contact city staff to discuss this matter further. Ms. Sax asked if the city has gone out for bids on this project. Assistant City Engineer Hale reported the project would be sent out for bid after receiving Council approval. He explained after bids were received the assessments amounts could go down, but would not go up. Motion by Councilmember Leith, seconded by Councilmember Hanson, to close the public hearing at 9: 06 p. m. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion by Councilmember Leith, seconded by Councilmember Hanson, to approve adopting Resolution No. 20- 034 ordering Chapel Wood, Weaver Estates, Wicklow Meadows and Weaver Lake Boat Launch Project No. 20- 02, Weaver Lake Highlands, Hiller, Hiller Autumn Woods, Hiller White Oaks on the Park Project No. 20- 03, and Timber Crest Forest, Scott Middlemist and Townhomes of Rosemary Woods Project No. 20- 04, adopting the special assessments against benefitted lands, ordering plans, approving plans and authorizing advertisement for bids. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Mayor Steffenson stated if residents wished to appeal their assessment they had 30 days to present this appeal to the District Court. Economic Development Manager Angell requested the Council 7: 30 p.m. consider approving a resolution that would approve the 2020 Maple Grove City Council Minutes February 18, 2020 Page 13 Public CDBG Fund Allocation. He reported CDBG funds came Hearing directly from HUD and were earmarked for low income residents, such as affordable housing. He explained the city was slated to receive $ 157, 000 from HUD, which was consistent 2020 CDBG with the funds received in 2019. He commented further on how Funds the CDBG funds would be allocated and recommend approval. Motion carried. Motion by Councilmember Jaeger, seconded by Councilmember Hanson, to approve adopting Resolution No. 20- 026 approving the 2020 CDBG Funds Allocation Plan. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Community Development Items Shake Shack Community and Economic Development Director Hogeboom PUD Non- stated the Shoppes at Arbor Lakes is proposing to construct a Residential stand-alone restaurant building located between the center' s primary access drive onto Elm Creek Boulevard and Red Concept Stage Lobster. The restaurant building will contain Shake Shack, a Plan fast- casual restaurant that specializes in hamburgers, fries and Amendment milkshakes. This development is part of a larger and ongoing and process to renew and revitalize the Shoppes at Arbor Lakes. It Development was noted the Shake Shack building will be contemporary in Stage Plan style, featuring clean lines, oversized windows, and a gray color scheme. In addition to indoor dining space, the restaurant will contain an outdoor patio. The restaurant will not feature a Maple Grove City Council Minutes February 18, 2020 Page 14 drive-through. Traffic generated by the restaurant during peak times will be under 100 cars per hour, which is generally desired for traffic flow within the shopping center. Staff commented further on the proposed Shake Shack restaurant and reported the Planning Commission recommended approval of the request. Michael Landstad, General Manager of the Shoppes at Arbor Lakes, thanked staff for the thorough report. He explained this project was being brought forward to assist in improving an underutilized corner of the Shoppes at Arbor Lakes. He stated the outdoor patio was a nice amenity that would be utilized during the summer months. He indicated the total number of parking stalls that would be lost due to the building would be 33 stalls but noted 31 stalls were added to the Shoppes at Arbor Lakes through the recent renovations. Councilmember Jaeger asked where the handicap parking would be located. Mr. Landstad explained he would have four handicap parking stalls just to the west of the building. Councilmember Jaeger questioned if the city could support all of the new restaurants coming into Maple Grove. Mr. Landstad believed Maple Grove would be able to support all of the restaurants coming into the community. Councilmember Barnett inquired if the Shake Shack served alcohol. Mr. Landstad stated he did not recall seeing alcohol in the Shake Shack' s business plan. Motion by Councilmember byLeith, seconded Councilmember Jaeger, to approve directing the City Attorney to draft a Planned Unit Development Agreement and a Resolution approving the Shake Shack PUD Non- Residential Concept Stage Plan Amendment and Development Stage Plan, subject to: 1. This item would Items come to the City Council on Monday, March 2nd A KinderCare will be coming to the Markets at RushCreek. ProMed was hoping to locate on Wedgewood Road. It was noted this week was National Entrepreneurs Week. Staff thanked all of the entrepreneurs that chose to work in Maple Grove. Report on Upcoming There was nothing to report at this time. Engineering Items Heidi Nelson, Ms. Nelson explained that the Council has her Monday report if City there are any questions. She reported the State of the City event Administrator would be held on Friday, February 28th at 7: 30 a.m. at the Community Center. She stated the City Council' s strategic planning session would be held on Saturday, February 29th from 8: 30 a.m. to 3: 00 p. m. Items Added Councilmember Jaeger reported the CROSS fundraiser would to the Agenda be held on Thursday, March 12th Councilmember Jaeger commented the city was offering free tax assistance to seniors. Councilmember Leith stated on Friday, March 6th the Lions would be hosting a 3rd Annual Wine and Beer tasting at the Maple Grove City Council Minutes February 18, 2020 Page 16 Community Center. Councilmember Barnett explained she recently attended an Advisory Board Meeting for the Center for Innovation in the Arts. She commented further on the partnership that was created between North Hennepin Community College, Metropolitan State University, Hennepin County, the Osseo Area Schools, and the City of Brooklyn Park. She explained this group has been brought together to request bonding from the State of Minnesota to assist with constructing a new art center. Adjournment Motion by Councilmember Jaeger, seconded by Councilmember Barnett, to adjourn to the regular City Council meeting on March 2, 2020 at 7: 30 p.m. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays.
