Maple Grove City Council Meeting Meeting Minutes June 15, 2020 Call to Order Pursuant to call and notice thereof, a Regular Meeting of the Maple Grove City Council was held at 7: 30 p. m. on June 15, 2020 at the Maple Grove Government Center/ Public Safety Facility, Hennepin County, Minnesota as well as via WebEx. Members present were Mayor Mark Steffenson and Councilmembers Judy Hanson, Karen Jaeger, Phil Leith, and Kristy Barnett. Absent was none. Present also were Heidi Nelson, City Administrator; Joe Hogeboom, Community and Economic Development Director; Peter Vickerman, Planning Manager; Ken Ashfeld, Public Works Director/City Engineer; Jupe Hale, Assistant City Engineer; Jesse Corrow, Associate Planner; and Justin Templin, City Attorney. Mayor Steffenson called the meeting to order at 7: 30 p. m. and led the city in the Pledge of Allegiance. Rental Housing Funding), 3H ( Lord of Life Purchase Agreement) and 3P Agreement for School Resource Officer Services by and Between Osseo Area Schools, ISD 279 and City of Maple Grove). Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Consideration The following items were pulled from the Consent Agenda. of Items Regarding Item 3D ( Bottineau Ridge Apartments — Phase III Pulled from Duffy Development Co. Rental Housing Funding), the Agenda Councilmember Barnett stated the city was working with John Duffy on the final phase of this development, noting Bottineau Ridge Apartments were providing lower income housing for Maple Grove residents. Motion by Councilmember Barnett, seconded by Councilmember Leith, to waive $ 140, 000 of the building permit fees, city sewer and water hookup, and Park Dedication fees, as identified in code. This is contingent upon approval of the Development Stage Plan of Bottineau Ridge Apartments Phase III. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Regarding Item 3H ( Lord of Life Purchase Agreement), Mayor Steffenson explained his law firm represents Lord of Life and therefore he would be abstaining from the vote on this item. Motion by Councilmember Jaeger, seconded by Councilmember Leith, to approve Purchase Agreement with Maple Grove City Council Minutes June 15, 2020 Page 6 Lord of Life Church ( Parcel No. 3011922240005, 7401 County Road 101) public right- of-way subject to the final approval of the City Attorney and Director of Public Works. Upon call of the motion by Acting Mayor Jaeger, there were four ayes, no nays and one abstention ( Mayor Steffenson). Motion carried. Regarding Item 3P ( Agreement for School Resource Officer Services by and Between Osseo Area Schools, ISD 279 and City of Maple Grove), Councilmember Barnett stated the city received several emails regarding this matter. Mayor Steffenson reported the City Council received 16 emails. He requested the Council make a motion to receive the emails as part of the record. Motion by Councilmember Leith, seconded by Councilmember Hanson, to receive the 16 emails received from the public as part of the record. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. All comments have been included in Maple Grove City Council Minutes June 15, 2020 Page 7 the agenda packet. Councilmember Leith stated there were a lot of people in the emails that asked the city to not move forward but he wanted it to be known this was a request for a specific position from the Maple Grove School District. Councilmember Barnett commented she spoke with four different school board members this afternoon, along with Chief Werner. She explained she would like to point out that the results from a student survey completed in 2019, 95% of the students supported the SRO' s provided by the Maple Grove Police Department.She was told by the school board members that the SRO' s foster positive relationships with the students and staff members. She indicated if the SRO' s were not in the schools other officers who were unfamiliar with the students and staff would arrive, and would have to try to de- escalate the crisis situation. She believed the SRO' s served a good purpose and noted there was no other alternative plan in place. She reported the contract had a cancellation clause within the agreement. She explained the SRO' s do not wear uniforms in the schools and these officers have built strong, positive relationship with the students that began when these kids attended DARE. Kristy Janigo, 13842 84th Place North, stated she appreciated the Maple Grove Police Department and noted she met many of the officers when she attended the Citizen' s Police Academy in 2017. She discussed some data regarding SRO' s and their effectiveness in school systems. She reported the murder of George Floyd has people reconsidering priorities regarding public safety. She explained Maple Grove was a suburban community that enjoys a low crime rate. However, residents cannot assume that such a tragedy could not happen in Maple Grove without planning ahead and changing a broken system. She offered some food for thought regarding SRO' s from a report drafted by University of Minnesota graduate students. This report stated 61% of all Minnesota public high schools have SRO' s with the belief these agents will keep kids safe. She explained research does not support this narrative but rather school communities have a stronger impact on school safety. She noted the Harvard Civil Rights Civil Liberties Review found that SRO' s do not deter mass shootings. She indicated these programs disproportionately target black and indigenous Maple Grove City Council Minutes June 15, 2020 Page 8 students and students of color, contributing to the school to prison pipeline. She stated the police presence in schools disrupts student learning by orienting school discipline to approach students as criminals. She explained empirical data shows SRO presence in schools increases the likelihood that school officials will refer students to law enforcement, even for low level offenses. She indicated SRO programs and punitive disciplinarian practices contribute to an increase in disproportionate racialized disparities pushing out black, indigenous and people of color from schools. She reported these and other studies show that SRO' s are ineffective. She commented in the 2015- 2016 school year, police in Minnesota made 1, 080 arrests and 5, 005 referrals at schools. She believed SRO' s were untrained in mediation and de- escalation when trying to manage youth behaviors that indicate exposure to violence, trauma and abuse. She stated over-policing can contribute to mistrust and community trauma. She thanked the Council for listening to her comments. Motion by Councilmember Barnett, seconded by Councilmember Hanson, to approve the agreement for School Resource Officer Services by and Between Osseo Area Schools, ISD 279 and City of Maple Grove for July 1, 2020 through June 30, 2023. Mayor Steffenson reported all officers within the Maple Grove Police Department must attend 40 hours of de- escalation training, which includes the SRO' s. He believed the program between the Maple Grove Police Department and the school district has worked well. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Special Business Open Forum Mayor Steffenson reported he received an email from Wendy Green, 8535 Shadow Creek Dr., stating the city should not defund the police. A second email was received from L. C. Harris, 9936 108th Ave N., stating concerns about a neighbor who was burning yard waste. A third email was received from Rosalind Anderson, 7911 Ithica Ln N., indicating if people are not required to wear masks when voting she would not be able Maple Grove City Council Minutes June 15, 2020 Page 9 to serve as an election judge. A fourth email was received from Hawanya Hopson, 12597 84th PI N., asking what can be done about the city' s hard water. Update on Fire Chief/ Emergency Management Director Tim Bush COVID- 19 provided the Council with an update on the city' s response to COVID- 19. He reported the City of Maple Grove has managed Response the pandemic well over the past few months through limiting contact and increased social distancing. He described how staff has been working over the past three months. He commented on how the city was slowly working to reopen, along with the State of Minnesota. He discussed the measures that were in place to protect staff that work at face- to- face counters. He explained virtual meetings would continue for the time being. He reported the total number of COVID- 19 cases across the nation continues to increase, however the number of visits to outpatient providers and emergency rooms was on the decline. He stated this did not mean the pandemic was over. He explained COVID- 19 remains especially dangerous to the elderly, 65 or older, especially those with underlying health conditions. He reported this Friday, Governor Walz issued another executive order. He discussed how the dials were being adjusted with respect to the Stay At Home order. He encouraged residents to remain at home when possible, to practice proper handwashing and to be socially distanced when in public. City Administrator Nelson stated due to the COVID- 19 City Staff Pandemic, the City is unable to honor city retirees with a Retirement celebration of service with colleagues, family and friends in Recognition attendance. Denise Thul took a moment to show the city' s appreciation to Human Resources Specialist Joyce Edmeier for her 20 years of dedicated service and contributions to the community. Mayor Steffenson thanked Joyce Edmeier for her dedication to the City of Maple Grove. Councilmember Jaeger wished Joyce Edmeier a wonderful retirement. 7: 30 p. m. Assistant City Engineer Hale requested the Council consider an easement vacation related to the Elm Road project. He Public described the location of the easements that would be vacated Hearing within the existing right-of-way along Elm Road. He reported the entire roadway would not be vacated, only the portions that Maple Grove City Council Minutes June 15, 2020 Page 10 were being developed. Easement Vacation Motion by Councilmember Leith, seconded by Mayor Steffenson, to open the public hearing. Upon call of the Resolution 20- motion by Mayor Steffenson, there were five ayes and no 087 nays. Motion carried. Mayor Steffenson opened the public hearing at 7: 57 p. m. and asked if anyone would like to address this issue. No public testimony was offered. Motion by Councilmember Leith, seconded by Councilmember Jaeger, to close the public hearing at 7: 58 p. m. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion by Councilmember Leith, seconded by Councilmember Jaeger, to approve adopting Resolution No. 20- 087 vacating certain easements located in the City of Maple Grove, County of Hennepin, State of Minnesota. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. 7. 30 p. m. Assistant City Engineer Hale requested the Council consider an Public easement vacation related to the Palisades at Nottingham 2° d Addition. He described the location of the easements that would Hearing be vacated within the perimeter of drainage and utility Easement easements, along with a remnant portion of Xene Lane N. He commented further on the requested easement vacation and Vacation recommended approval. Resolution No. Councilmember Jaeger requested if the water problems would 20- 088 be addressed. Assistant City Engineer Hale reported a grading plan has been approved and noted ponds have been added to handle the runoff. Motion by Councilmember Leith, seconded by Councilmember Barnett, to open the public hearing. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Mayor Steffenson opened the public hearing at 8: 00 p.m. and asked if anyone would like to address this issue. Maple Grove City Council Minutes June 15, 2020 Page I Greg Hoglund, 7310 Zanzibar Lane North, asked if this parcel had been approved by the Copper Creek Development Company. Mayor Steffenson reported this plan was approved six to twelve months ago. Planning Manager Vickerman discussed the Copper Creek at Nottingham project. He reported the project was taken over by a new developer and it was renamed to Palisades at Nottingham 2nd Addition. This renaming of the plat came through a few months ago and no changes had been made to the plat. Mr. Hoglund explained he did not oppose the development. He stated he has significant water challenges which flow under a driveway towards this development. He indicated he would like to better understand how the water was flowing because he would have to have water flowing off of his property into the development. He indicated he would like to speak with the developer and staff members regarding this concern. Mayor Steffenson stated the engineering staff would investigate this further and would be in touch with Mr. Hoglund. Public Works Director/ City Engineer Ashfeld commented on the history of this project and suggested members of the city' s engineering staff meet with Mr. Hoglund to discuss the drainage within the development as well as the surrounding properties. Motion by Councilmember Leith, seconded by Mayor Steffenson, to close the public hearing at 8: 08 p. m. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Motion by Councilmember Leith, seconded by Councilmember Hanson, to approve adopting Resolution No. 20- 088 vacating certain easements located in the City of Maple Grove,County of Hennepin, State of Minnesota. Community Development Items Territorial Motion by Mayor Steffenson, seconded by Councilmember Greens PUD Leith, to remove this item from the table. Upon call of the motion by Mayor Steffenson, there were five ayes and no Maple Grove City Council Minutes June 15, 2020 Page 12 Residential nays. Motion carried. Concept Plan Planning Manager Vickerman explained at the last City Council Amendment meeting the Council tabled action and directed staff to work Territorial with Hennepin County regarding traffic improvements at the Greens East & intersection of Territorial Road and Fernbrook Lane. Staff West reached out to Hennepin County and completed analysis on this intersection. He reported the analysis found that the existing Development Stage Plans traffic would not warrant any control device at the intersection of Territorial Road and Fernbrook Lane. He reported even with Preliminary the addition of the Fernbrook View Apartments traffic, this and Final would not warrant a control device. With the additional traffic Plats from the proposed development, then a warrant is made for a traffic signal. He commented this information was provided to Hennepin County and continued dialogue has been held with them. He reported Hennepin County was favoring a mini- roundabout at this intersection at this time. He stated Hennepin County was open to having an acceleration lane onto CSAH 81. Public Works Director/ City Engineer Ashfeld defined the word warrant and stated based on traffic volumes, a traffic signal would be warranted. He commented Hennepin County had roadway jurisdiction on Fernbrook Lane. He indicated traffic warrants were a national standard and a process must be followed in order to be installed. He reported the city has been working with Hennepin County on the need for this signal, encouraging the county to be more proactive. He explained the new developments and the proposed signal was a chicken and the egg situation. He reported Hennepin County has committed that as the city moves forward with the public improvements to support the proposed development, an element of that project would be to do some geometric changes at Fernbrook and Territorial to prepare for a traffic signal. He stated an all- way stop was considered along with doing nothing. He commented further on the options that were considered, which included a roundabout. He indicated a temporary signal was an option at this location and this would be an element of the upcoming public improvements. He explained a variation of a roundabout was also considered, but the city and the county understood this would take up a great deal of real estate. He commented on the benefits of moving forward with a mini-roundabout at the intersection of Fernbrook and Territorial. He believed there would be long-term benefits in pursuing the mini-roundabout versus a temporary signal. He reported Hennepin County has Maple Grove City Council Minutes June 15, 2020 Page 13 approved a temporary signal at this intersection or a mini- roundabout which could be constructed in conjunction with the public improvements to serve Territorial Greens and would replace the need for turn lanes. Councilmember Jaeger asked when construction on the mini- roundabout would begin. Public Works Director/ City Engineer Ashfeld reported there were no hard and fast rules as to when a roundabout can be built. He commented with regular intersections, turn lanes can be built in to accommodate traffic. However, with a roundabout it would not be wise to build the phased pieces and then come back and remove these improvements to accommodate a mini- roundabout. He explained staff was working with Hennepin County on an operational plan. He thought that a roundabout would be constructed in the spring of 2021. Councilmember Hanson stated it was her understanding that Hennepin County was not committed to the mini-roundabout at this time. Public Works Director/ City Engineer Ashfeld reported this was the case. He reported staff does have a commitment on the traffic signal. Councilmember Hanson questioned if staff supported the mini- roundabout. Public Works Director/ City Engineer Ashfeld explained staff was moving in favor of a mini- roundabout. He commented on the cost and real estate involved in a full- sized roundabout. He noted the cost and real estate involved in a mini- roundabout would be more closely aligned with that of a geometric signal. Councilmember Hanson inquired who would be responsible for paying for the mini-roundabout. Public Works Director/ City Engineer Ashfeld reported this would be a special assessment to all of the developments that have occurred and will occur in this area. Councilmember Hanson asked if the Council could approve this project, but making it subject to support from Hennepin County of the mini- roundabout. City Attorney Templin reported the Council could place this as a condition for approval. Councilmember Leith indicated he liked the idea of the roundabout because this would slow traffic while allowing people to accomplish the necessary traffic maneuvers. He Maple Grove City Council Minutes June 15, 2020 Page 14 explained he could support this project moving forward contingent upon the mini roundabout being installed in the spring of 2021. He questioned when the acceleration lane on CSAH 81 would be installed. Public Works Director/ City Engineer Ashfeld commented the acceleration lane should be accomplished fairly quickly due to the fact pavement was already in place. He stated he would continue to work on this matter with Hennepin County. Councilmember Jaeger supported the city pursuing the mini- roundabout and having this part of the condition for approval. Mayor Steffenson reported the City Council received a letter from Gregory Soule on behalf of the developers along with an email from John Cooper where he expressed his concerns regarding the project. Motion by Councilmember Jaeger, seconded by Councilmember Barnett, to accept the letters into the record. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Greg Soule, Attorney for the developer, introduced himself to the Council. He reported he was not going to address the traffic issues and applauded the Council for trying to remedy the situation. However, he emphasized yet again, that under city ordinances, the Council had no authority to disapprove the Development Stage Plans based on traffic concerns. He explained the sole criteria for deciding whether or not a Development Stage Plan was approved was in conformance with the Concept Plans. He commented all of the conversation regarding traffic was not a valid criteria for denying Development Stage approval, nor should the approval be conditioned upon the county completing some traffic measure. He stated he would like to hear from the City Attorney on where City Code allows for a development to be denied due to traffic concerns. Beth Hustad, Trek Real Estate, encouraged the Council to please reconsider what they were asking to do. She commented on the timing of her development and stated she hoped to have residents living in homes in late 2021. Councilmember Barnett asked if there was an amendment to the Concept Plan that she did not agree with would she vote the Maple Grove City Council Minutes June 15, 2020 Page 15 entire project down, or just the change. City Attorney Templin reported this project was being presented as a package and the vote would have to be against the entire project. Mr. Soule reported the developer has already received approval for Territorial West and no changes were being requested. He stated the developer was simply seeking Development Stage approval. Ms. Hustad commented the east side received Concept Stage approval and have since made a change to the plans. She noted staff supported the proposed change. Councilmember Leith questioned if a Development Stage plan was approved for the east. He indicated the developer has changed the unit type and was now requesting 30% more units. Planning Manager Vickerman clarified there was only one Concept Plan for the entire site. That was how the development was previously approved, with apartments on the west side and less density on the east side. He noted the changes to the east side going from a single family detached product to an attached product triggered the Concept Plan Amendment for Territorial Greens. He explained the City Council was being asked to approve this amendment along with a final Development Stage Plan approval for the east and west. William Gallagher, 13982 102° d Place North, explained he was the treasurer for the Territorial Woods homeowners association. He stated he sent an email to the City Council at 8: 10 p. m. on Sunday, June 14ti' Mayor Steffenson reported the Council had received this email. Mr. Gallagher commented on his email stating he was concerned with the west development. He explained the villas would back up to adjacent homes and requested a high plank fence be installed in the rear yards. Planning Manager Vickerman stated the initial proposal did not have any fence in that area because of a water line that was proposed to be located along this property line. However, after discussing this matter with the Fire Department it was determined this water line would be redundant and not necessary. He reported one of the initial conditions for approval that additional vegetation be planted between the two sites. Maple Grove City Council Minutes June 15, 2020 Page 16 Mr. Gallagher stated it was his understanding the villas would be rental units and he wanted to have a barrier or screening of some sort between the rental units and the adjacent homes. Ms. Hustad explained she spoke with Mr. Vickerman and agreed to put landscaping in the rear of the villas to assist with the transition to the adjacent homes. She indicated the villas would have an association to assist with grounds maintenance of the villas. She commented this was recommended as a condition for approval. Mr. Gallagher commented his second area of concern was with traffic. He stated he supported the mini-roundabout moving forward, along with the acceleration lane onto CSAH 81. Ms. Hustad indicated this project would take a significant amount of time. She explained if construction were to begin in August, streets would not be completed until the spring of 2021. She asked if the city believed it would be reasonable for the project to begin this fall while the city works on the traffic concerns with Hennepin County. Public Works Director/City Engineer Ashfeld stated he does not make decisions about what was reasonable. He noted the City Council has to address public safety concerns. He reported the issue boils down to whether or not Hennepin County would be comfortable with the mini-roundabout. Ms. Hustad stated the site does not warrant any additional traffic measures at this time. She reported no additional traffic measures would be required until her project was fully built out and this would not occur for three more years. She asked that the Council please consider not delaying this project again. Councilmember Hanson noted the 120- day deadline for this deadline was July 28th. She questioned if action on this item should be delayed to July 20th to allow staff to speak further with Hennepin County. Public Works Director/ City Engineer Ashfeld stated he made some great strides in the last 30 days. He commented the Council does not meet again for the next five weeks and he anticipated the city could have a commitment from the county in that time. Mayor Steffenson asked for comment from the City Attorney at this time. City Attorney Templin advised one concept was Maple Grove City Council Minutes June 15, 2020 Page 17 before the City Council and the developer was requesting an amendment. Mayor Steffenson questioned if the Council could approve the Concept Plan Amendment with a condition. City Attorney Templin explained the Council could approve the Concept Plan Amendment with a condition because reconsidering this matter brings all of the subject matter back into discussion. Councilmember Hanson stated she would consider tabling this matter again to allow staff to work with the county in hopes of getting a commitment before the 120- day deadline. Otherwise, she would be in support of making the traffic measures a condition for approval. Councilmember Leith agreed with this recommendation. He noted the city had until July 281h within the 120- day deadline and reported the City Council would meet next on July 20th. Mayor Steffenson reported if the Council were to delay action to July 201h the Council would be required to approve resolutions that evening. City Attorney Templin commented this would be the case and staff would be directed to prepare two competing resolutions for both outcomes. Mayor Steffenson stated his preference would be to direct staff to draft a resolution to pass the Concept Plan Amendment with the condition attached. He noted this matter would come back to the City Council for final approval on July 20th. He indicated the other option would be for the Council to table action on the item. Councilmember Leith stated he could go either way on this item. Councilmember Barnett explained it may be less confusing to table action to July 20th because the City Council would know more from the county by that date. Maple Grove City Council Minutes June 15, 2020 Page 18 New Creation Associate Planner Corrow stated the applicant is requesting a PUD Concept Stage Plan Amendment and Development Stage Daycare PUD Concept Stage Plan for the purpose of constructing a childcare center. The project was near the intersection of Highway 101 and County Plan Road 10 adjacent to the Havenwood senior living facility. The Amendment amendment was being requested to allow for an increase in the and building size from 10, 000 square feet to 12, 798 square feet. It Development was noted the building would have a 52- stall parking lot, along Stage Plan with and outdoor classroom and two large outdoor play areas. Staff commented further on the proposed request and recommended approval. Andy Bollig, representative for the applicant, thanked the Council for considering his request and explained New Creations was looking forward to being located in Maple Grove. The project was located Building D in the Village Arbor Lakes adjacent to Wahlburger' s. It was PUD Non- noted the building was previously proposed to be 3, 700 square Residential feet and would now be 5, 200 square feet. He explained a Concept Stage national coffee shop brand would be located in the building, Plan along with another retail user. Staff commented further on the Amendment proposed building design and recommended approval. Development Tony Kuechle, Doran Companies, thanked the Council for Stage Plan considering his request. He explained he was excited to finish and Final Plat this quadrant of the development and noted the building would be designed to occupy three tenants, however, at this time he had two tenants in mind. Report on Community and Economic Development Director Hogeboom Upcoming updated the Council regarding the following: Community It was noted most businesses in Maple Grove have reopened. and Economic He noted policies were in place to safely respond to the Development pandemic. Items Churches in the community were working with the city to accommodate outdoor services through special event permits. The Planning Commission would be transitioning to hybrid meetings, which would allow for commissioners to remain at home or to be present at City Hall. The next Planning Commission meeting was scheduled for July 27tn Report on Director of Public Works/ City Engineer Ashfeld updated the Council regarding the following: Upcoming Engineering MnDOT was preparing to close the east bound ramps of the Maple Grove Parkway interchange. These ramps would Items remain closed through mid-July and a detour was in place. With the great weather the city has had this spring the city' s street improvement projects were moving right along. Heidi Nelson, Ms. Nelson explained that the Council has her Monday report if City there are any questions. She reported staff continues to monitor Administrator the activity taking place during the legislative special session. Ms. Nelson reported these masks to the Agenda were ordered by city staff from Embroider Me. Councilmember Jager stated on June 17, 2000 the grand opening of Arbor Lakes was held and on June 16, 2014 Eric Werner became Maple Grove' s Chief of Police. Councilmember Jaeger explained the farmer' s market was up and running. She encouraged residents to visit the farmer' s market each Thursday from 3: 00 p. m. to 7: 00 p. m. Councilmember Jaeger commented the Historical Society would be meeting outdoors on Thursday, June 18th. Those interested in attending were encouraged to bring their own chair and mask.
