Maple Grove City Council meeting meeting minutes November 1, 2021 Call to order Pursuant to call and notice thereof, a regular meeting of the Maple Grove City Council was held at 7:30 p.m. on November 1, 2021 at the Maple Grove Government Center/Public Safety Facility, Hennepin County, Minnesota. Members present were Mayor Mark Steffenson and Councilmembers Judy Hanson, Karen Jaeger, Phil Leith, and Kristy Barnett. Absent was none. Present also were Heidi Nelson, City Administrator; Joe Hogeboom, Community and Economic Development Director; Ken Ashfeld, Public Works Director/City Engineer; and Justin Templin, City Attorney. Mayor Steffenson called the meeting to order at 7:33 p.m. and led the city in the Pledge of Allegiance. Additions or Mayor Steffenson asked if there were any additions and/or deletions to deletions to the consent agenda to which Heidi Nelson stated the following: the agenda Item amended to the agenda Item 6B is to be considered prior to Item 6A. Appointment of mechanic Motion to approve the appointment of Gary Peterson to the position of mechanic in the central equipment division for the public works department at an annual salary of $70,314.40, effective November 2, 2021 subject to a twelve-month probationary period. All required screenings and background checks have been successfully completed. C. Recruitment for police officer This item was removed by Councilmember Leith for discussion. COMMUNITY & ECONOMIC DEVELOPMENT ITEMS D. Arbor Day Proclamation Motion to proclaim Saturday, November 6, 2021, as Arbor Day in the City of Maple Grove. E. Government Center accessibility upgrades Motion to approve the proposals received by Brin Glass Service and Pro-Tec Design, Inc. to provide automatic door operators at eight (8) restroom doors, and one (1) at the Engineering Department Door. J. Main Street rehabilitation - project establishment Motion to adopt Resolution No. 21-161 establishing Main Street Rehabilitation Project No. 19-10 and ordering feasibility report. K. Palisades at Nottingham 3rd Addition - Change Order No. 1 Motion to approve Change Order No. 1 to the Palisades at Nottingham 3rd Addition Utility and Street Improvement Project No. 2021-09 extending the substantial completion date to October 22, 2021. L. Rush Creek stream restoration, phase III - final acceptance Motion to approve the final acceptance of the Phase III Rush Creek Stream Restoration Project No. 2016-05 completed by Minnesota Native Landscapes subject to the warranty provisions of the contract and statutory law. M. Senior citizen - annual assessment deferral renewal Motion to adopt Resolution No. 21-162 approving the senior citizen/permanently disabled assessment deferral on 11 deferred properties for the 2022 tax year. Weaver Lake Road - retaining walls Motion to approve the proposal from SRF Consulting Group, Inc. to provide right-of-way acquisition and plan update services. ADMINISTRATIVE ITEMS P. Annual designation of polling places - Resolution No. 21- 160 Motion to adopt Resolution No. 21-160 designating polling places for the 2022 election year. Q. Amendment to Maple Grove City Code Chapter 26, Article IV Refuse Collectors Motion to approve Ordinance No. 21-18 amending Maple Grove City Code Chapter 26, Article IV regarding refuse collectors. Motion to authorize publication of the ordinance summary of Ordinance No. 21-18. R. 2022 Local Board of Appeal and Equalization meetings Motion to approve the initial Local Board of Appeal and Equalization meeting on Tuesday, April 12, 2022 at 7:00 PM and the meeting date of Tuesday, April 26, 2022 at 7:00 PM for the reconvene meeting. Both meetings will be held in the City Council Chambers. S. Opioid settlement opt-in Motion to adopt Resolution No. 21-153 authorizing and directing staff and legal counsel to execute required documents for the City of Maple Grove to opt in to a nationwide opioid litigation settlement. T. Approval of 2021 North Metro Regional Public Safety Training Facility joint powers agreement between the City of Maple Grove, the City of Plymouth, and the City of Maple Grove City Council Minutes November 1, 2021 Page 5 Brooklyn Park Motion to approve the 2021 North Metro Regional Public Safety Training Facility Joint Powers Agreement between the City of Maple Grove, the City of Plymouth, and the City of Brooklyn Park; and authorizing the mayor and city administrator to execute the agreement subject to final review by the city attorney. U. Premises permit application for a pull tab and bingo operation at Max’s on Main - Resolution No. 21-159 Motion to adopt Resolution No. 21-159 approving a premises permit application for Osseo-Maple Grove Hockey Association to conduct a pull tab (paper and electronic) and bingo (electronic) operation at Max’s on Main, 7890 Main St N, Maple Grove, Minnesota 55369. V. Premises permit application for a pull tab and bingo operation at Rock Elm Tavern - Resolution No. 21-164 Motion to adopt Resolution No. 21-164 approving a premises permit application for Osseo-Maple Grove Hockey Association to conduct a pull tab (paper and electronic) and bingo (electronic) operation at Rock Elm Tavern, 15641 Grove Circle N, Maple Grove, Minnesota 55369. W. Snowplowing agreement amendment with Interstate Companies Motion that the City Council authorize the mayor and city administrator to execute Amendment 1 to the Agreement between the City of Maple Grove and Interstate Companies for Snow and Ice Management at the Government Center and three transit facilities for the term November 1, 2021 through October 31, 2024. X. Approve claims Motion to approve claims totaling $ 2,859,461.19 Motion by Councilmember Jaeger, seconded by Councilmember Barnett, to approve the consent items as amended, removing item 3C (Recruitment for police Maple Grove City Council Minutes November 1, 2021 Page 6 officer). Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Consideration The following items were pulled from the consent agenda. of items pulled Regarding Item 3C (Recruitment for police officer), from the Councilmember Leith thanked Ron Nagy for his 25 years of agenda dedicated service to the Maple Grove Police Department and wished him all the best in his retirement. Mayor Steffenson thanked Officer Nagy for his tremendous service to the community and thanked his family for allowing him to serve. Motion by Councilmember Leith, seconded by Councilmember Hanson, to authorize staff to begin the recruitment process for the position of police officer in the police department due to the resignation of Officer Ron Nagy effective December 19, 2021. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Special business Open forum Joe Piket, 17749 62nd Avenue North, discussed a storm water utility fee the Council was proposing to implement in January 2022. He questioned if there was a need for this and thanked staff for addressing his comments. He understood the city had reserves that could possibly be used to assist with funding storm water expenditures in order to negate the need for additional fees for residents and local business owners. Community and Economic Development items Community and Economic Development Director Hogeboom Loukusa explained the applicant is requesting a short plat review of his Addition proposal to split the lot at 8202 Walnut Grove Lane North into Short Plat two lots. The subject property is located within the R-1 Single- Family Residential District. Staff discussed the plans in further detail and reported the Planning Commission recommends Maple Grove City Council Minutes November 1, 2021 Page 7 approval. Councilmember Leith asked if the existing house would remain in place. Community and Economic Development Director Hogeboom reported this was the case. David Loukusa, 8202 Walnut Grove Lane North, thanked the council for considering his request. Motion by Councilmember Leith, seconded by Councilmember Hanson, to adopt Resolution No. 21-156 approving the Loukusa Addition short plat subject to: 1. The applicant addressing to the satisfaction of the city any remaining applicable comments contained in the memorandums from: a. The Community & Economic Development Department dated September 20, 2021 b. Water Resources dated September 16, 2021 c. The Parks & Recreation Department, dated October 5, 2021 The applicant shall acknowledge that park dedication requirements are based on staff review and recommendation to the Park and Recreation Board and their subsequent board action. Board meetings are held on the third Thursday of each month. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Hansen Shih Community and Economic Development Director Hogeboom Maple explained the applicants are proposing to subdivide the parcel at 12101 93rd Avenue North into four separate lots to build two Addition PUD twin homes (for a total of four units.) Existing conditions of the Concept Stage property show a lot area of 28,595 square feet (0.66 acres) and a Plan, lot width of 200 feet along County Road 30 (93rd Avenue Development North). The site is guided for medium density residential which Stage Plan has a density range of four to ten units per acre. The and Final Plat development is modeled after the twin home lots lining 92nd Avenue North located just south of this proposed development site. Each of those lots are approximately 45 feet wide. This allows the two townhome structures to be closer so that there is Maple Grove City Council Minutes November 1, 2021 Page 8 enough room to accommodate guest parking/turn around areas at the ends of the private driveway. Vehicular access to the site is proposed off of County Road 30 with a shared private driveway. The units and driveway are arranged so that residents leaving the site will not need to back onto County Road 30 but can turn around onsite. This property received a variance on September 3, 1991 which allowed the residential lot direct access onto a minor arterial street. The variance was approved in combination with the Wellington Crest 3rd Addition plat that changed this lot from an outlot to lot and block status. Staff discussed the plans in further detail and reported the Planning Commission recommended approval. Councilmember Leith stated he was surprised the county was allowing access to County Road 30. He questioned if staff had additional information regarding the culvert cleaning and how the culvert would be accessed. Community and Economic Development Director Hogeboom reported an easement would remain in place to allow the city to access the culvert. Jin Hansen, 12101 93rd Avenue North, explained he purchased this property to build two twinhomes, four total units. He indicated he met with the county to ensure he would have access to County Road 30. He reported the plans were designed to meet the city’s requirements and staff’s recommendations. He thanked the council for considering his request and noted he supported the property having an easement in place for the culvert. Jessica Hammer, 9278 Ives Lane North, reported the back of her property abutted 93rd. She indicated her neighborhood has concerns regarding this proposal which led her to send an email to the City Council. She explained she was concerned with how the proposed development would impact her property value. She feared the proposed rental units would not have adequate parking and anticipated parking would spill over into her cul-de- sac. In addition, she feared for the safety of the pedestrians and bikers that used the sidewalk. She encouraged the council to take into consideration the neighbors’ concerns and questioned what value this project would be bringing to Maple Grove. Mr. Hansen explained these concerns were taken into consideration and reported he did his best to accommodate the needs of the future tenants. He indicated there was only access Maple Grove City Council Minutes November 1, 2021 Page 9 point for safety purposes. He stated the county road would be restriped to help alleviate traffic concerns. Councilmember Leith questioned what the width of the driveways would be. Mr. Hansen discussed the driveway width and noted the guest parking would be allowed in the hammerheads. Councilmember Jaeger questioned how much storage these units would have given the fact there was no basement. Mr. Hansen explained the garage could be used for storage, along with the space under the stairs and in the laundry room. Councilmember Jaeger inquired if all of the units would be rented. Mr. Hansen stated this was the case. He reported it was his hope to sell the units in the future. Councilmember Jaeger asked if this item should be tabled until the request receives approval from Hennepin County. Community and Economic Development Director Hogeboom explained Hennepin County staff has given preliminary feedback, in the form of a memo, that states access will be granted. He indicated the city would not approve any city permits until an access permit was granted by the county. Councilmember Jaeger questioned what would happen if one of the units were to sell. Community and Economic Development Director Hogeboom stated cross easements would be in place so that if one unit were sold, they would have the right to cross to get to the entry point on County Road 30. Councilmember Leith inquired if rental units were allowed under the current zoning. Community and Economic Development Director Hogeboom commented rental units were allowed anywhere in the city. He explained the property owner would have to receive a rental license with the city in order to rent the twinhomes. Ms. Hammer provided the council with a photograph of how the new driveway would look from her neighborhood. She indicated these plans were taken from the meeting notes and commented her cul-de-sac would now have a parking lot in its rear yard. She commented she was also concerned about the level of traffic that would be generated by the proposed development. Maple Grove City Council Minutes November 1, 2021 Page 10 Councilmember Jaeger agreed stating she did not like all of the additional traffic that would be using 93rd. She asked if all requirements were being met with this request, or if the council could deny. Councilmember Hanson commented she did not believe the council had a legitimate reason to deny the request. She agreed this may not be the best place for these twinhomes, but noted there could be even more units than was being requested. Motion by Mayor Steffenson, seconded by Councilmember Hanson, to direct the city attorney to draft a resolution and a Planned Unit Development agreement approving the Hansen Shih Maple Addition PUD concept stage plan, development stage plan and final plat subject to: 1. The applicant addressing to the satisfaction of the city any remaining applicable comments contained in the memorandums from: a. The Parks & Recreation Department, dated October 5, 2021 b. Hennepin County Public Works dated September 30, 2021 c. Hennepin County Public Works dated October 28, 2020 2. The applicant addressing to the satisfaction of the Engineering Department all applicable comments contained in the drawing dated October 15, 2021. 3. The applicant expanding the drainage and utility easement on the east side of the property to allow access to the wetland to the south as directed by staff. The applicant shall acknowledge that park dedication requirements are based on staff review and recommendation to the Park and Recreation Board and their subsequent board action. Engineering- Public Works items Report on Director of Public Works/City Engineer Ashfeld updated the Council regarding the following: upcoming Engineering • A public informational meeting would be held regarding the items city’s wellhead protection plan amendment on Wednesday, November 17 at 2:00 p.m. at the Government Center. Administration items Report on City Administrator Nelson explained that the council has her upcoming Monday report if there are any questions. She reported there would be a Veteran’s Day event at the memorial at Central Park Administration on Thursday, November 11 at 9:00 a.m. Items Items added to Councilmember Jaeger reported there would be a holiday the agenda boutique on Saturday, November 13 at the Maple Grove Community Center. Councilmember Jaeger noted the Rotary gala would be held on Saturday, November 13.
