Maple Grove City Council meeting meeting minutes November 21, 2022 Call to order Pursuant to call and notice thereof, a regular meeting of the Maple Grove City Council was held at 7:30 p.m. on November 21, 2022 at the Maple Grove Government Center/Public Safety Facility, Hennepin County, Minnesota. Members present were Mayor Mark Steffenson and Councilmembers Judy Hanson, Karen Jaeger, Phil Leith, and Kristy Barnett. Absent was none. Present also were Heidi Nelson, City Administrator; Joe Hogeboom, Community and Economic Development Director; Brett Angell, Assistant Community and Economic Development Director; Ken Ashfeld, Public Works Director/City Engineer; and Justin Templin, City Attorney. Mayor Steffenson called the meeting to order at 7:30 p.m. and led the city in the Pledge of Allegiance. Additions or Mayor Steffenson asked if there were any additions and/or deletions to the deletions to the consent agenda to which Heidi Nelson stated agenda the following: Item amended to the agenda None Item amended to the consent agenda None Item added to the agenda None Item removed from the consent agenda for discussion 3F. Regular Meeting – November 7, 2022 HUMAN RESOURCES ITEMS B. Appointment of city assessor, and recruitment approval for senior residential appraiser Motion to approve the promotion of Markus Yager to the position of city assessor at an annual salary of $110,997.12, effective November 22, 2022 subject to a 12-month probationary period. All required screenings and background checks have been successfully completed. Motion to authorize staff to begin the recruitment process for senior residential appraiser. C. Position elimination of assessing technician Motion to approve the position elimination and related separation agreement for Pam Olson from the assessing technician position as of January 20, 2023. D. Recruitment approval for assistant fire chief of professional standards and training Motion to authorize staff to begin the recruitment process for the vacant assistant fire chief of professional standards and training position due to the resignation of Aaron Morris with an effective date of November 11, 2022. COMMUNITY & ECONOMIC DEVELOPMENT ITEMS E. Bella Woods planned unit development concept stage plan Motion to table the application for Bella Woods planned unit development concept stage until December 5, 2022. F. Evanswood Project No. 21-10 - Change Order No. 3 Motion to approve Change Order No. 3 to Evanswood Project No. 21-10 in the amount of $78,760.29. H. Resolution of support for funding Fish Lake Interchange improvements - Resolution Nos. 22-176 and 22-177 Motion to adopt Resolution Nos. 22-176 and 22-177, resolutions in support of the City of Maple Grove and the I-94 West Corridor Coalition’s 2022 Corridors of Commerce grant applications for funding of improvements to the Fish Lake Interchange. I. Special assessment deferment on MXD properties - Resolution No. 22-172 and 22-173 Motion to adopt Resolution No. 22-172 establishing the deferment of special assessments (principal payments) for certain Mixed Use guided properties for the tax year 2023. Motion to adopt Resolution No. 22-173 establishing the deferment of special assessments (principal and interest payments) for certain Mixed Use guided properties for tax year 2023. J. Street reconstruction Project No. 20-03 - final acceptance Motion to approve the final acceptance of Weaver Lake Highlands, Hiller, Hiller Autumn Woods, and Hiller White Oaks on the Park Street Reconstruction Project No. 20-03, completed by Park Construction Company subject to the warranty provisions of the contract and statutory law K. Sureties - November 21, 2022 Motion to approve the surety actions. L. Townhouse Villages at Eagle Lake, Project No. 22-01 - Maple Grove City Council minutes November 21, 2022 Page 4 Change Order No. 2 Motion to approve change order No. 2 to Townhouse Villages at Eagle Lake, Project No. 22-01 in the amount of $99,258.02. ADMINISTRATIVE ITEMS M. Annual transfers for the Long-Term Development Plan 22- 170 Motion to adopt Resolution No. 22-170 approving the 2022 Transfers for The Long-Term Development Plan. N. Gleason Fields Athletic Complex - Project Fund Allocation Motion authorizing funding for the Gleason Fields Athletic Complex from the Long-Term Development Fund (includes a reimbursement by OMGAA of $1.88M), General Fund surplus, Park Dedication Fund and a Hennepin Youth Sports Program grant, for a total allocation of $14,920,000. O. Technology upgrade to police department roll call room contract approval A motion to approve and the chief of police to execute the contract from Marco to provide technology upgrades to the Police Department’s roll call room in the amount of $38,286.64. The contract is subject to final approval by the Maple Grove city attorney. P. Approve claims Motion to approve claims totaling $ 3,319,674.28. Motion by Councilmember Jaeger, seconded by Councilmember Leith, to approve the consent items as amended, removing item 3F (Proclamation for Small Business Saturday). Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Consideration of The following items were pulled from the consent agenda. Maple Grove City Council minutes November 21, 2022 Page 5 items pulled from Regarding Item 3F (Proclamation for Small Business Saturday), the agenda Councilmember Barnett encouraged residents to get out and visit Maple Grove’s small businesses on Saturday, November 26. She thanked the city’s Community and Economic Development Department for bringing this proclamation forward. Motion by Councilmember Barnett, seconded by Councilmember Hanson, to approve Saturday, November 26, 2022 as Small Business Saturday in the City of Maple Grove and to recognize the positive economic impact that small businesses contribute to the community. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Special business Open forum Travis Mitchell, 9209 Upland Lane, congratulated Kristy Janigo and Rachelle Johnson for being elected to the City Council. He feared the city did leave some talent on the table and suggested the size of the City Council be increased to seven members. He discussed the Council’s pay scale and how it would be impacted if the group were increased to seven members. He asked that the Mayor and City Councilmembers ask Lifetime Fitness to move to TH610 in order to make room for the Community Center expansion. Public hearings 7:30 p.m. public Assistant Community and Economic Development Director hearing Angell stated Maple Commons, Limited Partnership, a related entity of MWF Properties, has requested that the city issue a MWF Properties multifamily housing revenue note to finance the acquisition and construction of the approximately 160-unit affordable Garland senior multifamily housing development to be called Garland Commons Commons. The development will include units ranging from efficiencies to two-bedrooms and estimated initial rents Multifamily ranging from $580/month to $1,527/month. Staff commented revenue note further on the proposed request and recommended approval issuance and sale of the issuance of the multifamily revenue note. resolution Mayor Steffenson stated the bonds, when issued, would create no liability to the city. Motion by Councilmember Barnett, seconded by Councilmember Hanson, to open the public hearing. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Mayor Steffenson opened the public hearing at 7:37 p.m. and asked if anyone would like to address this issue. No public testimony was offered. Motion by Councilmember Jaeger, seconded by Councilmember Barnett, to close the public hearing at 7:38 p.m. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Motion by Councilmember Leith, seconded by Councilmember Barnett, to adopt Resolution No. 22-174 approving the issuance and sale of Multifamily Housing Revenue Note (Garland Commons project), Series 2022, pursuant to Minnesota Statutes Chapter 462C. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Community and economic development items Dental Associates Assistant Community and Economic Development Director of Maple Grove Angell explained Sperides Reiners Architects, applicant, are comprehensive seeking a comprehensive plan amendment, PUD concept stage plan amendment, plan, development stage plan, rezoning, and final plat approval planned unit to accommodate a new 13,606 square foot dental office development building. The proposed development would be located on a concept stage portion of the Maple Grove Covenant Church property at 9350 plan, Upland Lane North. The applicant did host a neighborhood development meeting on Tuesday, October 25, 2022 at Maple Grove stage plan, Covenant Church regarding this development. The plat request rezoning and for the proposed development includes the creation of an final plat additional 2.5-acre lot on the northern portion of the lot. This Maple Grove City Council minutes November 21, 2022 Page 7 area of their lot is currently being utilized as greenspace and is primarily grass. The approximately 9.2-acres of remaining land would be retained by Maple Grove Covenant Church and the parcel would continue to operate as a religious institution. Staff commented further on the proposed request and reported the Planning Commission recommends approval. Councilmember Barnett questioned if the five handicap parking spaces were sufficient. Assistant Community and Economic Development Director Angell reported this did meet ADA requirements. Councilmember Leith asked what portion of the property was being rezoned. Assistant Community and Economic Development Director Angell reviewed the area that was proposed for rezoning, which was only the 2.5 acres being used for the dental office building. Councilmember Jaeger requested further information on where the handicap parking was located. Assistant Community and Economic Development Director Angell reviewed the location of the five handicap parking spaces on the site plan. Steve Miller, MSB Commercial, thanked the Council for considering his request. He explained he could move the handicap parking stalls if this was the desire of the Council. Mayor Steffenson reported the applicant would have to follow all ADA requirements regarding the placement of the handicap parking spaces. Eric Reiners, architect for the project, discussed the slope on the site and commented on how this would be addressed. Community and Economic Development Director Hogeboom reported the city’s building official had reviewed the proposed plans and supported the proposed placement of the handicap parking spaces. Councilmember Barnett questioned if the proposed building would interfere with the Medicine Lake Regional Trail. Mr. Miller reported the building would not interfere but rather the site would be connecting to the trail. Motion by Councilmember Jaeger, seconded by Maple Grove City Council minutes November 21, 2022 Page 8 Councilmember Hanson, to direct the city attorney to draft a resolution and a planned unit development agreement approving the Dental Associates of Maple Grove comprehensive plan amendment, planned unit development concept stage plan, development stage plan, rezoning, and final plat subject to: 1. The applicant addressing to the satisfaction of the city any remaining applicable comments contained in the memorandums from: a. The Community & Economic Development Department dated October 12, 2022 b. The Engineering Department dated November 14, 2022 c. The Fire Department dated October 10, 2022 d. The Parks & Recreation Department, dated November 3, 2022 The applicant shall acknowledge that park dedication requirements are based on staff review and recommendation to the Park and Recreation Board and their subsequent board action. It was noted city administration offices would be closed on Thursday, November 24 and Friday, items November 25 for the Thanksgiving holiday. She reported the Council would be holding a budget hearing on Monday, December 5 along with a CIP work session. Items added to Councilmember Jaeger encouraged residents to check the the agenda batteries in their smoke detectors. Councilmember Jaeger reported the indoor farmers market would be held indoor on Tuesday, November 22 at the Community Center from 3 to 6 p.m. Councilmember Jaeger thanked the Friends of the Angel for their generous donation to the Angel of Hope. Councilmember Jaeger wished everyone a safe and healthy Thanksgiving.
