Maple Grove City Council Meeting minutes May 6, 2024 Call to order Pursuant to call and notice thereof, a regular meeting of the Maple Grove City Council was held at 7:30 p.m. on May 6, 2024 at the Maple Grove Government Center/Public Safety Facility, Hennepin County, Minnesota. Members present were Mayor Mark Steffenson and Councilmembers Judy Hanson, Kristy Janigo and Rachelle Johnson. Absent was Councilmember Kristy Barnett. Present also were Heidi Nelson, City Administrator; Joe Hogeboom, Community and Economic Development Director; Joe Amerman, Economic Development Manager; Jesse Corrow, City Planner; Chris LaBounty, Public Works and Engineering Director; and Justin Templin, City Attorney. Mayor Steffenson called the meeting to order at 7:30 p.m. and led the city in the Pledge of Allegiance. Recruitment approval for police officer Motion to authorize staff to begin the recruitment process for the police officer position in the police department. COMMUNITY & ECONOMIC DEVELOPMENT ITEMS D. Evanswood of Maple Grove 3rd Addition final plat Motion to recommend that the City Council direct the city attorney to draft a resolution approving the Evanswood of Maple Grove 3rd Addition final plat. The applicant shall acknowledge that park dedication requirements are based on staff review and recommendation to the Park and Recreation Board and their subsequent board action. Board meetings are held on the third Thursday of each month. ENGINEERING ITEMS E. 2024 Sanitary Sewer Manhole Rehabilitation Project No. 24-09 Accept bid and award contract Resolution No. 24-059 Motion to adopt Resolution No. 24-059 accepting the bid for 2024 Sanitary Sewer Manhole Rehabilitation Project No. 24-09 and awarding to Innovative High-Performance Coatings at a contract amount of $342,800.00. F. 2024 Water Utility Capacity Analysis Project No. 24-14 Maple Grove City Council Minutes May 6, 2024 Page 3 Resolution No. 24-062 Motion to adopt Resolution No. 24-062 establishing 2024 Water Utility Capacity Analysis Project No. 24-14, approving Stantec Engineering proposal, and authorizing its execution of acceptance by city officials. G. Award transit stations improvements bid Motion for the City Council to award the transit station improvements project bid to Western Specialty Contractor for a cost not to exceed $347,371. H. Cedar Island Lake and Fish Lake water obstacle permits Motion to approve the 2024 water obstacle permits on Cedar Island Lake and Fish Lake. I. East Fish Lake Trail Replacement Project No. 25-05 establish project Motion to establish the East Fish Lake Trail Replacement Project No. 25-05. J. Fox Briar Ridge East Project No. 22-15 final acceptance Motion to approve the final acceptance of Fox Briar Ridge East Project No. 22-15 completed by Douglas-Kerr Underground, LLC subject to the warranty provisions of the contract and statutory law. K. Hennepin County crack sealing extended working hours Motion to approve extended working hours for crack filling and pavement maintenance work part of the Hennepin County 2024 Spring Crack Sealing Project. M. Minnesota Science and Technology Center Project No. 23- 18 Change Order No. 1 Motion to approve Change Order No. 1 to the Minnesota Science and Technology Center Project No. 23-18 in the amount of $40,920.00. N. Norsq Street and Utility Improvements Project No. 23-22 Change Order No. 1 Motion to approve Change Order No. 1 to the Norsq Street and Utility Improvements Project No. 23- 22 in the amount of $13,944.20. O. Purchase of additional 2024 vehicles and equipment Motion to approve the purchase of an additional marked patrol squad and to advance the replacement of an existing marked patrol squad. P. Rush Hollow North Project No. 24-10 authorize ad for bids Resolution No. 24-061 Motion to adopt Resolution No. 24-061 approving plans and specifications for Rush Hollow North Project No. 24-10, authorizing advertisement for bids, and entering into a development agreement for the above referenced project. Q. Roadway and trail pavement inspections Motion to approve the proposals received by WSB & Associates, Inc. to provide pavement inspections for the city roadway network and city trail network and authorize work necessary to develop funding scenarios for the future of the city pavement management plan. R. Transit stations digital signage proposal Motion for the City Council to accept the proposal from Bluum Maple Grove City Council Minutes May 6, 2024 Page 5 Tehcnology for a cost not to exceed $154,678.99 for the transit stations digital signage project. S. Sureties Motion to approve the surety actions. ADMINISTRATIVE ITEMS T. 2024-2025 recycling and transfer station license renewals Motion to approve 2023-2024 recycling and transfer licenses for:  Waste Management of Minnesota Inc. dba Waste Management of Maple Grove Transfer at 10633 89th Avenue North, Maple Grove, Minnesota  Northern Metals LLC dba Northern Metal Recycling – Maple Grove at 9025 Zachary Lane North, Maple Grove, Minnesota subject to compliance with all licensing requirements in Maple Grove Code of Ordinances, Section 26-65, with said license to expire May 31, 2025. Motion to place the city’s computer coverage with Travelers Property Casualty Company W. City Council salaries - Ordinance No. 24-05 Motion to approve Ordinance No. 24-05 amending Maple Grove City Code Section 2-31 establishing cost of living adjustments to Council salaries. Motion to authorize the publication of the Ordinance Summary of Ordinance No. 24-05. X. City services and fee waiver request - Resolution 24-063 Approve in-kind city services and waive all associated permit fees to support; Maple Grove Business Association and the Chalkfest event on June 8-9, 2024, Maple Grove Community Organization and the Maple Grove Days event on July 10-14, 2024 and Maple Grove Lions Club and the Rock’n the Grove event on September 13, 2024. Approve Maple Grove Business Association special event application for Chalkfest to allow food sales on public land, alcoholic beverage sales and consumption on public land, soliciting funds and fundraising on public land and the use of Main Street for the event. Y. Lower potency cannabinoid products license for Splitrock Dispensary Motion to approve a lower potency cannabinoid products license for Fullmelt Factory LLC, dba Splitrock Dispensary, 13777 Grove Dr., Maple Grove, Minnesota for the period of 18 months or until retailers selling lower potency cannabinoid products are required to obtain a license from the State of Minnesota, whichever occurs first. Proclamation of National Night Out 2024 This item was removed by Councilmember Johnson for discussion. AA. Proclamation to declare May 15 as Peace Officers Memorial Day and May 12 through 18, 2024 as Police Week This item was removed by Councilmember Hanson for discussion. BB. Zamboni purchase Approve the purchase of a Zamboni 552AC electric ice resurfacer with listed additional equipment. This is a Sourcewell contract # 120320-FZC. The contract price is $153,821.35. CC. Approve claims Motion to approve claims totaling $ 3,739,403.77. Motion by Councilmember Hanson, seconded by Councilmember Johnson, to approve the consent items as amended, removing items 3Z (Proclamation of National Night Out 2024) and 3AA (Proclamation to declare May 15 as Peace Officers Memorial Day and May 12 through 18, 2024 as Police Week). Consideration of The following items were pulled from the consent agenda. items pulled from the agenda Regarding Item 3Z (Proclamation of National Night Out 2024), Councilmember Johnson stated National Night Out would be held on Tuesday, August 6, 2024. She explained the city would be hosting a free barbeque with demonstrations from 11 a.m. to 1 p.m. at Central Park. She encouraged residents to participate in this great community event and to host their Maple Grove City Council Minutes May 6, 2024 Page 8 own National Night Out party. Motion by Councilmember Johnson, seconded by Councilmember Hanson, to proclaim Tuesday, August 6, 2024, as “National Night Out” in Maple Grove. Upon call of the motion by Mayor Steffenson, there were four ayes and no nays. Motion carried. Regarding Item 3AA (Proclamation to declare May 15 as Peace Officers Memorial Day and May 12 through 18, 2024 as Police Week), Councilmember Hanson stated May 12 through May 18 would be observed as Police Week and May 15 as Peace Officers Memorial Day in the City of Maple Grove. She commented on the recent losses the state has had and encouraged members of the community to honor Minnesota’s officers by turning their porch lights blue during Police Week. Councilmember Janigo indicated her brother was a deputy in another state. She explained her worst fear was losing her brother in the line of duty. She stated law enforcement was a dangerous job no matter the size of the community, officers are being lost. She reported it has brought her comfort to visit the Law Enforcement Memorial on the Capitol campus in St. Paul where officers are standing guard. She encouraged residents to visit this memorial. Motion by Councilmember Hanson, seconded by Councilmember Janigo, to approve and proclaim May 15 as Peace Officers Memorial Day and May 12 through 18, 2024 as Police Week. Upon call of the motion by Mayor Steffenson, there were four ayes and no nays. Motion carried. Special business Open forum There were no open forum issues brought before the Council at this meeting. Public hearings Public hearing Public Works & Engineering Director LaBounty stated the applicant desires to have the Pilgrim Lane right of way within Easement Outlot A, Arbor Lakes Gateway vacated. City staff notified Vacation No. 24- affected property owners, private utility companies, and Maple Grove City Council Minutes May 6, 2024 Page 9 01 published the public hearing for proposed vacation in the Osseo-Maple Grove Press on April 18 and 25. Comments from Resolution No. private utilities suggest there are no concerns with the 24-058 exception of Lumen. They have facilities located in the right of way proposed to be vacated, but will not be required to relocate as the drainage and utility easement dedicated within Outlot A, Arbor Lakes Gateway will remain in place. Following the opening and closing of the public hearing, it is recommended that Council adopt the resolution vacating said right of way. Motion by Councilmember Janigo, seconded by Councilmember Johnson, to open the public hearing. Upon call of the motion by Mayor Steffenson, there were four ayes and no nays. Motion carried. Mayor Steffenson opened the public hearing at 7:37 p.m. and asked if anyone would like to address this issue. No public testimony was offered. Motion by Councilmember Johnson, seconded by Councilmember Hanson, to close the public hearing at 7:38 p.m. Upon call of the motion by Mayor Steffenson, there were four ayes and no nays. Motion by Councilmember Hanson, seconded by Councilmember Johnson, to adopt Resolution No. 24-058 vacating certain easement located in the City of Maple Grove, County of Hennepin, State of Minnesota. Upon call of the motion by Mayor Steffenson, there were four ayes and no nays. Motion carried. Community and economic development items Arbor Lakes Economic Development Manager Amerman stated Endeavor Business Park Development is seeking to continue development of the Arbor Phase 4 Building Lakes Business Park with the construction of a ninth building. 9 planned unit The proposed building is roughly 198,000 square feet, and development would be located directly to the east of building eight, and Maple Grove City Council Minutes May 6, 2024 Page 10 concept stage west of the Boston Scientific location currently under plan amendment construction. The building would abut I-94 to the south. It was noted the east and south elevations would be matching with a higher finish. Staff commented on the request further and reported the Planning Commission recommended approval of the planned unit development concept stage plan amendment. Josh Budish, Endeavor Development representative, thanked the Council for considering his request. Mayor Steffenson asked if the applicant supported having higher finishes on the east side of the property. Mr. Budish explained he supported this requirement. Motion by Councilmember Janigo, seconded by Councilmember Hanson, to direct the city attorney to draft a resolution approving the Arbor Lakes Business Park Phase 4 Building 9 planned unit development concept stage plan amendment subject to: 1. The applicant addressing to the satisfaction of the city any remaining applicable comments contained in the memorandums from: a. The Engineering Department dated February 26, 2024 b. The Fire Department dated February 28, 2024. Councilmember Johnson explained she understood the reservation from the Planning Commission to have this building smaller due to its high visibility from the freeway. She stated she would be supporting the increased building size request and thanked the applicant for agreeing to improve the finish on the east side of the building. Upon call of the motion by Mayor Steffenson, there were four ayes and no nays. Motion carried. 7690 Urbandale City Planner Corrow stated the applicant is requesting Lane North conditional use permit for the purpose of installing a 20-foot conditional use tall section of protective netting in the back yard of their permit property located at 7690 Urbandale Lane North. The net and post system would provide protection from golf balls landing on the property. The home is located in The Woods at Rush Maple Grove City Council Minutes May 6, 2024 Page 11 Creek neighborhood and backs up to the driving range at the Rush Creek Golf Course. The property regularly sees golf balls landing in the yard with several hitting the house each year. As a remedy, the applicant would like to install the 65-foot section of protective netting supported by five removable aluminum posts in the back yard. The mesh netting is transparent and the system is specifically designed to stop golf balls in flight. The netting can be raised and lowered and the supporting poles are capable of being removed from their in-ground sleeves. Staff commented further on the request and reported the Planning Commission recommended approval. Betsy O’Donnell, 7690 Urbandale Lane, thanked the Council for considering her request. Mayor Steffenson appreciated the fact this system could go up and down with the seasons. Councilmember Hanson asked if the neighbors supported this netting system. Ms. O’Donnell reported the neighbors had supported this request. Councilmember Johnson discussed how she believed the golf course should be responsible for the netting system given the fact their use was responsible for damage to adjacent property. Ms. O’Donnell reported she works for Rush Creek and stated that her property is probably the most impacted, due to its layout and orientation toward the driving range. She indicated she did not have a problem with the driving range, but because she was selling her home, she wanted to have the netting in place to alleviate any future concerns. Motion by Councilmember Johnson, seconded by Councilmember Hanson, to direct the city attorney to draft a resolution approving the 7690 Urbandale Lane North conditional use permit subject to: 1. Administration items Report on City Administrator Nelson explained that the Council has her upcoming Monday report if there are any questions. She stated the first administration responders luncheon will be held at Clam Corp Headquarters in items Rogers on Tuesday, May 7. She reported the Community Center Working Group will meet next on Thursday, May 9 at 6:30 p.m. at the Maple Grove Community Center.
