Maple Grove City Council Meeting minutes July 15, 2024 Call to order Pursuant to call and notice thereof, a regular meeting of the Maple Grove City Council was held at 7:30 p.m. on July 15, 2024 at the Maple Grove Government Center/Public Safety Facility, Hennepin County, Minnesota. Members present were Mayor Mark Steffenson and Councilmembers Judy Hanson, Kristy Barnett, Kristy Janigo, and Rachelle Johnson. Absent was none. Present also were Heidi Nelson, City Administrator; Joe Hogeboom, Community and Economic Development Director; Jesse Corrow, City Planner; Joe Amerman, Economic Development Manager; Chris LaBounty, Public Works and Engineering Director; R.J. Kakach, City Engineer; John Hagen, Transportation Operations Engineer; and Justin Templin, City Attorney. Mayor Steffenson called the meeting to order at 7:30 p.m. and led the city in the Pledge of Allegiance. State of Minnesota joint powers agreement with the City of Maple Grove on behalf of its Police Department regarding the Minnesota Internet Crimes Against Children Task Force and Resolution No. 24-101 Motion to adopt Resolution No. 24-101 and authorize the mayor, city administrator and chief of police to sign and enter into the joint powers agreement with the State of Minnesota regarding the Minnesota Internet Crimes Against Children (ICAC) Task Force. Consideration of The following items were pulled from the consent agenda. items pulled from the agenda Regarding Item 3R (License agreement with the Metropolitan Council for 2024 State Fair bus service), Councilmember Barnett stated she was pleased to report staff has negotiated transit to the Minnesota State Fair through Metro Transit on the weekends and Labor Day. She explained more information regarding the transit services was available on the city’s website. Motion by Councilmember Barnett, seconded by Councilmember Hanson, to authorize the mayor and city Maple Grove City Council Minutes July 15, 2024 Page 7 administrator to execute an agreement between the City of Maple Grove and Metropolitan Council (Metro Transit) for 2024 State Fair shuttle bus service. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Special business Open forum Pastor Sarah Bunge, 7499 Walnut Grove Lane North, explained she has been a resident for the past 18 years. She addressed the Council regarding cannabis cultivation and suggested the Council consider allowing cannabis cultivation on hobby farms in Maple Grove. Public hearings Public hearing City Engineer Kakach stated phase one construction of the Maple Grove Community Center expansion is anticipated to Easement and begin this month and as part of the project the western portion Right of Way of the site is being plated. Vacating the right of way and Vacation No. 24- drainage and utility easements allows for establishing a new 04 Maple Grove plat. City staff notified affected property owners, private utility Community companies, and published the public hearing for the proposed Center vacation in the Osseo-Maple Grove Press on June 27 and July 4. Comcast, Lumen, and Xcel Energy have responded to the Resolution No. notification stating they have facilities located in the areas 24-086 proposed to be vacated. Staff is working with these private utilities to determine where new easements shall be placed on the Maple Grove Community Center expansion final plat, or relocating their infrastructure if in conflict with the Community Center project plans. Following the opening and closing of the public hearing, it is recommended that council adopt the resolution vacating said right of way and drainage and utility easements. Motion by Councilmember Janigo, seconded by Councilmember Johnson, to open the public hearing. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Motion by Councilmember Janigo, seconded by Councilmember Barnett, to adopt Resolution No. 24-086 vacating certain easements located in the City of Maple Grove, County of Hennepin, State of Minnesota. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Public Hearing City Engineer Kakach stated public infrastructure in the form of watermain, sanitary sewer, storm sewer, street, and sidewalk Hennessey Grove are required to serve the Hennessy Grove development. Project No. 24-16 Kimberly Lane will be extended north from 68th Avenue to just south of 69th Avenue and 68th Place will be extended west to Resolution No. Kimberly Lane. All public infrastructure will be built to city 24-089 standards. A feasibility report has been prepared for Hennessey Grove Project No. 24-16. The cost of the improvements benefitting this development is estimated to be $1,226,200. Those costs, together with area trunk assessments of $174,000 result in a proposed total assessment of $1,400,200 which equates to $100,014 per unit. Plans for the Hennessy Grove Project No. 24-16 have been prepared and are on file in the Engineering Department. It is recommended that council adopt the resolution ordering Hennessey Grove Project No. 24-16, receiving and approving feasibility report, receiving and approving plans and specs, and authorizing advertisement of bids for the project. Motion by Councilmember Barnett, seconded by Councilmember Johnson, to open the public hearing. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Mayor Steffenson opened the public hearing at 7:38 p.m. and asked if anyone would like to address this issue. No public testimony was offered. Motion by Councilmember Barnett, seconded by Councilmember Johnson, to adopt Resolution No. 24-089 ordering Hennessey Grove Project No. 24-16, receiving and approving feasibility report, receiving and approving plans and specifications, and authorizing advertisement of bids for the project. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Public hearing Economic Development Manager Amerman stated in 2022, the City Council directed staff to review rental licensing policies Policy on short- and procedures. A number of changes were made to rental term rental licensing fee structures, as well as the changes to the licensing inspections processes themselves. Council further requested that staff evaluate rental requirements for short-term rentals. Properties that are used for short-term rentals are currently required to receive a traditional city rental license. However, the current rental license and its components (inspections, Crime Free Multi-Family Housing training, timeframe) do not appropriately address the different needs of short-term rentals. While short-term rental websites indicate that there are approximately 50 short-term rentals in Maple Grove at any given time, only two properties used for short term rentals currently are licensed. Staff has reviewed best practices of licensing of short-term rentals with the city attorney, as well as with other peer communities, and proposes to add a separate licensing procedure for them. Staff commented on these details in further detail with the Council and recommended approval of the short-term rental policy. Councilmember Hanson asked how many property owners in Maple Grove would take advantage of the short-term rental licensing. Economic Development Manager Amerman stated right now the rental application license asks if properties will be rented short or long term. He indicated of rental licenses the city has in place, only two were used as short-term rentals. However, he noted staff found there were 52 short term rentals operating in the city in February. Maple Grove City Council Minutes July 15, 2024 Page 10 Councilmember Janigo questioned how staff would be reaching out to these 52 property owners that were renting without a license. Economic Development Manager Amerman explained staff does not have email addresses or contact information, but the city would reach out to these property owners by mail and would be promoting its short-term rental licensing program on its communication platforms. Councilmember Johnson inquired how staff found the 52 short-term rental properties. Economic Development Manager Amerman reported staff visited Airbnb, VRBO, Expedia, Priceline and Trip Advisor websites. Councilmember Janigo asked how long the 52 properties would have to get a short-term rental license in place. Economic Development Manager Amerman reported staff would reach out following adoption of the ordinance and starting September 1 the property owners would have 30 days to come into compliance with the short-term rental policy. Councilmember Johnson questioned if the short-term rental license would be revoked if a second disorderly conduct offense were to occur on the property. Economic Development Manager Amerman indicated the license would be suspended at the time of a second offense. He commented further on how a disorderly conduct offense was defined by City Code, noting the police department would have to be involved. Councilmember Hanson reported a hearing process was in place for property owners that wished to contest a license revocation. Motion by Councilmember Hanson, seconded by Councilmember Barnett, to open the public hearing. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Mayor Steffenson opened the public hearing at 7:50 p.m. and asked if anyone would like to address this issue. Barbara English, 8660 Terraceview Lane, explained she has lived in Maple Grove for almost 30 years and she has had an Airbnb for the past eight years. She indicated she has a five- Maple Grove City Council Minutes July 15, 2024 Page 11 star rating. She felt privileged to be an Airbnb host and noted she supported the city’s short-term licensing efforts. She commented on how she worked to enforce her own household rules through Airbnb. Dennis Belanger, 8660 Terraceview Lane, indicated he lived in his home full time. He discussed the rules that he and his wife have in place for the people coming to stay in his home. He noted he only allows two adults and no children. He commented he only works through Airbnb and no visitors are allowed. Ms. English stated she believed it was important to welcome guests to her property and noted she gets to know her guests. She described the types of guests she has had over the years and indicated she was proud to be able to have an Airbnb in Maple Grove. Brandy Logan, 14801 80th Place North, indicated she was looking into rental property regulations in Maple Grove. She learned there were no short-term rental regulations in place, but that this matter would be addressed by the Council tonight. She commented on the proposed fees for short term rentals and stated she believed the fees were excessive and could prove to be an obstacle for Maple Grove families. Austin Williams, 9330 Juneau Lane North, stated most of the rental sites require high standards when it comes to safety and cleanliness. He believed it was onerous for the city to charge a short-term rental fee. He suggested the fee be reduced over time if short-term rentals were operating properly. He recommended that disorderly conduct be clearly defined within the short-term rental license application for clarity purposes. He commented on how the public was unaware of the city’s short-term rental standards and suggested a circular be sent to all residents. Motion by Councilmember Barnett, seconded by Councilmember Janigo, to close the public hearing at 8:03 p.m. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion by Councilmember Hanson, seconded by Maple Grove City Council Minutes July 15, 2024 Page 12 Councilmember Janigo, to direct the city attorney to publish the final ordinance and publication summary adopting a short-term rental policy for the city. Councilmember Barnett stated with respect to the fees, short term rentals were an opportunity for residents to make money and fees were a way for the city to absorb the cost of inspections and maintaining a program. She commented she supported the proposed fees for short term rentals. Councilmember Janigo agreed and noted there was more flexibility with the short-term rental fees. Councilmember Johnson indicated there has been a rise in short term rentals throughout the community and she appreciated the fact the city had separated the short-term rental licensing process from long term rentals. She thanked all of the residents that had reached out to her with comments and feedback. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Motion carried. concept stage plan amendment, City Planner Corrow stated the applicant is proposing a 2,500 development square foot Popeyes Chicken restaurant with a drive thru on a stage plan, and vacant outlot located on the west side of Becker Furniture final plat World and Metro Self Storage. The proposal also seeks to amend the current Dunkirk Square concept plan which Resolution No. currently allows for a 6,400 square foot auto service/retail 24-096 building at this location. It was noted a full traffic analysis was completed for this project. Staff commented further on the history of this project, noting the traffic circulation for this use and recommended approval of the request. Maple Grove City Council Minutes July 15, 2024 Page 13 Councilmember Janigo requested further information regarding the restriping of the Maple Grove Parkway/94th Avenue intersection. Transportation Engineer Hagen explained staff was aware of the operational concerns at this intersection. He reported independent of this project staff looked into the traffic concerns further. He discussed how restriping the west leg of the intersection would assist with improving traffic flow. He reported the restriping would be done once easements were in place from Sam’s Club. Councilmember Hanson questioned if circulation concerns within the site were addressed by staff. Transportation Engineer Hagen explained he reviewed the wayfinding signage but noted he had not reviewed the easements on the property, as that is a private matter the developer would review. Mayor Steffenson invited the applicant up at this time. Mike Brandt, Kimley Horn, thanked staff for presenting a detailed staff report. He indicated there were several easements on the property. He explained a right in/right out was considered at the north entrance near Becker Furniture south, but noted it was determined this would create more confusion in the development. He believed the wayfinding signs would assist with properly directing traffic. He stated if this item moves forward, he would like to have the “Do Not Enter” sign removed from the drive behind the shopping center, and replaced with something that would still allow authorized vehicles to pass through. He commented further on the proposed application and asked for the Council’s support on this request. Mayor Steffenson asked if there were any comments from the public. There were no comments from the public. Mayor Steffenson supported the city working with the applicant on the signage behind Becker Furniture. He indicated this intersection continues to cause concern and the majority of the concern comes from the west side. He was hopeful that the restriping would assist with alleviating some of the congestion. While he understood this was not an easy spot, he did not have a problem with the overall project. Maple Grove City Council Minutes July 15, 2024 Page 14 Councilmember Janigo stated she appreciated the fact the 94th Avenue intersection would be addressed. Councilmember Johnson indicated this project has been discussed at length at previous Council meetings in October and December. She explained she did not believe the addition of wayfinding signs would be enough to address the congestion and traffic concerns for this property. She wanted to see an investment made in internal circulation at Dunkirk Square. She commented on the number of trips that would be generated by the proposed use and stated she was not comfortable with moving forward with this project. Councilmember Hanson reported she would love to see a Popeye’s in Maple Grove, but noted she was not excited about this site being chosen for the development. She stated she still had concerns about traffic and traffic flow through this site. Councilmember Barnett indicated she still had concerns with the project as well. She is concerned that the approval of a drive-thru restaurant could open the door to a busier drive- thru type business on the site in the future, beyond what the shopping center could accommodate. Motion by Councilmember Barnett, seconded by Councilmember Hanson, to deny Resolution No. 24-096 approving the Popeyes at Dunkirk Square planned unit development concept stage plan amendment, development stage plan, and final plat. Councilmember Janigo hoped that something would be able to develop in this area of Dunkirk Square someday, but she agreed this was not the right use or fit for this property. Upon call of the motion by Mayor Steffenson, there were four ayes and one nay (Mayor Steffenson opposed). Motion carried. Engineering- public works items Recycling Public Works and Engineering Director LaBounty stated the contract current contract with Republic Services to provide curbside extension recycling collection is set to expire on December 31, 2024; city staff have been working on negotiating contract extension terms, including exploring the cost of adding organized curbside organic collection to the contract. After reviewing different pricing models, staff is recommending the extension terms outlined in the staff report if the City Council desires to add organized curbside organics collection as a city service to residents. Staff commented further on the terms within the recycling contract extension and recommended approval. Councilmember Hanson asked if this program would begin in 2025. Public Works and Engineering Director LaBounty reported this was the case. Councilmember Hanson questioned if separate containers would be provided for organics. Public Works and Engineering Director LaBounty explained organics would have a separate container. Councilmember Barnett inquired if a $5 per month increase could begin in 2024 to assist with lowering increases in 2025. Finance Director Sticha stated this could be done, but noted the city would have to consider how to educate the public regarding this fee. Maple Grove City Council Minutes July 15, 2024 Page 16 Councilmember Hanson expressed concern with the fact the city would now have three garbage trucks in neighborhoods each week for garbage, recycling and organics. Public Works and Engineering Director LaBounty discussed how the organized collection of recycling and organics would reduce the number of trucks on the street in the long run. Bev Mathiasen with Republic Services stated organics was a very important topic right now. She explained one-third of garbage collected was organics. She indicated a separate 30- gallon container would be used for organics collection. She reported there was growing interested in organics collection and encouraged the Council to contact her with comments or questions. Mayor Steffenson stated it was his understanding residents are upset by the organics fee being charged. It was his hope that the haulers would remove the organics fee because the service would now be provided by the city. City Administrator Nelson stated the city would have to preclude the private haulers from providing organics services, since these services would now be provided by the city. She indicated this would ensure the haulers were not charging residents for this service. City Attorney Templin advised the city could require by City Code that the haulers not charge for a service that they were not providing. Councilmember Johnson reported when looking at the numbers more closely, she noted the organics collection would cost residents just over $2 per month. Public Works and Engineering Director LaBounty stated this was the case. Motion by Mayor Steffenson, seconded by Councilmember Barnett, to approve terms of the recycling contract extension with Republic Services, including adding organized curbside organic recycling collection, authorizing the city attorney and public works and engineering director to finalize amendment agreement, and the mayor and city administer to execute the agreement. Report on Public Works and Engineering Director LaBounty updated the upcoming Council regarding the following: Maple Grove City Council Minutes July 15, 2024 Page 17 engineering  MnDOT would be starting the I94 gap project next week. items Staff noted this would be a two-year project. Administration items Community Parks Director Stifter stated on June 27, 2024, bids were Center received at the City of Maple Grove Government Center for the Renovation and Maple Grove Community Center – arena renovation & Expansion Phase expansion bid package #2 which included 26 bid categories, One – Award Bid and 13 quote categories. RJM has completed its review of all Package #2 bids and is recommending award as outlined in their letter of recommendation. There are three bid categories that will require requoting and are highlighted in yellow on the summary estimate. Allowances are shown as placeholder estimates for these categories. APEX (geothermal and arena products consultant) has also put forth their recommendation for the Guaranteed Energy Savings contract which was procured through the best value process. This portion of the project is under a separate contract but for project clarity is included in the RJM project estimate summary, as Ice Rink System. The final recommendations are based on the low cumulative total bid received for the base bid plus any recommended alternates. Parks Director Stifter reported staff recommended alternates include renovation of the TCO Rink upper level restrooms, lower level restrooms and concourse flooring at a total cost of $177,257. With this addition the total project remains under the estimate. The total project cost for all bid/quote categories plus alternates including design, construction, Apex contract, owner costs, and contingency is $40,215,538. This is $262,651 or .06% under the estimate. City attorney has reviewed the bid recommendation from RJM Construction and prepared the resolution. Following a positive review by Council, this item will return on a future consent agenda to assign all contracts to RJM and approve the project Guaranteed Maximum Price per the construction manager at risk contract. Motion by Councilmember Johnson, seconded by Councilmember Barnett, to adopt Resolution No. 24-102 accepting and awarding bids for bid package #2 for the Maple Maple Grove City Council Minutes July 15, 2024 Page 18 Grove Community Center – arena renovation and expansion project. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Motion by Councilmember Johnson, seconded by Councilmember Janigo, to adopt Resolution No. 24-104 accepting and awarding a proposal from Apex Facility Solutions and entering into a Guaranteed Energy Savings Contract. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Report on City Administrator Nelson explained that the Council has her upcoming Monday report if there are any questions. She reported the administration Council would be holding budget work sessions on August 5 items and August 19. She thanked all of the staff members and City Councilmembers that were involved in Maple Grove Days.
