Maple Grove City Council Meeting minutes November 18, 2024 Call to order Pursuant to call and notice thereof, a regular meeting of the Maple Grove City Council was held at 7:30 p.m. on November 18, 2024 at the Maple Grove Government Center/Public Safety Facility, Hennepin County, Minnesota. Members present were Mayor Mark Steffenson and Councilmembers Judy Hanson, Kristy Barnett, Kristy Janigo, and Rachelle Johnson. Absent was none. Present also were Heidi Nelson, City Administrator; Joe Hogeboom, Community and Economic Development Director; Peter Vickerman, Planning Manager; Chris LaBounty, Public Works and Engineering Director; and Justin Templin, City Attorney. Mayor Steffenson called the meeting to order at 7:30 p.m. and led the city in the Pledge of Allegiance. Appointment of community service officer pt Motion to approve the appointment of Colton Bailey to the position of community service officer pt in the Police Department, subject to a twelve-month probation period, all preemployment requirements have been successfully completed. C. Appointment of community service officer pt Motion to approve the appointment of Sadie Dominick to the position of community service officer pt in the Police Department, subject to a twelve-month probation period, all preemployment requirements have been successfully completed. D. Appointment of community service officer pt Motion to approve the appointment of Caleb Larson to the position of community service officer pt in the Police Department, subject to a twelve-month probation period, all preemployment requirements have been successfully completed. ENGINEERING AND PUBLIC WORKS ITEMS G. 2025 Pond Maintenance Project No. 24-11 Establishing project, authorizing ad for bids, etc. - Resolution No. 24-142 Motion to adopt Resolution No. 24-142 establishing 2025 Pond Maintenance Project No. 24- 11, receiving feasibility report, ordering project, approving plans and specifications, and authorizing advertisement for bids. H. 2025 Sanitary Sewer CIPP Project No. 24-21 Resolution No. 24-145 Motion to adopt Resolution No. 24-145 establishing 2025 Sanitary Sewer CIPP Project No. 24- 21 and authorizing Stantec to prepare plans, specifications and bid documents. I. Adopting special assessments against benefited land - Resolution No. 24-146 Motion to adopt Resolution No. 24-146 adopting the special assessments against benefited lands for various projects. J. Amending special assessment deferral policy - Resolution No. 24-127 Motion to adopt Resolution No. 24-127 amending the special assessment deferment policy to allow deferment of principal and interest upon request for assessments due and payable with the taxes in year 2025 and establishing the deferment of special assessments (principal payments and principal and interest payments) for certain mixed use guided properties for the tax year 2025. K. Jefferson Lines Transit Station 2025 to 2027 license agreement Motion to authorize the mayor and city administrator to execute a three-year agreement between the City of Maple Maple Grove City Council Minutes November 18, 2024 Page 4 Grove and Jefferson Lines related to an intercity bus stop at the Maple Grove Transit Station for the period of January 1, 2025 through December 31, 2027. L. Maple Grove Middle School Trail Improvements Project No. 22-03 Final acceptance Motion to approve the final acceptance of the Maple Grove Middle School Trail Improvements Project No. 22-03 completed by Omann Brothers Paving, Inc. subject to the warranty provisions of the contract and statutory law. M. Stormwater facilities easement and maintenance agreement with Black Bear MN, LLC Motion to approve the stormwater facilities easement and maintenance agreement with Black Bear MN, LLC and authorize the mayor and city clerk to execute the agreement. N. Street Rehabilitation Project No. 23-01 Settlement agreement - Resolution No. 24-147 Motion to adopt Resolution No. 24-147 entering into settlement agreement with the Minnesota Pollution Control Agency. O. University of Minnesota Transit Station 2025 to 2027 license agreement Motion to authorize the mayor and city administrator to enter into a Maple Grove Transit Station license agreement with the Regents of the University of Minnesota to establish a University of Minnesota Morris campus shuttle stop at the Maple Grove Transit Station for the period January 1, 2025 through December 31, 2027. P. Sureties - 11-18-24 Motion to approve the surety actions. ADMINISTRATIVE ITEMS Maple Grove City Council Minutes November 18, 2024 Page 5 Q. Adopt and enact new city code - Ordinance No. 24-19 Motion to approve Ordinance No. 24-19 adopting and enacting a new code for the City of Maple Grove; providing for the repeal of certain ordinances not included therein; providing a penalty for the violation thereof; providing for the manner of amending such code; providing for the summary ordinance for publication purposes; and providing when such code and this ordinance shall become effective. Motion to authorize the publication of the Ordinance Summary of Ordinance No. 24-19. R. Lower potency cannabinoid products license for Smoker House Motion to approve a lower potency cannabinoid products license for Northstar Tobacco Inc., dba Smoker House, 13543 Grove Dr., Maple Grove, Minnesota for a term beginning November 19, 2024, until retailers selling lower potency cannabinoid products are required to obtain a license from the State of Minnesota. The establishment is subject to compliance with all licensing requirements as outlined in section 10-37 of the Maple Grove City Code. S. Approve claims Motion to approve claims totaling $ 4,174,369.62. Motion by Councilmember Johnson, seconded by Councilmember Barnett, to approve the consent items as presented. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Consideration None of items pulled from the agenda Special business Maple Grove City Council Minutes November 18, 2024 Page 6 Open forum Caroline Larson, 7761 Dallas Lane North, explained she has lived in Maple Grove for the past 37 years. She commented on how crime was rising in her neighborhood. She stated there were renters in a home in the neighborhood and described the two major incidents that had occurred at this property. She indicated the home adjacent to this rental property has recently put their home up for sale. She recommended that the owner of the rental property be held accountable for the actions of their tenants. She further recommended that the owner lose their rental license in Maple Grove. She stated her neighborhood was at a tipping point as she would be losing one nice family because of these renters. She explained she did not want to accept this was the direction her neighborhood was going. Mayor Steffenson reported staff was looking into this matter. Community and Economic Development Director Hogeboom stated the Maple Grove Police Department was investigating this matter and would be scheduling a neighborhood meeting in the near future. Recognition of Mayor Steffenson presented Councilmember Barnett with a service for plaque to honor her and thanked her for her many years of public service to the community. A round of applause was Council- offered by all in attendance. member Kristy Barnett Community and economic development items Maple Grove Planning Manager Vickerman stated the applicant is requesting new a conditional use permit and rezoning for a new elementary school located at the northwest corner of Arbor Ridge Parkway elementary North and 101st Avenue/Steig Road Extension. The rezoning is school required as schools are conditional uses in the R-2 district but conditional use not in the R-A district. The building will be approximately permit, 139,000 square feet in size, serving pre-K through 5th grade, rezoning, and and is planned to be open for the 2026-27 school year. The full preliminary capacity of the school is 1,100 students. The school building Maple Grove City Council Minutes November 18, 2024 Page 7 plat will occupy the center of the site with ballfields on the southern portion and open fields and a natural area (with outdoor classroom) in an existing forest on the northern portion. Two playgrounds are also planned for the site. The primary access will be from Arbor Ridge Parkway North providing car parking and a pickup and drop-off lane. A secondary access, primarily for busses and staff parking, will come from 101st Avenue/Steig Road Extension. As part of this proposal, a portion of 101st Avenue/Steig Road Extension will be constructed to the property line on the west. A trail will cross the northern portion of the site that will eventually link into the Bella Woods neighborhood. This trail will have a mid- block crossing of Arbor Ridge Parkway North as envisioned in the Northwest Area/610 Master Plan. The eastern side of the trail crosses the Evanswood neighborhood before connecting with the Three Rivers Park District Regional Trail near Rush Creek. The specific location of the trail connection to the Bella Woods neighborhood will be determined at a later date. Staff reported the Planning Commission reviewed this matter and recommended approval. Public Works and Engineering Director LaBounty addressed the Council regarding the infrastructure that would be installed as part of this project. He explained there was a proposal to realign 101st Avenue, which was consistent with the Northwest Area Plan. He further discussed the proposed land swap where land would be conveyed to the school district for ponding purposes, and school district land would be conveyed to the city. Councilmember Janigo asked when the Steig roadway construction would be completed. Public Works and Engineering Director LaBounty reported as part of the project, Steig Road would be built up to the property line next year. Councilmember Johnson questioned how traffic would travel to and from the school. She inquired if 101st Avenue could handle all of the additional school traffic. Public Works and Engineering Director LaBounty stated 101st Avenue can accommodate the traffic. Councilmember Janigo recommended school crossing safety be addressed by the school district. She asked if crossing guards Maple Grove City Council Minutes November 18, 2024 Page 8 would be located at the crosswalk. Dale Carlson, Director of Facilities at Osseo Schools, anticipated crossing guards would be located at the eastern side of the school. Mayor Steffenson asked when this project would begin. Mr. Carlson reported work would begin as soon as February 2025. Motion by Councilmember Johnson, seconded by Councilmember Barnett, to direct the city attorney to draft a resolution approving the Maple Grove new elementary school conditional use permit and preliminary plat subject to: 1. The applicant addressing to the satisfaction of the city any remaining applicable comments contained in the memorandums from: a. The Community & Economic Development Department dated November 4, 2024 b. The Engineering Department dated October 18, 2024 c. The Fire Department dated October 18, 2024. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Motion by Councilmember Barnett, seconded by Councilmember Johnson, to recommend that the City Council direct the city attorney to draft an ordinance approving the rezoning from R-A (Single-Family Agricultural District) to R-2 (Single-Family Residential District) The applicant shall acknowledge that park dedication requirements are based on staff review and recommendation to the Park and Recreation Board and their subsequent board action. Board meetings are held on the third Thursday of each month. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Zoning Planning Manager Vickerman stated the Office of Cannabis ordinance text Management (OCM) released the Guide for Local Governments on Adult Use Cannabis. The proposed hours of operation were amendment - detailed with the Council. Staff reviewed and identified the cannabis items that may need updating or to be added to the recent cannabis ZOTA in further detail with the Council and Maple Grove City Council Minutes November 18, 2024 Page 9 recommended approval of the text amendments. Motion by Councilmember Janigo, seconded by Councilmember Johnson, to direct the city attorney to draft an ordinance amending city code regarding cannabis businesses. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. He explained all proceeds from the sale of this home will be donated to St. Jude. Engineering- public works items Report on Public Works and Engineering Director LaBounty updated the Council regarding the following: upcoming engineering  A Lake Quality Commission meeting would be held on Wednesday, November 20. items Administration items Report on City Administrator Nelson explained that the Council has her upcoming Monday report if there are any questions. She explained the city would be hosting a farewell party for Councilmember administration Barnett and Councilmember Hanson on Wednesday, Maple Grove City Council Minutes November 18, 2024 Page 10 items November 20 from 3 to 4:30 p.m. at the Government Center. She noted city offices would be closed November 28 and November 29 for the Thanksgiving holiday. Items added to Mayor Steffenson thanked Councilmember Barnett for her the agenda tremendous service to the City of Maple Grove for the past eight years. He understood the time and effort it took to serve as a City Councilmember and wished her all the best in the future. Councilmember Hanson stated it had been a pleasure working alongside Councilmember Barnett for the past eight years. She appreciated how hard Councilmember Barnett worked on behalf of the community and how active and responsive she is with communicating with residents. She wished Councilmember Barnett all the best in the future. Councilmember Janigo thanked Councilmember Barnett for her eight years on City Council. She commented on how City Council work was not always easy and was sometimes exhausting. She stated she appreciated how diligently Councilmember Barnett worked on behalf of the community and for how well she advocated on behalf of the residents. She wished Councilmember Barnett all the best in her future endeavors. Councilmember Johnson thanked Councilmember Barnett for serving as a Councilmember and for giving 100% all the time. She appreciated Councilmember Barnett’s great leadership and stated she would be greatly missed. Councilmember Barnett stated a few years ago she was interviewed by a junior high student where she was asked what she was most proud of. She told this student she was most proud of being elected twice by the residents of Maple Grove to represent them as a City Councilmember. She stated it has been an honor to serve as a City Councilmember in this community. She explained she ran for City Council in order to help with public safety, economic development, protecting the city’s natural resources while also taking a mindful approach to new development. She discussed how the loss of Maria Pew, along with the formation of Maria’s Voice had impacted both her and the community. She indicated the other event that Maple Grove City Council Minutes November 18, 2024 Page 11 shaped her time on the Council was meeting Chrissy Princeton, whose son Grant, was lost to a fentanyl overdose. As a result, the city now has an overdose awareness day and lights Town Green purple in order to raise awareness. She stated she was proud of the great work that has been done in the community over the past eight years, but she was most proud of the relationships she has formed with the residents and families in the community. Councilmember Barnett thanked Maple Grove for allowing her to serve. She thanked the officers on the public safety team for keeping the community safe and indicated she will continue to pray for their safety. She thanked the Maple Grove Government Center staff members for serving the city well. She thanked the volunteers who served on the city’s commissions and committees. She thanked City Administrator Nelson for doing all she does to ensure the city runs well. Lastly, she thanked Mayor Steffenson and her fellow City Councilmembers. She stated it has been an honor to serve alongside each one of them and to be able to call each member on the Council her friend. A round of applause and standing ovation was offered by all in attendance.
