MAPLE GROVE PLANNING COMMISSION July 27, 2020 CALL TO ORDER A meeting of the Maple Grove Planning Commission was held at 7:00 p.m. on July 27, 2020 at the Maple Grove City Hall, Hennepin County, Minnesota. Chair Colson called the meeting to order at 7:00 p.m. PLEDGE OF ALLEGIANCE ROLL CALL Planning Commission members present were Chair Larry Colson, Vice- Chair Chris Ayika, Lorie Klein, Craig Lamothe, Susan Lindeman, Chuck Lenthe, and Joe Piket. Present also were Karen Jaeger, City Council Liaison; Peter Vickerman, Planning Manager; Jesse Corrow, Associate Planner; Scott Landsman, City Attorney. ITEMS TO BE None. REMOVED FROM THE AGENDA CONSENT ITEMS The following Consent Items were presented for the Commission’ s approval: MINUTES A. Regular Meeting – June 8, 2020 Motion by Commissioner Ayika, seconded by Commissioner Lindeman, to approve the Consent Items as presented. Upon call of the motion by Chair Colson, there were seven ayes and no nays. Motion carried. CONSIDERATION None. OF ITEMS PULLED FROM CONSENT AGENDA REVIEW OF THE Mr. Vickerman reviewed with the Commission what items the City CITY COUNCIL Council approved that was given direction at the Planning Commission level. MINUTES FROM THEIR REGULAR Maple Grove Planning Commission July 27, 2020 Page 2 MEETING OF JULY 13, 2020 NEW BUSINESS Mr. Corrow stated the applicant is requesting a 2.1-foot variance to PUBLIC HEARING the existing 40-foot shoreland setback for the purpose of constructing a porch and deck off the back of the house. The VARIANCE property is located on the far northeast side of Eagle Lake with 6995 MAGDA access to Magda Drive. A previous owner received a variance DRIVE approval in 2006 which reduced the shoreland setback from the standard 75 feet to 40 feet, ultimately creating a new buildable lot. MIKE SOWERS Staff commented further on the proposed porch and deck and recommended approval of the requested variance. VARIANCE FOR THE PURPOSE OF STAFF RECOMMENDATION: A PORCH AND DECK TO BE Motion to recommend that the City Council direct the City PLACED Attorney to draft a Resolution approving the Variance 6995 Magda PARTIALLY IN Dr, subject to: THE SHORELAND 1. Board meetings are held on the third Thursday of each month. The applicant was at the meeting to answer questions. Mike Sowers, 6995 Magda Drive, reported the fireplace had a smaller setback than on the site plan displayed by staff. He explained if he had to adhere to the City’ s setbacks his porch could only go out 10 feet. He stated this was not enough space for a table and room to sit around the table. He indicated the additional two feet would be greatly appreciated. Mr. Corrow noted that the small bump out created by the fireplace is permitted and does not require a variance. Maple Grove Planning Commission July 27, 2020 Page 3 Chair Colson opened the public hearing at 7:07 p.m. The public was asked by Chair Colson if they had any comments to make regarding this application. Mr. Vickerman reported staff received an email from Matt and Donna Eich at 7003 Magda Drive noting they supported the requested variance. Motion by Chair Colson, seconded by Commissioner Lenthe, to close the public hearing at 7:08 p.m. Upon call of the motion by Chair Colson, there were seven ayes and no nays. Motion carried. Motion by Commissioner Piket, seconded by Commissioner Ayika, to recommend that the City Council direct the City Attorney to draft a Resolution approving the Variance 6995 Magda Drive, subject to: 1. The applicant addressing to the satisfaction of the City any remaining applicable comments contained in the memorandum from: a. PUBLIC HEARING Mr. Vickerman stated the applicant is proposing a short plat preliminary and final plat together) in order to subdivide an exist TUCKER RIDGE lot into three new lots. There is a net increase of two lots with the proposal. All of the lots meet the R-1, Single Family Residential JENNIFER AND zoning district guidelines of at least 100 feet in width and 20,000 AARON s.f. in size. Per the subdivision ordinance at least 75% of the JACOBSON minimum lot area must be buildable ( so 15,000 s.f.) and all of these lots meet this requirement. Staff has no issues with the 8281 proposal and recommended approval of the short plat. The Water Resources Engineer, dated June 19, 2020 b. The Parks & Recreation Department, dated July 9, 2020 The applicant shall acknowledge that Park Dedication requirements are based on staff review and recommendation to the Park and Recreation Board and their subsequent board action. Board meetings are held on the third Thursday of each month. Discussion Commissioner Piket asked if the original plan was to subdivide this lot. Mr. Vickerman stated this was the plan. The applicant was at the meeting to answer questions. Chair Colson opened the public hearing at 7:12 p.m. The public was asked by Chair Colson if they had any comments to make regarding this application. No one wished to address the Commission. Motion by Chair Colson, seconded by Commissioner Lamothe, to close the public hearing at 7:13 p.m. Upon call of the motion by Chair Colson, there were seven ayes and no nays. Motion carried. Motion by Commissioner Ayika, seconded by Commissioner Klein, to recommend that the City Council direct the City Attorney to draft a Resolution approving the Tucker Ridge Short Plat, subject to: 1. PUBLIC HEARING Mr. Vickerman stated the applicant seeks applicant is requesting variances in order to build an attached garage on a two-family VARIANCE house located at 6240 Larch Lane. Each side of the two-family 6240 LARCH LANE house has an existing one-car garage. Staff reported there are two variances with this proposal: INNESA GOLDAYEVA 1. A setback variance of two feet along 62nd Avenue North. The standard setback is 15 feet. The applicant is proposing VARIANCE FOR a setback of 13 feet. THE PURPOSE OF 2. The size of the new garage and the existing garage is CONSTRUCTING A proposed to be 765 square feet and code limits garages in GARAGE the R3 zoning district to 700 square feet. ADDITION Mr. Vickerman commented further on the variance and explained staff supported the variance requests. STAFF RECOMMENDATION: Motion to recommend that the City Council direct the City Attorney to draft a Resolution approving the Variance 6240 Larch La, subject to: 1. Board meetings are held on the third Thursday of each month. Discussion Commissioner Piket commented the applicant currently has a single car garage. He asked if the applicant would be adding a second garage. Mr. Vickerman reported this was the case. Chair Colson inquired if there would be a driveway to access the second garage. Mr. Vickerman stated there would not be a driveway to access the second garage. He explained a secondary driveway would require an additional variance. Commissioner Ayika asked if the garage would be adjacent to 62nd Place. Mr. Vickerman commented this was correct. Commissioner Ayika inquired if the property was a duplex. Mr. Vickerman stated the property had one owner but was a duplex. Chair Colson indicated he recalled this property coming before the Planning Commission in the past. Mr. Vickerman commented he did not recall the previous request. Commissioner Lenthe questioned if there was any discussion with the applicant regarding staying within the 700 square foot dimension. Mr. Vickerman reported this was discussed with the applicant and in the end the applicant proposed a garage that was the length of the home. He indicated staff did not have any concerns given the fact it was such a minor increase. Commissioner Klein asked if the Planning Commission should revisit the 700 square foot limit given the fact vehicles were increasing in size. Mr. Vickerman commented this would be something staff could bring back to the Commission for further consideration. Commissioner Lindeman indicated this was the only duplex in the neighborhood that does not have a double car garage for both units. She explained the proposed garage expansion would be keeping in line with the adjacent neighborhood. Maple Grove Planning Commission July 27, 2020 Page 7 Chair Colson opened the public hearing at 7:27 p.m. The public was asked by Chair Colson if they had any comments to make regarding this application. Mr. Vickerman reported staff had received a petition from 13 neighbors in support of the variance request. Chair Colson accepted this petition into the record. Motion by Chair Colson, seconded by Commissioner Piket, to close the public hearing at 7:28 p.m. Upon call of the motion by Chair Colson, there were seven ayes and no nays. Motion carried. Motion by Commissioner Lindeman, seconded by Commissioner Klein, to recommend that the City Council direct the City Attorney to draft a Resolution approving the Variance 6240 Larch Lane, subject to: 1. The applicant addressing to the satisfaction of the City any remaining applicable comments contained in the memorandums from: a. The Community & Economic Development Department dated July 20, 2020 b. The Water Resources Engineer dated July 1, 2020 The applicant shall acknowledge that Park Dedication requirements are based on staff review and recommendation to the Park and Recreation Board and their subsequent board action.
