(2) ROLL CALL Present: 6- Chair McCann, Vice-Chair Lamb, Member McChesney, Member Novak, Member ODonnell and Member Eastman (3) PLEDGE OF ALLEGIANCE Led by Chair McCann. (4) APPROVAL OF THE AGENDA MOTION by Member McChesney to approve Agenda as amended by deleting Item 8.c., seconded by Vice-Chair Lamb, that this Agenda be approved. MOTION CARRIED BY THE FOLLOWING VOTE: Yes: 6- Chair McCann, Vice-Chair Lamb, Member McChesney, Member Novak, Member ODonnell and Member Eastman (5) APPROVAL OF THE MINUTES MOTION by Member McChesney, seconded by Vice-Chair Lamb, that these Minutes be approved. MIPD Beach Patrol Report ID 18-567 MIPD 2018 September Beach Patrol Report Attachments: Sept. 2018 MIPD Beach Report .pdf Lt. Smith explained article in newspaper regarding his position, bottom line this does not deter him from completing his mission. Reported the following: . 10 verbal warnings on glass . Turtle inspection at night . Wake zone violation warnings - jet skis come in fast on beach line . Fishing incident on beach, an organization bullied people to stop fishing on beach, Lt. Smith knows who it is. They can call Police Dept. and should not handle themselves. He will check into situation. Endangered Species Ordinance Edits Update ID 18-583 Endangered Species Ordinance Edits Attachments: Staff Report -Listed Species Ordinance 13-05 .docx ListedSpecies.pdf Ms. Selmeski reviewed attached draft edits provided by staff and Brad Cornell, Audubon. Waiting for follow up from City attorney on revisions to move forward with proposed changes. Ms. Selmeski will research other municipalities regarding complying with ordinance 18-146. Will request input from Tim Hall, Audubon on Gopher Tortoises on incentive programs. Add topic to BchCRAC agenda next month. Chair McCann stated Volusia County ordinance states house and tree removal permits are only issued after FWC permit is issued. Chair McCann asked that this be added to Ordinance 13-05. City ordinance speaks on all other agencies must be signed off before given a development order. Director Smith handles policy for permits to be in place and meet all federal and state agencies prior to signature. Will report next meeting on comments from City attorney. MOTION by Vice-Chair Lamb to approve language accepted by staff to be included in the first reading to be discussed at City Council meeting in November 2018, seconded by Member Eastman, that this Motion be approved. Beach Vendor Permits Update Ms. Selmeski stated all beach vendor permits have been issued. Some delays were due to people on leave or incomplete applications, all will be approved and processed. Requested vendors to relocate equipment, some in compliance, if not follow up with code enforcement. Chair McCann - Rules and Regulation - Facilities must be kept clean and orderly condition which ties into straw ban ordinance. City Council requested committee create language to keep beach clean. Director Smith stated he can incorporate straws, beach can make language stronger, spell out plastic straws as key issue. He will give committee copy of vendor language. d. Red Tide Update Ms. Selmeski reported from Collier County - no signs of dead fish, or respiratory conditions, no red tide present, wind forecast can change, another report on Friday updated on Collier County website. Florida Dept. of Health released debris from dunes last week, showed high bacteria, and posted health advisory. Ms. Selmeski will research debris falling in beaches. FWC Iguana Workshop October 24, 2018 - 6:00 - 7:30 p.m. (Community Room) Ms. Selmeski receives many calls on iguanas, she reached out to FWC - they will provide technical workshop, next Wednesday night open to public, streamed live with Q &A session, regulations and guidelines for property owners. f. Water Quality Sub-Committee Group Meeting October 25, 2018 - 12:00-1:00 p.m. - Community Room Coastal Advisory Committee meeting 1:00 p.m.-3:00 p.m. - Community Room Debbie Roddy, Collier County Coastal Advisory Committee, set up sub-committee for water quality, next Thursday at 12:00 p.m. in Community Room. Collier County agenda: polution control dept, red tide, water quality, rolls and responsilities of individuals. Ms. Selmeski last week met with 2018 Collier County Shorebird Partnership meeting for Rookery Bay - Shorebird Preservation for Lee /Collier County, breeding season, next meeting in Spring. (7) PUBLIC COMMENT (TIME CERTAIN 9:30 A.M.) Greg Whilley - Emerald Beach: Thick, high vegetation found in front of his condominium. Chair McCann stated Rake Operator retired, Collier County, Gary McAlpin trying to find someone else. Director Smith stated Collier County constructing regrade of beaches, need to address low area ponds, part of plan for regrading, and will find out Collier County process. Ms. Debbie Roddy stated this is on-going project from last two City Council meetings. Gary McAlpin created letter to waive dune expansion after received letter from City, need to work 24/7 to complete. North of Marriott to South Seas Towers, unable to do Tigertail. Will need instructions on easements before they start working on condominiums. Gene Burson - 1865 Apataki Court - representing Commanders Group, boating association, speak to committee concerns on Monday City Council meeting to use funds from ATON for water quality testing. He supports Waterways Committee to obtain quality water testing near shore, need better samplings. Mr. Burson's association is willing to volunteer boats for better testing throughout waterways on Marco Island. (8) PRESENTATIONS a. Ocean Habitats, Inc. Update On Projects in Ft. Myers - Jim Timmerman Mr. Timmerman updated committee on present and future projects on water quality testing, testing to increase nutrients, and Ft. Myers project. He will forward testing data and water quality reports to Chair McCann. Director Smith will speak to Ms. Malloy on Mackle Park lake project. Suggestion to use Habitat Reef for learning tool for kids. Ms. Selmeski will outreach, and Ms. Malloy can advertise. b. Presentation on "Rookery Bay-Celebrating 40 yrs". - Renee Wilson, Rookery Bay Renee Wilson, Rookery Bay National Estuarine (State/Federal Agency), Communications Coordinator presented 40 years+ Research Reserve on rich cultural history of Florida's Ten Thousand Islands presentation. Partnerships are: non profits, governments, make diverse impact on communities, and businesses. City of Marco Island Florida Page 3 Beach and Coastal Resources Meeting Minutes - Final October 17, 2018 Advisory Committee WGCU TV and PBS Stations - Florida Public Station for documentary film with Live Oak Production Group. Earth Day is April 21, 2019. Access data for water quality stations to: Rookery Bay.org. Following the presentation, a question and answer session was conducted for the committee. c. Discussion on Best Landscaping Practices Class at Rookery Bay - Yvette Benarroch, Affordable Landscaping Deferred to next month. (9) OLD BUSINESS a. Updated on Beach Signage for "No Plastic Straws" Ms. Selmeski looking for signage for "Beach Access", will need Interim City Manager approval. Could read: "No Plastic Straws on Beach" b. Contractor Licensing & Code Enforcement Director Smith implemented licensing for code which started October 1, 2018. Will meet every month for report showing violations, and enforcing penalties. Funds go into General Fund, Member McChesney suggested a portion of environmental fines should go into committee fund for environmental purposes. Mackle Park lake - research funding, and redirect elsewhere. Approval on fund allocations need approval from City Manager/City Council. c. Urban Bird Treaty - Update - Mimi Wolek, Executive Director, Audubon of Western Everglades Brad Purnell stated Mimi Wolek was unable to attend. (10) NEW BUSINESS a. Showing of "Plastic Ocean" Movie November 15, 2018 Chair McCann working with Renee Wilson, Rookery Bay on movie for local showing on November 15, 2018 on "National Recycling Day" , or in January/February 2019. (11) COMMITTEE COMMUNICATIONS a. Beach Clean-Up - November 2, 2018 at South Beach at 5:00 p.m. October 27th - 8:00 a.m. sponsored by Marco Island Women's Club November 2nd - 5:00-5:30 p.m. at South Beach At last clean up, found 17 pairs of sunglasses, bag of butts, smaller bag of straws, and huge amount of bottle caps. At next BchCRAC meeting November 22, 2018 (day before Thanksgiving), all members agreed they will be in attendance.
