MOTION CARRIED BY THE FOLLOWING VOTE: Yes: 4- Chair Freeman, Vice-Chair Barto, Member Fernstrum and Member Zinkan Not Present: 1- Member Delawder (4) APPROVAL OF MINUTES ID 18-019 Hideaway Beach Tax District Minutes for November 15, 2017 MOTION by Member Fernstrum, seconded by Vice-Chair Barto, to approve the November 15, 2017 Hideaway Beach Tax District Board Minutes. MOTION CARRIED BY THE FOLLOWING VOTE: Yes: 4- Chair Freeman, Vice-Chair Barto, Member Fernstrum and Member Zinkan Not Present: 1- Member Delawder (5) COMMUNICATIONS a. Discussion with Gary McAlpin regarding Collier Creek Chair Freeman added this topic to the agenda in order for the Board Members to engage in discussion without being in violation of the Florida Sunshine Law. He asked Mr. Michael Poff to provide an update from Collier County Coastal Zone Manager Gary McAlpin regarding the use of sand from the dredging of Collier Creek. It was suggested Hideaway Beach might be able to use that sand to place in the area in front of their clubhouse since it's mainly mud there and that will not be corrected until their dredging project in the spring of 2019. City of Marco Island Florida Page 1 Hideaway Beach Tax District Board Meeting Minutes - Final January 18, 2018 Mr. Poff replied the permit modification has been issued by the Florida Department of Environmental Protection (FDEP) to allow for the removal of the material with temporary stock piling on state property next to Collier Creek. The concern of the agency is that the material would have debris in it and the sand will not be suitable for beach use and Mr. McAlpin felt his hands were tied and the material has to be disposed off site. Mr. Poff disclosed that Villa De Marco has contacted him to assist their contractor (Kelly Brothers) with the seawall design portion of the project and is asking if the Board Members see any conflict of interest. Following discussion, it was determined by the Board and Mr. Tim Pinter on behalf of the City, there would be no conflict of interest with Mr. Poff designing the seawall. Mr. Pinter did ask Mr. Poff to review the City's most recent ordinance about seawall construction and design professional's requirements and Mr. Poff concurred. b. Discussions regarding Hideaway Beach Sand Issues 1. Items left on beach over night Chair Freeman held a discussion on Hideaway Beach sand issues. He noted a lot of items have been left on the beach, such as; kayaks, fishing rods, apparel, shoes, chairs, and a variety of other things. The items appear to be coming from the owners of Hideaway Beach. He has asked the Manager of Hideaway Beach to send out a blast email to the owners reminding them not to leave items on the beach since it effects the barber rake and is untidy. It is noted, the items have been removed. 2. Dangerous rigid protrusion from sand at Villa 4 area Chair Freeman held a discussion on the dangerous rigid protrusion out of the sand in front of Villa Four (4) near the fountain, land side. He commented it is twelve (12) to eighteen (18) inches long and is part of the T-Groin system and appears the beach has eroded causing the exposure. Following discussion, it was determined Member Fernstrum will speak to Mr. Eddie Chesser and express the Board's concerns regarding safety of the exposed T-Groin and also notify Mr. Chesser of the debris from the tidal flow that is not being picked up. Member Fernstrum will report back at the next meeting. (6) REPORTS a. Financials - Member Delawder ID 18-026 Revenue and Expense Report Public Works Director Tim Pinter provided the Board Members an update on their financials from October to December 31, 2017, which is twenty-five (25%) of the year completed. He advised them they have 1.8 million available cash on hand. MOTION by Vice-Chair Barto, seconded by Member Zinkan, to approve the financials. Sand Issues - Member Fernstrum Member Fernstrum provided the Board Members an update on the sand. He commented the beach is being groomed every week and is asking if the Board Members wish to continue with a weekly or bi-weekly schedule. Following discussion, it was determined to continue with the weekly schedule for this time of year. Member Fernstrum will discuss with Mr. Eddie Chesser the topic of the barber rake driver operating the tractor too fast; the rake time needs to be sped up, not the tractor. c. Bird Monitoring - Ms. Nancy Richie ID 18-033 Shorebird Report Island Environmental and Marine Specialist Nancy Richie provided the Board Members an update on the shorebirds. She advised them she has been out four (4) times since the last Hideaway Beach Tax District meeting. South Beach has a steady population of different shorebirds. She has observed a rare sighting of a White-winged scoter last week and has seen a lot of dolphin but no manatee. She noted the tip has changed again dramatically and she will continue to monitor and report back. d. Candidate Vetting for Counsel Position - Chair Freeman Chair Freeman held a discussion on candidate vetting for the vacant counsel position since Hideaway Beach Tax District Attorney Bruce Anderson has retired. He asked Vice-Chair Barto to chair the vetting of the candidates and Vice-Chair Barto accepted. The three (3) candidates that have been recommended are: * Mr. Clay Brooker - associate and partner in Bruce Anderson's law firm * Mr. Craig Woodward - well known attorney on Marco Island * Mr. Richard D. Yovanovich - former counsel to the City of Marco Island It is noted other candidates were reviewed, however their background did not fit in with what Hideaway Beach Tax District is looking for in an attorney. They need an attorney that will make sure the Board Members follow the Florida Sunshine Law and has a background with respect to both Marco Island and Collier County issues. Following discussion, it was determined the process would be as follows: *Vice-Chair Barto to draft a letter inviting the candidates in for an interview *forward draft letter to Mr. Tim Pinter to place on the City of Marco Island letterhead *obtain resumes from Mr. Woodward and Mr. Yovanovich (Chair Freeman has Mr. Brooker's resume) *interviews scheduled as the first item of business on the February 28, 2018 agenda *10-15 minute interviews, candidates not to be in the same room with their permission (7) PRESENTATIONS a. Coastal Engineering - Michael Poff ID 18-021 Permit Modification President at Coastal Engineering Consultants Michael Poff provided background information on the permit modification and answered the Board Member's questions and concerns. CITY MANAGER LEE NIBLOCK LEFT THE MEETING AT 3:27 P.M.) Mr. Poff commented the analysis of sea level rise has been studied by many scientist and has many theories. Mr. Poff chose the method that the United States Army Corp of Engineers (USACE) has adopted. It has three (3) curves; low (based on actual historic data) intermediate (has historically been used for projects used by consultants for work around the Gulf of Mexico) and high (based on predictions of global warming). He noted it is a realistic trend and recommended for acceptance, widely accepted for Southwest Florida, DEP has already reviewed it and commented it's consistent with what they are seeing in Southwest Florida and they are recommending approval of this approach as well; therefor Mr. Poff is recommending to follow the middle curve. Mr. Poff said they have received an update from the permit reviewer this morning asking three (3) questions; if there is enough sand identified to do the projects, any involvement with Collier Creek dredging and drainage. Mr. Poff asked for clarification in what they are looking regarding drainage and asked Mr. Pinter if the City of Marco is doing anything with Hideaway Beach. Mr. Pinter replied preliminary discussions. The outfall that goes across the beach needs to be addressed. It has been hidden and no one knew its existence until Hurricane Irma. The City wide permit doesnt allow for any outfalls into navigable waterways. There needs to be another method to retain that water that is coming from the golf course lake. Mr. Poff asked if this outfall was grandfathered in and it would be helpful in attempting to locate the permits for the Master Plan for Hideaway Beach. Member Fernstrum asked about changing the slope to address the flooding in front of the 6000 building. It was discussed how to correct this problem but Mr. Poff commented that the permitting is already in process and it is not realistic to change it, however they could plant certain species of plants that are known to trap wind blown sand and build elevation. The Board Members continued discussions in how to address the need of sand in front of the clubhouse. It was suggested to truck in a small amount of sand before the 2019 project begins. Mr. Poff will provide an estimate on how much sand will be needed and cost based on 300 x 100 x 12 inches. Mr. Poff said based on those dimensions, it would be approximately 1,100 cubic yards equally approximately eighty (80) truck loads. Mr. Pinter advised the Board Members if they keep the cost below $50,000. it will not have to go out for a formal bid. It is noted, there have been no complaints thus far from the owners of Hideaway Beach and was determined to defer any decision at this time. b. Humiston and Moore Engineering - Mr. Brett Moore ID 18-037 Tigertail Lagoon Study Mr. Brett Humiston noted since the last meeting, he has pulled together quite a bit of information from the preliminary modeling and it is a good cautious approach from this point. He then turned the presentation over to Mr. Mohamad Dabees. Mr. Dabees provided an updated presentation an answered the Board Member's questions and concerns. He commented it is gradually shifting but looks the same and to keep an eye on long term trends and how to prepare for them. He is looking at the system in its totality and with the program in place, will be able to document the system as it is now, and try to document the past with existing information ie; ariel photography and surveys and then try to establish trends and base lines for City of Marco Island Florida Page 4 Hideaway Beach Tax District Board Meeting Minutes - Final January 18, 2018 ecological systems. He summarized the systems by four (4) main zones: *Zone 1 - Entrance at the north end of Sand Dollar Island to R128 Remnant deep channel of Big Marco Pass ( > -10 ft ) Entrance Shoaling and Borrow area dredging Sparse Seagrass areas at present time *Zone 2 - R128 to R130 Shallow water depth, (-1 to -2 ft) Sand spit onshore migration, No seagrasses at present time *Zone 3 - R130 to R133 Shallow and narrow lagoon area Sand spit onshore migration and sand overwash spit vegetation Significant seagrass coverage Restricted tidal flow *Zone 4 - R133 to R135 Terminal end of the lagoon Average Water depth >-3 ft Seagrasses present is some areas Limited tidal exchange and large phase lag with Gulf tidal cycle. Following discussion, it was suggested to look at the entire lagoon from a comprehensive perspective. He is recommending small cuts in zone 2, south of the kayak launch area and not cutting through the seagrass areas, to increase tidal flow. It was recommended to put together an informal advisory committee from the leaders of all the stakeholders and hold a meeting to discuss what has already been done, goals and objectives, present scenarios and include the topic of what it will be like it nothing is done. Following discussion, it was determined the City of Marco Island will conduct a public meeting for discussions on how to obtain a regional understanding of what is occuring in Tigertail Lagoon and defer the advisory committee. Mr. Pinter advised the Board Members if they want to involve the City of Marco Island, the next step would be a presentation in front of City Council. Mr. Humiston replied he could have the executive summary ready for the City Manager's review by the end of February 2018. Chair Freeman summarized they would give the City Manager thirty (30) to sixty (60) days to review the material and hold a meeting with the Board Members afterwards. c. Member Zinkan asked the Board Members to consider scheduling all future Hideaway Beach Tax District meeting dates. Following discussion, it was determined to schedule these future meeting dates: * March 22, 2018 at 2:00 P.M. * July 26, 2018 at 2:00 P.M.
