(1) CALL TO ORDER
Chair Freeman called the meeting to order at 2:00 P.M.
(2) ROLL CALL
Present: 5- Member Delawder, Chair Freeman, Vice-Chair Barto, Member Fernstrum and
Member Zinkan
(3) APPROVAL OF THE AGENDA
Chair Freeman requested a change in the order of the Agenda, to move Item 8a (Presentation - Coastal
Engineering - Michael Poff) after Item 3 (Approval of the Agenda) and the Board Members concurred.
MOTION by Member Delawder, seconded by Vice-Chair Barto, to approve the
Agenda as amended. MOTION CARRIED BY THE FOLLOWING VOTE:
Yes: 5- Member Delawder, Chair Freeman, Vice-Chair Barto, Member Fernstrum and
Member Zinkan
(4) SUNSHINE LAW DISCUSSION
ID 18-729 Sunshine Law Presentation
Attorney Lenore Brakefield from Woodward, Pires and Lombardo Law Offices, 606 Bald Eagle Drive, Suite
500, Marco Island Florida, gave a slideshow presentation on Government Sunshine Law and answered the
Board Member's questions and concerns. It is noted for the record, the presentation can be viewed in its
entirety by clicking File ID 18-729.
(5) APPROVAL OF THE MINUTES
a. ID 18-665 Hideaway Beach Tax District Meeting Minutes of October 29, 2018
Chair Freeman chose to abstain from voting for the minutes due to him not being present at that meeting.
Hideaway Beach Tax District Board Attorney Craig Woodward recommended including his name on the
document and the Board Members concurred.

MOTION by Member Delawder, seconded by Member Fernstrum, to approve the
October 29, 2018 Hideaway Beach Tax District Meeting Minutes as amended.
MOTION CARRIED BY THE FOLLOWING VOTE:

Abstain: 1- Chair Freeman
(6) COMMUNICATIONS
Chair Freeman provided a review of their interest in obtaining better access at their picnic area and the
dredging opportunity to create more water flow that would benefit both Hideaway Beach and Tigertail.

Chair Freeman disclosed his email communicatoins to the Board Members.
(7) REPORTS
Financials - Dick Delawder
a. ID 18-690 Revenue and Expense Report
Member Delawder advised the Board Members the financials are at the same place as last time, but
there were a few more expenses which included Attorney Craig Woodward and Shorebird Monitor
Nancy Richie.
MOTION by Member Delawder, seconded by Member Fernstrum, to approve
the financials as presented. MOTION CARRIED BY THE FOLLOWING VOTE:

b. Beach Issues - Paul Fernstrum
Member Fernstrum provided the Board Members an update on the beach. He noted there was one (1)
dead dolphin on the 27th but it has been removed. It is believed that the tractor is not getting close
enough to the waters edge which is an on going problem. It is noted everyone seems to be happy with
the quality of the sand.
(It is noted for the record, Public Works Director Tim Pinter left the meeting at 2:58 P.M.)
(8) PRESENTATIONS
a. Coastal Engineering - Michael Poff
Mr. Michael Poff with Coastal Engineering provided an update on the permit modifications. They are on
schedule to be completed in January, 2019 and begin construction in late February or early March. He
noted he has sent an application to Florida Fish and Wildlife Conservation Commission (FWC) for
what is called an "Incidental Take" to allow them to implement the passage of shorebird abatement
measures to chase the birds off the work area to try and reduce and eliminate the problems faced in
2016. He said it is an extra layer of protection during the project and formalizes everyone's
responsibilities. Ideally construction would begin March 1 and completed by June 1, 2019 and it is
noted they are permitted to work during sea turtle nesting season which begins May 1.

He is asking the Board Members for direction on the following:
*time allotted for construction operations
*project to be done mechanically, hydraulically or combination of both
It was recommended to let the winning contractor use whatever methods available and the Board
Members concurred.
MOTION by Member Delawder, seconded by Member Fernstrum, to allow
construction twenty-four (24) hours, seven (7) days a week for the Hideaway
Beach Dredging Modification Project. MOTION CARRIED BY THE FOLLOWING

b. Humiston and Moore - Mohamed Dabees
Mr. Mohamed Dabees with Humiston and Moore noted the final presentation has been given to the
Hideaway Beach Tax District Board Members. He said they now have a scientific approach on how to
improve the quality of water and the habitats that exist and it is up to the stakeholders and agencies
to come to a consensus on where and how to engineer the channel to help the ecosystem.
Friends of Tigertail President Linda Colombo commented she has taken this to the Board Members
and they are in agreement to improve the water quality issue in the lagoon and prevent the choking.
Ms. Colombo will forward dates to Mr. Dabees and Chair Freeman for a meeting of the interested
parties.
Mr. Dabees advised he will attend the Friends of Tigertail Meeting to give his presentation on the work
that has already been completed and indicated the City of Marco Island and/or Collier County will need
to take the lead to try and obtain Collier County Tourist Development Council (TDC) funding.
