(2) ROLL CALL Present: 5- Vice-Chair Barto, Chair Delawder, Member Fernstrum, Member Ryan and Member Zinkan (3) PLEDGE OF ALLEGIANCE Led by Chair Delawder. (4) APPROVAL OF THE AGENDA MOTION by Member Fernstrum, seconded by Member Zinkan, that the Agenda be Approved. MOTION CARRIED BY THE FOLLOWING VOICE VOTE: Yes: 5- Vice-Chair Barto, Chair Delawder, Member Fernstrum, Member Ryan and Member Zinkan (5) APPROVAL OF THE MINUTES Member Ryan proposed amendments to the January 14, 2021 Minutes as follows: 1) correcting the word 'process' to 'progress' in reference to City Council Chair Grifoni's comments under Item 10 (Old Business); 2) correcting the spelling of Member Zinkan's name in multiple locations within the Minutes, and; 3) correcting the spelling of Mr. Tom Ryon's name in multiple locations within the Minutes ID 21-1395 January 14, 2021 Hideaway Beach Tax District Meeting Minutes MOTION by Vice-Chair Barto, seconded by Member Zinkan, that the Minutes of January 14, 2021, be Approved as Amended. (7) PUBLIC COMMENT None. (8) PRESENTATIONS None. (9) OLD BUSINESS City of Marco Island Florida Page 1 Hideaway Beach Tax District Board Meeting Minutes - Final February 18, 2021 a. Tigertail Lagoon/Sand Dollar Island Environmental Restoration Project Update- Mohamed Dabees ID 21-1399 Aerials 2020-06 to 2021-02 ID 21-1400 February 12, 2021 Pictures Mohamed Dabees, Vice President of Humiston & Moore Engineers, provided the Board with an update regarding the Tigertail Lagoon/Sand Dollar Island environmental restoration project. Chair Delawder expressed some concerns regarding dredging, and he inquired as to the plans for sanding the beach. Mr. Dabees indicated that the current plan calls for delaying dredging work until the conclusion of turtle nesting season. Member Zinkan asked Mr. Dabees when might be the earliest date for the dredging of Tigertail Lagoon. Mr. Dabees explained that the timing of turtle nesting season as well as bird nesting season must be considered . Realistically, dredging could begin in the December - January timeframe. Member Ryan noted that the Board would likely not be allowed to start dredging before January unless a special permit is granted to do so. She also questioned how both permits would be aligned if the permit modification for the north end is waiting for the permit that Mr. Dabees is working on for the area to the south. The Board expressed deep concern with getting backtracked and having to delay dredging operations for too long a period of time. Member Zinkan reported that he took a bike ride to Tigertail and that there were no parking spaces available. He also observed that traffic was backed up and that three police officers were helping to direct traffic. In response to Member Zinkan's report, Public Works Director Tim Pinter noted the problem was caused by a failing cross reader. Member Ryan noted that the flow of traffic increases during the holidays, and that this problem is a frequent occurrence. b. CEC Annual Monitoring Survey Proposal - Michael Poff ID 21-1398 Monitoring Scope Of Work Michael Poff, President of Coastal Engineering Consultants, presented the Board with a proposal for its annual monitoring surveys. Overall, the proposal comprehended the same scope and proposed the same cost as last year. If approved, the surveys could begin in either May or June. The overall proposed cost for the annual monitoring services would be $49,930, and included both the cost of monitoring ($43,200) as well as the District and City support service fee ($6,730). Member Ryan asked Mr. Poff when the surveys could be completed. Mr. Poff responded that much depended upon the dredging schedule. The next dredging event is currently scheduled for calendar year 2022. Logistically, the Board would have to solicit bids in July and, as a result, start the surveys as early as May to use them for the bid solicitation documents. Any plan to dredge as early as October or November, which is the Board's strong preference, would require a great deal of effort and cost a great deal of money. MOTION by Member Zinkan, seconded by Member Fernstrum, that the Annual Monitoring Survey Proposal presented by Michael Poff, President of Coastal Engineering Consultants, be Approved as Presented. CEC Beach Tilling Proposal - Poff ID 21-1396 Tilling Scope of Work Mr. Michael Poff reported that, as a result recent testing by Humiston & Moore Engineers, the need for compaction testing was eliminated, resulting in a reduction in the expected cost of the effort of $1,090. The only expense that would need the approval of the Committee would be the Beach Tilling expense. MOTION by Vice-Chair Barto, seconded by Member Fernstrum, that task #4 of the Coastal Engineering Consultants, Inc. Beach Tilling proposal be Approved. MOTION CARRIED BY THE FOLLOWING VOTE: Yes: 5- Vice-Chair Barto, Chair Delawder, Member Fernstrum, Member Ryan and Member Zinkan (10) NEW BUSINESS a. Discussion For Renewing The Tax District With Council - Attorney Woodward Attorney Craig Woodward indicated that he spoke with Bruce Anderson, prior attorney, Dave Carpenter, Supervisor of Elections, and Erik Brechnitz, former Tax District chairman, to get background on question of whether the Tax District’s ability to levy taxes needed to be renewed. He said things are much better than we thought and Attorney Lenore Brakefield will present her findings. Attorney Lenore Brakefield stated to the Board that its ability to tax does not sunset ever. However, in reviewing the minutes from 2012, there was a resolution passed and an August referendum that gave the District the ability to issue limited general obligation bonds not to exceed two million nine hundred thousand dollars. This sunsets in 2024. To renew this ability requires another referendum for approval by Hideaway Beach voters. Chair Delawder asked what would happen if the District did not have enough funds to cover a project. Mr. Dabees responded that it is too early to develop a project cost but, based on sand volumes, an estimated amount for the cost of the project is $2-3 million. There was a general discussion of projected cash on hand and financing options for the project. Currently the Board is authorized to tax up to 2.6 mills annually. Chair Delawder inquired about a past project where the city provided a loan to the District. In order to float bonds to help fund the anticipated project, the Board would need to start the process now. Member Barto suggested that the Board begin that process. Attorney Woodward offered that the legal team would report back on the election cycle and timeline for a referendum. For tax revenue budgeting purposes, Member Ryan asked Member Fernstrum if it might be possible to create a projection of what the funds availability would be under different millage rate scenarios. (11) COMMITTEE COMMUNICATIONS Member Fernstrum raised several concerns regarding the beach. Due to a storm in January by the 6000 Building, about 40% depth of the beach was lost. Member Fernstrum provided some pictures of the beach. Regarding the beach raking, it is currently being raked twice a week. Member Fernstrum displayed pictures of the effects on the beach. He noted that it appears that it is being raked more than 2 times a week and that he does not see much of a difference. Member Ryan questioned what depth is required City of Marco Island Florida Page 3 Hideaway Beach Tax District Board Meeting Minutes - Final February 18, 2021 when tilling the beach, Mr. Poff stated that 36 inches are required. Tilling will be done either in the first weeks of April or late March. As for the billing, Mr. Pinter indicated that he had not received anything yet from Hideaway. Member Fernstrum will check with Finance regarding the bill. The next meeting of the Board is scheduled for March 25, 2021.
