Chairman Timmerman requested a change in the order of the agenda, to move the review
of Engineer of Record Bulkhead (Discussion Item 9) before Old Business-Action Item
ORI Update (Item 7).
MOTION by Member Fleischer, seconded by Member Farnsworth, to approve the
agenda with the amended changes. MOTION CARRIED BY THE FOLLOWING

MOTION by Member Farnsworth, seconded by Member Jaskiewicz, to approve
the April 21, 2016 minutes. MOTION CARRIED BY THE FOLLOWING VOTE:

(5) STAFF COMMUNICATIONS
Director of Public Works Tim Pinter provided the Board with the following updates:
1. Hideaway Beach dredging has commenced and the contractor is on site fusing
together all the pipes. Dredging operations should begin in seven to ten days and will
take approximately two weeks to finish. Upon completion, Collier Creek dredging will
begin with an anticipated date for the end of June.
2. The vertical clearance and canal depth sign markers will be placed on the Herb
Savage Bridge shortly. They are awaiting information from the contractors so the design
engineer can certify the height of the bridge.

(7) OLD BUSINESS
ACTION ITEM: ATON (AIDS TO NAVIGATION) & PATON (PRIVATE AIDS TO
NAVIGATION) -JAMES TIMMERMAN
Director of Public Works Tim Pinter provided updated information on the Aton and
Patons. He advised they are waiting on permits from Florida Fish and Wildlife
Conservation Commission (FWC). They are continuing to check the Public Works
inventory for markers that need updating for the upcoming 2017 year. The City Manager
commented there are sixty total and the goal is to cycle them every five years equaling
twelve a year.
ACTION ITEM: ORI UPDATE-JAMES TIMMERMAN
Mr. David Wolfe, Director of Ocean Habitats, gave an update on the Ocean Restoration
Initiative (ORI) project and was available to answer the Committee's questions and
concerns. He advised twenty-five (25) habitats have been installed on Perrine Court. They
really needed to be installed by February 15th in order to get the full effect of getting the
spawn animals on the habitat. This will delay the full development of the habitat by
approximately 3 months. Originally the plan was to install 33 units, however, per Council's
direction, $2500.00 was to be allotted for water quality testing, therefore only twenty-five
units were placed instead of the original thirty-three units. Both units at Ville De Marco
West are also going to be replaced.
ACTION ITEM: COMMERCIAL VESSELS - BEN FARNSWORTH
This item was deferred to the July meeting.
ACTION ITEM: DOCUMENTING CANAL WATER DEPTHS
Director of Public Works Tim Pinter reminded the Committee, the action today was to
determine if the Committee was going to ask direction from City Council.
Marco Island City Council Vice-Chair Petricca commented most boat owners should
know the canal depths being they have depth finders on their vessels.
The City Manager believes the data collected would be valuable for possible federal
funding in case of a hurricane.
MOTION by Member Farnsworth, seconded by Chairman Timmerman, to move
this item forward to City Council for direction. MOTION FAILED BY THE
FOLLOWING VOTE:

DISCUSSION ITEM: REVIEW OF ENGINEER OF RECORD BULKHEAD
CONSTRUCTION OVERSIGHT - JAMES TIMMERMAN
Chairman Timmerman gave background information on seawall construction on Marco

Island along with the current seawall ordinance. Specifically the current process which
requires the engineer of record design and ensure that a seawall will be built to their
design specifications. The City has at this point minimal if any inspection process other
than verifying that the engineer of record has performed their duties as specified which
includes a before and after letter which states that the seawall was built to their
specifications . He has been contacted by people who are concerned that perhaps there
might be a better method of ensuring that the engineer is performing those duties as
specified.
Mr. Martin Pinckney with American Engineering spoke about the design build process for
seawall construction. He suggested quality control by having the City issue a specific list
of inspections that have to be done during the construction process along with affidavits
attached to each inspection.
Mr. Pinter advised that the ordinance does provide the option for the contractor to pay for
the City to do all of the inspections and that no contractors have ever selected that. They
choose to have their design professionial do the inspections. Tim Pinter commented
there have been no formal complaints issued to the building department regarding this.
Mr. Steve Sokol with Blue Marlin Marine Construction believes Marco Island needs an
independent party to monitor the contractors and they need to have more stringent
regulations of the contractors. He questioned who is responsible for construction
methods.
Mr. Jim Schuck with Blue Marlin Marine Construction commented that Marco Island used
to have a "pre" and "post" seawall inspection. The City of Naples is similar to Marco
Island in that they use the engineers certifications, however, the City of Naples does
conduct a final inspection.
Board Member Farnsworth provided ex-parte communications.
The City Manager commented that the City will not accept a "qualified" statement from
the engineers and or contractors which are the responsible parties. The City will look into
whether or not this is happening. The property owner has the option of having the City
conduct the inspection for a fee. He stated when Code Enforcement looks at a seawall, it
is either "vertical" or "not vertical". They do not handle degrees of deterioration.
Following discussion, it was determined that the City will make sure the engineers are
sending unqualified certifications that are compliant to City code and that the letters
stipulate exactly what was done. It was also agreed by consensus to keep this as a
discussion item on a future agenda.
ACTION ITEM: REPORT FROM MR. HEINDL REGARDING DEP PLANNING LIST
This item has been deferred to the next meeting.
DISCUSSION ITEM: SMOKEHOUSE BAY MOORING FIELD & ANCHORAGE-JAMES
TIMMERMAN
This item has been deferred to the next meeting, however Committee Member Fleischer
commented that the best place for a mooring field would be Factory Bay instead of
Smokehouse Bay, in his opinion.

Mr. Gene Burson, 1865 Apataki Court, raised concerns for public awareness on the
fertilizer ordinance and questioned the process. The City Manager clarified the following
points raised by Mr. Burson; Rookery Bay will hold educational classes; the City has
created an excel spreadsheet for the contractors to use for the permit process and that
will be placed on the City's website; Code Enforcement has been participating in the
meetings and implementation of the ordinance and have been instructed to educate the
public for now; new lawns, athletic fields, and golf courses are the exception to the rule in
the form of a resolution, Beautification Advisory Committee will be the citizen outreach
factor and Growth Management will be responsible for the follow up.
The June Waterways Advisory Committee has been cancelled.
