MOTION CARRIED BY THE FOLLOWING VOTE: Yes: 5- Vice-Chair Parcelles, Jaskiewicz, Chair Heindl, Timmerman and Fleischer Not Present: 2- Member Farnsworth and Landwaard (5) STAFF COMMUNICATIONS Mr. Pinter advised that all permits have been received for the ATON and PATONS in Factory Bay. (6) COMMITTEE COMMUNICATIONS Rodger Parcelles suggested a discussion regarding critical wildlife areas surrounding Marco Island for an item for the next meeting's agenda. On August 8th he attended a meeting at Rookery Bay with the FWC. They are looking to expand the critical wildlife areas within Rookery Bay which is just one of the areas they would like to expland around the state. In the State of Florida there are currently 20 critical wildlife areas with 5 of them located within ten miles of Marco Island. He wants to make sure that not just the residents but the stakeholders and the City Government itself be kept in the loop with the FWC for expanding critical wildlife area boundaries or the creation of any new ones. Mr. Heindl suggested having a representative come in to explain the critical wildlife areas to the Committee. This will be carried forward to the New Business section of today's meeting. Mr. Timmerman discussed adding an item to New Business to create a funding mechanism for the part time environmental specialist to be present at our meetings. Mr. Heindl asked the Committee about budget funding for ATON and PATONS. Mr. Timmerman advised it would be added to the agenda. (7) OLD BUSINESS City of Marco Island Florida Page 1 Waterways Advisory Committee Meeting Minutes - Final September 15, 2016 1 ACTION ITEM:ATONS (AIDS TO NAVIGATION) & PATON (PRIVATE AIDS TO NAVIGATION-JAMES TIMMERMAN Mr. Timmerman advised that he had spoken with the County and he was informed that they will be installing the ATONS that were requested some time ago. Mr. Pinter advised we finally got permits from the state for Factory Bay markers 3, 3A and 5. They will be completed in November. His staff has replaced 12 markers so far this year. Another 12 are on order and scheduled for replacement by the end of the 2016 calendar year. 2 ACTION ITEM: ORI UPDATE-JAMES TIMMERMAN Mr. Timmerman advised to change future agendas to reflect the name change from "ORI" to "Ocean Habitats." Mr. Timmerman read for the record a letter from Peter R. Foster, MD who has a habitat beneath his dock on Perrine Ct. and is seeing a diversity in the fish now being caught. He applauded the efforts of the pilot project. David Wolff, President, Ocean Habitats, gave an update on the habitats. He advised he is very pleased with what is growing after 120 days in the water. He will be getting in the water over the weekend to take photos and videos to present at the next meeting. Mr. Parcelles requested pictures of the construction and installations of the habitats as well. Discussion followed regarding the effectiveness of the program and ways to determine the progess of the habitats. Mr. Wolff thanked the Committee, the City Council and City Staff for their assistance with this project. Public Comment Mr. Jerry Miller, Environmental Science teacher at the Marco Island Academy advisted that students at the academy will be working with Ocean Habitats by assembling, placing and monitoring habitats on the island. He also advised that they would also like to incororporate this into their June Abassadors to the Environment Camp. Melissa Scott, Principal, Marco Island Academy advised the Committee that this project aligns with the school's mission to educate their students outside of the classroom in the real world. 3 ACTION ITEM: COMMERCIAL VESSELS-BEN FARNSWORTH Due to Mr. Farnsworth's absense from this meeting, this item will be continued to next month's meeting. 4 DOCUMENTING CANAL WATER DEPTHS By consensus it was decided to remove this Item from the Agenda and it will be handled as a site specific issue. 5 DISCUSSION ITEM: REVIEW OF ENGINEER OF RECORD BULKHEAD CONSTRUCTION OVERSIGHT-JAMES TIMMERMAN Mr. Timmerman discussed a letter from Mr. Steven Sokol from Blue Marlin Marine Construction & Services, Inc. that was forwarded to the Committee regarding inspection of seawall construction. The Committee members will review the letter and this item will be discussed at the next meeting. A brief discussion followed regarding seawall inspections and the seawall ordinance. City of Marco Island Florida Page 2 Waterways Advisory Committee Meeting Minutes - Final September 15, 2016 6 REVIEW AND DISCUSSION OF SECOND QUARTER CANAL WATER QUALITY DATA Mr. Timmerman suggested making a formal invitation for Chadd Chutz to attend the October meeting to discuss water quality results. 7 LIONFISH Mr. Parcelles provided a brief update. In 2016 there have been 19 Lionsfish derbies and another 6 are scheduled before the end of the year. Some of the past results include Ft. Lauderdale harvesting 1,250 and Jacksonville harvesting 3,478. A Naples event harvested 71. The biggest event was the FWC Lionfish Removal and Awareness Tournament which was a 3 day tournament based in Pensacola which harvested 8,089 Lionfish. NOAA is seeking public comment for the implementation of Lionfish traps. Fin's Bistro and CJ's on the Bay are now offering Lionfish on their menus. Local sightings continue to be reported but not in the quantity noticed in other parts of the state. Mr. Parcelles is hopefull that in the near future the City can promote public awareness regarding the Lionfish. (8) NEW BUSINESS 1 ACTION ITEM: REPORT FROM MR. HEINDL REGARDING DEP PLANNING LIST Mr. Heindl referenced the ongoing discussion the Committee has had regarding the legal environmental quality status of Marco Island and surrounding waterways relative to the Department of Environmental Protection regulations. He advised that at the last meeting Mr. Chutz was not aware of what that status was so Mr. Heindl volunteered to send him some information as to his understanding of what that status was. Mr. Heindl read for the record an email he sent to Mr. Chutz on April 18th. Mr. Chutz did not respond to the email. Mr. Heindl is concerned that Marco Island has a part time environmentalist and these issues need to be a priority. He still feels we need a comprehensive waterways management plan and he hopes the new City Council will act on that. This will be included on the next agenda under Canal Water Quality. 2 DISCUSSION ITEM: SMOKEHOUSE BAY MOORING FIELD & ANCHORAGE-JAMES TIMMERMAN The dock master from the Esplande was scheduled to attend this meeting. Due to his absense, this item will be moved to next month's agenda. 3 PER CITY COUNCIL DIRECTION, DISCUSSION OF SEAWALL ORDINANCE REVIEW Mr. Timmerman is still waiting for guidance and direction on this issue. This will be discussed next month. 4 REVIEW OF "SEAWALL OWNERS MANUAL" AND DISCUSSION TO INCLUDE BASIC FACTS REGARDING STANDARD SEAWALL CONSTRUCTION Mr. Timmerman met with Mr. Hernstadt and he suggested that if the Committee has additional City of Marco Island Florida Page 3 Waterways Advisory Committee Meeting Minutes - Final September 15, 2016 suggestions and information to add to the Seawall Owner's Manual that the committee should review the manual. MOTION by Member Heidl, seconded by Vice-Chair Parcelles, that the Committee review the Seawall Owner's Manual. MOTION CARRIED BY THE FOLLOWING VOTE: Yes: 5- Vice-Chair Parcelles, Jaskiewicz, Chair Heindl, Timmerman and Fleischer Not Present: 2- Member Farnsworth and Landwaard (9) PUBLIC COMMENT Gene Burson, Beach Advisory Committee and Marco Island Power Squadron, advised that the Caxambas #2 and #7 markers are down and in critical need of repair. Mr. Pinter advised those are the responsibility of the County. Mr. Timmerman will check with the County and also touch base with Mr. Hernstadt to see what he wants to do. Mr. Burson also advised that a representative from Rookery Bay did come to the Beach Advisory Committee meeting and speak to them on the critical wildlife areas. They will be at each of their montly meetings. They also have the same urgency in having Chadd attend their meetings and he has not done so so far. Mr. Burson is in support of him being a full time employee. (10) ADJOURN Next Meeting October 20th.
