MOTION by Member Farnsworth to approve the Agenda based upon the
Chairman's parameters picking the top 3 or 4 items to discuss first in any order
and anything that cannot be done today will be pushed to the next meeting.
Seconded by Member Roth. MOTION CARRIED BY THE FOLLOWING VOTE:

(4) APPROVAL OF MINUTES
Mr. Roth requested an update and more discussion on the Winterberry Park ball field and he also
requested an update on the Chlorophyll A test results and the golf course's potential involvement.
He also mentioned a typographical error on page 4 from "Eficacy "to "Efficiency"
MOTION by Vice-Chair Parcelles to approve the April 20, 2017 Meeting Minutes.

Chairman Heindl requested the minutes be rewritten in more detail as to the discussions of the committee

(5) STAFF COMMUNICATIONS
Chadd Chustz presented his report. (Attached)
Tim Pinter provided an update on the Winterberry Park ball field. In a recent rain event the filter fabric
did stop the clay from going into the storm drain however it caused severe flooding of the roadway with
vehicles hydroplaning in the area. At the direction of the City Manager, Mr. Pinter has contacted an
engineering firm to do a complete study of the ball field itself to look at on site retention or detention of all
the storm water runoff. American Engineering will be under contract quickly and there is not an estimate
of cost at this time. Mr. Young suggested adding swales in that area.

(6) PUBLIC COMMENT
Jim Timmerman, 831 Perrine Court, advised that he attended the workshop meeting and he felt very
positive things came out of it. In regards to Ocean Habitats, Marco Island Academy had a presentation
where they constructed 30 habitats, Chadd Chustz attended the presentation. MIA has also donated
funds to install a habitat at Rookery. Summer growth has started and the first year water quality testing
has been done and they are waiting for the results. He would like to present the data at the next meeting.
He thanked the committee for their support.
Dave Crane, 1076 Gayer Way, questioned how many landscapers are permitted on Marco Island for
landscaping and how many have applied and received permits to apply fertilizer.
(7) COMMITTEE DISCUSSION
A. WATER QUALITY TESTING WORKSHOP SCHEDULING
There was discussion on the scheduling of the workshop meeting.
Mr. Chustz will send available dates to the committee members to coordinate.

A. BUDGETING FOR ATON AND PATON REPAIR AND MAINTENANCE
B. REVIEW OF THE WATERWAYS COMMITTEE FY18 BUDGET
Mr. Chustz read from Mr. Heindl's email (attached) regarding the itemization of the $15,000 budget
request.
Mr. Pinter advised that the $15,000 was included in his budget as a separate line item. At the Budget
Workshop it was advised that the Chairman of the Committee needs to submit a letter to the City Manager
to request the funds. A standardized letter is being developed for this purpose. Also included in the
budget was a continuation of last years budget for the ATONS and PATONS replacement, waterway
hazard removal, etc. Both these requests are in the "add-on" portion of the budget which means it will be
specifically acted upon by the City Council.
Mr. Chustz advised that he did submit a water outfall monitoring item to the FY18 budget.
By consensus the committee authorized the Chairman to submit the letter.

(9) NEW BUSINESS
A. STORMWATER ORDINANCE
The Committee began their review of the Stormwater Ordinance (Draft for Review 5-9-17)
Mr. Pinter advised that the committee is to make their comments over and above what staff has already
done. The staff is not the recording secretary. The committee is to make their own comments and submit
them to staff so that staff can forward the comments along with everyone else's comments to the Planning
Board to see if it is going to be incorporated into this ordinance. The Planning Board will either agree or
disagree and then it will go forward to City Council. Mr. Roth advised that he will mark the changes with a
turquoise pen and hand them in to staff.
There was discussion regarding the MS4 definition and of the use of the word "swale" as referenced on
Page 8, Line 347. Mr. Heindl suggested using the definition as defined in the Federal Code of Definitions.
Mr. Pinter advised the committee of the definition of swales as per the City Code of Ordinances and
advised that his recommendation will be that the definition of the word swale will remain in this document.
There was a lengthy discussion on the purpose of swales and how they should be defined within the
Stormwater Ordinance. Mr. Roth read to the Committee several definitions of swales and he felt that they
should be reviewed in order for the committee to develop a definition that could be brought to Council at a
different time. Mr. Heindl advised that there were two options; one would be that they cannot complete the
ordinance until they have a good definition of swale in the City Code or put the committee's definition of
swale in the ordinance and recommend that concurrently the definition in the City Code be changed
consistently.
Mr. Roth read several definitions of swales including:
"Swales are shallow, broad and vegetated channels designed to store and/or convey runoff and remove
pollutants. They may be used as conveyance structures to pass the runoff to the next stage of the
treatment train and can be designed to promote infiltration where soild and ground water conditions allow."
The committee took a ten minute recess. The meeting reconveined with all seven members in
attendance.

Mr. Heindl advised that it was recommended to him that the committee not put the definition of swale in
the ordinance and instead include it as a package deal recommending a code amendment to add the new
definition. He came up with an alternate definition by adding language to the City of Naples definition:
"Swales mean depressions commonly used for landscaping plans to retain and slow the movement of
stormwater and maybe a means of storm water convenyance for flood control." Mr. Roth recommended
using the word "runoff" instead of "flood." The committee agreed upon this definition.
There was also discusson in reference to the City's Right-of Way Construction Standards Handbook in
refernce to swales. (Page 10, Line 446-448) It was decided to make this an agenda item and discuss this
at the next workshop.
Public Comment
John Moore, 679 Thrush Court, the ordinance referenced Goal 1 and he questioned if there was a goal 2?
He also felt the term "environmentally sound" was vague and he suggested it could be replaced by "that
restores local marine ecosystems."
MOTION by Member Farnsworth to ammend the Code definition of swale as a
linked package with the Stormwater Ordinance. Sconded by Member Roth, that
this be recommended for approval. MOTION CARRIED BY THE FOLLOWING
VOTE:
MOTION by Chairman Heindl to recommend the passage of this edited
Stormwater Ordinance in a packaged recommendation, that they both must be
passed together or neither be passed, to make it clear that along with the
Stormwater Ordinance is the swale defiintion amendment to the City of Marco
Island City Code of Ordinances. Seconded by Mr. Roth. MOTION CARRIED BY THE
FOLLOWING VOTE:
