(1) ROLL CALL Present: 7- Ben Farnsworth, Vice-Chair Rodger Parcelles, Chair Heindl, Steve Sokol, Monica Pierce, Robert Roth and Sam Young (2) PLEDGE OF ALLEGIANCE - Led by Chair Heindl (3) APPROVAL OF AGENDA Chair Heindl requested a change in the agenda, to add Public Comment at 9:30 A.M. time certain since it was inadvertently omitted from today's agenda. MOTION by Member Young, seconded by Member Farnsworth, to approve the agenda as amended. MOTION CARRIED BY THE FOLLOWING VOTE: Yes: 7- Member Farnsworth, Vice-Chair Parcelles, Chair Heindl, Member Sokol, Member Pierce, Member Roth and Member Young (4) APPROVAL OF MINUTES ID 17-1872 Waterways Advisory Committee Meeting Minutes for July 20, 2017 Member Pierce corrected the date from August 7, 2017 to August 17, 2017 under Committee Communications where Member Young made a motion to place a presentation on the agenda from Mr. Bill Walsh. MOTION by Member Farnsworth, seconded by Vice-Chair Parcelles, to approve the July 20, 2017 Waterways Advisory Committee Meeting Minutes as amended. MOTION CARRIED BY THE FOLLOWING VOTE: Yes: 7- Member Farnsworth, Vice-Chair Parcelles, Chair Heindl, Member Sokol, Member Pierce, Member Roth and Member Young (5) STAFF COMMUNICATIONS a. ID 17-1874 Sunshine Laws Marco Island Environmental Specialist Chadd Chustz reminded the Committee Members of the Florida Sunshine Laws. He advised them their opinions and agreements are not necessary in emails and not to utilize staff as a conduit. Chair Heindl recommended the Committee Members familiarize themselves with the Committee Handbook and revisit their duties as Committee Members. He stressed to them the importance of being courteous to City Staff Members and to be respectful since we all work together. b. Marco Island Police Department Marco Island Police Chief Al Schettino thanked the Committee Members for allowing him to speak. He is hoping to foster better communication between the Committees and the Police Department. He then introduced the Marine Patrol Officers Bob Marvin and Josh Ferris who were available to answer the Committee Members questions and concerns. City of Marco Island Florida Page 1 Waterways Advisory Committee Meeting Minutes - Final August 17, 2017 Upon conclusion of the discussion, it was determined the Police Department staff will revisit and fine tune a flyer or brochure to pass out when vessel inspections are being conducted, the Police Chief's monthly reports will be forwarded to the Waterways Advisory Committee and Police Chief Al Schettino will forward his cell phone to the Committee Members. c. Chadd Chustz - Staff Report ID 17-1875 Environmental Specialist Chadd Chustz Staff Report Marco Island Environmentalist Chadd Chustz gave a powerpoint presentation on the following: Weather Conditions - Hot and Wet June/July Rainfall *Temperatures one (1) degree above normal for Southwest Florida *The wettest June/July on record - from the South Florida Water Management District *Average total of 23.45 inches across the district (which includes parts of Central Florida) *Golden Gate received the most rainfall of any official NWS reporting stations with 37 inches *Close second - Marco Island with 33.9 inches of rainfall *Rainfall correlates to runoff and erosion *If you see erosion into the canals, call Marco Island Code Enforcement 239-389-5060 Public Outreach Florida Stormwater, Erosion and Sedimentation Control Inspector Training and Qualification Certification Course hosted by Lee County, Florida *1 1/2 Day Course - August 9th and 10th, 2017 *Advertised to Contractors, City Committees and the Public *28 Attendees including 14 City Staff Employees Marco Island Water Quality Relative to Southwest Florida Exploratory Analysis Comparing Marco Island Nitrogen and Phosphorous levels to the region *Data pulled from FDEP IWR database - Run 53 *Average data for years 2015 and 2016, for data available in Run 53 *Regions analyzed - Caloosahatchee down to Ten Thousand Islands *N.B. These figures should not be compared to FDEP Numeric Nutrient Criteria, because different analytical methods were used. *This analysis was only exploratory and statistical methods were not employed to determine if the differences in the averages are significant. *Estuaries included -Pine Island, Sanibel, Fort Myers Beach, Estero, Naples and Marco Island *Data Analysis indicates Marco Island (WBID 3728O) has some of the lowest levels of nitrogen and phosphorus in Southwest Florida for 2015/2016 *Must remain viligent to maintain and improve our water quality by: -Fertilizer Ordinance Education -Construction Site Erosion Control Education -Illicit Discharge Education *Reminder for boaters to slow down for the Manatees *Aton and Paton Update: -Marker one (1) in Snook Hole Channel has been replaced -Marker five (5) will not be replaced based on FWC and Coast Guard's recommendation -Marker seven (7) will be replaced in the next six (6) weeks City of Marco Island Florida Page 2 Waterways Advisory Committee Meeting Minutes - Final August 17, 2017 Following Mr. Chustz presentation, Member Farnsworth encouraged Marco Island boaters to be on the lookout for divers in the water in Collier Creek at the mouth of the Marco River for the next couple of weeks due to the divers surveying the area. Public Comment: Mr. John Moore, 679 Thrust Court, commented the data presented is interesting but it is qualitative data because the flow data which is important and more granular data is needed. He advised that Lovers Key which is between Marco Island and Fort Myers has significant grass beds and the water is clear there. PUBLIC COMMENT Ms. Andrea Battaglia, 39 North Collier Boulevard, thanked Public Works Director Tim Pinter for replacing the missing signs and noted how pleased she is with Collier County for replacing the atons. She expressed her concerns with Marker five (5) not being replaced and believes there should be lights by the jetty. Mr. Jim Timmerman, 831 Perrine Court, provided the Committee Members with an update on the Ocean Habitat Project and requested he be allowed time on the next agenda to give a presentation. Mr. John Moore, 679 Thrust Court, gave a brief description on the black muck or sludge is an algae bloom that dies and settles to the bottom caused by an anaerobic process. (7) PRESENTATIONS a. Captain Bill Walsh Captain Bill Walsh of Dawn Patrol Charter Fishing, Rose Marina, 951 Bald Eagle Drive Marco Island, Florida provided his opinion on the fishing on Marco Island and answered the Committee Member's questions and concerns. He remarked that the general preception that fishing quality over the past couple of years has deteriorated. He believes the warmer water temperatures,discharges from Lake Ochochobee, stormwater runoff and vanishing swales are determining factors. b. ID 17-1876 Mr. Harry Phillips Presentation on Cape Coral Canals Mr. Harry Phillips, Biologist for Environmental Resource Division for the City of Cape Coral, Florida gave a powerpoint presentation on their canal watch program and answered the Committee Member's questions and concerns. (MEETING WENT INTO RECESS AT 11:24 A.M. IT IS NOTED FOR THE RECORD THAT THE SAME MEMBERS WERE PRESENT WHEN THE MEETING RECONVENED AT 11:35 A.M.) (8) OLD BUSINESS a. ID 17-1873 Stormwater Ordinance Chair Heindl provided background information on why the Stormwater Ordinance is being revisited. Per Council's direction, the Waterways Advisory Committee is to forward their recommendations to them by the first City Council meeting in November; keeping in mind it has to be vetted through the Planning Board by their meeting in October. Chair Heindl suggested going through the document line by line and the Members concurred. City of Marco Island Florida Page 3 Waterways Advisory Committee Meeting Minutes - Final August 17, 2017 Public Works Director Tim Pinter addressed the Committee Members with two issues; first is to keep in mind when when going through the revision that the proposed Stormwater Ordinance does not comply with the Comprehensive Plan per the City Attorney's office, second issue the Committee Members passed the Stormwater Ordinance and forwarded it to the Planning Board and that recommendation should be rescinded or modified. The Committee Members engaged in a lengthy discussion and Chair Heindl asked Mr. Steve Morgan to comment on the alternate site development plan review. Mr. Steve Morgan, 216 Goodland Drive East, disclosed himself as a professional civil engineer and noted Marco Island is currently in compliance with their site plan review criteria for stormwater. He advised anything platted before 1986 on a single family lot is exempted by state law to provide stormwater retention and recommended coming up with a simple calculation for a single family residential stormwater retention. Public Comment: Mr. Jason Bailey, 1727 Dogwood Drive, agrees with the calculation suggested by Mr. Morgran. He believes that swales are an important part of Marco Island and there should be a swale management practice in place. Mr. Joe Rola, 879 Banyan Court, recommended establishing a personal contact with the MS4 Coordinator, Candace Richards and advise her that the swales are not being maintained. Mr. Jim Timmerman, 831 Perrine Court, suggested breaking the stormwater ordinance into two separate issues, comply with MS4 requirements and water quality. Community Affairs Director Dan Smith commented that anything approved has to be contingent on meeting the Comprehensive Plan requirements so the Planning Board can take action. Following discussion, Chair Heindl suggested forming a sub-committee to finish the additional language changes. It was determined Mr. Steve Morgan, Community Affairs Director Dan Smith, Mr. Jason Bailey and Committee Member Farnsworth will meet and address Section four (4) of the stormwater ordinance and forward to Chair Heindl for review. MOTION by Member Farnsworth, seconded by Member Young, to forward the proposed draft stormwater ordinance to the City Attorney to put into the correct format that is consistent with the Comprehensive Plan, forward to the MS4 Coordinator for approval and include Mr. Morgan's formula for stormwater retention. MOTION WITHDRAWN Motion by Member Farnsworth, seconded by Member Young, to forward the draft stormwater ordinance to the sub-committee of four (4) to rewrite Section four (4), including the formula for stormwater retention and forward to Chair Heindl and Environmental Specialist Chadd Chustz for review and to send to the City Attorney. Member Roth suggested the City purchase a book called "Establishing a Stormwater Utility in Florida" 2013 edition and City staff should attend the Florida Stormwater Association seminar in Tampa.
