BOH MEETING MINUTES 04-03-2023 Council Committee Room, 140 Main Street James Griffin, Chair Joseph Tennyson, MD, Vice-Chair Richard Tomanek, Member (absent) Also in attendance: Director John Garside and Clerk Tina Nolin Meeting was called to order at 6:30 pm. Reading and Approval of Minutes • Minutes for March 13, 2023, meeting: Chairman Griffin motioned to approve and place the minutes on file. Vice-Chair Tennyson seconded the motion; the Board vote was 2-0 to approve the motion to accept the minutes. New Business Discussion of 2023 Model Regulations Restricting the Sale of Tobacco and Vape Products • The Board reviewed the current Marlborough Board of Health Regulations Restricting the Sale of Tobacco Products against the States Model Regulations Restricting the Sale of Tobacco and Vape Products and discussed updates to the local regulations that would eliminate any inconsistencies or conflicts with the state law and 105 CMR 665.000, “Minimum Standards for Retail Sale of Tobacco.” After discussing, the Board charged Director Garside to make the desired changes to the proposed draft regulations and have legal review them. At the next meeting, the Board will review the revised draft regulations. Director’s Update Director Garside updated the Board on the following current events. • The department has received fine payments from five of the six tobacco permit holders who sold to underage buyers on March 11, 2023. The remaining one still has time to get their payment in before the deadline. • MWRA Waster Water Test results that track indicators of COVID-19 infection in the population are at their lowest levels since over a year ago. Subdivision, Site Plan & Special Permit Director Garside notified the Board of a site plan that will be coming regarding AMSA, which wants to add a new building to their site which will be labs and classrooms. Scheduling of the Next Meeting The Board’s next regular monthly meeting will be on Monday, May 8th at 6:30 pm.
