BOH MEETING MINUTES 05-08-2023 Council Committee Room, 140 Main Street Jim Griffin, Chair Joseph Tennyson, MD, Vice-Chair (absent) Richard Tomanek, Member Also in attendance: Director John Garside and Clerk Tina Nolin Meeting was called to order at 6:30 pm. Reading and Approval of Minutes • The approval of minutes from April 3, 2023, was tabled due to there not being a quorum from the April meeting in attendance at the meeting tonight. New Business Discussion of Draft Marlborough Board of Health Regulations Restricting the Sale of Tobacco and Vape Products There was discussion regarding the proposed draft regulations. The Board was in agreement to include the following sections in the draft regulations. • Prohibition of tobacco leaf kits or “roll your own.” • Prohibition of outdoor tobacco retailers. • Opticians & audiology type services are prohibited from selling tobacco products • Retailers cannot “possess, hold, or keep” prohibited tobacco products even if they are “not for sale.” • For violations that result in permit suspensions, there should be consistency between state regulations and local BOH regulations regarding the duration of permit suspension. • Prohibition of tobacco products at hotels, motels, and hospitality-type businesses. Director Garside was charged to further revise the draft regulations as was discussed and to work with the city solicitor to ensure the regulations are in proper legal form. Director’s Update • The following restaurants have recently opened or are about to open: Don Patron, Raising Cains • 4 properties on Red Spring Road have connected to the sewer so far. All properties have until July 11, 2023, to connect under the terms of their variance relief that they received from the Board. • Alta development, on the corner of Mechanic and Lincoln is getting ready to start with demolition (276 units of residential, 10,000 square feet of commercial/retail); 28 South Bolton has been demolished and construction should start soon (36 residential units); and AMSA is permitting a new academic building (classrooms, labs, and administration) and with this new proposal, traffic flow onto and through the facility should be greatly improved. BOH Meeting Minutes, 05-08-2023 – Page 2 Subdivision, Site Plan & Special Permit There were no subdivisions, site plans, or special permits to review. Scheduling of the Next Meeting The next regularly scheduled meeting of the Board was scheduled for June 5, 2023. It was decided that the July regular meeting may not be warranted unless a time-sensitive issue develops requiring Board action. ADJOURN Member Tomanek motioned to adjourn the meeting at 7:08 pm; Chair Griffin seconded the motion; the vote was 2-0 in favor to adjourn. Respectfully submitted, June 7, 2023 James H.
