July 11, 2017 The regular meeting of the Council of the City of Martinsville, Virginia was held on July 11, 2017 in Council Chambers, Municipal Building, at 7:30 PM with Mayor Gene Teague presiding. Council Members present included Gene Teague, Sharon Hodge, Chad Martin, Jennifer Bowles, and Kathy Lawson. Staff present included City Manager Leon Towarnicki, City Attorney Eric Monday, Clerk of Council Karen Roberts, Finance Director Linda Conover, Public Works Manager Chris Morris and Police Chief Eddie Cassady. Mayor Teague called the meeting to order and advised Council would go into Closed Session beginning at 7:00 PM. In accordance with Section 2.1-344 (A) of the Code of Virginia (1950, and as amended) and upon a motion by Council Member Lawson, seconded by Council Member Hodge, with the following 5-0 recorded vote: Mayor Teague, aye; Vice Mayor Martin, aye; Council Member Lawson, aye; Council Member Bowles, aye; and Council Member Hodge, aye. Council Member Bowles arrived at 6:10pm. Council convened in Closed Session to discuss the following matters: (A) A personnel matter as authorized by Subsection 1 and (B) Consultation with legal counsel and briefings by staff members, attorneys or consultants pertaining to actual or probable litigation, or other specific legal matters requiring the provision of legal advice by such counsel, as authorized by Subsection 7. At 7:30pm, Mayor Teague recessed Closed Session, each returning member of Council certified that (1) only public business matters exempt from open meeting requirements were discussed in said Closed Session; and (2) only those business matters identified in the motion convening the Closed Session were heard, discussed, or considered during the Session. A motion was made by Council Member Lawson, seconded by Council Member Hodge, with the following 5-0 recorded vote in favor to return to Open Session: Council Member Hodge, aye; Mayor Teague, aye; Council Member Lawson, aye; Council Member Bowles, aye; and Vice Mayor Martin, aye. Mayor Teague stated that Closed Session and discussion regarding item (A) would be continued after the regular session. Following the invocation by Council Member Bowles and Pledge to the American Flag, Teague welcomed everyone to the meeting. Present a proclamation honoring Ridgeway resident Kristen “Krissy” Esget for recent accomplishments in the 2017 Warrior Games in Chicago, Illinois – Mayor Teague read the proclamation, which was presented to Esget by Council Members. Esget stated that she appreciated the support from the community and said there was life after her injury by finding her new normal and encouraged others to do the same. July 11, 2017 Consider approval of minutes of the June 13, 2017 and June 27, 2017 – Council Member Bowles asked for a change to be made in the June 27, 2017 minutes, correcting the name to New Heights Foundation participants. Council Member Bowles made a motion to approve the minutes as amended; Council Member Hodge seconded the motion with all in favor. Hear a presentation from Virginia 2-1-1 Regional Outreach Specialist Carissa South – City Manager Towarnicki summarized the purpose of Virginia 2-1-1 and welcomed Carissa South to the meeting. South further explained that Virginia 2-1-1 is a service of the Department of Social Services and connects residents with information on additional community services including contact numbers and documents needed when the residents visit those organizations. The system allows agencies who participate with them to view data on the systems people need and may not be receiving. Council Member Hodge asked if Council could receive that data from Virginia 2-1-1. South said she could pull reports on needs, locations, and what is available in the Martinsville area. Hodge suggested those reports could be helpful when Council works on the Strategic Plan. Virginia 2-1-1 fields approximately 200,000 calls throughout the state each year. Kim Adkins with the United Way will meet with South regarding the Virginia 2-1-1 program to ensure that all information on local organizations is updated by October 2017. South said there is an application process on their website for any organizations wishing to work with Virginia 2-1-1. July 11, 2017 Consider approval on second reading of the Zoning Ordinance with related updates and amendments as approved and recommended by the Planning Commission – City Manager July 11, 2017 Towarnicki said Council approved the Ordinance on first reading at the last meeting. Tonya Rumley, with the Zoning Department provided details on the total calls, visits, and emails with questions with all inquires being satisfied with responses. Council Member Hodge made a motion to approve the ordinance on second reading; Council Member Bowles seconded the motion with the following roll call: Council Member Hodge, aye; Council Member Lawson, aye; Vice Mayor Martin, aye; Council Member Bowles, aye; and Mayor Teague, aye. Hear an update from the Public Works Department regarding various projects and operations – Public Works Director Chris Morris summarized several projects and operations currently being handled by the Public Works department including the Uptown paving and revitalization project. Bridge Street from Main Street to Church Street will become a 2-way street with new traffic lights and stripping. Council Member Bowles expressed concern for workers during nighttime work. Morris advised there would be lights, flaggers, etc. to ensure those worker’s safety. The City received a grant of $160,000 from the Virginia Department of Transportation for the Starling Avenue milling and paving project; this project will be bid out in the upcoming week. Council Member Hodge asked if there was a list of streets being paved and asked for confirmation that the City would continue to maintain those residential streets that are not included. Morris confirmed that those streets would be maintained. Morris shared the street sweeper schedule, the bulk trash pickup and policy requiring resident’s call in their pickup request as well as what items are accepted. Morris described the grass and leaf disposal policy, information on bulk and brush pickup and reminded residents that yard sale signs are not permitted to be attached to any poles or trees in the city. July 11, 2017 Consider approval of consent agenda – Council Member Lawson made a motion to approve the consent agenda as presented; Council Member Bowles seconded the motion with all Council Members voting in favor. Business from the Floor – Ural Harris, 217 Stewart Street – residents are still waiting on information regarding the medical school and he would also like an update on why Danville is getting economic development assistance and Martinsville is not; Harris blames that on the article about the Martinsville opioid prescription rating. Patrick Wright, 1201 Spruce Street – offered to help the YMCA and serve as a spokesman. Comments by members of City Council – Council Member Hodge attended the first school board meeting of the year and congratulated Joan Montgomery for being voted Chairman and Donna Dillard for being voted Vice Chairman. Hodge reached out to other educators in the community sharing that there are nine positons still available in the school system. Council Member Bowles congratulated Rob Fincher and Eddie Cassady of the Police Department on their promotions and offered prayers for Ashley Agee’s family. Agee was struck and killed by a drunk driver Sunday. Comments by City Manager – City Manager Towarnicki pointed out important dates on the Council calendar. The Fire Department is working in the Chatham Heights area on the smoke detector installations on Saturday. Towarnicki thanked the Police, Fire, and Inspection departments for their help on a residential situation in the City. At 8:37pm, Mayor Teague explained that Council would resume Closed session. At approximately 9:45pm Council Member Hodge made a motion to return to Open Session; the motion was seconded by Council Member Lawson, with a 5-0 vote in favor. No action was taken from Closed Session. July 11, 2017 There being no further business, Council Member Hodge made a motion to adjourn the meeting; the motion was seconded by Council Member Bowles with all Council Members voting in favor. Hear an update from United Way Executive Director Kim Adkins – Mayor Teague indicated that this item would be delayed until the June 27, 2017 Council meeting. Conduct a public hearing for consideration of citizens interested in appointments for two 3-year term positions beginning July 1, 2017 and ending June 30, 2020 to the Martinsville City School Board – Mayor Teague opened the public hearing. City Manager Towarnicki announced Donna Dillard who submitted an online application was interested in the vacancy. City Attorney Monday announced James Hyler and Victor Correa would also like to be considered. Tonya Jones and Phillip Harris expressed their interest in being considered for the vacancy. Council Member Hodge announced Barry Broadnax. No other names were June 13, 2017 mentioned so Mayor Teague closed the hearing. Towarnicki indicated that interviews would be scheduled for June 27, 2017 before and after the scheduled Council Meeting. Candidates would be contacted to schedule their interview time next week. Conduct a public hearing concerning the intention of City Council to propose for passage an Ordinance authorizing the issuance of not to exceed $11,740,000 principal amount of water and sewer revenue bonds of the City of Martinsville, Virginia related to the City’s sewer interceptor project – Mayor Teague rearranged the agenda moving items 5 and 6 up. After comments by City Manager Towarnicki regarding the sewer interceptor project and financing, Teague opened the hearing on sewer bond issues. No one approached the podium. The hearing was closed and no Council action was necessary. Consider approval on second reading of an ordinance authorizing the issuance of up to $11,740,000 principal amount of water and sewer revenue bonds of the City of Martinsville, Virginia and providing for the form, details, and payment thereof, related to the City’s sewer interceptor project – Council Member Bowles made a motion to approve the ordinance on second reading; Council Member Hodge seconded the motion with a 5-0 roll call vote: Council Member Hodge, aye; Council Member Lawson, aye; Mayor Teague, aye; Vice Mayor Martin, aye; and Council Member Bowles aye. June 13, 2017 June 13, 2017 June 13, 2017 Conduct a public hearing jointly with the Martinsville Planning Commission on the Zoning Ordinance update and consider approval of the ordinance on first reading – Planning Commission Chairman Tim Martin opened the Planning Commission meeting. Commission attendees included: Tim Martin, Joseph Martin, Ural Harris, Jim Barnett and Sarah Krauss. June 13, 2017 Wayne Knox provided a summary of the Zoning Ordinance changes for Council using the same PowerPoint Frank Cox presented at the May 9, 2017 joint Council Meeting. After the presentation, Council members asked questions to clarify certain points and after discussion, Mayor Teague opened the public hearing by asking how many desired to speak. Commissioner of Revenue Ruth Easley addressed the impact on property assessments by noting most of the zoning ordinance changes are lateral changes with no need to reassess at this time. The next scheduled reassessment is in 2019 and she noted by then, there may be an impact particularly in the commercial district. Glen Powell of Forest Street asked when the last time the flood plain ordinance was updated, stating that he likes the R16, R9, and R6 current designations since the designations clearly note the required lot sizes. He thinks multi-family should be allowed in all districts and said he cannot find a definition of “cluster homes” in the ordinance. It was later noted by the Planning Commission staff that multi- family is allowed in all districts contingent on obtaining a special use permit, which requires both Planning Commission and Council action. Don Grayson of Mulberry Road asked if multi- family residences are allowed on the vacant parcel below his house and it was confirmed that yes, it was allowed subject to the special use permit. Grayson said he did not favor multi- family in that area due to possible devaluation of residential single-family properties. Council Member Hodge noted that same argument could be applied anywhere in the City and that the ordinance need to ensure such issues are handled fairly and consistently in all areas. It was noted again that multi-family is allowed in all residential areas subject to a special use permit. Glen Powell cited the Breezes Apartments on Mulberry Road as an example of multi-family that does not seem to negatively affect the value of surrounding properties. Planning Commission Secretary Krauss cited several areas needing grammar changes and the day care provision in the Zoning Ordinance should match the state regulations. Mayor Teague asked why these issues were brought to Council at the public hearing rather than addressed through the Planning Commission before the ordinance was brought to Council. Hearing no further public comments, Teague declared the hearing closed. After further discussion, Chairman Martin heard a motion from Joseph Martin to recommend to Council adoption of the ordinance on first reading as amended; the motion was seconded by Ural Harris. City Attorney Monday noted that the ordinance would have to be approved on first reading as presented, not as amended since an amended ordinance has not yet been provided to Council. Any changes to the ordinance could then be provided to Council at the next meeting when final approval on second reading occurs. After further discussion and research by Monday, it was recommended that, given amendments would be discussed at the Planning Commission’s June 22nd meeting with further recommendations coming to Council, rather than the public hearing being officially closed, it be continued to the next meeting when Council can have the full text of any amendments. City Attorney Monday said if Council is fine waiting on first reading adoption, he recommends the public hearing be continued to the next meeting since amendments are expected. Mayor June 13, 2017 Teague reopened the public hearing for the purpose of the adoption of the zoning ordinance. Council Member Lawson made a motion to continue the public hearing to June 27, 2017; Council Member Hodge seconded the motion with all Council Members voting in favor. Teague asked that anyone who had questions or concerns to contact Tim Martin or Wayne Knox. Teague asked Knox to provide a list of concerns that have been addressed be made available at the next Council meeting. Business from the Floor – India Martin, 845 Dogwood Drive, a recent Radford University graduate and Sophia Esdaile introduced themselves to Council noting that they are both interning with Council Member Bowles for the summer. Ural Harris, 217 Stewart Street noted from the newspaper article that $100 million is going to the Berryhill Industrial Park in Danville and wanted to know why Danville gets economic development and Martinsville gets left out. Harris noted that residents are waiting on information from Council regarding the sewer negotiations, stating that it was a shame that the City let the water/sewer agreement “get away from us” and it has put the City in a bad position. June 13, 2017 Mayor Teague asked Police Chief Sean Dunn to come to the podium. Mayor Teague expressed his regret that Dunn would be leaving the Martinsville City Police Department. Council Member Hodge echoed Teague’s words; she thanked Dunn for his management of the police department and appreciated that he was familiar and worked with the Strategic Plan. Council Member Lawson said Dunn brought an entirely different style of leadership to the Police Department and she thanked him for his relationship with the community. Vice Mayor Martin said Dunn has always shared the spotlight and brought others to the forefront. Martin said he would see him in Williamsburg later in the month. Council Member Bowles shared other Council Member sentiments, stating the community policing efforts make her proud and residents feel safe. City Manager Towarnicki said Chief Dunn brought many successful ideas with him to Martinsville and he has heard many positive comments from residents. He says that crime is down which reflects on Dunn’s leadership. Chief Dunn said he is humbled and says it has touched his heart to hear from the residents the past few weeks. Every step of the way, Eddie Cassady has been by his side so he has no doubt that the City will be in good hands. The community-policing legacy will carry on and the future looks bright. Dunn thanked the City for the opportunity and said it has been the greatest three years of his career. Comments by members of City Council – Council Member Bowles congratulated recent graduates. Vice Mayor Martin reflected on Father’s Day and the men who have served an important role in his life presenting City Attorney Monday, Mayor Teague, City Manager Towarnicki and Assistant City Manager Knox with neckties. Council Member Hodge commented on a recent incident involving the new meter system, acknowledging that the new meters are beneficial. The City system received a notice from the electric meter at her house indicating an unusually high temperature at the meter, an electric crew responded and pulled the meter and found an unsafe situation in the meter box that could possibly have led to a fire. Power was temporarily disconnected. Although inconvenienced by the interruption in power, Council Member Hodge was appreciative of the notification that may have prevented serious damage. Council Member Lawson thanked City Attorney Monday for the Best of Virginia list which including several local businesses. Lawson reminded residents of upcoming Mustangs games and fireworks shows. Lawson also recognized Bobby Scott, Safety Coordinator who would be leaving the City for other employment. Mayor Teague thanked the Planning Commission for their hard work and reminded residents that those members are volunteers. Comments by City Manager – Towarnicki commented on the meter incident at Council Member Hodge’s residence and explained that the Electric Department follows up with those alarms regarding electricity and water at residents. Mayor Teague asked for a report on power outages and alarms since the new system has been in place. Towarnicki reported on the meeting earlier in the day at New College Institute hosted by Bassett Furniture CEO Rob Spillman and Senator Stanley, which was attended by approximately 35 business and industry leaders discussing the future of NCI. The meeting June 13, 2017 was productive with many good ideas and discussion, the future for NCI appears encouraging. Towarnicki said there would be another town hall meeting later in the month. City Attorney Monday pointed out that Martinsville and Henry County was probably second only to Roanoke on the Best of Virginia awards list in the number of local businesses recognized. Monday recognized Carlisle School for being on that list for years running. Monday encouraged citizens to fly their flags June 14, 2017 for Flag Day. Mayor Teague announced that Council would return to closed session after the regular session. Following the invocation by Mayor Teague and Pledge to the American Flag, Teague welcomed everyone to the meeting. Present proclamations honoring Martinsville High School track and field athletes Sidney Allen and Justin Manns for winning the Virginia High School League Group 2A State Championship in their respective outdoor track and field events – City Manager Towarnicki recognized two Martinsville High School track stars and their coach Greg Dean. Council Member Lawson read the proclamation recognizing Sidney Allen. Vice Mayor Martin read the proclamation recognizing Justin Manns. Council Members presented the proclamations to Allen and Manns. Coach Dean thanked Council for honoring Allen and Manns and said the championship was a great experience. June 27, 2017 Consider adoption of a resolution regarding Workers’ Compensation Coverage for Volunteer Fire/EMS members – Finance Director Linda Conover said the resolution is a formality to provide new coverage for Fire and EMS departments and provides cost savings along with a training program. Council Member Lawson made a motion to adopt the resolution; Council Member Bowles seconded the motion with all Council Members voting in favor. June 27, 2017 Hear an update from United Way Executive Director Kim Adkins – Executive Director Kim Adkins explained that this year is the 80th Anniversary for the local United Way program and provided a brief history of the organization. Adkins attributes the local United Way success to a generous community along with the organization’s volunteers and leadership over the years. A new campaign goal will be announced at their next meeting. Vice Mayor Martin questioned the HEY Collaborative, Adkins explained that it was still funded but fell under a different category. Council Member Bowles asked about uncollected pledges and if an individual could donate from their paycheck or if it would need to go through the employer. Adkins explained they would work with any individual wishing to make a donation. June 27, 2017 June 27, 2017 Continue the joint public hearing with the Martinsville Planning Commission on the Zoning Ordinance update and consider approval of the ordinance on first reading – Chairman Tim Martin called the Planning Commission to order and commended those participants on the Planning Commission. Susan McCulloch, Zoning Administrator explained that some items were left undone at the previous meeting and have since been reviewed, revised and corrected since meeting with the Planning Commission. She said Council had a list of changes made to the zoning ordinance. McCulloch explained that most resident requests for changes were honored with few exceptions. City Attorney Monday said there was a concern voiced at the Planning Commission hearing and from a resident regarding non-conforming properties that do not conform but are grandfathered in. If that property is destroyed by fire for example, then it would need to be built back to conform to current requirements and could cause financial hardship on the property owner. Monday explained Council options and property owner options in that case. Monday’s recommendation is to leave the ordinance unchanged with the variance process in case of financial hardship to the property owner. Hodge asked about the $200 application fee, Monday confirmed that fee could be waived to prevent further hardship to the property owner. Council Member Lawson expressed her concern about the ordinance and the compassion needed for homeowners who may not be able to afford to rebuild to meet the ordinance. Tim Martin asked Council to not take specifics out of context and asked Council to allow the Board of Appeals to do their job in individual circumstances. Planning Commission representative Ural Harris noted that the variance request could take a month to 6 months to get approval to rebuild a home on the same foundation. Tim Martin made a motion to approve the amendment; Sarah Krauss seconded the motion with all Planning Commission Members voting in favor. Martin made a motion to send the Zoning Ordinance to Council; Krauss seconded the motion with all members voting in favor. Harris expressed his concern about the variance timeframe. Council Member Hodge made a motion to approve the ordinance and map as amended by the Planning commission on June 22 and June 27, 2017; Vice Mayor Martin seconded the motion. Teague verified that if there is a resident with a hardship, the variance process could be expedited on an individual basis. Council Member Hodge requested that Council revisit the $200 fee to apply for variance at a future date. Council Member Lawson asked how long it would take to update the amended document to the website. McCulloch said the consultant had the Word document but does not feel that it will take long. June 27, 2017 Business from the Floor – No one approached the podium Comments by members of City Council – Council Member Bowles thanked to Martinsville City police, Sheriff and Fire departments for being positive role models to the New Horizons participants. Vice Mayor Martin congratulated Police Chief Eddie Cassady. Police Chief Eddie Cassady thanked Council and City Manager Towarnicki, he said he had some big shoes to fill but commended the members of the Martinsville Police Department. Comments by City Manager – City Manager Towarnicki acknowledged the passing of Donald Thompson who worked for the City for 23 years as well as Mike Mabe who was employed for 31 years. Towarnicki recognized the 25 Boards and Commissions, explaining there are 104 available seats with 36 current vacancies for any citizens interested in applying. Monday July 3 and July 4 the municipal building will be closed. Towarnicki explained that the City was recognized for the energy project that was performed on the municipal building along with the meter project which providing savings without impacting the City budget. City Attorney Monday wished citizens a good July 4 holiday. Teague also mentioned the Celebration event at Martinsville Speedway. June 27, 2017 Council reconvened into closed session at 8:40pm. At the conclusion of Closed Session, each returning member of Council certified that (1) only public business matters exempt from open meeting requirements were discussed in said Closed Session; and (2) only those business matters identified in the motion convening the Closed Session were heard, discussed, or considered during the Session. Department: Community Development Issue: Consider approval on second reading of the Zoning Ordinance with related updates and amendments as approved and recommended by the Planning Commission. Summary: At Council’s June 13th meeting, a joint public hearing with the Planning Commission was held regarding the proposed updates to the City’s Zoning Ordinance. After hearing a presentation on details related to the update, the public hearing was opened and there were a number of comments, suggestions, and questions from the public, the Planning Commission, and Council. Recognizing that additional review was needed on several matters, Council voted to continue the public hearing to the June 27 meeting, allowing time for the Planning Commission at their June 22nd meeting to formalize any additional recommendations and/or amendments. Amendments recommended by the Planning Commission to the ordinance were presented and discussed on June 27th, followed by a continuation of the public hearing. No action is required of Council Upcoming Street Projects Dillard Street Reconstruction Project J. C. Joyce Trucking and Paving Company is currently reconstructing Dillard Street as part of the City’s Community Development Block Grant for the Northside Neighborhood area. Work includes improved driveway access to 7 homes in the area. Work should be completed by the end of the month. East Church Street Slurry Paving Project Boxley Materials Company will begin a slurry sealing project on East Church Street from Brookdale to the East City corporate limits near Cabell Street. Work will involve applying a thin coat of a sand-tar slurry coating and new lane striping. Work should begin later this summer. A media release will be issued prior to start of the work. Uptown Repaving Project Bids will be received later this month for the repaving of the Uptown Streets. Work includes milling or removing of 1-½ inches of pavement, new pavement, striping, and crosswalks. Streets include Church Street from Moss Street to Starling Avenue, Main Street from Clay Street to Moss Street, and the side streets between Church and Main; Clay, Lester, Walnut, and Bridge. Jones Street and Ford Street will also have a portion repaved. Work will be performed between the hours of 7:00 p.m. and 7:00 a.m. in order not to disrupt normal businesses in the Uptown area. During the repaving process, Bridge Street from Church to Main will be converted into a two-way street. This will allow cars to turn left off Main Street. A new traffic light will be installed near the corner of the post office to regulate traffic at this intersection. A media release will be issued prior to start of the work. Public Works Operations Street Sweeper Schedule: The street sweeper runs uptown business district and Parking lots every Tuesday and Friday morning starting at 4:00 a.m. The residential areas and main thoroughfares are swept on a once in a six week period cycle. In the fall the uptown business district is swept Monday, Wednesday and Friday morning. And the residential sections are once every four weeks. Bulk Trash Pickup: Weekly bulk trash pickup is provided on a call-in basis. Citizens must call the bulk trash pickup line at 403-5419 to schedule a bulk pickup before 2:00 p.m. the day prior to their regular collection day. This service is provided to residential customers only. Acceptable items include furniture, appliances, tires (maximum of four), bagged yard waste such as leaves and grass clippings, and buckets not containing liquids with the lids removed. Brush Pickup: Brush pickup is provided on Monday’s, once per month, and cycles through the City’s four trash pickup areas. Citizens must call the brush pickup line at 403-5141 to schedule the pickup. Acceptable items include brush and small limbs no larger than 4-inches in diameter, and cut into lengths no longer than 8-feet. This service is not intended to include entire trees cut by individuals or any work done by contractors. The following items are not acceptable for pickup by the City: Carpeting, rugs, floor coverings, construction debris, hazardous materials, and automobile or lawnmower parts. Grass and Leaves: No person is permitted to rake, deposit, or blow grass clippings, brush trimmings, or other green waste or cuttings in or on any street, alley or other public property. Attaching signs or posters to City poles: No person is permitted to attach, fasten, or tape any flyers, yard sale notices, or other signs to any light pole, tree, or utility pole.
