CITY OF MCKEESPORT REGULAR MEETING WEDNESDAY 7:00 P.M. MAY 2, 2018 This Meeting of Council was called to order on the above-stated date at the above-stated time after the Pledge of Allegiance and a Moment of Silence by President of Council Richard Dellapenna. Prayer was led by Chaplain Boniface Igba from Auberle. The following Members of Council were present: RC-1 PRESENT: RICHARD DELLAPENNA, KEITH SOLES, JAMIE BREWSTER-FILOTEI, BRIAN EVANS, TIMOTHY BROWN, LUETHEL NESBIT ABSENT: JIM BARRY APPROVAL OF MINUTES: MOTION: Mr. Soles, seconded by Mrs. Brewster-Filotei, “to approve the Minutes of the Regular Meeting of April 4, 2018.” RC-2 YEAS: DELLAPENNA, SOLES, BREWSTER-FILOTEI, EVANS, BROWN, NESBIT (6) NAYS: NONE (0) COMMUNICATIONS: Received both the Police and Fire Department Reports for the month of April 2018. MAYOR’S REPORT: Mayor Cherepko said thank you Mr. President. I did talk a little bit earlier, so I shouldn’t be too long. So, we talked a little bit about the McKeesport Rising. We will see 300 homes on the demolition. We will see paving from beginning to end of the paving season. There are much needed improvements here in the City, part of moving our City forward. With that, also, part of McKeesport rising is the new technology that we are incorporating through the District Attorney’s office and the camera system [1] that we are going to have throughout the City of McKeesport. We will be doing an official press release when it is all up and running. Right now, you probably have in the neighborhood of 20 cameras that are up around the City of McKeesport. When it is all said and done we are going to have well over 100 and we’re pretty much, the Chief and I and Mr. Tedesco, as well, and Mr. Maglicco, we have been talking about different locations and we are pretty much going to have the City covered. You are not going to get into this City or out of this City without you showing up on one of our cameras. So, when this all comes about and we get it up and running and we put all the information out there and we demonstrate the technology through You Tube videos, we are actually working with a company that’s, to see if they will actually help us make the videos, make it very professional looking, and to get them out there through social media. I will tell you that you are not going to want to come into our town to sell drugs and you are sure not going to want to come into our town to commit an act of violence. You will not eliminate these types of things but there is no question if the people on the streets find out and they know what we know, we are going to curb the amount of instances we have. You will still have people in town doing certain things with the addiction that goes on, whether it’s to support their own habits, but I am going to tell you right now your major players are going to stay out of town. I can’t be any more excited as we continue to identify locations, but I mean, these aren’t just on the outskirts, these are going to be all up and down your streets and in these neighborhoods. The technology, as I said before, it’s second to none as far as I am concerned. If someone has a description of a vehicle, it’s very simple to search it. Black sedan, we look through our cameras and pick up every black sedan that came up between certain hours. Partial license plates, bumper stickers on cars, whatever the case may be. We will also be tapped in as I said prior, in all of Allegheny County, so these cameras won’t just be in the City of McKeesport but they will also be tapped into cameras throughout Allegheny County. So, we are very excited and continue to work with the District Attorney. He will have a presence here. His office will have a presence in the Daily News Building. Our officers will have access to these cameras and the technology and when you really talk about McKeesport Rising and all the things we need to do, without question your blights are a concern and public safety is a concern. I can’t remember a time as long as I’ve been around where we are going to have such an aggressive approach to both of these. Our police are our police. [2] They will continue to do what they do, and they do it like no other Department and they will continue to do their policing but when you get technology like this that can help them as well, it just takes it to a whole other level. So, when you deal with those two issues you deal with issues of rental properties, landlords, and the new Landlord Tenant Ordinance, well the old Landlord Tenant Ordinance but the new enforcement, trying to get them registered, trying to identify them, trying to hold individuals accountable to make sure that people are living in conditions that they deserve to be living in which will also help preserve the neighborhoods as well. So, those are three of the largest things that face our City. Of course, we have bringing jobs in and bringing new businesses in, well you know, Durabond, right there out that window, finally they are starting to get up and running now with 200 jobs. Pure Penn will be, they are up and running, they are looking to with the demand of the industry I am sure they will be expanding in no time. We talked about the businesses on Walnut Street that are going to be building on vacant lots that have been vacant for quite some time. We closed on the property across from Natalie’s that has been vacant for probably 30 years or more. We will have a new building going up there with the bank as an anchor tenant and three other tenants as well with store fronts. We have offers. We have a company that just bought the Murphy’s building. We have offers on the old Golden Rule building. Right now, I see someone is working in Pozzuto Plumbing’s old building. O’Reilly’s will be building there new building in Christy Park. You see an excavator down there, they will be demolishing the old building there, Chick’s is already down obviously but the building next to it, to build a new store there. So, you see a lot of good things going on and that is all part of McKeesport Rising. Some of which we had in the works and would have happened anyway, the new businesses and things like that we are working on, those are things that we’ve been fighting for. I think you are going to see some special things on East Fifth Avenue as well. But a lot of the other things would not be possible without the sale of the Authority. With that in mind, next Saturday PA American is holding an open house and welcoming the public to come tour the plant, tour the facilities, I’m not sure of the times off hand but they will be having an open house next Saturday. American Water is there to be a partner with the City. It wasn’t an easy decision when it came but we were in a situation where we really had no other options, [3] but I will tell you it was a wise decision. If I knew back then what I knew now I could promise you I would have slept just a little bit more, but there’s no question, no reason for us not to have that liability away from us. Not only did we reap the benefits of the sale from an economic standpoint and the money itself but when you start thinking about the liability of lines over 100 years old and everything that comes with it and we are not in the gas business, we are not in the water business, we are not in the electric business, and why should we be in the sewage business as well. It totally makes sense. You put all that in hand and know that at the end of the day our ratepayers now have an extra line of protection because any rate increases have to be approved by the PUC, so our rate payers now have an extra line of protection that they never had before. Before, it was up to the Board, who did a great job and did so very responsibly when it came to increases, but you now have that extra line of protection and any future costs that may have come that would have all been just put on our residents, we don’t know what the future holds. Act 537 was just one unfunded mandate. Who knows when the next one is going to come, but it won’t be our issue at the time. So, and the fact that they really want to be a great community partner and be involved in our community, I can’t speak highly enough about American Water. I can tell you I am in constant communication with them and when you have a deal of this magnitude, the transition overall, we’ve had our issues and bumps in the road, but it really has been pretty smooth over all because I don’t think people realize just how large of a transition this was. We are still working on it; the deal is done but we are still trying to get over some of the bumps in the road. But, you have a lot going on and you should be proud of that. We need you, as Council and individuals that show up to our meetings, to get out there and be part of the solution. It’s human nature, and I am not going to get into a big lecture, especially since Council has probably heard me say it a thousand times, but it’s human nature in this day and age, with technology and social media and everything else and it’s just negative, negative, negative. The glass is never half-full in so many people’s eyes and I think if some people realized how detrimental it was to have that attitude about their City many of the people wouldn’t do it because I think many of the people out there they are not even doing it to be malicious. It’s just, it almost becomes contagious, and that’s why with us doing McKeesport Rising and this Council working with this administration to do all the good things that are going on around this town. That’s why it’s [4] important for us to be part of spreading that because the good stuff is contagious as well. I met with a couple community groups over the last couple weeks and I could tell you these are leaders in the community and people well respected. I could tell you when I went through a lot of things going on, some that I just vaguely mentioned tonight and what not, the vast majority of stuff, people had no idea. We will continue to utilize our resources to get the information out. Social media and the Mon Valley Independent and the Post-Gazette and what not and we will continue to do that, but the reality of it is that’s one of the biggest obstacles we have in the City of McKeesport is because when something bad happens don’t worry they will be a line. The news is knocking on your door but when something good is happening here in the City of McKeesport it’s not the same way. We are fortunate to have the Mon Valley Independent, Dina with the Post-Gazette who gives us, when she has the opportunity, especially the Post, they do what they can to get our good news out and I am grateful to have that as well, but it takes us in this room as well to continue to spread the word to make sure we are part of the solution in getting the word out there. Other than that, it is open, PA is open 9 a.m. until noon on Saturday, May 12, so if anyone wants to, it’s an Open House. They are going to be involved. You will see them at a lot of our activities throughout town as well. Whether they bring their water truck or whatever the case may be. But they really want to be part of this community. I think we know about the Vietnam Wall, we are going to be getting the Wall I see Walt Yeager in the audience today. I didn’t, did he sign in to speak? So, we are going to be brining the Wall here, one of how many Cities, Walt this year? Walt said this year we are one of 39 cities. Mayor Cherepko said one of 39 cities in the whole entire country that is going to have the Wall and we are going to put it at Jimmy Long Field. It will pretty much take up the most part of both fields there. But, it’s going to be on display for 4 days in August and I do commend Walt for his hard work and his commitment in trying to make this happen. So, we are excited to have that. Another way here in the City to really honor our Vets and we always look for an opportunity here in the City, whatever it may be, to honor those for their sacrifice so that we can be here having the conversations that we are having right now. It’s something that I most certainly don’t take for granted. President Dellapenna asked what are the dates on that? [5] Walt said it is August 9-12th, but there’s a notice out that they may come in a day early and we may be having the Opening Ceremony as early as Wednesday, August 8th. It will be 24-hour continuous perpetual vigil all the way through Sunday. If I could make just a couple short announcements. President Dellapenna said please come forward. Walt said as Mike said, we are very proud and very privileged to be able to host the Wall here and like I said it’s one out of 39 cities that are on tour this year. A big cornerstone, and Mike mentioned a lot of negativity and what have you, this has the opportunity of shining a real bright shining light not only on the City of McKeesport but the whole area. I guess one of the best kept secrets around here, but some of us that belong to the Boys & Girls Club, and I have been a member for 60 years, that Memorial on Ravine Street is repeatedly the very first memorial to the Vietnam Veteran killed in the whole United States. Senator Brewster did a little back-ground search for me and I know that from the standpoint of Vietnam Veterans of America they classify as one of the first four, but I visited the other three and from that stand-point, from a traditional stand-point and from the stand-point of having 50 continuous years of both Veterans Day and Memorial Day Services, none of the others have that. I am real close within the next 10 days or so to put out a web site that not only solicits funds and tells you about the Wall that Heals but also paints a real historical picture about the City and the sacrifices that were made. So, I have 24 points of light. The Wall will take about $12,000 to bring here but I am trying to raise $1 for every name on the Wall and there are $58,318 names on there so if I am successful in doing that and paying off the $12,000 to the Vietnam Veterans Memorial Foundation that money then would be redistributed in this area to various Veterans educational and preservation items, so I am looking for some help along those ways. I appreciate, I didn’t get a chance to sign in, I didn’t want to interrupt Mike when he was talking, so thank you very much, I appreciate it. President Dellapenna said that you Walt. Mayor Cherepko said thank you, we are very excited to have this privilege of this. Mayor Cherepko said last thing I have is the one entity that I didn’t get into when it comes to getting our positive news out and that’s Jason Togyer with Tube City. I can’t speak highly enough about what he has done especially back when the Daily [6] News went down, no Mon Valley Independent was around, Post-Gazette is here when they can be here, he really was there for us and he continues to be with us as well. I mean, he’s done a presentation with the Penn McKee and that was the last thing I want to talk about and that’s why I was waiting for him to lead up to that. He put a presentation at the Penn McKee, which I know many of you have looked at one point or another that was second to none, first class, to really try to get people get interested in restoring and preserving the Penn McKee. We had a meeting this week, well we had a few meetings, but Jason has been taking the lead on the meetings as well. I have attended a few and we made a lot of progress. We had a lot of good news this week. We feel like that it’s a strong reality at this point to at least get the ball rolling with restoring and preserving the Penn McKee. I want to thank Jason for all his work and his efforts on this as well as he continues to work with us, but we had a lot of good news and when you talk about the positive and talk about keep focusing on things going on, I can’t think of anything other than some of the things we talked about going on. I mean wouldn’t it be amazing to really make that into something and some possible investors and groups we are working with now, the visions they have of what that place could be. It might not be exactly what it was remembered to be but if we could restore that building and get it back to where it’s utilized, whether it’s store fronts or whether it’s possible housing and like hotel type housing, tie it in with the Trail and the Palisades and everything that we have going on around here, it will be a tremendous asset. So, I do want to just thank Jason publicly once again for all of his efforts in continuing to try to promote McKeesport as he has done for a very, very long time, but you know, also what he’s doing with the Penn McKee. Other than that Mr. President, that concludes my Report. President Dellapenna said thank you Mayor. CITIZENS IN THE AUDIENCE: President Dellapenna stated next is Citizens in the Audience. We have one gentleman signed up to speak. Mr. Wakefield if you could please come forward, state your address and proceed with your comments, questions and concerns. Allen Wakefield. Thank you to the honorable Council and the honorable Mayor for allowing me to speak again. I appreciate that you indulge me like this. Mayor Cherepko said can you state your address as well please. Mr. Wakefield said yes, I [7] am at 2013 Ohio Avenue in White Oak, but I also have property at 1307 Soles Street here in McKeesport and 1215 Scott Street in McKeesport. I want you to know that we have retained counsel to pursue our case and counsel, I don’t know how he did it, he read all 51 of the documents that were filed, he read them all and I told him I was going to take this one document which is a challenge to the Oath of Office which was filed in 2006 and I am sure that Mayor Brewster didn’t see it and the Council in those days didn’t see it but I am going to make sure that you all see it tonight and there will be, as part of the Trial, there will be Pre-Trial Discovery. We didn’t know that when we did our case the first time and so the counsel, our counsel suggested there would be pre-Trial interviews of everyone. Mayor Cherepko said I am going to be very honest Mr. President, this gentleman just mentioned that this is now going to be under litigation. We are not going to debate this in public. Our Solicitor is not here but at this point I don’t think we should be discussing anything. President Dellapenna said I have to agree with the Mayor. Mr. Wakefield said I am telegraphing something to you. Mayor Cherepko said we don’t need it, we will get it through Discovery. President Dellapenna said Mr. Wakefield. Mr. Wakefield said all right, I appreciate your time anyway and then Mr. Wakefield was asked to leave the room. NEW BUSINESS: President Dellapenna asked Secretary James for New Business. RESOLUTION NO. 2018-022 – BILL #36 – A RESOLUTION OF THE CITY OF MCKEESPORT, ALLEGHENY COUNTY, PENNSYLVANIA, AWARDING THE BID FOR THE RECONSTRUCTION OF THE GERGELY PARK AMPITHEATRE TO LUTTERMAN EXCAVATING, AND AUTHORIZING THE PROPERTY CITY OFFICIALS TO EXECUTE ALL DOCUMENTS NECESSARY TO ENTER INTO AN AGREEMENT WITH LUTTERMAN EXCAVATING FOR AN AMOUNT NOT TO EXCEED $62,600. MOTION: Mrs. Nesbit moved, seconded by Mr. Soles, “to approve Bill #36.” [8] President Dellapenna asked for questions or discussion and Mayor Cherepko said this is Phase 2, Phase 1 was the pier in Gergely Park. This is Phase 2. The winning bidder is Lutterman. It kind of works out because I think he knows exactly what we need done and wants done because he was actually the winner of the first Phase when he did the pier, so we are looking forward to the improvements in Gergely Park. President Dellapenna said thank you Mayor. RC-3 YEAS: DELLAPENNA, SOLES, BREWSTER-FILOTEI, EVANS, BROWN, NESBIT (6) NAYS: NONE (0) RESOLUTION NO. 2018-023 – BILL #37 – A RESOLUTION OF THE CITY OF MCKEESPORT, ALLEGHENY COUNTY, PENNSYLVANIA, AWARDING THE BID FOR THE RECONSTRUCTION OF BOWMAN AVENUE PHASE I, TO MORGAN EXCAVATING LP, AND AUTHORIZING THE PROPERTY CITY OFFICIALS TO EXECUTE ALL DOCUMENTS NECESSARY TO ENTER INTO AN AGREEMENT WITH MORGAN EXCAVATING LP FOR AN AMOUNT NOT TO EXCEED $181,260. MOTION: Mr. Brown moved, seconded by Mrs. Brewster-Filotei, “to approve Bill #37.” President Dellapenna asked for questions or discussion and Mayor Cherepko said this will be the first Phase of a Bowman Avenue Project. This will be the S Bend which really is a major concern with the trucks that utilize the road. It’s a road that we are up there constantly fixing, and it gets destroyed very quickly. So, this will be fixed the proper way, everything ripped out and built back up with I believe up to 8” of asphalt from 5” binder and then a couple inches on top. So, this is a long-awaited project. The majority, we are hoping, we don’t have bids for the second Phase, but we are hoping, well the vast majority should be covered by either between Grant money or Liquid Fuel money which is allocated, and we are only able to use Liquid Fuels money certain ways so there shouldn’t be much, if any, coming out of the General Fund for this. I’d like to see none, but that’s no guarantee, probably will be a little. President Dellapenna said thank you Mayor. RC-4 YEAS: DELLAPENNA, SOLES, BREWSTER-FILOTEI, EVANS, BROWN, NESBIT (6) NAYS: NONE (0) [9] RESOLUTION NO. 2018-024 – BILL #38 – A RESOLUTION OF THE CITY OF MCKEESPORT, ALLEGHENY COUNTY, PENNSYLVANIA, REQUESTING A GRANT FROM THE REDEVELOPMENT AUTHORITY OF ALLEGHENY COUNTY IN THE AMOUNT OF $1,000,000.00 FOR THE MCKEESPORT RISING DOWNTOWN REVITALIZATION PROJECT. MOTION: Mr. Evans moved, seconded by Mr. Brown, “to approve Bill #38.” President Dellapenna asked for questions or discussion and Mayor Cherepko said this is going to be money utilized for it’s going to be Phase 1 of revitalizing downtown. Phase 1 usually consists of eliminating blight and getting land shovel ready for new development. So, you know the downtown is something we are going to work on. We know our heart, as far as the next commercial area, the bigger end of McKeesport will be the Christy Park and Walnut Corridor but there’s no question that the downtown McKeesport could be something again. It may consist of more Mom and Pop type stores, but between the Trail and things going on down there, and we won’t rule out something bigger. I mean, there’s a lot of land that could be developed. Especially from Walnut Street down to Joe Bendel Way which is Water Street. So, when you go up to Walnut Street all the way down to Fifth Avenue, all the way to Ninth Street. So, we are not saying it won’t be a big area because there’s definitely potential, especially if something special comes out at the Penn McKee and that could become an anchor and things like that. We have a new building going up across the street, across from Natalie’s but this is definitely a much-needed use is to eliminate some of the blight. We are actually looking to get into a, what’s that project called, I’ll tell you guys about it, but it will be a partnership to where some of the existing buildings we are going to look to get some money in order to start like fixing their facades and things like that to just help beautify the stores down there as well. So, this will be much needed money to help with some of the commercial demos that have become extremely expensive. Mr. Soles said I have a question, what’s going on with the Executive Building? Mayor Cherepko said, the Executive Building, we have been dealing with the owner, and we are trying to get the owner to do the right thing. I have to watch what I say. We are hoping he just stands up and does the right thing. The owner is not from McKeesport, he is not even from the State of Pennsylvania for that [10] matter, but we are hoping to at the very least we have some interest where people might be interested in investing in it if the money is right. So, I think you know some perspective may have changed with the façade with the balusters falling which was not part of the structure. But prior to that I think the owner was looking if he were going to sell he would want more but maybe with everything we can get something done but I wish I knew, I wish I had clear answers but I can just tell you that it’s something we are working on because it is a major concern because that’s the last thing we need is another building taking up half of our block, well more than half our block. Well, one side of the street, for the most part, with the exception of a few stores. So, it’s really something we want to get resolved and we do have some interest if they get it for the right price. But it’s a matter of getting this guy to come to the table and let’s have a discussion, so that’s where we are at. President Dellapenna said thank you Mayor. MOTION: Mr. Soles moved, seconded by Mrs. Nesbit, “to approve Bill #39.” President Dellapenna asked for questions or discussion and Mayor Cherepko said this is just a great opportunity to bring a financial company into really look at how we are conducting business with recommendations and it will all be paid. It’s kind of an early intervention to make sure we stay out of Act 47. We are in no danger of going into Act 47 in the next couple of years because of the sale of the Authority but we are trying to make sure we are doing everything we can to extend this well into the future. So, I may be coming to you in a month or two and bringing a recommendation from another company that it will be a different type of service but literally someone that looks at everything we spend and how it's spent and any way to save us money as well and they are a company that doesn’t get paid unless they find a way to save you money and you know like I [11] said one thing you will find out about this administration if you don’t already know is it’s about the City of McKeesport to us. So, I have no problem with someone saying hey you might want to save here. We said it from day one and we will utilize every resource we can find around us to make sure we are running this City in the most efficient manner and to make sure that we do everything we can and to make the City a better place to live and work. So, that’s something we might be coming to you with in a week or two as well now. MOTION: Mrs. Brewster-Filotei moved, seconded by Mr. Soles, “to approve Bill #41.” President Dellapenna asked for questions or discussion and Mayor Cherepko said this Grant will go to road repairs, most likely Bowman, unless Bowman would come way below what we expect it to cost which would be more than great and we will just use it somewhere else, but this is also I feel very confident we are going to get this money with the help of Senator Brewster. We should get this. So, without question with the help of the Senator. At the beginning it was going to be a Phase 1 and Phase 2 just for this year but being that the third contract won’t finish until 2019 anyway we don’t have to worry about the Budget money because we will just take it out of the 2019 Budget. But one thing I will say about the other bidding process is this is a reputable company and I want to say it’s probably the first time they have bid on one of our contracts, so I think this process may have opened it up a little bit. So, I heard of this company and they are reputable and have been in business for almost 20 years and I heard [13] about them prior to this too and I just always wondered why they never really bid but they came through with this one they were the winning bidder and we look forward to working with them.
