AGENDA REVIEW STAFF PRESENTATIONS 1 Receive briefing regarding the IH-20 Corridor Development plan and budget. 2 Receive proposed 2016-17 budget presentations including Neighborhood Services, Library Services, Parks and Recreation, Planning and Development Services and Human Resources. Received presentations from Neighborhood Services and Library Services. 3 Discuss results of separation pay audit for executive level employees. EXECUTIVE SESSION - EXECUTIVE CONFERENCE ROOM - 4:20 P.M. The City Council met in Executive Session pursuant to Section 551.071 of the Texas Government Code to conduct a private consultation with its attorney (Discuss results of separation pay audit for executive level employees); whereupon, the City Council proceeded to meet in the Executive Conference Room. After the closed meeting ended at 4:55 p.m., the City Council reconvened in Open Session. No executive action was necessary. EXECUTIVE SESSION - EXECUTIVE CONFERENCE ROOM - 4:55 P.M. The City Council met in Executive Session pursuant to Section 551.074 of the Texas Government Code to consider the appointment, evaluation, employment, reassignment, duties, discipline or dismissal of the City Manager, City Attorney, Municipal Court Judge, City Secretary, members of the various City boards and commissions, and City officers or other City employees (Follow-up regarding annual review of Municipal Court Judge); whereupon, the City Council proceeded to meet in the Executive Conference Room. After the closed meeting ended at 5:00 p.m., the City Council reconvened in Open Session. Executive action resulting from the closed session was taken later in the meeting. The City Council met in Executive Session pursuant to Section 551.087 of the Texas Government Code to consider commercial or financial information regarding business prospects or projects (Discuss economic development incentives for a business expansion in the Skyline Logistics Hub); whereupon, the City Council proceeded to meet in the Executive Conference Room. After the closed meeting ended at 5:15 p.m., the City Council reconvened in Open Session. No executive action was necessary. REGULAR CITY COUNCIL MEETING - CITY COUNCIL CHAMBER - 7:00 P.M. INVOCATION Teresa Jackson, Executive Director, Sharing Life Community Outreach, Mesquite, Texas. PLEDGE OF ALLEGIANCE Nicolas and Gabriel Cordero. SPECIAL ANNOUNCEMENTS (1) Mr. Casper announced that a Shands neighborhood meeting will be held on Thursday, July 28, 2016, at 7:00 p.m., at the Elks Lodge, 4201 Gus Thomasson Road and invited all residents in the neighborhood to attend. (2) Mr. Archer reminded everyone that a Rollingwood Hills neighborhood meeting will be held on Tuesday, July 26, 2016, at 7:00 p.m., at West Mesquite Baptist Church and encouraged all residents in the area to attend. (3) Mr. Aleman invited residents to “Get to Know Your Councilmember” on Thursday, July 28, 2016, at 7:00 p.m., at Jireh Tabernacle Worship Center, 1228 Newsome Road. (4) Councilmembers praised and expressed thanks to Police Chief Charles Cato and Police Department personnel for supporting the Dallas Police Department this past week and providing services to the City of Dallas during this difficult time. They commended Dallas Mayor Mike Rawlings and Dallas Police Chief David Brown for their leadership and strength. CITIZENS FORUM (1) Allison Marable, 815 Sumner Drive, requested information regarding using the old Big Town Mall parking lot for a semi-annual event, suggested that more City events be published in the Mainstream newsletter and thanked the Council for evening meetings. CONSENT AGENDA Approval of the Consent Agenda Mr. Tarpley requested that Item No. 5 be removed from the Consent Agenda to be considered separately. Mr. Noschese requested that Item No. 8 be removed from the Consent Agenda to be considered separately. Mr. Archer moved to approve the remaining items on the Consent Agenda, as follows. Approved on the Consent Agenda. 6 A resolution directing the Department of Planning and Development Services to give written notice of the City’s intent to annex approximately 180 acres in its extraterritorial jurisdiction and draft a service plan for such area. Approved on the Consent Agenda. Resolution No. 31-2016, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MESQUITE, TEXAS, DIRECTING THAT THE PLANNING AND DEVELOPMENT SERVICES DEPARTMENT GIVE WRITTEN NOTICE OF THE CITY’S INTENT TO ANNEX CERTAIN PROPERTY IN ITS EXTRATERRITORIAL JURISDICTION AS REQUIRED BY TEXAS LOCAL GOVERNMENT CODE §43.062(b) AND DRAFT A SERVICE PLAN FOR SUCH AREA PURSUANT TO TEXAS LOCAL GOVERNMENT CODE §43.065; AND PROVIDING AN EFFECTIVE DATE THEREOF. (Resolution No. 31-2016 recorded on page of Resolution Book No. 50.) 7 A resolution granting recognition of Local 1518 of the International Association of Fire Fighters as the sole and exclusive bargaining agent for all firefighters employed by the City of Mesquite, Texas, excluding the head of the Mesquite Fire Department and excluding exempt employees of the Mesquite Fire Department under Section 142.108(b) of the Texas Local Government Code, and authorizing the City of Mesquite, Texas, to meet and confer with Local 1518 of the International Association of Fire Fighters under Subchapter C of Chapter 142 of the Texas Local Government Code without conducting an election by the voters in the City under Section 142.105 of the Texas Local Government Code. Resolution No. 32-2016, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MESQUITE, TEXAS, GRANTING RECOGNITION OF LOCAL 1518 OF THE INTERNATIONAL ASSSOCIATION OF FIRE FIGHTERS AS THE SOLE AND EXCLUSIVE BARGAINING AGENT FOR ALL FIREFIGHTERS EMPLOYED BY THE CITY OF MESQUITE, TEXAS, EXCLUDING THE HEAD OF THE MESQUITE FIRE DEPARTMENT AND EXCLUDING EXEMPT EMPLOYEES OF THE MESQUITE FIRE DEPARTMENT UNDER SECTION 142.108(b) OF THE TEXAS LOCAL GOVERNMENT CODE, AND AUTHORIZING THE CITY OF MESQUITE, TEXAS, TO MEET AND CONFER WITH LOCAL 1518 OF THE INTERNATIONAL ASSOCIATION OF FIRE FIGHTERS UNDER SUBCHAPTER C OF CHAPTER 142 OF THE TEXAS LOCAL GOVERNMENT CODE WITHOUT CONDUCTING AN ELECTION BY THE VOTERS IN THE CITY UNDER SECTION 142.105 OF THE TEXAS LOCAL GOVERNMENT CODE. (Staff recommends award to Silsbee Ford, in Silsbee, Texas, through BuyBoard Contract No. 430-13, sponsored by the Texas Association of School Boards, in the amount of $60,920.00.) Approved on the Consent Agenda. City of Mesquite, Texas Page 3 City Council Minutes - Final July 18, 2016 10 Consider approval of an extension of the existing Memorandum of Understanding (MOU) between the City of Mesquite, Texas (“City”) and the Mesquite Police Association (the “MPA”) originally entered into on or about September 10, 2010, with an effective date of October 1, 2010, as thereafter extended, amended and restated (collectively the “City/MPA Meet and Confer Agreement”) and ratify and authorize the City Manager to execute a Second Amended and Restated Memorandum of Understanding Between the City and the MPA under Subchapter B of Chapter 142 of the Texas Local Government Code extending the term of the existing City/MPA Meet and Confer Agreement to expire on April 30, 2017. Approved on the Consent Agenda. CONSENT AGENDA ITEMS CONSIDERED SEPARATELY 5 A resolution approving the Mesquite Quality of Life Corporation budget for the fiscal year 2016-17. Mr. Tarpley expressed opposition to the proposed Mesquite Quality of Life Corporation budget. Mr. Noschese moved to approve Resolution No. 33-2016, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MESQUITE, TEXAS, APPROVING THE MESQUITE QUALITY OF LIFE TYPE 4B CORPORATION BUDGET FOR THE FISCAL YEAR 2016-17 AND CONTAINING OTHER PROVISIONS RELATING TO THE SUBJECT. Motion was seconded by Mr. Casper. On call for a vote on the motion, the following votes were cast: Ayes: Noschese, Casper, Pickett, Porter, Archer, Aleman Nayes: Tarpley Motion carried. (Resolution No. 33-2016 recorded on page of Resolution Book No. 50.) 8 Bid No. 2016-085 - Annual Contract for Sidewalk, Handicapped Ramps, Drive Approaches and Curb & Gutter Replacement. (Staff recommends all bids be rejected and rebid at a later date.) Mr. Noschese moved to reject all bids for Bid No. 2016-085, Annual Contract for Sidewalk, Handicapped Ramps, Drive Approaches and Curb & Gutter Replacement. Motion was seconded by Mr. Aleman and approved unanimously. END OF CONSENT AGENDA PUBLIC HEARINGS 11 Conduct a public hearing to receive citizen input on the proposed 2016-17 budget. A public hearing was held to receive citizen input on the proposed 2016-17 budget. Mayor Pickett stated that the City Council Budget Workshop will be held August 5-6, 2016, at City Hall, Training Rooms A&B. The public is invited to attend. Conduct a public hearing to receive input from residents regarding the PY 2016-17 Community Development Block Grant Annual Action Plan. B. A resolution authorizing the filing of an application for an amount not to exceed $997,041.00 for federal funds under the Housing and Community Development Act; approving and adopting the program year 2016-17 Community Development Block Grant Annual Action Plan; and designating the City Manager as Chief Executive Officer and authorized representative for the purpose of giving required assurances and acting in connection with said application. A public hearing was held to receive input from residents regarding the PY 2016-17 Community Development Block Grant Annual Action Plan. Erin Kincaid, Director of Community Education for New Beginning Center, expressed appreciation to the Council for its support as they serve domestic violence victims in Mesquite. New Beginning Center has provided domestic violence education to Mesquite Independent School District (MISD) students and recently partnered with Eastfield College to provide domestic violence education to its faculty and students. As of September 1, 2016, New Beginning Center will be merging with Hope's Door in Plano to become the state's largest service provider for domestic violence services. Teresa Jackson, Executive Director of Sharing Life Community Outreach (SLCO), expressed appreciation for the City's support in past years. SLCO recently became a partner agency with the North Texas Food Bank as a Food Assistance Partner. SLCO is the pilot agency in the nation for the Parkland Center for Clinical Innovation to connect the healthcare environment with the social service provider environment to provide casework management for those who utilize the emergency department as their healthcare provider. Ms. Jackson stated that SLCO requested additional money this year to help MISD students who are homeless. Charles Wiltraut, Chief Executive Officer of Mission East Dallas, expressed appreciation for the City's support as they assist individuals with primary medical and dental care needs. Dr. Karen Ellis stated that they have a facility located at 4550 Gus Thomasson Road and are seeking to expand from five to ten dental exam rooms. Trisha Lowery, Executive Director of Mesquite Social Services, expressed appreciation for the City's support and invited the Council for a special tour to be held on Thursday, August 4. No others appeared regarding the PY 2016-17 Community Development Block Grant Annual Action Plan. Mayor Pickett declared the public hearing closed. Mr. Tarpley moved to approve Resolution No. 34-2016, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MESQUITE, TEXAS, AUTHORIZING THE FILING OF AN APPLICATION FOR AN AMOUNT NOT TO EXCEED $997,041.00 FOR FEDERAL FUNDS UNDER THE HOUSING AND COMMUNITY DEVELOPMENT ACT; APPROVING AND ADOPTING THE PROGRAM YEAR 2016-17 COMMUNITY DEVELOPMENT BLOCK GRANT ANNUAL ACTION PLAN; AND DESIGNATING City of Mesquite, Texas Page 5 City Council Minutes - Final July 18, 2016 THE CITY MANAGER AS CHIEF EXECUTIVE OFFICER AND AUTHORIZED REPRESENTATIVE FOR THE PURPOSE OF GIVING REQUIRED ASSURANCES AND ACTION IN CONNECTION WITH SAID APPLICATION.
