Middletown Planning and Zoning Meeting of October 24, 2018 Page 1 REGULAR MEETING OF THE PLANNING AND ZONING COMMISSION MIDDLETOWN CONNECTICUT OCTOBER 24, 2018 1. Pledge of Allegiance 2. Roll Taking Present: Commissioner Stephen Devoto Commissioner Joyce Rossiter, Commissioner Richard Pelletier Commissioner Molly Salafia Commissioner Elizabeth Emery Commissioner Steven Kovach (seated for Commissioner Brown) Commissioner Christopher Sugar (seated for Commissioner Fazzino) Absent: Commissioner Nicholas Fazzino Commissioner Tyrell Brown Commissioner Thom Pattavina Staff: Director Joseph Samolis, Director of Planning, Conservation and Development Public: 6 members 3. Items removed from the agenda and why None 4. Public comment on items on agenda which are not currently scheduled for a public hearing None 5. ZEO Certification that all public hearing signs have been properly noticed (when scheduled) Director Samolis said that all public hearing signs were posted. 6. Public Hearings (when scheduled) 1) Proposed Zoning Map Amendment to rezone 2 parcels of land (R11604 & R00954) on Middlefield Street and West Street from R-15 (Residential), M (Multi-Family) and B-2 (General Business) Zones to an MX Zone (Mixed Use). A copy of the proposed map is on file in the Office of the Town Clerk. Applicant/agent Delfavero Associates, Inc. Z2018-7 Middletown Planning and Zoning Meeting of October 24, 2018 Page 2 Dennis Sentavia, Attorney spoke on the application. He explained that he represents the owner (Jeff DelFavero) of one lot. He is under contract to purchase the other lot. He explained the history of the lots and the different zoning of connecting lots. Jeff Delfavero, President and Owner of DelFavero Associates explained that he is 4th generation builder. He explained that he could ask for everything a B-2 Zone or M Zone, but decided that the best thing for that location would be to change to mixed use. It is better conducive to the neighborhood. From the public: John Tepley lives across the street from Aldi’s. He asked what they were going to build if it’s no residential and questioned the traffic. Director Samolis said that this application was strictly for a zone change. As far as the use, they would have to come back for Planning and Zoning for review. Since these lots face 2 state roads they may need a traffic analysis from the State. George ______ of 33 West Street lives half a block from the proposed parcel. He agrees that the best zone for this property is MX Zone. He also expressed concern if it is going to be commercial, that it would have sufficient parking. Sal Milardo of 66 West Street lives directly across the street and hopes that they will keep it residential. Commercial use should be on Route 66 and not in a residential area. Commissioner Pelletier moves for to close the public hearing. Commissioner Kovach seconds the motion. The chair calls for the vote. The chair states the matter passes unanimously with 7 affirmative votes. Commissioner Devoto stated that he is in favor of this. Commissioner Pelletier thinks that it would be a positive change and he will approve it. Commissioner Pelletier moves for approval for a Zoning Map Amendment to rezone 2 parcels of land (R11604 & R00954) on Middlefield Street and West Street from R-15 (Residential), M (Multi-Family) and B-2 (General Business) Zones to an MX Zone (Mixed Use). Commissioner Sugar seconds the motion. The chair calls for the vote. The chair states the matter passes unanimously with 7 affirmative votes. 7. Old Business None 8. New Business 1) Proposed Special Exception to Section 46.03.04 for an Inventory Storage Lot in a non-residential development in a Flood Zone at 1232 Newfield Street which requires P&Z approval. Applicant/agent Middletown Nissan SE2018-7 Director Samolis recommends moving this item to the November 14th meeting as a public hearing. Middletown Planning and Zoning Meeting of October 24, 2018 Page 3 Commissioner Kovach moved, seconded by Commissioner Pelletier to accept application and schedule as Old Business for the November 14, 2018 meeting. 9. Public comment on topics which are not or have not been the subject of a public hearing None 10. Minutes of the Regular Meeting, Transcripts, Staff Reports and Commission Affairs 10.1 Minutes of October 10, 2018 Commissioner Devoto wished to add to the minutes under Other Commission Affairs, River Cog Report. Commissioner Emery reminded the Commission that it had formerly elected Commissioner Sugar as an alternate representative to the River Bog at a meeting in early summer. She asked Mr. Samolis if he had submitted Commissioner Sugar’s name to be appointed by the Mayor, noting that Commissioner Sugar could not represent the City until this happened. Mr. Samolis said he had not done so, but would do so soon. Commissioner Emery moves for approval of the minutes of October 10, 2018 as amended. Commissioner Sugar seconds the motion. The Chair states the matter passes with 6 affirmative votes and 1 abstention. 10.2 Other Commission Affairs a. River-Cog Report Commissioner Emery stated that there is no report as the meeting was cancelled. Director Samolis said that Commissioner Sugar’s name would be on the next Council meeting. 11. Adjournment Commissioner Rossiter moves adjournment at 7:31 PM. Commissioner Pelletier seconds the motion. The chair calls for the vote.
