Village of Millbrook Board of Trustees Wednesday, 06/12/2024 - 6 PM Millbrook Firehouse, 20 Front Street, Millbrook NY,12545 1. Roll Call: Mayor Collopy, Deputy Mayor Doro, Trustee Herzog, Trustee Murphy, Fire Department (FD) Chief Boscardin, Matt Rochfort (FD President), Scott Osborn (VRI), Public Works Supervisor (PWS) Collocola, Chief Dworkin, Attorney MacDonald, and Clerk Witt Absent: Trustee Contino 2. Open meeting – 6:00 PM with Pledge of Allegiance. 3. Administrative Business: Deputy Mayor: Mayor Collopy announced that Trustee Murphy has accepted the position of Deputy Mayor and thanked Trustee Doro for all he did as Deputy Mayor. Oath of Office: Motion made by Trustee Herzog, seconded by Deputy Mayor Murphy to accept the resignation of Planning Board member Matt Anderson. Mayor Collopy appointed Doug Dundas to fill Mr. Anderson’s seat. Clerk Witt administered the Oath of Office to Doug Dundas for Planning Board member. Minutes Approval: Motion made by Trustee Doro to approve the April Minutes (4/10, 4/16, 4/17, and 4/24) and May minutes, seconded by Deputy Mayor Murphy and all were in favor. Voucher Approval: Motion made by Trustee Herzog to accept the Voucher fund totals as presented, seconded by Trustee Doro and all were in favor (attached in presentation). 4. Department Reports: a. Fire & Rescue – Chief Boscardin Read from attached report. Chief Boscardin reported if OSHA’s new proposed regulations pass, it would be extremely costly to Volunteer Fire Department’s and would require more training hours and more equipment/ gear. Dutchess County (DC) Legislator Houston said the DC Legislators sent a letter to Governor Hocul asking New York State to not pass these new regulations. Mayor Collopy said he had also signed a letter that was sent to Hocul through the Mayors and Supervisors Association stating they were not in favor of the new proposed rule asking for NYS not to pass the proposal. Chief Boscardin announced 7 new members joined the Fire Department. Motion made by Trustee Doro to accept the new members, seconded by Deputy Mayor Murphy and all were in favor. b. Police – Chief Dworkin read from attached monthly report. Reported the Village was awarded $129K in grants (tech grant and body armor grant). He will be working on applying to modify the tech grant to include computer items needed. Trustee Doro said parking throughout the Village on the weekends can get crazy. Chief Dworkin said he will look out for that. Ongoing- Lexipol Polices and Procedures. c. Highway – PWS Collocola read highlights from the monthly report. He reported the 2011 truck will be going to auction in July. Oil and stone of Maple Avenue is scheduled for the end of August- weather depending. This was PWS Collocola’s last report as he is retiring in June. The Village Board thanked Bob for his hard work and dedication for the past 19 years. d. Water & Sewer – S. Osborn: read from attached monthly reports. Reported the concrete pad for the generator will be poured and he will be making arrangements to have the generator moved to its final location. Resolution 2024-009 – Applying for a WQIP Grant - Board resolution to apply for funds through the NYS Water Quality Improvement Project (WQIP) for the WWTP Upgrade project (attached). Old Business: Sidewalk Connection (Maple Ave to Franklin)-Deputy Mayor Murphy: To be completed in June. Local Law 6 of 2024: Resolution LL0062024.1- Introducing Local Law No. 6 of 2024 Amending Chapter 79 of the Village Code Entitled “Brush, Grass and Weeds” to Establish Rules and Regulations for Keeping the Public Thoroughfare Free of Debris and Water. Motion made by Trustee Doro, seconded by Trustee Herzog to accept Resolution LL0062024.1 (attached). Roll Call Vote: 4 ayes 1 absent. Public hearing to enact Local Law 6 of 2024 set for July 10th meeting. Local Law 7 of 2024: Resolution LL0072024- Introducing Local Law No. 7 of 2024 Imposing a Temporary Six- Month Moratorium on Site Plan, Special Use Permit, Variance and Subdivision Approvals in the RLD Zoning District. After discussion, the Board tabled this resolution pending changes. Attorney MacDonald to send out amended resolution before July meeting. June 12, 2024- Village Board of Trustees- www.villageofmillbrookny.com- for video of meeting  Convert streetlights to LED-Trustee Herzog: Explained Central Hudson’s proposal is to replace the sodium filaments on 75 of the large pole lights in the Village with LEDs at a cost of $8800 to the Village. The savings in electricity cost would exceed the $8800 in 3 years and Central Hudson would continue ownership and maintenance of the poles. Trustee Herzog to bring updated proposal to July meeting. 6. New Business: Tennis Court Fence- Trustee Doro: Received three quotes to repair and reinforce the bottom of the fence around the tennis court. Motion made by Trustee Doro to accept the quote from Salem Fence Company, seconded by Trustee Herzog and all were in favor. Clerk Witt to transfer the funds from the Tennis Court Reserves (NY CLASS) to pay for the bill. 7. Public Comments: No additional comments. 8. Board Member Updates 9. Witt June 12, 2024- Village Board of Trustees- www.villageofmillbrookny.com- for video of meeting  Resolution #2024-009- Adopted June 12, 2024 VILLAGE OF MILLBROOK WWTP UPGRADE PROJECT Board Resolution – WQIP Funding Application WHEREAS, The Village of Millbrook, New York (hereinafter the “Village”) has established the public benefit of the Wastewater Treatment Plant Upgrade Project (hereinafter the “Project); and WHEREAS, the Project includes rehabilitation and upgrade of the existing equipment at the WWTP (hereinafter the “Project”); and, WHEREAS, the Village has the opportunity to apply for grant funds from the NYS Water Quality Improvement Project (WQIP) which may fund up to $25 million or 25% of the total project costs; and, WHEREAS, the total Project cost is estimated at $9,700,000; and, WHEREAS, the Village is prepared to contribute matching funds through the Clean Water State Revolving Fund loan program; and, THEREFORE, BE IT RESOLVED THAT 1. The Village of Millbrook is authorized to submit the WQIP grant application. 2. The Mayor of the Village of Millbrook is authorized to sign the WQIP grant application. 3. The Village agrees to provide the matching funds required for the WQIP project through the Clean Water State Revolving Fund loan program. Mayor Collopy Aye____ x Nay____ Deputy Mayor Murphy Aye____ x Nay____ Trustee Herzog Aye____ x Nay____ Trustee Contino Aye____ Nay____ - Absent Trustee Doro x Aye____ Nay____ The resolution was thereupon duly adopted on June 12, 2024. ___________________________ Sarah Witt, Clerk, Village of Millbrook  RESOLUTION No. LL0062024.1 Introducing Local Law No. 6 of 2024 Amending Chapter 79 of the Village Code Entitled “Brush, Grass and Weeds” to Establish Rules and Regulations for Keeping the Public Thoroughfare Free of Debris and Water At a meeting of the Village Board of Trustees of the Village of Millbrook (“Village Board”), held at the Village Fire House, 20 Front Street, Millbrook, New York on the 12th day of June, 2024, at 6:00 p.m., Village Mayor, Tim Collopy called the meeting to order, and Trustee Doro, seconded by Trustee Herzog, moved the following resolution, to introduce the following proposed local law, to be known as Proposed Local Law No. 6 of 2024, entitled “A Local Law No. 6 of 2024 Amending Chapter 79 of the Village Code Entitled “Brush, Grass and Weeds” to Establish Rules and Regulations for Keeping the Public Thoroughfare Free of Debris and Water as follows: BE IT ENACTED by the Board of Trustees of the Village of Millbrook (“Village Board”) as follows: Section 1. Legislative intent: Chapter 79 of the Village of Millbrook Village Code entitled “Brush, Grass and Weeds” contains regulations for property owner’s obligations to maintain brush, grass and weeds so as not to grow in excess of four inches on any improved lot but does not include any regulations for keeping the sidewalk, curb or traveled portion of the street or free of debris or water. The Village Board has observed that more and more residents of the Village are allowing debris and water to move or flow from their property onto the sidewalk, curb or traveled portion of the street or highway (“public thoroughfares”). This movement of such debris and water is most often caused by weather conditions or other natural and man-made hazards. The Village Board has also observed property owners directing water via hoses or other pipes onto public thoroughfares. Stone and dirt driveways occasionally “wash out” onto public thoroughfares. These conditions are dangerous to the public traveling on public thoroughfares and could be avoided by proper maintenance conducted by the property owner. This has led the Village Board to determine it is in the best interest of the Village to amend the Village Code to establish regulations for keeping the public thoroughfare free of debris and water. The Village Board now, therefore, wishes to amend Chapter 79 of the Village Code entitled “Brush, Grass and Weeds” to Establish Rules and Regulations for Keeping the Public Thoroughfare Free of Debris and Water. {00377456 3 } 1 Section 2. Chapter 79 of the Village Code entitled “Brush, Grass and Weeds” is hereby amended by adding a new Subsections 79-3 and 79-4 to read as follows. “79-3 Keeping the Public Thoroughfare Free of Debris and Water. No person shall permit debris or water to move or flow from the owner’s property onto the sidewalk and the curb or traveled portion of the street or highway abutting said premises. 79-4 Village to Prevent Debris or Water From Moving or Flowing onto the Public Thoroughfare. If the owner or responsible party to the owner shall fail to perform the work needed to prevent debris or water from moving or flowing onto the public thoroughfare within five days after notice by the appropriate Village official, the Village may perform the work and assess the cost thereof against the premises and collect the amount in the same manner as Village taxes are collected.” Further, Chapter 79 of the Village Code entitled “Brush, Grass and Weeds” is hereby amended by Subsections 79-3 to 79-5. Section 3. Severability. Should any word, section, clause, paragraph, sentence, part or provision of this local law be declared invalid by a Court of competent jurisdiction, such determination shall not affect the validity of any other part hereof. Section 4. All other ordinances or local laws of the Village of Millbrook which are in conflict with the provisions of this local law are hereby superseded or repealed to the extent necessary to give this local law full force and effect during its effective period. Section 5. Numbering for codification. It is the intention of the Village of Millbrook Board of Trustees and it is hereby enacted that the provisions of this Local Law shall be included in the Code of the Village of Millbrook; that the sections and subsections of this Local Law may be re- numbered or re-lettered by the Codifier to accomplish such intention; that the Codifier shall make no substantive changes to this Local Law; that the word “Local Law” shall be changed to “Chapter,” “Section” or other appropriate word as required for codification; and that any such rearranging of the numbering and editing shall not affect the validity of this Local Law or the provisions of the Code affected thereby. {00377456 3 } 2 Section 6. This Local Law shall take effect as of the date of filing with the New York Secretary of State. Mayor, Tim Collopy, advised the Board of Trustees that, pursuant to the Municipal Home Rule Law of the State of New York, it will be necessary to hold a public hearing upon this proposed local law. Trustee Doro offered the following resolution which was seconded by Trustee Herzog, who moved its adoption: WHEREAS, on June 12, 2024, Trustee Doro introduced this Local Law for the Village of Millbrook, to be known as “A Local Law No. 6 of 2024 Amending Chapter 79 of the Village Code Entitled “Brush, Grass and Weeds” to Establish Rules and Regulations for Keeping the Public Thoroughfare Free of Debris and Water.” RESOLVED, that a public hearing be held in relation to the proposed Local Law as set forth in the form of notice, hereinafter provided, at which hearing parties in interest and citizens shall have an opportunity to be heard, to be held at the Village Fire House, 20 Front Street, Millbrook, New York, on July 6th, 2024, at 6:00 o’clock, p.m., Prevailing Time, and that notice of said hearing shall be published in the official newspaper of general circulation in the Village of Millbrook, by the Village Clerk, at least ten (10) days before such hearing and that such notice shall be in the following form: NOTICE OF PUBLIC HEARING TAKE NOTICE, that the Board of Trustees of the Village of Millbrook will hold a public hearing at the Village Hall, 35 Merritt Ave, Millbrook, New York, on July 10th, 2024, at 6:00 o’clock, p.m., Prevailing Time, on Proposed Local Law No. 6 of the Year 2024, entitled “A Local Law No. 6 of 2024 Amending Chapter 79 of the Village Code Entitled “Brush, Grass and Weeds” to Establish Rules and Regulations for Keeping the Public Thoroughfare Free of Debris.
