Minutes of the Millcreek City Council November 14, 2022 7:00 p.m. Regular Meeting The City Council of Millcreek, Utah, met in a regular public meeting on November 14, 2022, at City Hall, located at 3330 S. 1300 E., Millcreek, UT 84106. The meeting was live streamed via the City's website with an option for online public cornrnent. Welcome, Introduction and Preliminary Matters 1.1 Pledge of Allegiance Mayor Silvestrini called the meeting to order and led the pledge of allegiance. 1.2 Public Comment There were no comments. 1.3 Small Business Saturday in Mfflcreek Proclamation Mayor Silvestrini proclaimed the following: PROCLAAdATION SMALL BUSINESS SATURDAY IN MILLCREEK WHEREAS, the government ofMillcreek, Utah, celebrates our local small businessesand the contributions they malce to our local economy and commtmity; and WHEREAS, according to the United States Small Business Administration, there are 32.5 million small businessesin the United States, small businessesrepresent 99. 7% offirms with paid employees,small businessesare responsiblefor 62% of net newjobs created since 1995, and small businessesemploy 46.8% of the employeesin the private sector in the Urtited States, and WHEREAS, 79% of consumersunderstand the importance of supporting the small businessesin their commtmity on Small Busiriess Saturday@, 70% report the day makes them want to Millcreek City Council Meeting Minutes 14 November 2022 Page 2 of 4 encourage others to Shop Small@, independerttly-owrted retailers, and 66% report that the day malces them want to Shop Small ail year long; and WHEREAS,58% of shoppers reported they shopped online with a small businessand 54% reported they dined or ordered takeoutfrom a small restaurant, bar, or cafi on SmallBusiness Saturday in 2021; and TT[HEREAS, Millcreek, Utah supports our local businesses that create jobs, boost our local economy, and preserve our communities; and WHEREAS, advocacy groups, as well as public and private orgarxizations, across the country have endorsed the Saturday after Thanlcs8ving as Small Business Saturday. NOF, THEREFORE, I, Jeff Silvestrini, Mayor of Millcreelc, Utah do hereby proclaim, November 26, 2022, as: SMM,L BUSINESS SATURDAY AND urge the residents of our community, and communities across the country, to support small businesses and merchants on Small Business Saturday and throughout the year. Council Member Jackson moved to ratify the small business Saturday proclamation. Council Member Uipi seconded. Mayor Silvestriffi called for the vote. Council Member Catten voted yes, Council Member DeSirant voted yes, Council Member Jackson voted yes, Council Member Uipi voted yes, and Mayor Silvestrini voted yes. The motion passed unanimously. 2. Business Matters 2.1 Discussion and Consideration of Resolution 22-33, Approving an Interlocal Cooperative Agreement Accepting Transfer of Sunnyvale Park, Fortuna Park, and Canyon Rim Park from Salt Lake County Mayor Silvestrini said the interlocal would be for transferring ownership of three of the four parks from the county to the city. This was an oversight since the county never formally transferred ownership when the city incorporated though the city has been paying to maintain and improve the parks. This interlocal did not include Scott Avenue Park as it is a flood control area. The city was working with the county on that transfer since it would require additional stipulations. The parks will remain public parks in perpetutty. Council Member Uipi moved to approve item 2.1. Council Member Jackson seconded. The Recorder called for the vote. Council Member Catten voted yes, Council Member DeSirant voted yes, Council Member Jackson voted yes, Council Member Uipi voted yes, and Mayor Snvestrini voted yes. The motion passed unanimously. 2.2 Discussion and Consideration of Ordinance 22-47, Declaring 1.0 Acre of Real Property Located at 3179 South Highland Drive, Millcreek, Utah, as Surplus; Establish a Minimum Bid; and 'Establish a Method to Determine the Highest and Best Economic Returns to the City Mayor Silvestrini said this was the property underlying the Wilford Ward chapel on Highland Drive. The city purchased the property to relocate a natural gas facility from Millcreek Common. The regulating station reduces high pressure gas to natural gas for customers in the area. The use did not require the entire property, therefore the city sought to surplus the remainder. There were discussions with Crown Burger to move, but Mfflcreek City Council Meeting Minutes 14 November 2022 Page 3 of 4 they declined. The city would surplus the property to replenish the funds used to purchase it. The stipulation that the Church of Jesus Christ of Latter-Day Saints put on the sale of the property was that the demolition of the chapel building would occur within 90 days. Mike Winder said it would be demolished before mid-December. Council Member Jackson requested the nearby residents be notified in advance of when that would be. She asked for a reminder on what could be built there by any entity that purchases the property. Francis Lilly said the underlying commercial zone had a maximum height of 35 feet. The City Center Overlay Zone had additional restrictions. He did not anticipate a building being more than two stories. John Brems noted the city owned the property, so the city could put any condition on the sale the council wanted. Winder said a request for proposals (RFP) would be published which would give applicants guidelines on what the city wanted on the property. The city would get to pick the proposal based on the amount to be paid and what use was to be built. He encouraged retail/office uses. Council Member Jackson moved to adopt Ordinance 22-47, declaring 1.O acre of real property on Highland Drive as surplus and establish a minimum bid. Council Member DeSirant seconded. The Recorder called for the vote. Council Member Catten voted yes, Council Member DeSirant voted yes, Council Member Jackson voted yes, Council Member Uipi voted yes', and Mayor Silvestrini voted yes. The motion passed unanimously John Brems noted the council would make the final determination on the buyer of the property under the RFP. Winder said staff would make a final recommendation to the council for approval. Mayor Silvestrini said the decision would be made in an open meeting. Winder said the RFP would be issued that week and the recommendation would come to the council in January 2023. 3. Reports 3.1 Mayor's Report Mayor Silvestrini reported he would attend the National League of Cities Conference in Kansas City that week. He said Millcreek Cornrnon had holiday lights up and there would be a special ice show on December 1, 2, and 3. Free tickets needed to be reserved online. Mayor Silvestrini said the city hosted a Utah League of Cities and Towns meeting at the Adventure Hub. 3.2 City Council Member Reports Council Member Uipi reported that Mayor Silvestrini would be receiving the Lt. Governor's Public Service Award on November 15I11.Council Member Jackson reported on the city's first interfaith council held the prior week. The first city co-creator mixer was also held the prior week. She commended those events and hoped they would continue. Winder noted a survey on the mixer was sent out to participants to receive feedback. Council Member Catten reported Mike Winder received an award as a "Friend of the River" from the Jordan River Commission. 3.3 Staff Reports Winder noted the city had been featuring the Millcreek Library in the electronic newsletter. The city was also looking to acquire Scott Avenue Park. 4.
